<section id="H842B477145B34DFD9DAB199496C8A80E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reading Excellence and Achievement for Development Act</short-title></quote> or the <quote><short-title>READ Act</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="H037FDB86F27042E69D0FABB6964C0426"><enum>2.</enum><header>Definitions</header> <subsection id="H9FDD734037D84C52862DF9130EF34A3E"><enum>(a)</enum><header>Definitions</header><text>Section 2221(b) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6641">20 U.S.C. 6641(b)</external-xref>) is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H578EAACFE3BC4477A5DFEBB985B1A9D0"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraph (3) as paragraph (5);</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H4D8A2EF4E5A74B029B6797B4A3A06B3C"><enum>(2)</enum><text>by inserting after paragraph (2) the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="H502EA8D0E74448239F1435C02A0D1620">
<paragraph commented="no" display-inline="no-display-inline" id="H7FF8BE0E14484A2186D45D0B413E1547"><enum>(3)</enum><header>Eligible low-performing state</header><text display-inline="yes-display-inline">The term <term>eligible low-performing State</term> means a State that, for the 2 most recent consecutive assessment cycles, ranks within the lowest quintile based on the percentage of students performing at or above the <quote>basic</quote> achievement level in 4th grade reading, as measured under the National Assessment of Educational Progress carried out under section 303(b)(2) of the National Assessment of Educational Progress Authorization Act.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H6FE3F7D68ACB42DAB4A4D92657036260"><enum>(4)</enum><header>High-impact tutoring</header><text display-inline="yes-display-inline">The term <term>high-impact tutoring</term> means a form of teaching that—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H63B6C734D36E49489A2EA86CA219F4E0"><enum>(A)</enum><text display-inline="yes-display-inline">is conducted 1-on-1 or in small groups;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HFD86F3BDDADA455CA8BF9924894DBA8E"><enum>(B)</enum><text display-inline="yes-display-inline">is intended to complement core classroom instruction; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H1174EACB15374472B082F1D9184E86B2"><enum>(C)</enum><text display-inline="yes-display-inline">includes—</text> <clause commented="no" display-inline="no-display-inline" id="HC48798E2D4F64DB5BCB095DE5A5417A3"><enum>(i)</enum><text display-inline="yes-display-inline">substantial time each week engaged in tutoring with trained personnel;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H8C84C1C37E4B48098FE9C32D2755997A"><enum>(ii)</enum><text display-inline="yes-display-inline">a sustained and strong relationship between the student and tutor;</text></clause> <clause commented="no" display-inline="no-display-inline" id="HA3209394989F455D88E4326A746A10A7"><enum>(iii)</enum><text display-inline="yes-display-inline">progress monitoring of student knowledge and skills attainment;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H7372E7085CE147ACA7BEBE223195179C"><enum>(iv)</enum><text display-inline="yes-display-inline">an alignment with core classroom instruction; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="H945568AC21544EA6924FBCD8145D8292"><enum>(v)</enum><text display-inline="yes-display-inline">supportive coaching for the tutor to ensure quality interactions.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>
<paragraph id="H8CF2E58FAAF04E938618194881C08DEC"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HB16FC57274C04D2E991CCC83708E0DAF"> <paragraph id="H1D93ED9CB47248BAB7777DB0124D5F20"><enum>(6)</enum><header>Science of reading</header><text>The term <term>science of reading</term> means an interdisciplinary body of research from cognitive science, neuroscience, and education regarding the development of reading and writing proficiency, including research that—</text>
<subparagraph id="H19BF7D5AA66E4A23BA036AA5842D6AD2"><enum>(A)</enum><text>demonstrates the explicit, systematic use of the essential components of phonemic awareness, phonic decoding, fluency, language structure, oral language, vocabulary, background knowledge, and literacy knowledge, which together lead to strong comprehension; and</text></subparagraph> <subparagraph id="HD4965ECD6F0742A99E9D8086FD017769"><enum>(B)</enum><text>recognizes the connection of reading and writing and the importance of strong writing instruction.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H5D999E0592DF4EEAA03B5B5367D49C9E"><enum>(7)</enum><header>Universal early literacy screening</header><text display-inline="yes-display-inline">The term <term>universal early literacy screening</term> means the systematic and periodic evidence-based assessment of all students’ foundational reading skills, including phonological and phonemic awareness, phonics, fluency, vocabulary, and comprehension, as developmentally appropriate, to identify those at risk for reading difficulties and to provide timely, evidence-based interventions.