<section section-type="section-one" id="H90AFAE90BA804DAAA2584FC22CFF2BE9"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reducing the Effects of the Cyberattack on OPM Victims Enduring Response and Protecting Identifiable Information Act</short-title></quote> or the <quote><short-title>RECOVER PII Act</short-title></quote>.</text></section> 
<section id="H3CD1DD1A87C84465814BCB7360B7FE91"><enum>2.</enum><header>Identity protection coverage for individuals affected by Federal agency data breaches</header><text display-inline="no-display-inline">Section 633 of title VI of division E of the Consolidated Appropriations Act, 2017 (<external-xref legal-doc="public-law" parsable-cite="pl/115/31">Public Law 115–31</external-xref>), as amended by section 630 of title VI of division D of the Consolidated Appropriations Act, 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/141">Public Law 115–141</external-xref>), is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="H98A67A8E8DA04536BF83E76ABDEE06EA"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="HBE13DC8A2A5C4E36A14FF8F94A6DFA1C"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>For fiscal years 2016 through 2026,</quote> and inserting <quote>For fiscal year 2016 and each fiscal year thereafter,</quote>;</text></subparagraph> <subparagraph id="H448E0B75FBA1448BB553AE1E31C629A0"><enum>(B)</enum><text>in paragraph (1), by striking <quote>and</quote> at the end; and</text></subparagraph> 
<subparagraph id="H545AC91FD2DF4DED8C6819A7DBC3BF68"><enum>(C)</enum><text display-inline="yes-display-inline">by striking paragraph (2) and inserting the following:</text> <quoted-block style="appropriations" display-inline="no-display-inline" id="H0D42F3564DE04B489F1FFACEB2460BD8"> <paragraph id="H19BD2A43B10F4259974994944C3A3CAF"> <enum>(2)</enum> <text display-inline="yes-display-inline">is effective for the remainder of the life of the affected individual; and</text>

                            <enum>(3)</enum>
 <text display-inline="yes-display-inline">includes not less than $5,000,000 in identity theft insurance.</text>

<paragraph commented="no" display-inline="no-display-inline" id="HDDC815F53A0E49F28428B1091C77335F"><enum>(2)</enum><text>in subsection (b), by striking <quote><header-in-text style="appropriations" level="subsection">Definition.—</header-in-text></quote>.</text></paragraph></section> <section commented="no" display-inline="no-display-inline" id="H7E4C78EA243642ED86379AEFCEA28565"><enum>3.</enum><header>Reimbursements relating to privacy-enhancing services</header> <subsection commented="no" display-inline="no-display-inline" id="H2DD4AC4FDD4249AE84B10F9FF81CF61A"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HFD2DAB3EBA844D20BB38B92A053D4500"><enum>(1)</enum><header>Agency</header><text display-inline="yes-display-inline">The term <term>agency</term> means each authority of the executive, legislative, or judicial branch of the Government of the United States.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HCE2C5AD696C742ECBFC5F7170D6B3BF3"><enum>(2)</enum><header>Privacy-enhancing service</header><text display-inline="yes-display-inline">The term <term>privacy-enhancing service</term> means any software or hardware solution, technical process, technique, or other technological means that mitigates privacy risks arising from data processing, including by eliminating, reducing, or suppressing personal information, including restricted personal information, as defined in section 119(b) of title 18, United States Code.</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H178E364A38CE4FCBA0DA21E16BBE9A8E"><enum>(b)</enum><header>Reimbursements</header><text>Notwithstanding any other provision of law, amounts appropriated by any Act for fiscal year 2026, or any fiscal year thereafter, for salaries and expenses of an agency may be used by that agency to reimburse an employee employed by that agency (or to make a payment to a contractor of the agency to reimburse an employee of the contractor who provides support to that agency) for not more than 100 percent of the costs incurred by the applicable individual for privacy-enhancing services.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="HA75554D0FC7B48168E71134EE3F71067"><enum>(c)</enum><header>Documentation</header><text>Any reimbursement or payment that is authorized under subsection (b) shall be contingent upon the submission by the employee or contractor, as applicable, of such information or documentation as the applicable agency may reasonably require.</text></subsection></section>
