RES. 53</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action display="yes"><action-date date="20230209">February 9, 2023</action-date><action-desc><sponsor name-id="S395">Mrs. Hyde-Smith</sponsor> (for herself, <cosponsor name-id="S350">Mr. Rubio</cosponsor>, <cosponsor name-id="S355">Mr. Cruz</cosponsor>, <cosponsor name-id="S410">Ms. Lummis</cosponsor>, <cosponsor name-id="S346">Mr. Lee</cosponsor>, and <cosponsor name-id="S416">Mrs. Britt</cosponsor>) submitted the following resolution; which was referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>RESOLUTION</legis-type><official-title display="yes">Establishing a Women’s Bill of Rights to reaffirm legal protections afforded to women under Federal law.</official-title></form><preamble><whereas><text>Whereas males and females possess unique and immutable biological differences that manifest prior to birth and increase as they age and experience puberty;</text></whereas><whereas><text>Whereas biological differences between the sexes mean that only females may get pregnant, give birth, and breastfeed children;</text></whereas><whereas><text>Whereas biological differences between the sexes mean that males are, on average, larger in size and possess greater body strength than females;</text></whereas><whereas><text>Whereas biological differences between the sexes can expose females to more harm than males from specific forms of violence, including sexual violence;</text></whereas><whereas><text>Whereas women have achieved inspirational and significant accomplishments in education, athletics, and employment; and</text></whereas><whereas><text>Whereas recent misguided court rulings related to the definition of <quote>sex</quote> have led to endangerment of spaces and resources dedicated to women, thereby necessitating clarification of certain terms: Now, therefore, be it</text></whereas></preamble><resolution-body style="OLC" id="H42C4B47C4DAB44BC9C2C4CC87F3E855D"><section display-inline="yes-display-inline" section-type="undesignated-section" id="H2E2FB4B213214F4B87B7CFF43C3B1981"><text>That the Senate reaffirms that—</text><paragraph id="H77C2E1DE32F54B569E992CC7091ABB6C"><enum>(1)</enum><text>for the purposes of Federal law, the <quote>sex</quote> of an individual means his or her biological sex (either male or female) at birth;</text></paragraph><paragraph id="HC3F5FBCEE2C74BFCBD472B96B0FBFB97"><enum>(2)</enum><text>for the purposes of Federal laws addressing sex, the terms <quote>woman</quote> and <quote>girl</quote> refer to human females, and the terms <quote>man</quote> and <quote>boy</quote> refer to human males;</text></paragraph><paragraph id="HBF55285C08234308A3AAFBCB7151672E"><enum>(3)</enum><text>for the purposes of Federal law, the word <quote>mother</quote> means a parent of the female sex and <quote>father</quote> is defined as a parent of the male sex;</text></paragraph><paragraph id="H79128797E1A241028EEAE35B9B7E32C3"><enum>(4)</enum><text>there are important reasons to distinguish between the sexes with respect to athletics, prisons, domestic violence shelters, restrooms, and other areas, particularly where biology, safety, and privacy are implicated;</text></paragraph><paragraph id="HD1CD20DAD50744C1AC8A3530BFEA0DCD"><enum>(5)</enum><text>policies and laws that distinguish between the sexes are subject to intermediate constitutional scrutiny and permitted when they serve an important governmental objective and are substantially related to achieving that objective; and</text></paragraph><paragraph id="HC0F0F00D4C6C45748783ABA94D1ECD81"><enum>(6)</enum><text>for the purposes of complying with Federal laws that require State and local government agencies to collect or report data disaggregated by sex, such as Federal antidiscrimination laws, agencies are required to base such data on the biological sex of individuals at birth.</text></paragraph></section></resolution-body></resolution>