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H45CA1C66A583413BA78EFED96ECEFCBA"><enum>(b)</enum><header>Amendment to comprehensive literacy instruction definition</header><text>Section 2221(b)(1) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6641">20 U.S.C. 6641(b)(1)</external-xref>) is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="HDE6F69C8355B44A1AABD766E78AA52FB"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (K), by striking <quote>and</quote> after the semicolon;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H7C9E54A6BA0C4A43B5B299BB41FEBC74"><enum>(2)</enum><text>in subparagraph (L), by striking the period at the end and inserting a semicolon; and</text></paragraph>
<paragraph id="H3379BF7F1A664155A1B4837E5B9FC6C9"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HCF167B38F3DC43068BD6697E4D1DCC78"> <subparagraph id="H4CA78815CCA8472CB09B5E3011A12A21"><enum>(M)</enum><text>excludes three-cueing models or related instructional approaches that primarily—</text>
<clause id="H87D0285496EE46F3B6D6AB715F47ED9E"><enum>(i)</enum><text>use meaning drawn from context, pictures, or syntax as the primary basis for teaching word recognition (commonly referred to as <quote>meaning, structure and syntax, and visual cues</quote> or <quote>MSV</quote>); or</text></clause> <clause id="H39E904CBB4044C00951DC1809783B0F4"><enum>(ii)</enum><text>teach visual memory as the primary basis for word recognition; and</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HBDEB479B167F4A1ABFCB56E7D0FBAFA2"><enum>(N)</enum><text display-inline="yes-display-inline">uses effective language instruction to support literacy and oral language development, particularly for English learners and children with disabilities.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> <section id="H92BEA515365F4FB9B8E2448082E5F0C8"><enum>3.</enum><header>Reauthorization of the comprehensive literacy State development grants program</header><text display-inline="no-display-inline">Section 2222 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6642">20 U.S.C. 6642</external-xref>) is amended—</text>
<paragraph id="H3CF98B772D494B8D9EFA112B1CC00B09"><enum>(1)</enum><text>by striking subsection (a) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H7F375E6A64674D28BEDCEA783796EB4B"> <subsection id="H7C2A9DD88E8844F3A798FEC33092EDED"><enum>(a)</enum><header>Grants authorized</header><text>From the amounts reserved by the Secretary under section 2201(2) and not reserved under subsection (b), the Secretary shall—</text>
<paragraph id="H3BD78B082E0745528C43C83B6CD61B4A"><enum>(1)</enum><text>award grants, on a competitive basis, to State educational agencies to enable the State educational agencies to—</text> <subparagraph id="HC39313E1B2CA430C9BBB8E420731642B"><enum>(A)</enum><text>provide subgrants to eligible entities serving a diversity of geographic areas, giving priority to entities serving greater numbers or percentages of children from low-income families;</text></subparagraph>
<subparagraph id="H0F58F7D44E874D15A16DEF2A6522166F"><enum>(B)</enum><text>develop or enhance comprehensive literacy instruction plans that ensure high-quality instruction and effective strategies in reading and writing for children from early childhood education through grade 12, including English learners and children with disabilities; and</text></subparagraph> <subparagraph id="H157252B56FD541CD92C3383B6D4EBCFC"><enum>(C)</enum><text>implement statewide policies and systems of support to assist local educational agencies and teacher preparation programs in improving literacy instruction and outcomes; and</text></subparagraph></paragraph>
<paragraph id="H3AE2030DBE744D92A2A0D250E83AC18F"><enum>(2)</enum><text>award grants to all eligible low-performing States that submit applications, pursuant to the absolute priority provided under subsection (e)(2).</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H993B78836CBB4D00892D54CF27EF506E"><enum>(2)</enum><text>by striking subsection (b) and inserting the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="H5A6225F99A704FC495FEA3E751883380">
<subsection commented="no" display-inline="no-display-inline" id="H933D99DAC6894D4D951861AD7CCED306"><enum>(b)</enum><header>Reservation</header><text display-inline="yes-display-inline">From the amounts reserved to carry out this subpart for a fiscal year, the Secretary shall reserve—</text> <paragraph commented="no" display-inline="no-display-inline" id="H034655C33BEA4EE0A656C87AA8F1CE72"><enum>(1)</enum><text>not more than a total of 5 percent for national activities, which—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HB35051A4AB4C4E09AE6541E09C054648"><enum>(A)</enum><text display-inline="yes-display-inline">shall include an evaluation—</text> <clause id="HD253294728FD4F3C8EF7A4C90DF96B04"><enum>(i)</enum><text>that meets the requirements of section 2225; and</text></clause>
