<congress display="yes">118th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 912</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To require the Secretary of Energy to provide technology grants to strengthen domestic mining education, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section id="S1" section-type="section-one" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Technology Grants to Strengthen Domestic Mining Education Act of 2023</short-title></quote> or the <quote><short-title>Mining Schools Act of 2023</short-title></quote>.</text></section><section id="idaccc9b6a9feb4fb09e3079f8a5f8ed64" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Technology grants to strengthen domestic mining education</header><subsection id="id4e6edcdfbd374cf4a0e89885c33df8c1" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="ida88c4a7001eb4c4a9832060752ce90f7" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Board</header><text display-inline="yes-display-inline">The term <term>Board</term> means the Mining Professional Development Advisory Board established by subsection (d)(1).</text></paragraph><paragraph id="ide223b137148243a28cc6b1ecdc4e01a6" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Mining industry</header><text display-inline="yes-display-inline">The term <term>mining industry</term> means the mining industry of the United States, consisting of the search for, and extraction, beneficiation, refining, smelting, and processing of, naturally occurring metal and nonmetal minerals from the earth. </text></paragraph><paragraph id="id6d7f76a035a24d8cb4c552845d09f203" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Mining profession</header><text display-inline="yes-display-inline">The term <term>mining profession</term> means the body of jobs directly relevant to—</text><subparagraph commented="no" id="idEE668A2D8BF14F73842B0E403466BD10" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the exploration, planning, execution, and remediation of metal and nonmetal mining sites; and</text></subparagraph><subparagraph commented="no" id="idBF48FD338F1F4366BBD859585C946ACC" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the extraction, including the separation, refining, alloying, smelting, concentration, and processing, of mineral ores.</text></subparagraph></paragraph><paragraph id="idcdb035e6083a44609acdfaa3159f12d3" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Mining school</header><text display-inline="yes-display-inline">The term <term>mining school</term> means—</text><subparagraph id="id91f7b0302b2c407584ca19927be51138" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a mining, metallurgical, geological, or mineral engineering program accredited by the Accreditation Board for Engineering and Technology, Inc., that is located at an institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)); or</text></subparagraph><subparagraph id="id445b68189a6643a1b1c14c857f58bcc2" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">a geology or engineering program or department that is located at a 4-year public institution of higher education (as so defined) located in a State the gross domestic product of which in 2021 was not less than $2,000,000,000 in the combined categories of “Mining (except oil and gas)” and “Support activities for mining”, according to the Bureau of Economic Analysis.</text></subparagraph></paragraph><paragraph id="idfa680f66db5647a3b90ed7f3924e1dc5" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph></subsection><subsection id="id626CCA36B0634FBB93C2F1CAB8AA49AD" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Domestic mining education strengthening program</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Secretary of the Interior (acting through the Director of the United States Geological Survey), shall—</text><paragraph commented="no" display-inline="no-display-inline" id="iddca1007e91bb4feba4003c99398a6df7"><enum>(1)</enum><text display-inline="yes-display-inline">establish a grant program to strengthen domestic mining education; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf51638e3f92647c59cf7b4afc68f7735"><enum>(2)</enum><text display-inline="yes-display-inline">under the program established in paragraph (1), award competitive grants to mining schools for the purpose of recruiting and educating the next generation of mining engineers and other qualified professionals to meet the future energy and mineral needs of the United States.</text></paragraph></subsection><subsection id="idf08c8c16b6cc4d36bdd5fdca0814f26f" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Grants</header><paragraph id="idB20C0AF338114D00B05A35BEE75AD31C" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In carrying out the grant program established under subsection (b)(1), the Secretary shall award not more than 10 grants each year to mining schools.</text></paragraph><paragraph id="id7B095F9C1C2A4346842E48127FE6DD70" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Selection requirements</header><subparagraph id="id32BB170C487649DA9797E3B8ED03F937" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">To the maximum extent practicable, the Secretary shall select recipients for grants under paragraph (1) to ensure geographic diversity among grant recipients to ensure that region-specific specialties are developed for region-specific geology.