<section id="H5D812D39FEF34909A993A87530F35743" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Defense Expenditure Planning for Optimizing Throughput and Sustainment Act</short-title></quote> or the <quote><short-title>DEPOTS Act</short-title></quote>.</text></section> <section id="HD0B3BF99AEAE4EC2864CAB50F2B9A071"><enum>2.</enum><header>Capital expenditure write-offs for Department of Defense depots and arsenals</header> <subsection commented="no" display-inline="no-display-inline" id="H04FB3055619341C2AF2ED2F33D105884"> <enum>(a)</enum> <header display-inline="yes-display-inline">Write-Offs</header> <paragraph commented="no" display-inline="no-display-inline" id="H053D489C5E2749EFAB9936F181A14716"> <enum>(1)</enum> <header>In general</header> <text display-inline="yes-display-inline">With respect to any depot or arsenal of the Department of Defense, the Secretary of Defense may write-off or eliminate any internal Department accounting charges, such as remaining depreciation or internal debt from an account of a military department or the Department associated with capital assets that do not generate revenue due to mission realignments directed by the Federal Government.</text>

          <enum>(2)</enum>
          <header>Recovery of outlays</header>
 <text>Write-offs under paragraph (1) shall be done in a manner than ensures any previous cash outlay from a revolving fund is recovered.</text>

          <enum>(3)</enum>
          <header>Application of authority</header>
 <text>The authority under paragraph (1) applies only to financial balances within the accounts of a military department or the Department of Defense, not to payments owed to commercial contractors.</text>
        </paragraph>
      </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H2EEB80973D1B4729A37D39DDC4ECFFC9"><enum>(b)</enum><header>Delegation</header><text display-inline="yes-display-inline">The Secretary may delegate the authority under subsection (a) to the Secretary of a military department.</text></subsection></section> </legis-body></bill>