<clause id="H7C97701FD26E423F91A9BED7863D2A12"><enum>(ii)</enum><text>that may not be canceled or deferred, unless the entity contracted by the Director of the Institute of Education Sciences to conduct the evaluation violates the terms of the contract, has been given written justification for the contract’s termination, and has been provided an opportunity to appeal the termination within 30 days of receiving the notice of termination; and</text></clause></subparagraph> <subparagraph id="H4115DE1C8D074607BE59F91D0604CC5A"><enum>(B)</enum><text>shall include technical assistance, training, data collection, and reporting, which may include support for the regional educational laboratories (described in section 174 of the Education Sciences Reform Act of 2002) and comprehensive centers (established pursuant to section 203 of the Educational Technical Assistance Act of 2002) to support literacy research and technical assistance;</text></subparagraph></paragraph>
<paragraph id="H556D891815B045448F84ACDAB05BDC34"><enum>(2)</enum><text>sufficient funds to provide grant awards to all eligible low-performing States, pursuant to the absolute priority provided under subsection (e)(2);</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H33AEB4CD6FC24123B2046B6482522491"><enum>(3)</enum><text>one half of 1 percent for the Secretary of the Interior to carry out a program described in this subpart at schools operated or funded by the Bureau of Indian Education; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H8ACCE2C5A545461C9A2EDC13743C46D8"><enum>(4)</enum><text>one half of 1 percent for the outlying areas to carry out a program under this subpart.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="HB54389F7C1FD473DA0893FB56D62DFB5"><enum>(3)</enum><text>in subsection (c), by striking <quote>5 years</quote> and inserting <quote>4 years</quote>;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H3DF209E706B04A3A9E5258B383AA38B1"><enum>(4)</enum><text>in subsection (d)(2)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H1C6D2EEF55BD4721918110146F424E01"><enum>(A)</enum><text display-inline="yes-display-inline">by striking subparagraph (B) and inserting the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="H31D7A1006FBB49248BF6F40C35D72E78">
<subparagraph id="H3C4A5B376A3C43768BE89D1F30D18FC9" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">A description of how the State educational agency, in collaboration with the State literacy team, if applicable, will develop a State comprehensive literacy instruction plan or will revise and update an already existing State comprehensive literacy instruction plan, including how the State will—</text> <clause commented="no" display-inline="no-display-inline" id="HBF220798AD684C2C8E5AE6AEC17C5C0B"><enum>(i)</enum><text display-inline="yes-display-inline">implement universal early literacy screenings and intervention services for students at-risk of falling behind in becoming proficient in reading by third grade, which may include high-impact tutoring and summer learning programs;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HB21A785AF51841FA87144F1EF1D385F8"><enum>(ii)</enum><text display-inline="yes-display-inline">increase access for educators to high-quality instructional materials aligned with the science of reading;</text></clause> <clause commented="no" display-inline="no-display-inline" id="HC64C384521F9434C82651EB11A01D27D"><enum>(iii)</enum><text display-inline="yes-display-inline">deliver professional development and instructional coaching for educators, with the input of educators, in high-needs schools with the lowest literacy outcomes;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H35573B3C9E654D22BE9E8FA1BEE653AD"><enum>(iv)</enum><text display-inline="yes-display-inline">evaluate teacher preparation programs to assess alignment with the science of reading; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="H147B6709030F4E26871BA42E1B6B4D2D"><enum>(v)</enum><text display-inline="yes-display-inline">meaningfully engage educators from across the State to provide early and ongoing input on how to effectively support educators in improving instructional practice and educational outcomes.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph>
<subparagraph id="HC471D4BDF16D440F966B3E5F0A8D32B6"><enum>(B)</enum><text>by striking subparagraphs (D) and (E) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HDE6D099A98694824A0B6C3830FB65B3B"> <subparagraph id="H716D2B4240704916803D7958FBE8A0AC"><enum>(D)</enum><text>A description of how the State educational agency will use implementation grant funds described in subsection (f)(1) for comprehensive literacy instruction programs as follows:</text>
<clause id="H12F4A81BD9244A9EB6ED6C4BCC150E38"><enum>(i)</enum><text>Not less than 15 percent of such grant funds shall be used for State and local programs and activities pertaining to children from birth through kindergarten entry.</text></clause> <clause id="H9BB20EE4E54E48558931A79526FA0581"><enum>(ii)</enum><text>Not less than 40 percent of such grant funds shall be used for State and local programs and activities, allocated equitably among the grades of kindergarten through grade 5.</text></clause>
