which was referred to the <committee-name committee-id="SSRA00">Committee on Rules and Administration</committee-name></action-desc></action><legis-type>RESOLUTION</legis-type><official-title display="yes">Relating to proceedings of the Senate in the event of a partial or full shutdown of the Federal Government.</official-title></form><resolution-body id="HB63740B3C5AB42C09B686FF47CD98DF1"><section section-type="section-one" id="id53355B01C34945ABB78B38E1557C187B"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This resolution may be cited as the <quote><short-title>Shutdown Accountability Resolution</short-title></quote>.</text></section><section section-type="subsequent-section" id="idBA21885200E14F9090D51756570B2516"><enum>2.</enum><header>Proceedings of the Senate during a full or partial government shutdown</header><subsection id="id14C6432ECDC74165AC37FE97932ED116"><enum>(a)</enum><header>Definitions</header><text>In this section— </text><paragraph commented="no" display-inline="no-display-inline" id="id5f51ef22a0fa4924aad907361a11704a"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>Government shutdown</term> means a lapse in appropriations for 1 or more agencies of the Federal Government; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddfa88291c2344218ab4fc7f8c3b3f2cd"><enum>(2)</enum><text>the term <term>Sergeant at Arms</term> means the Sergeant at Arms and Doorkeeper of the Senate.</text></paragraph></subsection><subsection id="idE2F33F1E6B3343B0B750189CA7BBD051"><enum>(b)</enum><header>Convening of the Senate</header><paragraph id="id1C118BA786944199B536A64EE9FBCE3A"><enum>(1)</enum><header>In general</header><text>Notwithstanding any rule or order of the Senate, during the period of a Government shutdown—</text><subparagraph id="id4980D96A298C4C69A7FBC719DB83A3F8"><enum>(A)</enum><text>the Senate shall convene at 8:00 a.m. each day, unless the body is in continuous session; and</text></subparagraph><subparagraph id="id148AF5A047524EF88E517FC10F2C24DE"><enum>(B)</enum><text>it shall not be in order to ask for, and the Presiding Officer shall not entertain a request for, unanimous consent to change the hour or day on which the Senate shall convene under subparagraph (A).</text></subparagraph></paragraph><paragraph id="idCFB1B0D5799A49FF910E45554E104BB2"><enum>(2)</enum><header>Senate not in session</header><text>If the Senate is not in session on the first calendar day of a Government shutdown, the majority leader, after consultation with the minority leader, shall notify Members of the Senate that, pursuant to this standing order, the Senate shall convene at 8:00 a.m. on the next calendar day of the Government shutdown.</text></paragraph></subsection><subsection id="id6214394C43D14D32B9BB61ADCDA1E83A"><enum>(c)</enum><header>Presence of a quorum</header><paragraph id="idCFAB43D79EE546C0880FE4A94DC0C2E1"><enum>(1)</enum><header>In general</header><text>During the period of a Government shutdown, and notwithstanding any provision of the Standing Rules of the Senate—</text><subparagraph id="id7D5DEBCD86ED4934B076F3B8F9218330"><enum>(A)</enum><text>immediately after the Presiding Officer takes the chair in accordance with rule IV of the Standing Rules of the Senate, the Presiding Officer shall direct the Clerk to call the roll to ascertain the presence of a quorum; and</text></subparagraph><subparagraph id="id80D6FECC3AA74520810183EFBA68DCC0"><enum>(B)</enum><text>1 hour after the presence of a quorum has last been demonstrated, the Presiding Officer shall direct the Clerk to call the roll to ascertain the presence of a quorum.</text></subparagraph></paragraph><paragraph id="id46746CC65CAE497DBC6CD21C186E00EE"><enum>(2)</enum><header>Lack of quorum</header><subparagraph id="id9A32F1508D4C4E7F9CA60B0EAA8DF550"><enum>(A)</enum><header>In general</header><text>If, upon a calling of the roll under paragraph (1), it shall be ascertained that a quorum is not present—</text><clause id="id3db3bec147c544c19edf023ba84a0fc2"><enum>(i)</enum><text>the Presiding Officer shall direct the Clerk to call the names of any absent Senators; and</text></clause><clause id="idddc234fe2bce43a9a7a937cb437e4e44"><enum>(ii)</enum><text>following the calling of the names under clause (i), the Presiding Officer shall, without intervening motion or debate, submit to the Senate by a yea-and-nay vote the question: <quote>Shall the Sergeant at Arms and Doorkeeper of the Senate be directed to request the attendance of absent Senators?</quote>.