which was referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>RESOLUTION</legis-type><official-title display="yes">Relating to the establishment of a means for the Senate to provide advice and consent regarding the form of an international agreement relating to pandemic prevention, preparedness, and response.</official-title></form><preamble><whereas><text>Whereas clause 2 of section 2 of article II of the Constitution of the United States empowers the President <quote>by and with the Advice and Consent of the Senate, to make Treaties, provided two-thirds of the Senators present concur</quote>;</text></whereas><whereas><text>Whereas without appropriate and meaningful consultation with the Senate—</text><paragraph id="idA90B0A7B90F04F129E59DCA3C3E8C1D1"><enum>(1)</enum><text>the requirement for Senate advice and consent to treaties remains unfulfilled; and </text></paragraph><paragraph id="id0793ADBD0E40426696397BF6959C96BF"><enum>(2)</enum><text>in some cases, executive agreements, political agreements, and other arrangements have been improperly used by the executive branch to circumvent the appropriate review of significant agreements by Congress;</text></paragraph></whereas><whereas><text>Whereas, as an appropriate exercise of the advice and consent power entrusted to the Senate, the Senate may refuse to consider legislative measures intended to authorize or appropriate funds to implement international agreements which, in the opinion of the Senate, constitute treaties under the Constitution of the United States to which the Senate has not given its advice and consent to ratification;</text></whereas><whereas><text>Whereas clause 2 of section 5 of article I of the Constitution of the United States, grants plenary power to the Senate to <quote>determine the Rules of its Proceedings</quote>;</text></whereas><whereas><text>Whereas an international agreement should take the form of a treaty requiring Senate advice and consent and should be transmitted by the President to the Senate for the Senate’s consideration and approval if—</text><paragraph id="id2c2067e4041d4818b8a83a8e859ab5d1"><enum>(1)</enum><text>the agreement involves commitments or risks affecting the Nation as a whole;</text></paragraph><paragraph id="ida8ec94b9d13841ebbf0fa188b22418cb"><enum>(2)</enum><text>the agreement is intended to affect State laws;</text></paragraph><paragraph id="id58bd23ad3c044e039d8e9ca7eac6cf0b"><enum>(3)</enum><text>the agreement will not take effect until after subsequent legislation is enacted by Congress;</text></paragraph><paragraph id="id8f21bd10a10e418b816b30e61f70804d"><enum>(4)</enum><text>similar agreements were subjected to the advice and consent of the Senate;</text></paragraph><paragraph id="id22c8307f85c4444c93d19a3b0e1011c2"><enum>(5)</enum><text>similar agreements are typically subject to the approval of national legislatures in other countries;</text></paragraph><paragraph id="idf1128d09f1094886a771bc6d49f2cb5d"><enum>(6)</enum><text>Congress has expressed a preference regarding its involvement in such type of agreement;</text></paragraph><paragraph id="id8b366f1f502e4ff9893a3c4263004a53"><enum>(7)</enum><text>the agreement involves a high degree of formality;</text></paragraph><paragraph id="id54394712b81f48deb0dae5b2223e1e6f"><enum>(8)</enum><text>the agreement is not routine, is not expected to have a short duration, and does not need to be promptly concluded; or</text></paragraph><paragraph id="id18d7675e3775440787b59ea5a55d8c46" commented="no" display-inline="no-display-inline"><enum>(9)</enum><text>if the agreement is intended to implement an existing treaty or make technical amendments to an existing treaty, the relevant Senate committee has previously indicated that such implementation or amendments are significant enough to require submission to the Senate for its advice and consent:</text></paragraph></whereas><whereas><text>Now, therefore, be it</text></whereas></preamble><resolution-body><section section-type="section-one" id="idCB224D16B2AB4FC98A7D166264FDDB33"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Resolution may be cited as the <quote><short-title>World Health Organization Pandemic Treaty Implementation Resolution</short-title></quote>.</text></section><section id="id7929FFE8BAB94FCD90A1A110857F87CC"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Resolution is for the Senate, as the article I branch of the United States Government that is entrusted with the Advice and Consent power under clause 2 of section 2 of article II of the Constitution of the United States, to establish, through the use of the rulemaking authority of the Senate, a means for determining the form that an international agreement, protocol, legal instrument or agreed outcome with legal force, signed by the President or by his designee, shall take and to which the President intends the United States to become a Party or to otherwise be bound under international law, in whole or in part.