<clause id="H2C0C38CBEBC047EFB17A4C06EC7436AC"><enum>(iii)</enum><text>Not less than 40 percent of such grant funds shall be used for State and local programs and activities, allocated equitably among grades 6 through 12.</text></clause></subparagraph> <subparagraph id="H892F124D69FE49E3A41E7E441AA3DE37"><enum>(E)</enum><text>An assurance that the State educational agency will collaborate with the State agency responsible for administering early childhood education programs and the State agency responsible for administering child care programs in the State in improving early literacy opportunities for children and early childhood educators.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HB636E7A39A314BF9995617583A1FD513"><enum>(F)</enum><text display-inline="yes-display-inline">An assurance that the State educational agency will require each local educational agency in the State to provide sufficient and timely notification to a parent of a student served by such local educational agency who is identified as at risk of reading difficulties or performing below grade level in reading. Such notification shall—</text> <clause id="H578DC7E8B13540049DCB2C493F854905"><enum>(i)</enum><text>include the results of the assessment or screening;</text></clause>
<clause id="H524EC04E5737434A843114E2F7EFCC68"><enum>(ii)</enum><text>include the strategies that will be provided to the student to help reach proficiency in grade-level literacy standards;</text></clause> <clause id="H6F3FF7B12EC44BBDAA777DF150653CF9"><enum>(iii)</enum><text>include strategies to parents to support learning at home; and</text></clause>
<clause id="H3FF149CBF90746CF8AEE9C1B3A8D7030"><enum>(iv)</enum><text>be provided in an understandable and uniform format and, to the extent practicable, provided in a language the parents can understand.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HB4655C9B413D461FB3C558E9FCB972CE"><enum>(5)</enum><text>by striking subsection (e) and inserting the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="HDF4EDC12AA1C40F8A929C58C58D68CEC">
<subsection id="HB836DD4BAC4844F59B8C73E111AC10D3"><enum>(e)</enum><header>Priority</header>
<paragraph id="H2C27557C3222497E8D051955DE01434A"><enum>(1)</enum><header>Competitive priority</header><text>In awarding grants under this section, the Secretary shall give competitive priority—</text> <subparagraph id="H65E7ABE3CCDA4825BA9AB5D3F411B46D"><enum>(A)</enum><text>to State educational agencies that will use the grant funds for evidence-based activities, defined for the purpose of this subsection as activities meeting the requirements of section 8101(21), except that subclause (III) of subparagraph (A)(i) of such section shall not apply;</text></subparagraph>
<subparagraph id="HA9D87B2CC2864253AF51007B26B61454"><enum>(B)</enum><text>to States that demonstrate, based on the needs assessment described in subsection (d)(2)(A), that the State has not yet implemented, on a statewide basis, a comprehensive approach to the required activities described in subsection (f)(1)(A); and</text></subparagraph> <subparagraph id="H04AA4F146ABC478CA8FAA06237D72C22" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">to States that experienced a significant decline in biennial State academic assessment outcomes of 4th and 8th grade reading under the National Assessment of Educational Progress carried out under section 303(b)(3) of the National Assessment of Educational Progress Authorization.</text></subparagraph></paragraph>
<paragraph id="H0B3CC56D3FD045F088B908F4BA398D2F" commented="no"><enum>(2)</enum><header>Absolute priority</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H2A2EFDB940C2450E985217EE7996B0A6"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In awarding grants under this section, the Secretary shall give absolute priority to eligible low-performing States that satisfy the application requirements described in subsection (d).</text></subparagraph> <subparagraph id="HCCA75EC673024A69A7DDAE145DA85119" commented="no"><enum>(B)</enum><header>Identification of eligible low-performing states</header><text>Before announcing a grant competition under this section, the Secretary shall identify and notify any State that qualifies as an eligible low-performing State.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H1CF0B03EBEDB4D858A0A7A5CA9D0BF29"><enum>(C)</enum><header>Clarification on meeting same requirements</header><text>An eligible low-performing State that receives a grant under this section shall meet the same requirements as a State awarded a grant under this section on a competitive basis.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H4D6E96A161A445378413B3B544835096"><enum>(6)</enum><text>by striking subsection (f) and inserting the following:</text>

<subsection commented="no" display-inline="no-display-inline" id="HC03A7695081A40E68EAC7823CF91A8ED"><enum>(f)</enum><header>State activities</header>
