which was considered and agreed to</action-desc></action><legis-type>RESOLUTION</legis-type><official-title display="yes">Amending the broadcasting and recording procedures of the Senate.</official-title></form><resolution-body><section id="id93b49fe19af94a709ed623725959048a" section-type="section-one"><enum>1.</enum><header>Broadcasting and recording procedures of the Senate</header><subsection commented="no" display-inline="no-display-inline" id="id3884caad74ad4d97a79c9e22e7ddde29"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Senate Resolution 28 (99th Congress), agreed to February 27, 1986, is amended by striking all after the resolving clause and inserting the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id821F4F02EB214A78921899789AFD9ADC"><section id="id0781abd41bae41819606e0501ee542c3" section-type="section-one"><enum>1.</enum><header>Broadcasting and recording procedures of the Senate</header><subsection id="id2BDAB841212144EDAB32D63D23DF1A12"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Senate hereby authorizes and directs that there be broadcast coverage of proceedings in the Senate Chamber and recordings of such proceedings.</text></subsection><subsection id="id4f72e71b018842c1827e8d0ef8f47f76"><enum>(b)</enum><header>Type of coverage</header><text>The broadcast coverage described in subsection (a) shall be provided—</text><paragraph id="id70c9ddab74ff441d962dd5c58ab207d4"><enum>(1)</enum><text>in accordance with provisions of this resolution;</text></paragraph><paragraph id="id1398c44c1b4b4659a20e8893d8c31418"><enum>(2)</enum><text>continuously, except for any time when the Senate is conducting a quorum call, or when a meeting with closed doors is ordered; and</text></paragraph><paragraph id="id4864ebad978c44fa9c3f0d6bbaea44fc"><enum>(3)</enum><text>subject to the provisions pertaining to the Senate gallery contained in the following rules of the Standing Rules of the Senate: </text><subparagraph commented="no" display-inline="no-display-inline" id="idb651716ca6cd4e688d27ba1d7aedba3f"><enum>(A)</enum><text display-inline="yes-display-inline">Paragraphs 6 and 7 of rule XIX.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idda3be02333654046a4f5a4617a869543"><enum>(B)</enum><text>Paragraph 1(n) of rule XXV.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7a615fd2d0dd4acc9b7f0fa188c15987"><enum>(C)</enum><text>Paragraph (2) of rule XXXIII.</text></subparagraph></paragraph></subsection></section><section id="idec21af43567b4f23aec09a38a30d19f5"><enum>2.</enum><header>Supervision of broadcast coverage</header><text display-inline="no-display-inline">The broadcast coverage of Senate proceedings shall be supervised and operated by the Senate.</text></section><section id="id956523a6c97e4e34b70fc514bc91c88a"><enum>3.</enum><header>Video broadcast coverage</header><text display-inline="no-display-inline">The video broadcast coverage of Senate proceedings shall follow the Presiding Officer and Senators who are speaking, clerks, and the Chaplain of the Senate except during rollcall votes, when the cameras shall show the entire Chamber.</text></section><section id="ida4aa1c97a5834b739e1bbdb9987852cb"><enum>4.</enum><header>Broadcasting and recording implementation</header><subsection id="id3F5BFD87EC5C45348A43B9E7E23B9247"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The broadcast coverage and recording of Senate proceedings shall be implemented as provided in this section.</text></subsection><subsection id="idf23669fabb124602841693fa24a87611"><enum>(b)</enum><header>Architect of the Capitol duties</header><paragraph commented="no" display-inline="no-display-inline" id="id91bc089414df48698010d04491fe5364"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Architect of the Capitol, in consultation with the Sergeant at Arms and Doorkeeper of the Senate, shall—</text><subparagraph id="ide0aaa058fa964f49842b556b87592a5a"><enum>(A)</enum><text>construct necessary facilities for broadcast coverage (including a control room and the modification of Senate sound and lighting fixtures);</text></subparagraph><subparagraph id="idbbef75d24c53470c8f20e21a2f7ecac2"><enum>(B)</enum><text>employ necessary expert consultants; and</text></subparagraph><subparagraph id="idef9e5db98521484caf12c1b361665d96"><enum>(C)</enum><text>acquire and install all necessary equipment and facilities to—</text><clause commented="no" display-inline="no-display-inline" id="idbbef5b9abfb044ba88330695e6fdcae2"><enum>(i)</enum><text display-inline="yes-display-inline">produce a broadcast-quality <quote>live</quote> audio and color video signal of Senate proceedings; and </text></clause><clause commented="no" display-inline="no-display-inline" id="idfcc1745cd6494e9cb13e6f4830f29c62"><enum>(ii)</enum><text display-inline="yes-display-inline">provide an archive-quality audio and color video recording of Senate proceedings.<proviso></proviso></text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id62d1a779b2e44b17a86dd4a122106764"><enum>(2)</enum><header>Approval required</header><text display-inline="yes-display-inline">In carrying out the duties specified in subparagraphs (A) through (C) of paragraph (1), the Architect of the Capitol shall not enter into any contract for the purchase or installation of equipment, for employment of any consultant, or for the provision of training to any person, unless the same shall first have been approved by the Committee on Rules and Administration.