which was referred to the <committee-name committee-id="SSRA00">Committee on Rules and Administration</committee-name></action-desc></action><legis-type>CONCURRENT RESOLUTION</legis-type><official-title display="yes">Establishing new congressional oversight to address regulatory reform.</official-title></form><preamble><whereas><text>Whereas there are more than 3,000 final rules issued every year by more than 50 Federal agencies;</text></whereas><whereas><text>Whereas a rule is defined in section 551 of title 5, United States Code, as <quote>the whole or part of an agency statement of general or particular applicability and future effect designed to implement, interpret, or prescribe law or policy</quote>;</text></whereas><whereas><text>Whereas subchapter II of chapter 5, and chapter 7, of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>) established standards for the issuance of rules using formal rulemaking and informal rulemaking procedures;</text></whereas><whereas><text>Whereas informal rulemaking, also known as <quote>notice and comment</quote> rulemaking or <quote>section 553</quote> rulemaking, is the most common type of rulemaking;</text></whereas><whereas><text>Whereas, in rulemaking proceedings, formal hearings must be held and interested parties must be given the chance to comment on the proposed rule or regulation, and once adopted, the rule or regulation is required to be published in the Federal Register;</text></whereas><whereas><text>Whereas, according to the 2023 Ten Thousand Commandments report by the Competitive Enterprise Institute, the top 5 Federal rulemaking agencies (which, in 2022, were the Department of the Interior, the Department of the Treasury, the Department of Transportation, the Department of Commerce, and the Department of Health and Human Services) account for 41 percent of all Federal rules;</text></whereas><whereas><text>Whereas <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/8">chapter 8</external-xref> of title 5, United States Code (commonly known as the <quote>Congressional Review Act</quote>) established a mechanism through which Congress could overturn Federal regulations by enacting a joint resolution of disapproval;</text></whereas><whereas><text>Whereas the Congressional Review Act requires that rules that have a $100,000,000 effect or more on the economy are submitted by agencies to both Houses of Congress and the Government Accountability Office and have a delayed effective date of not less than 60 days to pass a resolution of disapproval rejecting the rule, which must be approved by the President; and</text></whereas><whereas><text>Whereas, since the enactment of the Congressional Review Act in 1996, the procedures under the Act have been used 20 times to overturn a rule: Now, therefore, be it </text></whereas></preamble><resolution-body><section id="iddd038af0c8d1449282f7e27b2a195da4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This resolution may be cited as the <quote><short-title>Regulation Sensibility Through Oversight Restoration Resolution of 2024</short-title></quote> or the <quote><short-title>RESTORE Resolution of 2024</short-title></quote>.</text></section><section id="id51b592d88ba048c2925c0778d5590b19"><enum>2.</enum><header>Joint Select Committee on Regulatory Reform</header><text display-inline="no-display-inline">There is established a joint select committee to be known as the Joint Select Committee on Regulatory Reform (hereinafter in this concurrent resolution referred to as the <quote>Joint Select Committee</quote>).</text></section><section id="id31372a5ac8184dd49e56d739f26e4bbb"><enum>3.</enum><header>Duties of Joint Select Committee</header><subsection id="id39239e8572a549ed947b4e2710aea0c9"><enum>(a)</enum><header>Definitions</header><text>In this section, the terms <term>agency</term> and <term>rule</term> have the meanings given those terms in section 551 of title 5, United States Code.