RES. 121</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action display="yes"><action-date date="20241212">December 12, 2024</action-date><action-desc><sponsor name-id="S353">Mr. Schatz</sponsor> (for himself, <cosponsor name-id="S253">Mr. Durbin</cosponsor>, and <cosponsor name-id="S422">Mr. Welch</cosponsor>) introduced the following joint resolution; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>JOINT RESOLUTION</legis-type><official-title display="yes">Proposing an amendment to the Constitution of the United States to abolish the electoral college and to provide for the direct election of the President and Vice President of the United States.</official-title></form><resolution-body style="constitutional-amendment" id="HF32951A2B9B94CD1AC6CEAA28BB24D6A"><section display-inline="yes-display-inline" section-type="undesignated-section" id="H14469B63F84C41958A259ADDC7947B66"><text>That the following article is proposed as an amendment to the Constitution of the United States, which shall be valid to all intents and purposes as part of the Constitution when ratified by the legislatures of three-fourths of the several States:</text><quoted-block style="traditional" display-inline="no-display-inline" id="H77D454C0F34B4137B8C4D5A24EAD53C5"><constitution-article id="H1234"><enum> —</enum><section section-type="section-one" id="H6AC306F220894266AE8AEA2EAA0B887F"><enum>1.</enum><text display-inline="yes-display-inline">The President and Vice President shall be elected by the people of the several States and the district constituting the seat of government of the United States.</text></section><section section-type="section-one" id="HEF57814991554E2FAE56D7B6F6AD595B"><enum>2.</enum><text display-inline="yes-display-inline">Each voter shall cast a single vote for two persons who have consented to the joining of their names as candidates for President and Vice President.</text></section><section section-type="section-one" id="HE68129944E6444948BE1D94C3F05342B"><enum>3.</enum><text display-inline="yes-display-inline">The pair of candidates having the greatest number of votes for President and Vice President shall be elected.</text></section><section section-type="section-one" id="HD08D4842BC4641B1A192A67E962C5548"><enum>4.</enum><text display-inline="yes-display-inline">The Congress may by law provide for the case of the death or any other disqualification of any candidate for President or Vice President before the day on which the President-elect or Vice President-elect has been chosen, and for the case of a tie in any election.</text></section><section commented="no" display-inline="no-display-inline" section-type="section-one" id="id4e40b9e83c91468c91376fd34f94b7b6"><enum>5.</enum><text display-inline="yes-display-inline">This article shall take effect one year after the first day of January following ratification.</text></section></constitution-article><after-quoted-block>.</after-quoted-block></quoted-block></section></resolution-body></resolution>
