<section id="H4858241764C244BFB67D6F8218928AB4" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Person’s Race, Ethnicity, Job, or Use of Dialect or Inflection is Cause for Enforcement Act</short-title></quote> or the <quote><short-title>No PREJUDICE Act</short-title></quote>.</text></section>
<section id="HE9FFB8A344394BAE921D4CF2627FB4E2"><enum>2.</enum><header>Prohibition on discriminatory profiling by the Department of Homeland Security</header> 
<subsection id="HF09E4C19F0254A4087095E7CA1243BFC"><enum>(a)</enum><header>Limitation on use of Federal funds</header><text>No officer or employee of the Department of Homeland Security, or a person acting under the authority of the Department of Homeland Security, may seize, detain, or arrest an individual, or subject an individual to routine or spontaneous investigatory activities on the basis of any of the following, or any combination thereof:</text> <paragraph id="HA6DDF33B04054150953EB0F8A3DCBF0B"><enum>(1)</enum><text>The actual or perceived race, color, religion, sex, national origin, gender, gender identity, sexual orientation, or ethnicity of the individual.</text></paragraph> 
<paragraph id="HAF1A3198218348A4A9B9356CF67B2807"><enum>(2)</enum><text>The presence of that individual at a location associated with the recruitment or transportation of individuals for informal or temporary employment, including bus stops, car washes, or agricultural sites.</text></paragraph> <paragraph id="HD6520669A08E4379A5A7E24DD77C6D77"><enum>(3)</enum><text>Participation by that individual in a particular hobby, leisure activity, job, or career.</text></paragraph> 
<paragraph id="H7B2AD08A67774B13BD614C1892E8242C"><enum>(4)</enum><text>The use of Spanish or any language other than English, or the use of English with an accent, by that individual.</text></paragraph></subsection> <subsection id="H58E88E811EBE4080994FCE23964673F5"><enum>(b)</enum><header>Immigration proceedings</header> <paragraph id="H860F5A4BFCC940D1A2BE464445DE60B7"><enum>(1)</enum><header>Request for hearing</header><text display-inline="yes-display-inline">An alien who in removal proceedings under the immigration laws (as such term is defined in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>)) may request a hearing in the appropriate district court of the United States to determine whether the prohibition under subsection (a) was violated with respect to the alien.</text></paragraph> 
<paragraph id="H1123D63F01B742F8B9E0131364E14229"><enum>(2)</enum><header>Dismissal</header><text>If the district judge determines that the prohibition under subsection (a) was violated with respect to the alien, the judge shall dismiss the removal proceedings against the alien.</text></paragraph> <paragraph id="H23BC16C58A1F4EFAA14F336A7C5AF76A"><enum>(3)</enum><header>Remand</header><text display-inline="yes-display-inline">If the district judge determines that the prohibition under subsection (a) was not violated with respect to the alien, the judge shall remand the case to the immigration court for further removal proceedings.</text></paragraph></subsection></section>