<paragraph commented="no" display-inline="no-display-inline" id="H2C3D7AD84D66447986C8F0F4E53BC0FB"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H12E7FEDFAB464747BF13B2ABB2DCE5CA"><enum>(A)</enum><header>State uses of funds</header><text display-inline="yes-display-inline">Each State that receives a grant under this section shall use grant funds not allocated under paragraph (2) to carry out each of the following:</text> <clause commented="no" display-inline="no-display-inline" id="H1EFF22B9656548A2A9803A35A44189CD"><enum>(i)</enum><text display-inline="yes-display-inline">Ensure pre-service training and in-service training are aligned between them and with the science of reading and designed, in collaboration with teachers and institutions of higher education, to support teachers in understanding the evidence base on how students learn to read and in using evidence-based instructional materials and practices in their classrooms, which may include—</text>
<subclause commented="no" display-inline="no-display-inline" id="H006C9C111DD04872BBF17E95F2C0E638"><enum>(I)</enum><text display-inline="yes-display-inline">creating statewide and regional literacy coaching networks;</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="HF1A54057F62140099804BAB0786448A4"><enum>(II)</enum><text display-inline="yes-display-inline">evaluating teacher preparation programs to strengthen coursework and training in the science of reading;</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H465C42EB13924684B296AF33BE5112A8"><enum>(III)</enum><text display-inline="yes-display-inline">evaluating State licensure or certification standards to reflect the science of reading; and</text></subclause> <subclause id="HBE4092D0D6FD402093A08A2312607EA9"><enum>(IV)</enum><text>providing pre-service and in-service training for educators on evidence-based screening, assessment, and progress monitoring and instruction for students with or at risk of dyslexia or other reading difficulties.</text></subclause></clause>
<clause commented="no" display-inline="no-display-inline" id="H3628207397AE447BB29628DC469DD177"><enum>(ii)</enum><text display-inline="yes-display-inline">Implement evidence-based interventions aligned with the science of reading and designed to prepare students for success with grade-level work in their core classes, which may include high-impact tutoring and summer learning programs.</text></clause> <clause commented="no" display-inline="no-display-inline" id="HBB194DCC849D49478CE8867F6ADD877C"><enum>(iii)</enum><text display-inline="yes-display-inline">Provide universal early literacy screening at least once before the third grade, with more regular literacy screenings encouraged as a tool to help identify reading difficulties or dyslexia early, and ensure support is provided to struggling readers.</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H73991AEFDFF54795872DF209ACF1653A"><enum>(iv)</enum><text display-inline="yes-display-inline">Develop, incentivize, and support the adoption and implementation of recommended high-quality instructional materials aligned with the science of reading.</text></clause> <clause commented="no" display-inline="no-display-inline" id="HB6ED6262582F49E5833738B7F4598A37"><enum>(v)</enum><text display-inline="yes-display-inline">Convene and solicit input from educators as collaborative, expert partners to advise on improving pre-service training, in-service training, and identify other supports that they may need to successfully implement the science of reading in classrooms.</text></clause>
<clause id="H0EA740A535D34A4AAE417238D9DC7B8D" commented="no"><enum>(vi)</enum><text>Develop policies and procedures, including a parental notification template or other materials for optional use by local educational agencies, to support such local educational agencies in providing sufficient and timely notification, as required under subsection (d)(2)(F), to a parent of a student who is identified as at risk of reading difficulties or performing below grade level in reading.</text></clause></subparagraph></paragraph> <paragraph id="HD6F53D618C394F6383B8ACED18A898F8"><enum>(2)</enum><header>Subgrants</header><text>Each State that receives a grant under this section shall allocate not less than 75 percent of the grant funds to award subgrants to eligible entities to enable the eligible entities to carry out activities to improve literacy, such as—</text>