</text></subparagraph><subparagraph id="id4B1B43A84A46496086EC66EB3369CDFF" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Timeline</header><text display-inline="yes-display-inline">The Secretary shall award the grants under paragraph (1) by not later than the later of—</text><clause commented="no" display-inline="no-display-inline" id="id70bc9959eb81499991961bf78b028cb9"><enum>(i)</enum><text display-inline="yes-display-inline">the date that is 180 days after the start of the applicable fiscal year; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id6182debafcde4df0b42bb6c87135f0a9"><enum>(ii)</enum><text display-inline="yes-display-inline">the date that is 180 days after the date on which the Act making full-year appropriations for the Department of Energy for the applicable fiscal year is enacted.</text></clause></subparagraph></paragraph><paragraph id="id982f2fb8c6db40d582c9ed0b14613635" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Recommendations of the Board</header><subparagraph commented="no" display-inline="no-display-inline" id="idd4916611988844589cbaaeea03e3d062"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In selecting recipients for grants under paragraph (1) and determining the amount of each grant, the Secretary, to the maximum extent practicable, shall take into consideration the recommendations of the Board under subparagraphs (A) and (B) of subsection (d)(3).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id660b886e0f3a4119afb2450f38cb5173"><enum>(B)</enum><header display-inline="yes-display-inline">Selection statement</header><text display-inline="yes-display-inline">In selecting recipients for grants under paragraph (1), the Secretary shall—</text><clause commented="no" display-inline="no-display-inline" id="id9247da763b024ed2be1c988c5423daec"><enum>(i)</enum><text display-inline="yes-display-inline">in response to a recommendation from the Board, submit to the Board a statement that describes—</text><subclause commented="no" display-inline="no-display-inline" id="id879d99dae5884372ae504a44b823c191"><enum>(I)</enum><text display-inline="yes-display-inline">whether the Secretary accepts or rejects, in whole or in part, the recommendation of the Board; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idedd723be29ef469bb2959abaf93212f0"><enum>(II)</enum><text display-inline="yes-display-inline">the justification and rationale for any rejection, in whole or in part, of the recommendation of the Board; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="ideb0d1ef4f7b44cef943f66286b3d7366"><enum>(ii)</enum><text display-inline="yes-display-inline">not later than 15 days after awarding a grant for which the Board submitted a recommendation, publish the statement submitted under clause (i) on the Department of Energy website.</text></clause></subparagraph></paragraph><paragraph id="idb4effb853fec4a90a7976249a629b6d4" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Use of funds</header><text display-inline="yes-display-inline">A mining school receiving a grant under paragraph (1) shall use the grant funds—</text><subparagraph id="idB01B5C68AAB14EB38D36E370E49B0A21" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">to recruit students to the mining school; and </text></subparagraph><subparagraph id="id1155AE1DBB14495CB8687EE8D47C829C" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">to enhance and support programs related to, as applicable— </text><clause id="id1ad4a4bf40d64710ae1193141c47d0e2" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">mining, mineral extraction efficiency, and related processing technology;</text></clause><clause id="idED67075E7FF94AF6B2B6CE3AB10F9FC7" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">emphasizing critical mineral and rare earth element exploration, extraction, and refining;</text></clause><clause id="id68959f0f7570413e96418140b82fb258" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">reclamation technology and practices for active mining operations;</text></clause><clause id="idc2600768409e45d594654cb861e311d4" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">the development of reprocessing systems and technologies that facilitate reclamation that fosters the recovery of resources at abandoned mine sites;</text></clause><clause id="id8055c3d67091498091ce4ab22254b13c" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text display-inline="yes-display-inline">mineral extraction methods that reduce environmental and human impacts;</text></clause><clause id="idc8fa732598df4297b6ea27d664ab5505" commented="no" display-inline="no-display-inline"><enum>(vi)</enum><text display-inline="yes-display-inline">technologies to extract, refine, separate, smelt, or produce minerals, including rare earth elements;</text></clause><clause id="id7d8215c583f948be92958eca9d452b0e" commented="no" display-inline="no-display-inline"><enum>(vii)</enum><text display-inline="yes-display-inline">reducing dependence on foreign energy and mineral supplies through increased domestic critical mineral production;</text></clause><clause id="idd366b493aba04e2bbdf29a51a26440ac" commented="no" display-inline="no-display-inline"><enum>(viii)</enum><text display-inline="yes-display-inline">enhancing the competitiveness of United States energy and mineral technology exports;</text></clause><clause id="id1e60ef6690e345e0aa47c6858f9f0cfe" commented="no" display-inline="no-display-inline"><enum>(ix)</enum><text