</text></subsection><subsection id="idaa3e6726e83746e5ab16b364693b0071"><enum>(b)</enum><header>Duties</header><text>The Joint Select Committee shall—</text><paragraph id="id008e4e6a2cb54a84abda725ac22c6bc4"><enum>(1)</enum><text>conduct a systematic review of the process by which rules are promulgated by agencies;</text></paragraph><paragraph id="idbd1425a7a40b4b99a8bf3f2608f859d7"><enum>(2)</enum><text>hold hearings on the effects of and how to reduce regulatory overreach in all sectors of the economy;</text></paragraph><paragraph id="ide7129a5d3d3e4f88a9d134331d431fb6"><enum>(3)</enum><text>conduct a review of the Code of Federal Regulations to identify rules and sets of rules that should be repealed; and</text></paragraph><paragraph id="id478b012da35f4880b57eade7192857d3"><enum>(4)</enum><text>submit to the Senate and the House of Representatives—</text><subparagraph id="idd5cb8d3f912e403a99546396fe83e25d"><enum>(A)</enum><text>recommendations for legislation—</text><clause id="id51d5cdebbd3d4d12a56c4ccc7a61de3b"><enum>(i)</enum><text>to create a process under which an agency, before promulgating a rule, shall—</text><subclause id="id8a1e1326db7446d38f207def30c47457"><enum>(I)</enum><text>seek advice from Congress;</text></subclause><subclause id="id58427ffe9b034f9f96bf2c15606e1bb7"><enum>(II)</enum><text>publish the proposed rule;</text></subclause><subclause id="id0ec63ba813e940728a74d8b7a4c8d8d4"><enum>(III)</enum><text>hold a public comment period on the proposed rule;</text></subclause><subclause id="id12aae79f7fbe4f9abf5bb4b06c556789"><enum>(IV)</enum><text>seek advice from Congress based on the public comments; and</text></subclause><subclause id="idf6f609993b1945e9b33843714f8e1ba4"><enum>(V)</enum><text>hold issuance of the rule until Congress can review the rule for a period of not more than 1 year; and</text></subclause></clause><clause id="id99a6d3fac25c48c99e0e9d6fedf40be3"><enum>(ii)</enum><text>to create a process to appropriately sunset as many rules as possible;</text></clause></subparagraph><subparagraph id="id93d993da70ad461dac8f944b2f8d2720"><enum>(B)</enum><text>recommendations for ways to reduce the financial burden placed on the various sectors of the economy in order to comply with rules;</text></subparagraph><subparagraph id="idf5b76330b60947dfb27a2331b05289d9"><enum>(C)</enum><text>an analysis of the feasibility of the creation of a permanent Joint Committee on Rules Review in accordance with subsection (c);</text></subparagraph><subparagraph id="id7478b2d31ff34852856fe603f5a8cfc5"><enum>(D)</enum><text>an analysis of the feasibility of requiring each agency to submit each proposed rule of the agency to the appropriate committees of Congress for review in a similar manner as set forth for a permanent Joint Committee on Rules Review under subsection (c); and</text></subparagraph><subparagraph id="id236f990c480a4c2ea93d4ff9ff901356"><enum>(E)</enum><text>a list of rules and sets of rules that the Joint Select Committee recommends should be repealed.</text></subparagraph></paragraph></subsection><subsection id="ide35c14b7fd314c3abe6d55105f1d3101"><enum>(c)</enum><header>Analysis of permanent Joint Committee on Rules Review</header><text>The Joint Select Committee shall analyze the feasibility of the creation of a permanent Joint Committee on Rules Review. The Joint Committee on Rules Review would—</text><paragraph id="idae15cbfb96b84bba8658e667a06ce8f3"><enum>(1)</enum><text>review each proposed rule that an agency determines is likely to have an annual effect on the economy of $50,000,000 or more before the agency promulgates the final rule;</text></paragraph><paragraph id="id96c15b9fb6cd4ad8bc8747c63b8d30c9"><enum>(2)</enum><text>require each agency to submit to the Committee—</text><subparagraph id="id696397a4e07e428fb75adb6ff9aabe97"><enum>(A)</enum><text>the text of each proposed rule of the agency described in paragraph (1); and</text></subparagraph><subparagraph id="id0b4fe643c1ec45ebbba7ed91a3faed75"><enum>(B)</enum><text>an analysis of the economic impact of the rule on the economy;</text></subparagraph></paragraph><paragraph