<subparagraph id="H9B93D737E5ED45938E21A2A3E9DDD745"><enum>(A)</enum><text>strengthening literacy instruction aligned to the science of reading in early childhood education programs or elementary schools and secondary schools, including through in-service training for educators;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HEB17FD42144B4109832787C5F1B4C437"><enum>(B)</enum><text display-inline="yes-display-inline">employing and training literacy instructional coaches and interventionists;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HF83EF20FCD23451FAFCD45BE2656F586"><enum>(C)</enum><text display-inline="yes-display-inline">purchasing and adopting high-quality instructional materials aligned with the science of reading;</text></subparagraph> <subparagraph id="H374880AB178145659AF39139C119A668"><enum>(D)</enum><text>conducting universal early literacy screenings to help identify reading difficulties or dyslexia early;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H2D9F59323DEA404291FD405A96D523C9"><enum>(E)</enum><text display-inline="yes-display-inline">providing direct services to students, which may include high-impact tutoring and summer learning programs, designed to help students reach proficiency in grade-level literacy standards;</text></subparagraph> <subparagraph id="H13046DC2DD164BBAABF0297F2C4A6178"><enum>(F)</enum><text>supporting a child’s learning at home through family literacy services and parents and family engagement initiatives that provide parents with actionable strategies aligned with the science of reading;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HE93346CBCAB74CEEB831FAFCA4A42FB7"><enum>(G)</enum><text>supporting evidence-based bilingual literacy instruction, including biliteracy development aligned with the science of reading;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H0CDD623901264D78B43CFC8FFF441D8B"><enum>(H)</enum><text display-inline="yes-display-inline">convening and soliciting early and ongoing input from educators as collaborative, expert partners to advise on improving in-service training and identify other supports that they may need to successfully implement the science of reading in classrooms; and</text></subparagraph>
<subparagraph id="H4590BDD83D584034A90B8390E92E6D39"><enum>(I)</enum><text>supporting principals and other school leaders to have the necessary understanding of the science of reading to coordinate schoolwide activities and leverage the expertise of teachers, literacy instructional coaches and interventionists, paraprofessionals, school librarians, special education teachers, and other appropriate school-based staff in serving students.</text></subparagraph></paragraph> <paragraph id="H4E16F42CB3D3476FB94B48057360F338"><enum>(3)</enum><header>Teacher preparation requirements</header> <subparagraph commented="no" display-inline="no-display-inline" id="HD45D80EC8AFA4873996BDD790B938E2C"><enum>(A)</enum><header display-inline="yes-display-inline">Alignment with the science of reading</header><text>Except as provided in subparagraph (B), each State that receives a grant under this section shall complete and publish, not later than 3 years after the date of receipt of the grant funds, a review of all teacher preparation programs in the State to assess alignment with the science of reading and make recommendations to programs, as appropriate, for better aligning course offerings to the science of reading.</text></subparagraph>
<subparagraph id="H5BA5AFF657B44309A6335861E7DABD2B"><enum>(B)</enum><header>Exemption</header><text>A State that demonstrates that a review described in subparagraph (A) has recently and similarly been completed and published by the State is not required to use grant funds received under this section to complete and publish an additional review.</text></subparagraph></paragraph></subsection> <subsection id="HA544C2A3833D4089941D0CE6B0A6362E"><enum>(g)</enum><header>Reporting Requirements</header> <paragraph id="H8931EBF8F60B4B87ADEC7713EA02373F"><enum>(1)</enum><header>Annual report</header><text>Each State that receives a grant under this section shall submit a public report to the Secretary on an annual basis and publish such report in a clear and easily accessible format on the website of the State. Such report shall contain, at a minimum and at the statewide and local educational agency level (in accordance with paragraph (3)) the following information:</text>
<subparagraph id="H819DEE36DAD444428AC909D28BDC1223"><enum>(A)</enum><text>The number and percent of students receiving screenings and interventions for reading difficulties, disaggregated by grade level and disaggregated by each of the subgroups of students, as defined in section 1111(c)(2).</text></subparagraph> <subparagraph id="H2DEB3178F4754B30B16A0B4304AD0880"><enum>(B)</enum><text>The number and percent of pre-service and in-service teachers receiving professional development and coaching related to the science of reading.</text></subparagraph>
