which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Controlled Substances Act and the Controlled Substances Import and Export Act to modify the offenses relating to fentanyl, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fairness in Fentanyl Sentencing Act of 2023</short-title></quote>.</text></section><section id="id42F8D8A221E3426586C1ED3548D706FB"><enum>2.</enum><header>Controlled Substances Act amendments</header><text display-inline="no-display-inline">Section 401(b)(1) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841(b)(1)</external-xref>) is amended—</text><paragraph id="id713A438401974BCC949E39FCC1629FB6"><enum>(1)</enum><text>in subparagraph (A)(vi)—</text><subparagraph id="id772B436F4AD24699A0B2D928244FB7DE"><enum>(A)</enum><text>by striking <quote>400</quote> and inserting <quote>20</quote>;</text></subparagraph><subparagraph id="id79F03A377EEE4E96B2740B972FC7BFE2"><enum>(B)</enum><text>by striking <quote>100</quote> and inserting <quote>5</quote>; and</text></subparagraph><subparagraph id="id53A19E07094941A0BE057BC8AA0D85BC"><enum>(C)</enum><text>by inserting <quote>scheduled or unscheduled</quote> before <quote>analogue of</quote>; and</text></subparagraph></paragraph><paragraph id="id37CA93355BB948D0B8D918D803AC803D"><enum>(2)</enum><text>in subparagraph (B)(vi)—</text><subparagraph id="id291BBCCE080D4E33953C2BD59EF3B8FD"><enum>(A)</enum><text>by striking <quote>40</quote> and inserting <quote>2</quote>;</text></subparagraph><subparagraph id="id91616EFC00D24ABCBB6FD7640DCD2577"><enum>(B)</enum><text>by striking <quote>10</quote> and inserting <quote>0.5</quote>; and</text></subparagraph><subparagraph id="idBFF25400A1184B879F185934D104D88F"><enum>(C)</enum><text>by inserting <quote>scheduled or unscheduled</quote> before <quote>analogue of</quote>.</text></subparagraph></paragraph></section><section id="id23B00A8724864EEDB322C74A010E3B62"><enum>3.</enum><header>Controlled Substances Import and Export Act amendments</header><text display-inline="no-display-inline">Section 1010(b) of the Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/960">21 U.S.C. 960(b)</external-xref>) is amended—</text><paragraph id="idA661A909EBC14435A91D1DE70F4965AA"><enum>(1)</enum><text>in paragraph (1)(F)—</text><subparagraph id="idD9CB8D74CC9945D39B385F5BD233F0BB"><enum>(A)</enum><text>by striking <quote>400</quote> and inserting <quote>20</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id28F52D99E4FF420298D38945EE894495"><enum>(B)</enum><text>by striking <quote>100</quote> and inserting <quote>5</quote>; and</text></subparagraph><subparagraph id="id9D08BEC91163440AA30DF33FC30E5B18"><enum>(C)</enum><text>by inserting <quote>scheduled or unscheduled</quote> before <quote>analogue of</quote>; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id453C5ACB6E5E42E2A1ED71A154233AED"><enum>(2)</enum><text>in paragraph (2)(F)—</text><subparagraph id="idAD69B6F7BFFC4F7095897BD90B58ABC5"><enum>(A)</enum><text>by striking <quote>40</quote> and inserting <quote>2</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDC7B4362E8CE46FE9E47D2DAEB147B37"><enum>(B)</enum><text>by striking <quote>10</quote> and inserting <quote>0.5</quote>; and</text></subparagraph><subparagraph id="idE15BD65973F84D7386BC04C6754DE2DB"><enum>(C)</enum><text>by inserting <quote>scheduled or unscheduled</quote> before <quote>analogue of</quote>.</text></subparagraph></paragraph></section><section id="id02FA9184E5004D209105B2E00DF8B3A1"><enum>4.</enum><header>Directive to the Sentencing Commission</header><subsection id="id57D174EEE35D49A6B8430E5C9FBE97D1"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>Commission</term> means the United States Sentencing Commission.</text></subsection><subsection id="idB9F66FBE4B6B44E6A19C04B7C418D13B"><enum>(b)</enum><header>Directive to the United States Sentencing Commission</header><text>Pursuant to the authority of the Commission under section 994(p) of title 28, United States Code, and in accordance with this section, the Commission shall review and amend, if appropriate, the guidelines and policy statements of the Commission applicable to a person convicted of an offense under section 401 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841</external-xref>) or section 1010 of the Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/960">21 U.S.C. 960</external-xref>) to ensure that the guidelines and policy statements are consistent with the amendments made by sections 2 and 3 of this Act.