<section id="HD147E62E611A43C98EE19F5EEECA6197" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop ICE’s Medical Neglect Act of 2026</short-title></quote>.</text></section> <section id="HE15271A8B78445049A4186BB848B067B"><enum>2.</enum><header>Complaint submission platform</header> <subsection id="H768D084B091B4AA49D42131AFD7A5454"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall establish a publicly accessible, online platform that any individual detained by U.S. Immigration and Customs Enforcement or U.S. Customs and Border Protection may use to submit a complaint alleging medical neglect at the covered facility in which such individual is being held.</text></subsection> 
<subsection id="HBDF4485A5A5B4B24A0234F7E321EF49F"><enum>(b)</enum><header>Complaint</header> 
<paragraph id="H79FA482120BD499486FE128FEEB08A2C"><enum>(1)</enum><header>Filing</header><text>Individuals who may file a complaint described under subsection (a) include—</text> <subparagraph id="HF2270971363A4A1E9E09970AC64DC239"><enum>(A)</enum><text display-inline="yes-display-inline">an individual detained by U.S. Immigration and Customs Enforcement or U.S. Customs and Border Protection who is being held in a covered facility;</text></subparagraph> 
<subparagraph id="H0CBE8A935C614E4C972E3114715AF23E"><enum>(B)</enum><text>legal counsel filing on behalf of an individual described under subparagraph (A); or</text></subparagraph> <subparagraph id="H453F4C43297E429CA14435D78935B105"><enum>(C)</enum><text display-inline="yes-display-inline">a family member filing on behalf of an individual described under such subparagraph.</text></subparagraph></paragraph> 
<paragraph id="H2159ACB6816449DD9C4EBAED307927C2"><enum>(2)</enum><header>Required information</header><text display-inline="yes-display-inline">A complaint described under subsection (a) shall include the following information:</text> <subparagraph id="H6BE31DF3F66B4AFD9EE2787A8080717B"><enum>(A)</enum><text display-inline="yes-display-inline">The name of the individual detained by U.S. Immigration and Customs Enforcement or U.S. Customs and Border Protection who is being held in a covered facility.</text></subparagraph> 
<subparagraph id="H0D99D0C07ED64C3E894CCFA6EC4E92F2"><enum>(B)</enum><text>The alien registration number of such individual.</text></subparagraph> <subparagraph id="HAD11289F6CBB4A8BB9943F2A36D547E9"><enum>(C)</enum><text>The name of the covered facility in which such individual is being held.</text></subparagraph> 
<subparagraph id="HA860F0B61F58474F97E5616E7726B75C"><enum>(D)</enum><text>A description of the medical neglect such individual experienced at such cover facility.</text></subparagraph></paragraph> <paragraph id="HC3906E35E37343678071A2964506F3D9"><enum>(3)</enum><header>Confidentiality</header><text>Any complaint submitted by an individual described under paragraph (1)—</text> 
<subparagraph id="H5C102A7A995D40EE8CDBC972EE8E0CCB"><enum>(A)</enum><text>shall be confidential; and</text></subparagraph> <subparagraph id="H4BE9DD26F2A542E09BDCE23D4A7BB4BB"><enum>(B)</enum><text>may not be shared without the consent of the individual who is the subject of such complaint.</text></subparagraph></paragraph></subsection> 
<subsection id="H445D20D3CEB848259C9AE14E3F27329E"><enum>(c)</enum><header>Review</header> 
<paragraph id="H1FA391FB77D04AAC86985E98D9BE7A29"><enum>(1)</enum><header>Review by medical expert</header><text display-inline="yes-display-inline">Any complaint submitted to the online platform established under this section shall be reviewed by a contracted medical expert to determine if the medical neglect alleged in the complaint occurred.</text></paragraph> <paragraph id="HA41351A8A32647BF99B5175F6D4C14BD"><enum>(2)</enum><header>Referral</header> <subparagraph id="HA1E25FEA0BA74E15AAC1A2171A7B287E"><enum>(A)</enum><header>Determination</header><text>If a contracted medical expert determines medical neglect occurred after conducting a review pursuant to paragraph (1), the Secretary of Homeland Security shall ensure the individual who experienced such neglect in a covered facility receives necessary medical treatment.</text></subparagraph> 
<subparagraph id="H9CF12A5A870E48E185984158F6855874"><enum>(B)</enum><header>Appeal</header><text display-inline="yes-display-inline">If a contracted medical expert determines no medical neglect occurred after conducting a review pursuant to paragraph (1), an individual described under subsection (b)(1) may appeal such determination for further review to the Office for Civil Rights and Civil Liberties of the Department of Homeland Security.</text></subparagraph></paragraph> <paragraph id="H692FFF78789F49FE8BCB2B0D077C47A0"><enum>(3)</enum><header>Updates</header><text>The Secretary of Homeland Security shall provide updates on the status of any complaint submitted under this section on the platform established under this section.</text></paragraph> </subsection> 