<subparagraph id="H38AC7654F5AA46A0B2FF4491335B3B8D"><enum>(C)</enum><text>The number of local educational agencies using high-quality instructional materials aligned with the science of reading as recommended by the State.</text></subparagraph></paragraph> <paragraph id="HF64BDAFCBCB948D58D79CBA2B0C0E9BD"><enum>(2)</enum><header>Secretary’s report</header> <subparagraph commented="no" display-inline="no-display-inline" id="HECC2886E752C4092875EF8BAE3E41D20"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after receiving the reports described in paragraph (1), and every 2 years thereafter, the Secretary shall submit a report to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Education and Workforce of the House of Representatives that includes a summary of the reports submitted by States.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H3EE8E3D495FE49FC98BD49BC1A95F956"><enum>(B)</enum><header>Public availability</header><text display-inline="yes-display-inline">The Secretary shall make the reports described in subparagraph (A) publicly available in a clear and easily accessible format on the website of the Department of Education.</text></subparagraph></paragraph> <paragraph id="H648FCD7DC3E642E48E9B1A04B36ADD9F"><enum>(3)</enum><header>Data privacy</header> <subparagraph id="HFECEE60A58484627B089F0DFCCD6FE4B" commented="no"><enum>(A)</enum><header>Personally identifiable data limitation</header><text>A State shall not include any personally identifiable information in a report submitted under paragraph (1).</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HC63C9563B0DD4F00AD556E78092C1ADD"><enum>(B)</enum><header>Disaggregation of data</header><text display-inline="yes-display-inline">Disaggregation of data shall not be required under this subsection when the number is insufficient to yield statistically reliable information or the results would reveal personally identifiable information about an individual.</text></subparagraph></paragraph></subsection> <subsection id="HF1B0356B2E0B4292ABECE860ED04E6A1"><enum>(h)</enum><header>Supplement not supplant</header><text>Funds made available to a State through a grant awarded under this section shall be used only to supplement and not supplant, any State, local, or non-Federal funds that would otherwise be used to carry out literacy instruction, teacher preparation, or interventions.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="H49EE12B3B9EE4CA685C041E343F6C67C"><enum>4.</enum><header>General provisions</header>
<subsection id="H84FDD49C53A84E0B84FAD69B3FCF5E39"><enum>(a)</enum><header>Applicability</header><text>This Act and the amendments made by this Act shall apply with respect to funds awarded under the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6301">20 U.S.C. 6301</external-xref> note et seq.) on or after the date of enactment of this Act.</text></subsection> <subsection id="H9E10191926EB4607AC6E56F7F97BF336"><enum>(b)</enum><header>Secretarial prohibition</header><text>Section 2302 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6692">20 U.S.C. 6692</external-xref>) is amended by adding at the end the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="H6CC90B326BE9453A9C13E354FA81EFAB">
<subsection id="HB256B3593ECC41ABBFA633EDC659F02F"><enum>(c)</enum><header>Limitations on secretarial authority</header><text>In carrying out subpart 2 of part B of this title, the Secretary shall not issue any regulation—</text> <paragraph id="H0ED4DF99C2C74E59BD60193E9E37A3D1"> <enum>(1)</enum> <text>regarding the definition of the science of reading and comprehensive literacy instruction; or</text>
                        </paragraph>
<paragraph id="H2AFE5A8C03B747048F325F9F2791F435"><enum>(2)</enum><text>that would directly or indirectly mandate, direct, or control a State, local educational agency, or school’s specific instructional content, academic standards and assessments, curricula, or program of instruction.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H5599D717B69D4F1398B6E18B5CB6DE7E"><enum>(c)</enum><header>Rules of construction</header><text>Nothing in this Act or the amendments made by this Act shall be construed to—</text>
<paragraph id="H43B17D412FC0464A9A5A84E5190ED2A1"><enum>(1)</enum><text>limit or alter the rights, protections, and individualized educational requirements under the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1400">20 U.S.C. 1400 et seq.</external-xref>), section 504 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794">29 U.S.C. 794</external-xref>), or the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>); or</text></paragraph> <paragraph id="H9F1F949EA20C4017ACDFC29C750CA5A4" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>authorize any officer or employee of the Federal Government to mandate, direct, or control a State, local educational agency, or school’s specific instructional content, academic standards and assessments, curricula, or program of instruction.</text></paragraph></subsection></section>
<section id="HC6258C0392514EC7AA8942B858AE1AC3"><enum>5.</enum><header>Research and development</header><text display-inline="no-display-inline">Section 2225 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6645">20 U.S.C. 6645</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H8CCD11AD1410494EA6BC0053B54F6C3A"> <subsection id="H240D6E6185C2468A8C85DCC14098BFAE"><enum>(c)</enum><header>Research and development</header><text>The Director of the Institute of Education Sciences shall—</text>