</text></section><section id="id46246b4a1fb746eaad9250e824192e60"><enum>3.</enum><header>Declarations</header><subsection id="ide901c9fab6024c198669d7b2d4c40b1b"><enum>(a)</enum><header>In general</header><text>Exercising the rulemaking authority of the Senate, the Senate declares, under clause 2 of section 2 of article II of the Constitution of the United States, that any international convention, agreement, protocol, legal instrument, or agreed outcome with legal force relating to pandemic prevention, preparedness, and response drafted by the intergovernmental negotiating body of the World Health Assembly that—</text><paragraph id="id2dfda8db6b0b459793200591ca3a821f"><enum>(1)</enum><text>is intended to be adopted pursuant to article 19 or any other provision of the Constitution of the World Health Organization; and</text></paragraph><paragraph id="id6a809c940d594932a99421f22b9ceb98"><enum>(2)</enum><text>establishes significant international commitments by the United States under the authority of World Health Assembly Decision SSA2(5) or any related decision,</text></paragraph><continuation-text continuation-text-level="subsection">meets 1 or more of the factors set forth in the last clause of the preamble, indicating that such agreement should take the form of a treaty requiring Senate approval.</continuation-text></subsection><subsection id="id0f162eca994542dea353b9b5cbb9d68f"><enum>(b)</enum><header>Limitation of agreement</header><text>The Senate declares that any agreement described in subsection (a)—</text><paragraph id="id07A195862F6E4BA285544EBF53572506"><enum>(1)</enum><text>involves a significant political and economic commitment of the United States to foreign countries; and </text></paragraph><paragraph id="idA4572659561E4173935D0EA15220C10C"><enum>(2)</enum><text>does not legally bind the United States until after—</text><subparagraph id="id3FC513611F1D43F5BBFD782B8C06AE4C"><enum>(A)</enum><text>the President transmits such agreement to the Senate for its consideration as a treaty, subject to the applicable constitutional advice and consent procedures; and </text></subparagraph><subparagraph id="id10AD8F5DD70F4D9D90688EAB268EFD89"><enum>(B)</enum><text>the Senate provides its consent to such treaty through a resolution of ratification.</text></subparagraph></paragraph></subsection></section><section id="id451034a78f7749128eec5937a81ed30b"><enum>4.</enum><header>Advice</header><subsection id="id2bfd54f3120e4bdf85ebec02bc6ff126"><enum>(a)</enum><header>Referral</header><text>Any agreement described in section 3(a) that is transmitted to the Senate pursuant to section 3(b)(2)(A) shall be referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name> for its consideration.</text></subsection><subsection id="id7b702aff8f4a4dfd823deb9d91af5739"><enum>(b)</enum><header>Consultation with the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name></header><paragraph id="ide27e4869ea04416e9d7f2dbf14d0640d"><enum>(1)</enum><header>Consultations during negotiations</header><text>The Secretary of State, or the designee of the Secretary, shall—</text><subparagraph id="id66a49bf8958c458ead688d71131b5f94"><enum>(A)</enum><text>at the request of the Chair or the Ranking Member of the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>, meet with any or all members of the Committee regarding—</text><clause id="idFDE8ADC389124EBB8C30C7152EF5CE25"><enum>(i)</enum><text>negotiating objectives;</text></clause><clause id="id72FD272E2D0E4782AF8CB631C8135EA1"><enum>(ii)</enum><text>the status of negotiations in progress; and </text></clause><clause id="id0AE63BD225FE44CA876EB96C551D0956"><enum>(iii)</enum><text>the nature of any potential changes to the laws of the United States or the administration of such laws that may be recommended to Congress to carry out—</text><subclause id="idDC74059B00C24821890844E3E359E1E6"><enum>(I)</enum><text>an agreement described in section 3(a); or </text></subclause><subclause id="idD2C51D3FC933436BB2F9B38960FB0EE8"><enum>(II)</enum><text>any requirement of, amendment to, or recommendation under, such agreement; and</text></subclause></clause></subparagraph><subparagraph id="id4ebb4960bfb44852ab42dccf137b2c89"><enum>(B)</enum><text>consult closely and on a timely basis with, and keep fully apprised of the negotiations, the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>.