</text></paragraph></subsection><subsection id="id22f7f8b06ed34c4797c060f589d1a5e1"><enum>(c)</enum><header>Sergeant at Arms and Doorkeeper of the Senate duties</header><paragraph commented="no" display-inline="no-display-inline" id="idfdfea38e2cc74160a59ce6938e5ee958"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Sergeant at Arms and Doorkeeper of the Senate shall—</text><subparagraph id="idb9a9d492ec8744dfa47fac374c1a7e1d"><enum>(A)</enum><text>employ such staff as may be necessary, working in conjunction with the Senate Recording Studio, to operate and maintain all broadcast equipment installed pursuant to this resolution; and</text></subparagraph><subparagraph id="id651675a28bc0400ba151058fec29cf7e"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idf0cbc086674749289f9fa0e8aeb4cd56"><enum>(i)</enum><text>make recordings of Senate proceedings; and</text></clause><clause id="id616cbfe58ae246ab918a816978a954b0" indent="up2"><enum>(ii)</enum><text>make copies of recordings as requested by the Secretary of the Senate under paragraph (3) and, as soon thereafter as possible, transmit the copies of recordings to the Secretary.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc404f0fa744c49f795abb9cf9f84f103"><enum>(2)</enum><header>Compliance with Senate rules and procedures</header><text display-inline="yes-display-inline">The Sergeant at Arms and Doorkeeper of the Senate, in carrying out the duties specified in subparagraphs (A) and (B) of paragraph (1), shall comply with appropriate Senate procurement and other regulations.</text></paragraph><paragraph id="id015fc31ea66a4e85ac327cf35f5c085b"><enum>(3)</enum><header>Authority of the Secretary of the Senate</header><text>The Secretary of the Senate is authorized to obtain from the Sergeant at Arms and Doorkeeper of the Senate recordings of Senate proceedings and, as soon thereafter as possible, transmit such recordings to the Librarian of Congress and to the Archivist of the United States.</text></paragraph></subsection></section><section id="id2c0f8d5887e140eca2350696dd8bdcf5"><enum>5.</enum><header>Limitations on use of recordings</header><subsection id="idAC8CAD51B1EA49FFA39CB043BBB31D84"><enum>(a)</enum><header>Prohibition on use for political campaign purposes</header><text display-inline="yes-display-inline">The use of any recording of Senate proceedings for political campaign purposes is strictly prohibited.</text></subsection><subsection id="idfacd558959234f4abb89a0044abbf536"><enum>(b)</enum><header>Agreement required</header><paragraph commented="no" display-inline="no-display-inline" id="id6f1958cda1644973962a94612d86319d"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Except as provided in paragraph (2), any recording of Senate proceedings furnished to any person or organization shall be made on the condition, agreed to in writing, that the recording shall not be used for political campaign purposes.</text></paragraph><paragraph id="ide42b585f5493481497f451400542fafd"><enum>(2)</enum><header>Exception</header><text>Any public or commercial news organization furnished a recording described in paragraph (1) shall be subject to the provisions of paragraph (1) but shall not be required to enter into a written agreement.</text></paragraph></subsection></section><section id="id865c97eda3864042a824a8ee85882a75"><enum>6.</enum><header>Availability of broadcast coverage</header><text display-inline="no-display-inline">Broadcast coverage of Senate proceedings shall be made available on a <quote>live</quote> basis and free of charge to—</text><paragraph commented="no" display-inline="no-display-inline" id="ide486a730d17946bcbc8da7a584cbb693"><enum>(1)</enum><text display-inline="yes-display-inline">any accredited member of the Senate Radio and Television Correspondents Gallery;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2a717e4686ae432f842838527c353785"><enum>(2)</enum><text display-inline="yes-display-inline">the cable system of the Architect of the Capitol; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id45a0c2335f5848838b599d5746a3bab8"><enum>(3)</enum><text display-inline="yes-display-inline">such other news gathering, educational, or information distributing entity as may be authorized by the Committee on Rules and Administration.</text></paragraph></section><section id="id199a0f7384994623ac353578727b1deb"><enum>7.</enum><header>Broadcasting prohibition</header><text display-inline="no-display-inline">Official noting of a Senator’s absence from committees while the Senate is broadcasting is prohibited.</text></section><section id="ide6669e36c6994c2aae5c9cba0557e156"><enum>8.</enum><header>Closed captioning</header><text display-inline="no-display-inline">Closed captioning for broadcast coverage of Senate proceedings shall be provided as directed by the Committee on Rules and Administration.</text></section><section id="ida4641e15f41c4599b1f77c8d6b4df035"><enum>9.</enum><header>Broadcasting and reporting procedures and regulations</header><subsection commented="no" display-inline="no-display-inline" id="idbfb7a2b1edc9401b921d9eeab744e5fb"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Any changes in the regulations made by this resolution shall be made only by Senate resolution. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="idc1c7b1759d7e429a8299dfa799dd684b"><enum>(b)</enum><header>Committee on Rules and Administration</header><text display-inline="yes-display-inline">The Committee on Rules and Administration may adopt such procedures and such regulations, which do not contravene the regulations made by this resolution, as the Committee deems necessary to assure the proper implementation of the purposes of this resolution.</text></subsection></section><section id="id93436c32e1494e79bd356e91f50ac8c1"><enum>10.</enum><header>Funding</header><text display-inline="no-display-inline">Such funds as may be necessary (but not in excess of $3,500,000) to carry out this resolution shall be expended from the contingent fund of the Senate.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="ide830e6a35efe4805a3b530321ce7dc9e"><enum>(b)</enum><header>Technical amendment</header><text>Senate Resolution 444 (99th Congress), agreed to July 15, 1986, is repealed.</text></subsection></section></resolution-body></resolution>