id="id646537179a2846c685ec754f947d0ccb"><enum>(3)</enum><text>require each agency to revise a proposed rule submitted under paragraph (2) if the Committee determines that the proposed rule—</text><subparagraph id="iddb588b3c9a124a35ae01b2817f96aede"><enum>(A)</enum><text>needs to be significantly rewritten to accomplish the intent of the agency or address the recommendations or objections of the Committee;</text></subparagraph><subparagraph id="idee5994bf89974f24966a1807170aefac"><enum>(B)</enum><text>is not a valid exercise of delegated authority from Congress;</text></subparagraph><subparagraph id="id0d3b0d9d14c54d5893e074fff716bfc7"><enum>(C)</enum><text>is not in proper form;</text></subparagraph><subparagraph id="idc037f10a27bf4552beb3bf2acf14e5b3"><enum>(D)</enum><text>is inconsistent with the intent of Congress with respect to the provision of law that the proposed rule implements; or</text></subparagraph><subparagraph id="id74c04a44ea784b72816882492e20810d"><enum>(E)</enum><text>is not a reasonable implementation of the law;</text></subparagraph></paragraph><paragraph id="id77e2757e051a4bdba00455df445da4da"><enum>(4)</enum><text>delay the effective date of a proposed rule for a period of not more than 1 year beginning on the date on which the agency submits the proposed rule under paragraph (2);</text></paragraph><paragraph id="id447797bf31b1469287b16199f75759f9"><enum>(5)</enum><text>allow an agency to promulgate a final rule without any delay in the effective date of the rule if the agency designates the rule as an emergency rule, unless the Committee by majority vote determines that the rule is not an emergency rule; and</text></paragraph><paragraph id="idd6bea4184cb5444e9f71da1c0e58fc1e"><enum>(6)</enum><text>if applicable, recommend that Congress should overturn a final rule promulgated by an agency by enacting a joint resolution of disapproval.</text></paragraph></subsection></section><section id="idc77c71a148f34117b4b3e4ebaa2a2ed1"><enum>4.</enum><header>Composition of Joint Select Committee</header><subsection id="idbd2a67ebe70746b18686641f2d4777e4"><enum>(a)</enum><header>Membership</header><paragraph id="idb276b9b5bf4042fd8562c107671c510b"><enum>(1)</enum><header>In general</header><text>The Joint Select Committee shall be composed of 30 members, of whom—</text><subparagraph id="idf69c51211fe64941aa773b56a5e1f28d"><enum>(A)</enum><text>15 shall be appointed by the majority and the minority leaders of the Senate from among Members of the Senate in a manner that reflects the ratio of the number of Members of the Senate from the majority party to the number of Members of the Senate from the minority party on the date of enactment of this Act; and</text></subparagraph><subparagraph id="id0f14b32084cf4163b54426abe6439b6f"><enum>(B)</enum><text>15 shall be appointed by the Speaker and the minority leader of the House of Representatives among Members of the House of Representatives in a manner that reflects the ratio of the number of members of the House of Representatives from the majority party to the number of Members of the House of Representatives from the minority party on the date of enactment of this Act.</text></subparagraph></paragraph><paragraph id="id9ff3630755f5459d95408243b0576c22"><enum>(2)</enum><header>Date</header><text>The appointments of the members of the Joint Select Committee shall be made not later than 30 days after the date of adoption of this concurrent resolution.</text></paragraph></subsection><subsection id="idc1ed1c1ee975498d8e091cdd4afbb09c"><enum>(b)</enum><header>Vacancies</header><text>Any vacancy in the Joint Select Committee shall not affect its powers, but shall be filled in the same manner as the original appointment.