<section id="HF7E503EE22864E54A36977FA16B6294B" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No TSA Data for ICE Act</short-title></quote>.</text></section> 
<section id="H126D9BD7707346538EFFADB4AD785202"><enum>2.</enum><header>Prohibitions regarding information sharing and Trusted Traveler programs</header> 
<subsection id="H7F97867D2ABC49FAB925E90A6F7475AE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title VII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/341">6 U.S.C. 341 et seq.</external-xref>) is amended by adding at the end the following new section:</text> <quoted-block style="OLC" id="H4EF39964726342D59967762DADF2A165" display-inline="no-display-inline"> <section id="HEA173FBCE1FC4D6897845E4462A1319B"><enum>714.</enum><header>Prohibitions regarding information sharing and Trusted Traveler programs</header> <subsection id="HA65B1AD4484F41DDB11CA23FDFE9230A"><enum>(a)</enum><header>Information sharing</header><text>The Secretary may neither access nor utilize, whether through direct means or indirect means, such as Mobile Fortify or another similar application, specified information to carry out a function of any of the following:</text> 
<paragraph id="H4720D1D3E224460CA508AFF8216539D9"><enum>(1)</enum><text>U.S. Customs and Border Protection.</text></paragraph> <paragraph id="H73BC96BA4E2F4D35910B92B60C3E3083"><enum>(2)</enum><text>U.S. Immigration and Customs Enforcement.</text></paragraph></subsection> 
<subsection id="HFB7B3105E4EA468DAB7F42F23E2720E9"><enum>(b)</enum><header>Trusted Traveler programs</header> 
<paragraph id="H1E76F0532FC14D1C9752ED4F09ACAF82"><enum>(1)</enum><header>In general</header><text>The Secretary may not deny, suspend, or early terminate an individual’s enrollment in a program specified in paragraph (2) on the basis of such individual’s participation in an activity protected by the First Amendment to the Constitution of the United States.</text></paragraph> <paragraph id="H06080CFD51AB4803A3A9C843C7D762CC"><enum>(2)</enum><header>Programs specified</header><text>A program specified in this paragraph is any of the following:</text> 
<subparagraph id="HBEC3645E831D47B09E8D123A12D25703"><enum>(A)</enum><text>The PreCheck Program under section 44919 of title 49, United States Code.</text></subparagraph> <subparagraph id="H23ADD6FCDD404F98ABD0EF416239CE97"><enum>(B)</enum><text>The Global Entry, SENTRI, and FAST programs under subsection (k) of section 7208 of the Intelligence Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/8/1365b">8 U.S.C. 1365b</external-xref>).</text></subparagraph> 
<subparagraph id="H096EB9E6A4354EA5BB2819B7B4CF472D"><enum>(C)</enum><text display-inline="yes-display-inline">The NEXUS program under section 404 of the Enhanced Border Security and Visa Entry Reform Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/8/1753">8 U.S.C. 1753</external-xref>).</text></subparagraph> <subparagraph id="HC51DD372A7A64CB19B3FED06359848BA"><enum>(D)</enum><text>The Asia-Pacific Economic Cooperation Business Travel Card program under section 418.</text></subparagraph></paragraph></subsection> 
<subsection id="HC2F67CBDD056468C8A82C8A293579619"><enum>(c)</enum><header>Specified information defined</header><text>In this section, the term <term>specified information</term> means any of the following:</text> <paragraph id="H517185F69B7D4F3793F671AD8CD12ABF"><enum>(1)</enum><text display-inline="yes-display-inline">Information from the Transportation Security Administration.</text></paragraph> 
<paragraph id="HE72F47DB9B2F47AAA6CD2185C8B210AF"><enum>(2)</enum><text>Data that satisfies the following requirements:</text> <subparagraph id="H2FA499EE52814260981F068D4BAB05CE"><enum>(A)</enum><text>Includes personally identifiable information of a flight passenger.</text></subparagraph> 
<subparagraph id="HB7591E4A66DA41A0B684FD53222FC997"><enum>(B)</enum><text>Is from a private sector entity that brokers such data.</text></subparagraph></paragraph></subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HB48D6CC594AC49B4A280A4CBD713C46F"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents in section 1(b) of the Homeland Security Act of 2002 is amended by inserting after the item relating to section 713 the following new item:</text>