display-inline="yes-display-inline">the extraction or processing of coinciding mineralization, including rare earth elements, within coal, coal processing byproduct, overburden, or coal residue;</text></clause><clause id="ida967ce82ecff4e099bcafb435a526fa7" commented="no" display-inline="no-display-inline"><enum>(x)</enum><text display-inline="yes-display-inline">enhancing technologies and practices relating to mitigation of acid mine drainage, reforestation, and revegetation in the reclamation of land and water resources adversely affected by mining;</text></clause><clause id="idc944c42c421f47a19c174d946c1efef8" commented="no" display-inline="no-display-inline"><enum>(xi)</enum><text display-inline="yes-display-inline">enhancing exploration and characterization of new or novel deposits, including rare earth elements and critical minerals within phosphate rocks, uranium-bearing deposits, and other nontraditional sources;</text></clause><clause id="ide0efededaf9643efa85d8170e3179600" commented="no" display-inline="no-display-inline"><enum>(xii)</enum><text display-inline="yes-display-inline">meeting challenges of extreme mining conditions, such as deeper deposits or offshore or cold region mining; and</text></clause><clause id="idb077f23317594e938b785ccb843e73df" commented="no" display-inline="no-display-inline"><enum>(xiii)</enum><text display-inline="yes-display-inline">mineral economics, including analysis of supply chains, future mineral needs, and unconventional mining resources.</text></clause></subparagraph></paragraph></subsection><subsection id="id4d4db7d322e14a398949c912735f401a" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Mining Professional Development Advisory Board</header><paragraph id="id210815fb21ca4e0b83429db2a315998c" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There is established an advisory board, to be known as the <quote>Mining Professional Development Advisory Board</quote>. </text></paragraph><paragraph id="ided2adbbec3134b74b8a275362e287c2c" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Composition</header><text display-inline="yes-display-inline">The Board shall be composed of 6 members, to be appointed by the Secretary not later than 180 days after the date of enactment of this Act, of whom—</text><subparagraph id="id48731C18D3194B69842CA2FD59612393" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">3 shall be individuals who are actively working in the mining profession and for the mining industry; and </text></subparagraph><subparagraph id="id67AEFF5EAA7E4A5B917F281D2CADF770" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">3 shall have experience in academia implementing and operating professional skills training and education programs in the mining sector.</text></subparagraph></paragraph><paragraph id="id232a6d3691e34e81a0ca8978832f9856" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">The Board shall—</text><subparagraph id="idd55e94318bb0488caed6a11dc16a4a97" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">evaluate grant applications received under subsection (c) and make recommendations to the Secretary for selection of grant recipients under that subsection;</text></subparagraph><subparagraph id="ida01d6c9cfb61459bbcdfe31ffc6e7b4f" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">propose the amount of the grant for each applicant recommended to be selected under subparagraph (A); and</text></subparagraph><subparagraph id="id2fe8530edd8b42d1bf0a468e38b3ea35" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">perform oversight to ensure that grant funds awarded under subsection (c) are used for the purposes described in paragraph (4) of that subsection.</text></subparagraph></paragraph><paragraph id="idedda46ebf842490fbc3d7b34278c4316" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Term</header><text display-inline="yes-display-inline">A member of the Board shall serve for a term of 4 years.</text></paragraph><paragraph id="id880ca663a614426eb07c1784a36901f3" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Vacancies</header><text display-inline="yes-display-inline">A vacancy on the Board—</text><subparagraph id="ide227514cf01e4866b5fd212aaddd630f" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">shall not affect the powers of the Board; and</text></subparagraph><subparagraph id="id884712424f014248a95ad346a26306f6" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">shall be filled in the same manner as the original appointment was made by not later than 180 days after the date on which the vacancy occurs.</text></subparagraph></paragraph></subsection><subsection id="id93d616aa7f81459ab543efa1d09f797d" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $10,000,000 for each of fiscal years 2024 through 2031. </text></subsection></section><section commented="no" display-inline="no-display-inline" id="id5366906a34354646ac088a9a7ac7a1d7" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Repeal of the Mining and Mineral Resources Research Institute Act of 1984</header><text display-inline="no-display-inline">The Mining and Mineral Resources Research Institute Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/30/1221">30 U.S.C. 1221 et seq.</external-xref>) is repealed.</text></section></legis-body><attestation><attestation-group><attestation-date date="20240710" chamber="Senate">Passed the Senate July 10, 2024.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