</text></subsection><subsection id="id73877446dc2c4e95a1796582c31e8c38"><enum>(c)</enum><header>Chairperson and Vice Chairperson</header><paragraph id="ida1c50f3dc14144deab383f60638c558e"><enum>(1)</enum><header>Chairperson</header><text>The members of the Joint Select Committee shall elect a Chairperson for the Joint Select Committee by majority vote from each of—</text><subparagraph id="ida491c1680413488182ec2d075422f715"><enum>(A)</enum><text>the members of the majority party of the Senate; and</text></subparagraph><subparagraph id="idc399ec8e6302453baab4707da09d0607"><enum>(B)</enum><text>the members of the majority party of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id19b5f8dd95fd45ba9db470dd4ff28216"><enum>(2)</enum><header>Vice chairperson</header><text>The members of the Joint Select Committee shall elect a Vice Chairperson for the Joint Select Committee by majority vote from each of—</text><subparagraph id="idc44f56a496174e2985632931b8b04998"><enum>(A)</enum><text>the members of the minority party of the Senate; and</text></subparagraph><subparagraph id="idf848bbad5ac848d29df5a177d61dbcde"><enum>(B)</enum><text>the members of the minority party of the House of Representatives.</text></subparagraph></paragraph></subsection><subsection id="idab0f354a5a0743eda292dcd0ebc4240a"><enum>(d)</enum><header>Quorum</header><text>A majority of the members of the Joint Select Committee each from the Senate and the House of Representatives shall constitute a quorum for the purpose of conducting the business of the Joint Select Committee.</text></subsection></section><section id="id3de3f88d6141497aa140d15ec577923d"><enum>5.</enum><header>Rules and procedures</header><subsection id="idb23ebfdd24644a2bacd50e158ab382ad"><enum>(a)</enum><header>Governance under Standing Rules of the Senate</header><text>Except as otherwise specifically provided in this resolution, the investigations and hearings conducted by the Joint Select Committee shall be governed by the Standing Rules of the Senate.</text></subsection><subsection id="idcddb54b00f474316b21150bedb9bce59"><enum>(b)</enum><header>Additional rules and procedures</header><text>The Joint Select Committee may adopt such additional rules or procedures if the Chairperson and Vice Chairperson agree, or if the Joint Select Committee by majority vote so decides, that such additional rules or procedures are necessary or advisable to conduct the duties of the Joint Select Committee.</text></subsection></section><section id="id8d7d77c69bbf43aab4d51f68b6e77d4f"><enum>6.</enum><header>Authority of Joint Select Committee</header><subsection id="id7acd7d74c7144c058b24a05e2b1df120"><enum>(a)</enum><header>In general</header><text>The Joint Select Committee may exercise all of the powers and responsibilities of a committee under rule XXVI of the Standing Rules of the Senate.</text></subsection><subsection id="idcdb83514e28645df9865e957ec3b4ff3"><enum>(b)</enum><header>Powers</header><text>The Joint Select Committee may, for the purpose of carrying out this resolution—</text><paragraph id="id431d3703a40541efb9b5b7a769f5048c"><enum>(1)</enum><text>hold such hearings, sit and act at such times and places, take such testimony, receive such evidence, and administer such oaths as the Joint Select Committee considers advisable; and</text></paragraph><paragraph id="id43dd0a7d4a184eec9c2e26339eeba9fe"><enum>(2)</enum><text>authorize and require, by issuance of subpoena or otherwise, the attendance and testimony of witnesses and the preservation and production of books, records, correspondence, memoranda, papers, documents, tapes, and any other materials in whatever form the Joint Select Committee considers advisable.</text></paragraph></subsection><subsection id="idac5019b64e6c4e27b53cd4294dc99150"><enum>(c)</enum><header>Subpoenas</header><text>Subpoenas authorized by the Joint Select Committee—</text><paragraph id="id9e100b4bafc2464188d30c8ee26d91ac"><enum>(1)</enum><text>may be issued with the joint concurrence of the Chairperson and Vice Chairperson;</text></paragraph><paragraph id="id632cb9e5e16c4655914aff2ccc2d130a"><enum>(2)</enum><text>shall bear the signature of the Chairperson and Vice Chairperson, or the designee of the Chairperson or Vice Chairperson; and</text></paragraph><paragraph id="id4a30eca17cd743e598b95742f38d95ad"><enum>(3)</enum><text>shall be served by any person or class of persons designated by the Chairperson and Vice Chairperson for that purpose anywhere within or without the borders of the United States to the full extent provided by law.