<subsection id="H7E94E1E9BB5C488A8A5D7B6B3A82230E"><enum>(d)</enum><header>Retaliation</header><text display-inline="yes-display-inline">Any individual being held in a covered facility may not be subject to retaliation or adverse treatment for submitting a complaint pursuant to this section, communicating with legal counsel, or corresponding with Congressional offices with respect to—</text> <paragraph id="H04DAD3C6D2CF441ABAF8A7E78163870E"><enum>(1)</enum><text>the conditions of their detention in such covered facility; or</text></paragraph> 
<paragraph id="HE68EAF90C124409D87AC7BECB944FE55"><enum>(2)</enum><text>access to appropriate and timely medical care in such covered facility.</text></paragraph></subsection> <subsection id="HD134BBED2214496DA853F8F3736EE2BF"><enum>(e)</enum><header>Interpretation services</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall ensure language translation services are made available to any individual being held in a covered facility.</text></subsection> 
<subsection id="H358DC708BC8C4BC0AA23F23355D9A742"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="HE926E8435C5A4DE0956EE70DB633B3F2"><enum>(1)</enum><header>Covered facility</header><text display-inline="yes-display-inline">The term <term>covered facility</term> means a facility where noncitizens are being held by the Secretary of Homeland Security pursuant to the immigration laws (as such term in defined under section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>)), including—</text> 
<subparagraph id="HA8D24279E12A4449AD2B4BFB35FB6020"><enum>(A)</enum><text>any facility that provides detention services under a competitive bid contract awarded by the Secretary of Homeland Security;</text></subparagraph> <subparagraph id="H1C3D5843C750422499FDECDB48358E81"><enum>(B)</enum><text display-inline="yes-display-inline">any facility operated by or for the Department of Homeland Security used to hold or otherwise house noncitizens; and</text></subparagraph> 
<subparagraph id="H7F0097A3635548ECB008AFF08F1C3F66"><enum>(C)</enum><text display-inline="yes-display-inline">any additional space that may be utilized for the purposes of temporarily detaining a noncitizen for a period longer than 4 hours.</text> </subparagraph></paragraph> <paragraph id="H295CF305A53746F281CDF66B6102554B"><enum>(2)</enum><header>Contracted medical expert</header><text display-inline="yes-display-inline">The term <term>contracted medical expert</term> means an academic, licensed, and board-certified medical clinician, academic, doctor, provider, physician assistant, nurse practitioner, or mental health professional that—</text> 
<subparagraph id="HB428998EEBEB42DF8F6C9CB36872D082"><enum>(A)</enum><text>maintains an active medical license in at least one State;</text></subparagraph> <subparagraph id="H79567DCB57A44B55B756E2AA10F65204"><enum>(B)</enum><text display-inline="yes-display-inline">is board certified in family medicine, internal medicine, emergency medicine, obstetrics, gynecology, or behavioral medicine;</text></subparagraph> 
<subparagraph id="HF94EF824A108432E848BB691EF5DFFB4"><enum>(C)</enum><text>is in compliance with any other applicable State and Federal requirements or certifications;</text></subparagraph> <subparagraph id="HC2449B43BD114D6BB06B4CFE41E7140B"><enum>(D)</enum><text>has certifications or special training related to providing medical care in a detention facility or setting;</text></subparagraph> 
<subparagraph id="HF0E7144F656847639224BAFFDF25C987"><enum>(E)</enum><text>has at least 5 to 10 years of experience providing medical care in a detention facility or setting;</text></subparagraph> <subparagraph id="HE9D10E3913604384BFB0CDDF55690DD7"><enum>(F)</enum><text display-inline="yes-display-inline">has experience objectively critiquing the treatment provided by other medical practitioners in a detention facility or setting;</text></subparagraph> 
<subparagraph id="H49B1888EEBC14C12943004A01AB57502"><enum>(G)</enum><text>has experience formulating recommendations or other steps to address issues, violations or concerns identified as part of a complaint submitted to the platform established under this section; and</text></subparagraph> <subparagraph id="H4ABF3FE10F5E422991764716BA38BA98"><enum>(H)</enum><text>has the ability to travel to any covered facility to perform onsite medical care or administer aid through video telehealth conference call.</text></subparagraph></paragraph> 
<paragraph id="H6266172B693B46DD8A1516DB49F8BC1F"><enum>(3)</enum><header>Medical neglect</header><text display-inline="yes-display-inline">The term <quote>medical neglect</quote> means the failure to provide timely access to—</text> <subparagraph id="H0BC6B53503D24C3FB667E86C55392063"><enum>(A)</enum><text>medically necessary care or follow-up;</text></subparagraph> 
<subparagraph id="HF25A1196A82C4C55AA6916468FBC1E28"><enum>(B)</enum><text>continuity of treatment and medication;</text></subparagraph> <subparagraph id="H3265F9C0BA1F41D09B3F02DED9611C9A"><enum>(C)</enum><text>specialty referrals when clinically indicated;</text></subparagraph> 
<subparagraph id="H7D3B4D3DBC6C4912B858FC6110291DF1"><enum>(D)</enum><text>medication management; or</text></subparagraph> <subparagraph id="H51B172921C7B4CF0B466983478363B8D"><enum>(E)</enum><text>processes that identify deficiencies in patient care for any illness, medical or mental health condition, or physical injury.</text></subparagraph></paragraph></subsection></section>