<paragraph id="HBDCB8C500CD84E9A81D554D870358076"><enum>(1)</enum><text>sponsor basic and applied research to improve comprehensive literacy instruction and improve students’ academic outcomes, such as on—</text> <subparagraph id="H7B8213F85FB340E692A53705BE32DA1C"><enum>(A)</enum><text>the relationship between reading books rather than passages in building reading stamina, the relationship between writing instruction and reading comprehension, optimal amounts of time for different aspects of reading and writing instruction in the average classroom, the essential components of effective reading curricula, the relationship between teacher preparation, professional development, and effective reading and writing instruction, and out-of-school factors that impact reading proficiency, including oral language development; and</text></subparagraph>
<subparagraph id="HE0FE552232884C35B855929FFA3A7D17" commented="no"><enum>(B)</enum><text>the decreases in cognitive capabilities and attention spans amongst children and youth, including the relationship between screentime, social media, and addictive technology features; and</text></subparagraph></paragraph> <paragraph id="H2C6D526ACC3140BD99D8D07E6BEC235A"><enum>(2)</enum><text>conduct initiatives or activities that promote engagement, the synthesis of education research on the topics described in paragraph (1), the development of related evidence-based practices, and the wide dissemination of such findings—</text>
<subparagraph id="H9BB19F85ED9F4A019BEC190F7D5C63F2"><enum>(A)</enum><text>in a manner that is responsive to the educational challenges facing students, families, practitioners, and education system leaders; and</text></subparagraph> <subparagraph id="H8F98AB86232A492BB16D1FB83CCDED2E"><enum>(B)</enum><text>that can provide the basis for improving academic instruction and lifelong learning.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="HF8D4ED2A99994E24B538F955E168AD51"><enum>6.</enum><header>NAEP reporting</header><text display-inline="no-display-inline">Section 2225 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6645">20 U.S.C. 6645</external-xref>), as amended by section 5, is further amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H0742943DC58E4965BD7564215902493F"> <subsection id="HEA16A08DCE814F45AE76CFEFADE80213"><enum>(d)</enum><header>NAEP reporting to States</header> <paragraph id="H661DB620238F4C84ABE347A00C4F36AD"> <enum>(1)</enum> <header>In general</header> <text>Not later than 5 days after the date described in paragraph (2), the Director of the Institute of Education Sciences, acting through the Commissioner for Education Statistics, shall make available to the public and submit a public report to each State (including, to the greatest extent practicable, the Governor, the State educational agency, and State legislators) a report that contains easily accessible information on each of the following:</text>
                        <subparagraph id="H56C02596FEE3486F9ADBA4817F4CBEA9">
                            <enum>(A)</enum>
 <text>The academic outcomes of students in the State.</text> </subparagraph> <subparagraph id="HF6CE6E4D22FD4CA7BD21FA0148324188"> <enum>(B)</enum> <text>The State’s ranking compared to other States based on proficiency levels of each academic assessment conducted.</text>
                        </subparagraph>
                        <subparagraph id="H9DB997A0AEB24AB58948E7AFA03427F7">
                            <enum>(C)</enum>
 <text>The State's ranking compared to other States on the following basis, to the greatest extent practicable:</text>
                            <clause id="HE5F2C8F6172E45069945AF9529760CCE">
                                <enum>(i)</enum>
 <text>Proficiency levels adjusted for poverty or similar demographics.</text>
                            </clause>
                            <clause id="H9DC7682320984FD889E2A54A3DE1981A">
                                <enum>(ii)</enum>
 <text>Magnitude of achievement gaps, including between subgroups of students and gaps between the highest and lowest performing students in the State.</text>
                            </clause>
                            <clause id="H7A9A07B1933046C9AF907BADD3852264">
                                <enum>(iii)</enum>
 <text>Percentage of students at below basic achievement levels.</text>
                            </clause>
                        </subparagraph>
                        <subparagraph id="HA49DA708251647F298C9429FDC1D1511">
                            <enum>(D)</enum>
 <text>Relevant trend or longitudinal data, such as whether the State’s outcomes are increasing, decreasing, or stagnant, or whether cohorts of students demonstrate any significant achievement trends.</text>
                        </subparagraph>
                    </paragraph>
<paragraph id="H4E6BC57A14CA4C1499BFE10E83B266A5"><enum>(2)</enum><header>Date</header><text>The date described in this paragraph is the date that the Commissioner for Education Statistics releases the results of the biennial State academic assessments in reading and mathematics in grades 4 and 8 of the National Assessment of Educational Progress carried out under section 303(b)(3) of the National Assessment of Educational Progress Authorization Act.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body></bill>