</text></paragraph></subsection><subsection id="idfab484a72c8a4a2d8dc34a0cb90d04c6"><enum>(d)</enum><header>Access to information</header><text>The Joint Select Committee shall have, to the fullest extent permitted by law, access to any such information or materials obtained by any other department or agency of the Federal Government or by any other governmental department, agency, or body investigating the matters described in section 3(b).</text></subsection><subsection id="id3d86572a6bad41b2961b4f9f97d2360e"><enum>(e)</enum><header>Cooperation of other committees</header><text>In carrying out the duties of the Joint Select Committee, the Joint Select Committee may obtain the input and cooperation of any other standing committee of the Senate or the House of Representatives.</text></subsection></section><section id="id779cd28cdb5a48abbd30db4dfe76dc79"><enum>7.</enum><header>Reports</header><subsection id="ide56a5c834f0f49f38a664f0aa18a14ff"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date on which the Joint Select Committee terminates, the Joint Select Committee shall submit to the Senate and the House of Representatives a report, which shall contain—</text><paragraph id="id166d429df00a43ec9ceccb54981c933e"><enum>(1)</enum><text>the results and findings of the reviews and hearings carried out by the Joint Select Committee pursuant to this resolution; and</text></paragraph><paragraph id="id3fb44183b17c4ec495743e919361f7a8"><enum>(2)</enum><text>any information required to be submitted under section 3(b)(4).</text></paragraph></subsection><subsection id="id5e9bf68352b24edf9585026ed9cae9ff"><enum>(b)</enum><header>Interim reports</header><text>The Joint Select Committee may submit to the Senate and the House of Representatives such interim reports as the Joint Select Committee considers appropriate.</text></subsection></section><section id="id478b74d1f17f4b418913c1b694e866c7"><enum>8.</enum><header>Administrative provisions</header><subsection id="id99e918a023c64019adb92a162e1f71bf"><enum>(a)</enum><header>Staff</header><paragraph id="id627b6376af944302a23544fd9f8e8c4b"><enum>(1)</enum><header>In general</header><text>The Joint Select Committee may employ, in accordance with paragraph (2), a staff composed of such clerical, investigatory, legal, technical, and other personnel as the Joint Select Committee considers necessary or appropriate.</text></paragraph><paragraph id="id0a68879e9c5944c699368f578ba6a1a8"><enum>(2)</enum><header>Appointment of staff</header><subparagraph id="id22535bd5dc4b476591268809fe16c992"><enum>(A)</enum><header>In general</header><text>The Joint Select Committee shall appoint a staff for the majority, a staff for the minority, and a nondesignated staff.</text></subparagraph><subparagraph id="idc4399d72ec6f4b8db8ec15fd321391a3"><enum>(B)</enum><header>Majority staff</header><text>The majority staff shall be appointed, and may be removed, by the Chairperson and shall work under the general supervision and direction of the Chairperson.</text></subparagraph><subparagraph id="id936031df50104c79afe0e941e54240b7"><enum>(C)</enum><header>Minority staff</header><text>The minority staff shall be appointed, and may be removed, by the Vice Chairperson and shall work under the general supervision and direction of the Vice Chairperson.</text></subparagraph><subparagraph id="idae136abf9a9b478fb1b4e2c4f6c20577"><enum>(D)</enum><header>Nondesignated staff</header><text>Nondesignated staff shall be appointed, and may be removed, jointly by the Chairperson and Vice Chairperson, and shall work under the joint general supervision and direction of the Chairperson and Vice Chairperson.