</text></subparagraph></paragraph><paragraph id="id7fd98ec90aed4d8194c757df469d5ec6"><enum>(2)</enum><header>Consultations before signing agreement</header><text>Before signing an agreement described in section 3(a), the President shall—</text><subparagraph id="idF784D3EDB0F1427AB13589B8F56CAFAF"><enum>(A)</enum><text>consult closely, and on a timely basis, with the members of the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>; and</text></subparagraph><subparagraph id="idAC5C5F61934342B2B2EED841F9163184"><enum>(B)</enum><text>keep such members fully apprised of the measures other nations have taken to comply with the provisions of such agreement that are to take effect on the date on which such agreement enters into force.</text></subparagraph></paragraph></subsection><subsection id="id2fbed7280d5a457cabf349cf0a9a38d8"><enum>(c)</enum><header>Designated Senate advisors</header><paragraph id="id9b5e6d47da6c45a8bbaf05b92764ebf6"><enum>(1)</enum><header>Designation</header><text>The Secretary of State—</text><subparagraph id="id68A0694FCAC14337A4BAAF2D2E15B63D"><enum>(A)</enum><text>shall designate not fewer than 2 members of the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>, on a bipartisan basis, to serve as Senate advisors to the negotiations regarding an agreement described in section 3(a); and</text></subparagraph><subparagraph id="idB521CED6DC8844759BAF0DB3336D1AE8"><enum>(B)</enum><text>may designate additional members of the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name> as Senate advisors, after consultation with the Chair and Ranking Member of the Committee.</text></subparagraph></paragraph><paragraph id="id6ab627a8b0894fa39a39bff51e5c2e03"><enum>(2)</enum><header>Consultations with designated congressional advisors</header><text>During negotiations regarding an agreement described in section 3(a), the Secretary of State or an officer of the Department of State who has been confirmed to such position by the Senate and designated by the Secretary, shall consult closely and on a timely basis (including immediately before initialing any agreement) with, and keep fully apprised of the negotiations, the Senate advisors designated pursuant to paragraph (1).</text></paragraph><paragraph id="idad333cfb518045b58ab6b926669110fb"><enum>(3)</enum><header>Accreditation</header><text>Each Senator designated as a Senate advisor pursuant to paragraph (1) shall be accredited by the Secretary of State on behalf of the President as an official advisor to the United States delegation to any relevant international conferences, meetings, and negotiating sessions relating to an agreement described in section 3(a).</text></paragraph></subsection></section><section id="idf14763fb43464753b11a03bc3edb05c4"><enum>5.</enum><header>Consent</header><subsection id="id7adc4b20384945d49e2c0efdc090c5dc"><enum>(a)</enum><header>Submission of treaty to the Senate</header><text>An international convention, agreement, protocol, legal instrument, or agreed outcome with legal force relating to pandemic prevention, preparedness, and response described in section 3(a) shall not become effective with respect to the United States until after the President, not later than 60 days after such agreement is signed, submits to the Senate—</text><paragraph id="idDF15BD5962014D9EBA2CE5DFBA8D42A9"><enum>(1)</enum><text>such agreement, including all related materials, annexes, and other relevant documents; and</text></paragraph><paragraph id="id4C8B80C6C8D2480EB17453458AD926C9"><enum>(2)</enum><text>a certification that—</text><subparagraph id="idA38CC9F1A37F437EA82EF7FB1A3C2E3E"><enum>(A)</enum><text>the materials submitted pursuant to paragraph (1) constitute the totality of such agreement in question; and </text></subparagraph><subparagraph id="id33127AB57B6747D6BE54B07C12A1030A"><enum>(B)</enum><text>the adoption of the treaty is in the vital national security interest of the United States.</text></subparagraph></paragraph></subsection><subsection id="id73d8af057b344b30955a62fbdc74b986"><enum>(b)</enum><header>Declaration</header><text>Exercising the rulemaking authority granted to the Senate under clause 2 of section 5 of article I of the Constitution of the United States, the Senate declares that it shall not be in order for the Senate to consider any bill, any joint or concurrent resolution, any amendment to such bill or amendment, or any conference report authorizing or providing budget authority to implement, in whole or in part, any international pandemic preparedness, prevention, and response convention, agreement, protocol, legal instrument, or agreed outcome with legal force of the World Health Assembly, the purpose of which is to implement, in whole or in part, an agreement described in section 3(a).</text></subsection><subsection id="id20041ca29b6a4efd8afddcfba8b4aba5"><enum>(c)</enum><header>Sunset</header><text>This section shall remain in effect until the date on which the President submits the agreement and certification required under subsection (a) to the Senate as a treaty for its constitutional advice and consent.</text></subsection></section></resolution-body></resolution>
