RES. 266IN THE SENATE OF THE UNITED STATESJune 22, 2023Mr. Paul (for himself, Mr. Hawley, Mr. Braun, Ms. Lummis, and Mr. Lee) submitted the following resolution; which was referred to the Committee on Foreign RelationsRESOLUTIONExpressing the sense of the Senate regarding the relationship between certain obligations under the North Atlantic Treaty and constitutional declarations of war by Congress.

That it is the sense of the Senate that, pursuant to article 11 of the North Atlantic Treaty, done at Washington, District of Columbia, on April 4, 1949 (63 Stat. 2241; 34 U.N.T.S. 243), if the President determines it necessary to engage United States forces in hostilities in order to restore or maintain the security of the North Atlantic area as stated in article 5 of such treaty, such action does not supersede the constitutional requirement that Congress declare war or authorize the use of military force prior to the United States engaging in hostilities.