</text></subparagraph></paragraph></subsection><subsection id="id65a1cd17d16740a4bb62bc9c8eb58ef5"><enum>(b)</enum><header>Compensation</header><paragraph id="idb357d195f86f4003a19db5b8b5804cab"><enum>(1)</enum><header>Majority staff</header><text>The Chairperson shall fix the compensation of all personnel of the majority staff of the Joint Select Committee.</text></paragraph><paragraph id="id326cbd0480f24148b570d29005f8fc1f"><enum>(2)</enum><header>Minority staff</header><text>The Vice Chairperson shall fix the compensation of all personnel of the minority staff of the Joint Select Committee.</text></paragraph><paragraph id="id17f6f5dd4bb04cbda091028b37fc07bb"><enum>(3)</enum><header>Nondesignated staff</header><text>The Chairperson and Vice Chairperson shall jointly fix the compensation of all nondesignated staff of the Joint Select Committee.</text></paragraph><paragraph id="id508683a6b4794d1db05f3d549a6565ac"><enum>(4)</enum><header>Pay and benefits</header><text>All employees of the Joint Select Committee shall be treated as employees of the Senate for purposes of disbursing pay and processing benefits.</text></paragraph></subsection><subsection id="id6c1ba3260e6443f686d320ad9a0dbb29"><enum>(c)</enum><header>Facilities</header><text>The Joint Select Committee may use, with the prior consent of the chair of any other committee of the Senate or the House of Representatives or the chair of any subcommittee of any committee of the Senate or the House of Representatives, the facilities of any other committee of the Senate or the House of Representatives, whenever the Joint Select Committee or the Chairperson and Vice Chairperson consider that such action is necessary or appropriate to enable the Joint Select Committee to carry out the responsibilities, duties, or functions of the Joint Select Committee under this resolution.</text></subsection><subsection id="ided0689eb83f045fb9a4885b81043bb72"><enum>(d)</enum><header>Detail of employees</header><text>The Joint Select Committee may use on a reimbursable basis, with the prior consent of the head of the department or agency of the Federal Government concerned and the approval of the Committee on Rules and Administration of the Senate, the services of personnel of the department or agency.</text></subsection><subsection id="idf7d206ba46d74d6da1ab890a30e695e7"><enum>(e)</enum><header>Temporary and intermittent services</header><text>The Joint Select Committee may procure the temporary or intermittent services of individual consultants or organizations.</text></subsection><subsection id="idbfe325f30a3a4e72a14a3d96abedebfc"><enum>(f)</enum><header>Ethics</header><text>The Joint Select Committee shall establish ethical rules for the members and employees of the Joint Select Committee, which shall, to the extent practicable, be comparable to the ethical rules that apply to employees of the Senate.</text></subsection><subsection id="id803c28ffea524e8db44ee9b93daa251e"><enum>(g)</enum><header>Authorization of appropriations</header><text>For the expenses of the Joint Select Committee, there are authorized to be appropriated $3,000,000 for fiscal year 2025, to remain available until expended.</text></subsection></section><section id="idbd34f0bdc25648f88f7b5f0d39b43b46"><enum>9.</enum><header>Effective date; termination</header><subsection id="id9c40e302a1744550960af3f3a916c82e"><enum>(a)</enum><header>Effective date</header><text>This resolution shall take effect on the date of adoption of this concurrent resolution.</text></subsection><subsection id="id9d9011832089473f88449512cd065e1c"><enum>(b)</enum><header>Termination</header><text>The Joint Select Committee shall terminate on the date that is 1 year after the appointment of the members of the Joint Select Committee.</text></subsection><subsection id="id6ded1817262c4172bc2476472be4289c"><enum>(c)</enum><header>Disposition of records</header><text>Upon termination of the Joint Select Committee, the records of the Joint Select Committee shall become the records of any committee or committees designated by the majority leader of the Senate and the Speaker of the House of
