which was referred to the <committee-name committee-id="SSRA00">Committee on Rules and Administration</committee-name></action-desc></action><legis-type>RESOLUTION</legis-type><official-title display="yes">Prohibiting Senators charged with certain criminal offenses from receiving classified information, and for other purposes. </official-title></form><resolution-body><section id="id3bcd8ff5c2394bfea3b9fcbb0c83a571" section-type="section-one"><enum>1.</enum><header>Prohibition on receipt of classified information by Senators charged with certain criminal offenses</header><subsection commented="no" display-inline="no-display-inline" id="id516dd95def624c94899b51be1cff47e0"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph commented="no" display-inline="no-display-inline" id="idce0abf438e5c42de8d3aa6284de5e973"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>covered criminal offense</term> means a criminal offense under Federal law relating to—</text><subparagraph id="id21ea0bcc584042fbac74e36ab7a64aa6"><enum>(A)</enum><text>the unlawful disclosure or improper handling of classified information;</text></subparagraph><subparagraph id="idb64629e39c6f47668ae6077b75052845"><enum>(B)</enum><text>acting as a foreign agent; or</text></subparagraph><subparagraph id="id329c1b8d4fc74966a860ea11a86250c0"><enum>(C)</enum><text>compromising the national security of the United States; and</text></subparagraph></paragraph><paragraph id="idb5cf18d53a43498d8d7d5c166886165e"><enum>(2)</enum><text>the term <term>period a Senator is charged with a covered criminal offense</term> means the period— </text><subparagraph commented="no" display-inline="no-display-inline" id="id93ec2e2e185c4afcb3a5412f6e2f37a8"><enum>(A)</enum><text display-inline="yes-display-inline">beginning on the date on which an indictment or information is filed charging a Senator with 1 or more covered criminal offenses; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0b29896d996342cf891a0289e67083e6"><enum>(B)</enum><text display-inline="yes-display-inline">ending on the date on which, for each such covered criminal offense—</text><clause commented="no" display-inline="no-display-inline" id="iddb2b1c7621824005a9a563e8dc47e8a8"><enum>(i)</enum><text display-inline="yes-display-inline">the charge for the covered criminal offense is dismissed; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id773c75c372ff447db8ff9f8a3729936a"><enum>(ii)</enum><text>the Senator is found not guilty of the covered criminal offense.</text></clause></subparagraph></paragraph></subsection><subsection id="id8a098773a1324ea69c500ece3362e20c"><enum>(b)</enum><header>Prohibitions</header><text>Except as provided in subsection (c), during a period a Senator is charged with a covered criminal offense—</text><paragraph commented="no" display-inline="no-display-inline" id="idc046c94b08ff494d97563b0fa766b6b6"><enum>(1)</enum><text display-inline="yes-display-inline">the Senator may not receive any classified information, including classified information received as a part of information provided to the personal office of the Senator, to a committee of the Senate or of Congress, or through a briefing of Senators; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf8564e4f4cbd4b338338fca77372a699"><enum>(2)</enum><text>the Senator may not serve as a member of any committee of the Senate or of Congress; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id064aa33ec5954c27a8f1a0ca0cabd98a"><enum>(3)</enum><text display-inline="yes-display-inline">the Senator may not submit a congressionally directed spending request for any appropriation bill or other legislation; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id96f22c9f32414180906c6473d6c680f5"><enum>(4)</enum><text display-inline="yes-display-inline">it shall not be in order to include an item of congressionally directed spending requested by the Senator in any appropriation bill or other legislation; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7ce02c21d7e24c2db893ca93d328ee43"><enum>(5)</enum><text display-inline="yes-display-inline">the Senator may not obligate official funds for any international travel.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7e942a20e3f64657bacb0d686ca2c519"><enum>(c)</enum><header>Waiver</header><text display-inline="yes-display-inline">Subsection (b) may be waived with respect to a Senator upon an affirmative vote of two-thirds of the Members of the Senate, duly chosen and sworn. </text></subsection></section></resolution-body></resolution>
