which was referred to the <committee-name committee-id="SSRA00">Committee on Rules and Administration</committee-name></action-desc></action><legis-type>RESOLUTION</legis-type><official-title display="yes">Amending the Standing Rules of the Senate to prohibit the consideration of legislation in the Senate unless the text of the legislation that will be considered has been made publicly available in electronic form for a mandatory minimum review period.</official-title></form><resolution-body><section section-type="section-one" id="id14BF6CDE12004BF98FD992628C425CEF"><enum>1.</enum><header>Prohibiting consideration of text of legislation until completion of mandatory minimum review period</header><subsection display-inline="no-display-inline" id="idDEB87D39758242CE8F9D2DFD4A82563D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Rule XII of the Standing Rules of the Senate is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBADACF2858024E7F9FC2033581403244"><paragraph id="idF39EBD051D7644C89F164D04127C51B2"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id3D8E80E0E2394B44AE29EE6CA5363F89"><enum>(a)</enum><text>It shall not be in order to consider a bill, joint resolution, resolution, or conference report unless the text of the bill, joint resolution, resolution, or conference report to be considered has been publicly available in electronic form for the mandatory minimum review period.</text></subparagraph><subparagraph indent="up1" id="idD0F47B62F28C43FCAB0F926BA3CFDEEB"><enum>(b)</enum><text>Each Senator shall self certify that the Senator has read a bill, joint resolution, resolution, or conference report before voting on the bill, joint resolution, resolution, or conference report.</text></subparagraph><subparagraph indent="up1" id="id8C5982A5700E4E4C8B2F2BCFD97111AA"><enum>(c)</enum><text>In this paragraph, the term <term>mandatory minimum review period</term> means, with respect to a bill, joint resolution, resolution, or conference report, the greater of—</text><clause id="idD045C8709BFB4A1A9975358BD73F0449"><enum>(i)</enum><text>the period—</text><subclause id="id6E394CBD6BD4421E858A6DFC20E0387B"><enum>(I)</enum><text>beginning on the first hour after the text of the bill, joint resolution, resolution, or conference report to be considered is first made publicly available in electronic form; and</text></subclause><subclause id="idFCD81B73C1064F9BA61C8E1BCC1C9FCD"><enum>(II)</enum><text>that consists of a number of minutes equal to 2 times the number of pages of the text of the bill, joint resolution, resolution, or conference report to be considered; and</text></subclause></clause><clause id="id0EA34FBA4E3E48D189C51F90A86948D2"><enum>(ii)</enum><text>72 hours after the text of the bill, joint resolution, resolution, or conference report to be considered is first made publicly available in electronic form.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection display-inline="no-display-inline" id="idFBDA1B93DD284FB598FFC1A9AE3AB5D6"><enum>(b)</enum><header>Technical and conforming amendments</header><text display-inline="no-display-inline">The Standing Rules of the Senate is amended—</text><paragraph id="id5A10B108C9674D3ABE1C624049D0FCC2"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph 1 of rule VIII, by inserting <quote>the text of which has been available for the mandatory minimum review period, as defined in paragraph 5 of rule XII, and</quote> after <quote>bills and resolutions</quote>;</text></paragraph><paragraph id="id9255E8E7CAA447E1AE5C75100A640F3F"><enum>(2)</enum><text>in rule XIV—</text><subparagraph id="id74463711B34D4B0FA50D77DFDC7879C4"><enum>(A)</enum><text>in paragraph 3, by striking <quote>on that day</quote> and inserting <quote>before the expiration of the mandatory minimum review period, as defined in paragraph 5 of rule XII,</quote>; and</text></subparagraph><subparagraph id="idCE63280D2BB0427DAF61FB59F6C712B0"><enum>(B)</enum><text>in paragraph 6, by striking <quote>one day</quote> and inserting <quote>for the mandatory minimum review period, as defined in paragraph 5 of rule XII,</quote>;</text></subparagraph></paragraph><paragraph id="id3358661E22974C64BB3CCB418FD2D523"><enum>(3)</enum><text>in paragraph 5 of rule XVII, by striking <quote>two calendar days (excluding Sundays and legal holidays</quote> and inserting <quote>the mandatory minimum review period, as defined in paragraph 5 of rule XII,</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE82358B17D3C469C963F073808C9DAFC"><enum>(4)</enum><text>in paragraph 5 of rule XXVIII, by striking <quote>shall be immediately put</quote> and inserting <quote>shall be put after the expiration of the mandatory minimum review period, as defined in paragraph 5 of rule XII</quote>.</text></paragraph></subsection></section><section display-inline="no-display-inline" commented="no" id="id228DC434B646421988FFB3B6A85C962F"><enum>2.</enum><header>CBO cost estimate</header><subsection id="id1b3109df7b994cb581743cab13ce2912"><enum>(a)</enum><header>Point of order</header><text>It shall not be in order in the Senate to consider any bill, joint resolution, motion, amendment, amendment between the Houses, or conference report unless a cost estimate under section 402(1) of the Congressional Budget Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/653">2 U.S.C. 653(1)</external-xref>) for the exact text of the bill, joint resolution, motion, amendment, amendment between the Houses, or conference report has been available for not fewer than 24 hours.</text></subsection><subsection id="ide5dc64a409af43d091621705775252af"><enum>(b)</enum><header>Waiver and appeal</header><text>Subsection (a) may be waived or suspended in the Senate only by an affirmative vote of two-thirds of the Members, duly chosen and sworn. An affirmative vote of two-thirds of the Members of the Senate, duly chosen and sworn, shall be required to sustain an appeal of the ruling of the Chair on a point of order raised under subsection (a).</text></subsection></section></resolution-body></resolution>
