<section id="HB250205A5F894F7D9828B8847B19FB2D" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Data Center Resource Disclosure Act</short-title></quote>.</text></section> 
<section id="H77D9E5F907AA483EA2F1F36B77D34385"><enum>2.</enum><header>Data center resource consumption survey</header> 
<subsection id="H189AB8AFE48B412394555EFB13E9B98D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, and annually thereafter, the Assistant Secretary shall—</text> <paragraph id="H0EC546302ACD4C94AC235F1EAA69E9FD"><enum>(1)</enum><text>conduct a survey through which the Assistant Secretary shall request the operator of each data center located in the United States to provide, on a voluntary basis, information on—</text> 
<subparagraph id="HF46533F1BB074D888A89726459884979"><enum>(A)</enum><text>the energy consumption of such data center for the preceding 1-year period; and</text></subparagraph> <subparagraph id="H8ADD1AA7DA1B488F8DC0504AF88E7F1D"><enum>(B)</enum><text>the water consumption of such data center for the preceding 1-year period; and</text></subparagraph></paragraph> 
<paragraph id="H5ECF3D0E6A7B44008ED50948762CAAEB"><enum>(2)</enum><text>provide an opportunity for individuals and entities, including public utility boards, labor organizations, State regulatory authorities, and public interest organizations representing consumers, to submit comments in relation to such survey.</text></paragraph> </subsection> <subsection id="HE0D8ED43B49B40D9BA640431E46C265A"><enum>(b)</enum><header>Publication of results</header><text>Not later than 180 days after conducting a survey under subsection (a), the Assistant Secretary shall—</text> 
<paragraph id="H5D06AA7477A04D248E6B4DE0DB55DFF8"><enum>(1)</enum><text>publish on the primary website of the National Telecommunications and Information Administration the results of such survey, which shall include—</text> <subparagraph id="H7AF835AC20C04E3694E1B22F6D3B9394"><enum>(A)</enum><text>the presentation of such results using an interactive map of the United States;</text></subparagraph> 
<subparagraph id="HEBEFC1E682514CEF843C9103921E93C3"><enum>(B)</enum><text display-inline="yes-display-inline">an identification of each data center with respect to which complete information was not provided in response to the survey; and</text></subparagraph> <subparagraph id="H59B8EE3688C14EE19A944F782C0F5D42"><enum>(C)</enum><text>a summary of the comments received pursuant to the most recent opportunity to submit comments under subsection (a)(2); and</text></subparagraph></paragraph> 
<paragraph id="H8D3CED61EB6342A1B39D6007C7EB922E"><enum>(2)</enum><text display-inline="yes-display-inline">submit to Congress a report with recommendations to improve the regulation of data centers, including with respect to the issue of transparency.</text></paragraph></subsection> <subsection id="HD3765311DDB341419FF80FD9F4BF5144"><enum>(c)</enum><header>Coordination</header><text>In carrying out this section, the Assistant Secretary shall coordinate with—</text> 
<paragraph id="HF5F36D4DD7E649A98A80D60D64D5C4BD"><enum>(1)</enum><text display-inline="yes-display-inline">the Administrator of the Environmental Protection Agency;</text></paragraph> <paragraph id="H0AA213A7B7664DD1982BB8F9263457FF"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary of Energy; and</text></paragraph> 
<paragraph id="HE09691C2B36B4B7B873583B12FCF5095"><enum>(3)</enum><text>the head of any other Federal department or agency the Assistant Secretary determines appropriate.</text></paragraph></subsection> <subsection id="H70196BBF22D347F49BD452D266203336"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HB1AE392174F04AD4B168E666E43F3917"><enum>(1)</enum><header>Assistant Secretary</header><text display-inline="yes-display-inline">The term <term>Assistant Secretary</term> means the Assistant Secretary of Commerce for Communications and Information.</text></paragraph> <paragraph id="H04C275BEDEB84E1291B546810F1571F4"><enum>(2)</enum><header>Data center</header><text display-inline="yes-display-inline">The term <term>data center</term> has the meaning given that term in section 453(a) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17112">42 U.S.C. 17112(a)</external-xref>).</text> </paragraph></subsection></section>