</text></clause></subparagraph><subparagraph id="id07C7280C988B4DC89F5D9AC2A1DC243B"><enum>(B)</enum><header>Direction to compel attendance</header><text>If a quorum is not present 15 minutes after the time at which the vote on a question submitted under subparagraph (A)(ii) starts, the Presiding Officer shall, without intervening motion or debate, submit to the Senate by a yea-and-nay vote the question: <quote>Shall the Sergeant at Arms and Doorkeeper of the Senate be directed to compel the attendance of absent Senators?</quote>.</text></subparagraph><subparagraph id="id06f87364f95040019f2a904e359961a3"><enum>(C)</enum><header>Arrest of absent Senators</header><text>Effective 1 hour after the Sergeant at Arms is directed to compel the attendance of absent Senators under subparagraph (B), if any Senator not excused under rule XII of the Standing Rules of the Senate is not in attendance, the Senate shall be deemed to have agreed an order that reads as follows: <quote>Ordered, That the Sergeant at Arms and Doorkeeper of the Senate be directed to arrest absent Senators; that warrants for the arrests of all Senators not sick nor excused be issued under the signature of the Presiding Officer and attested by the Secretary, and that such warrants be executed without delay.</quote>.</text></subparagraph><subparagraph id="id0F5B49951B02492C85E5596663BFD7F6"><enum>(D)</enum><header>Reports</header><text>Not less frequently than once per hour during proceedings to compel the attendance of absent Senators, the Sergeant at Arms shall submit to the Senate a report on absent Senators, which shall—</text><clause id="idB1320CA4D96B47CA8440F84A8F8D563A"><enum>(i)</enum><text>be laid before the Senate;</text></clause><clause id="id1373BE25C3D84465B371A69E015CFBE3"><enum>(ii)</enum><text>identify each Senator whose absence is excused;</text></clause><clause id="id83274133F58346C989E478BD8AFC2174"><enum>(iii)</enum><text>identify each Senator who is absent without excuse; and</text></clause><clause id="idC73EDE50FD9A41898DEFC3D241BFB4BD"><enum>(iv)</enum><text>for each Senator identified under clause (iii), provide information on the current location of the Senator.</text></clause></subparagraph></paragraph><paragraph id="id9C4A27E2A0134C368A1EB759C2750263"><enum>(3)</enum><header>Regaining the floor</header><text>If a Senator had been recognized to speak at the time a call of the roll to ascertain the presence of a quorum was initiated under paragraph (2)(A), and if the presence of a quorum is established, that Senator shall be entitled to be recognized to speak.</text></paragraph></subsection><subsection id="id8C8AF0E6BDAA424D9240C1EF5FF07642"><enum>(d)</enum><header>Adjourning and recessing</header><text>During the period of a Government shutdown—</text><paragraph id="id64c2b27a529a4ef4bc29da3a39d259c6"><enum>(1)</enum><text>a motion to adjourn or to recess the Senate shall be decided by a yea-or-nay vote;</text></paragraph><paragraph id="id48b822b64ded4d07926359d1980cff2b"><enum>(2)</enum><text>if a quorum is present, the Presiding Officer shall not entertain a request to adjourn or recess the Senate by unanimous consent or to vitiate the yeas and nays on such a motion by unanimous consent;</text></paragraph><paragraph id="id7ef100fa33434d3aa5d51320bd6ab1d6"><enum>(3)</enum><text>a motion to adjourn or a motion to recess made during the period beginning at 8:00 a.m. and ending at 11:59 p.m., shall only be agreed to upon an affirmative vote of two-thirds of the Senators present and voting, a quorum being present; and</text></paragraph><paragraph id="id117D27585A7D4331AE0141766FD5C4ED"><enum>(4)</enum><text>if the Senate must adjourn due to the absence of a quorum, the Senate shall reconvene 2 hours after the time at which it adjourns and ascertain the presence of a quorum in accordance with subsection (c)(1).</text></paragraph></subsection><subsection id="id439cf91f63484e78a79e8f16871b67df"><enum>(e)</enum><header>No suspension of requirements</header><text>The Presiding Officer may not entertain a request to suspend the operation of this standing order by unanimous consent or motion.</text></subsection><subsection id="idbdf9dccd3b2d4ce9b77acaa21c464f35"><enum>(f)</enum><header>Consistency with senate emergency procedures and practices</header><text>Nothing in this standing order shall be construed in a manner that is inconsistent with S. Res. 296 (108th Congress) or any other emergency procedures or practices of the Senate.</text></subsection><subsection id="idADE30C9435924D2F957D4F7E1D9E17CC"><enum>(g)</enum><header>Standing order</header><text display-inline="yes-display-inline">This section shall be a standing order of the Senate.</text></subsection></section></resolution-body></resolution>