</text></subsection><subsection id="id50524992F47C464B9B3B1B339413E02E"><enum>(c)</enum><header>Emergency authority</header><text>The Commission shall—</text><paragraph id="idf4ab4c513ebe436cafd53974591d5e59"><enum>(1)</enum><text>promulgate the guidelines, policy statements, or amendments provided for in this Act as soon as practicable, and in any event not later than 120 days after the date of enactment of this Act, in accordance with the procedure set forth in section 21(a) of the Sentencing Act of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/28/994">28 U.S.C. 994</external-xref> note), as though the authority under that Act had not expired; and</text></paragraph><paragraph id="idbced6e915aa5463698e7eec4c4d47309"><enum>(2)</enum><text>pursuant to the emergency authority provided under paragraph (1), make such conforming amendments to the Federal sentencing guidelines as the Commission determines necessary to achieve consistency with other guideline provisions and applicable law.</text></paragraph></subsection></section><section id="idC8A7318937AA4B72ABB84CFD60A111E1"><enum>5.</enum><header>Interdiction of fentanyl, other synthetic opioids, and other narcotics and psychoactive substances</header><subsection id="idD4326F1610C142F9A7CA04375DC50B64"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="HD2C7B61165FC44D3BF8908FC5637FCE2"><enum>(1)</enum><text>the term <term>chemical screening device</term> means an immunoassay, narcotics field test kit, infrared spectrophotometer, mass spectrometer, nuclear magnetic resonance spectrometer, Raman spec­tro­pho­to­me­ter, or other scientific instrumentation able to collect data that can be interpreted to determine the presence of fentanyl, other synthetic opioids, and other narcotics and psychoactive substances;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H138DBBC248B246A38D19C7C54BFCE227"><enum>(2)</enum><text>the term <term>express consignment operator or carrier</term> has the meaning given the term in section 128.1 of title 19, Code of Federal Regulations, or any successor thereto; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBD13FF585FA84E14ACCCE532CED5C4AC"><enum>(3)</enum><text>the term <term>Postmaster General</term> means the Postmaster General of the United States Postal Service.</text></paragraph></subsection><subsection id="H55B24C2853364F449DB67A7C3DB1D7B3"><enum>(b)</enum><header>Interdiction of fentanyl, other synthetic opioids, and other narcotics and psychoactive substances</header><paragraph id="HEEE70B90F9B347B39BE2A47B866ED491"><enum>(1)</enum><header>Chemical screening devices</header><text>The Postmaster General shall—</text><subparagraph id="H95C8818715BD45A6995D9DA62181EEED"><enum>(A)</enum><text>increase the number of chemical screening devices that are available to the United States Postal Service; and</text></subparagraph><subparagraph id="H5C4AB4C2365547FEA232C5E4D83DDD78"><enum>(B)</enum><text>make additional chemical screening devices available to the United States Postal Service as the Postmaster General determines are necessary to interdict fentanyl, other synthetic opioids, and other narcotics and psychoactive substances that are illegally imported into the United States, including such substances that are imported through the mail or by an express consignment operator or carrier.</text></subparagraph></paragraph><paragraph id="HEC64DCD22A5741DFB2E0BB5A2D64FDD3"><enum>(2)</enum><header>Personnel to interpret data</header><text>The Postmaster General shall dedicate the appropriate number of personnel of the United States Postal Service, including scientists, so that those personnel are available during all operational hours to interpret data collected by chemical screening devices.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF621715E8CDA414C9ADAB44C4AA20885"><enum>(c)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Postmaster General $9,000,000 to ensure that the United States Postal Service has resources, including chemical screening devices, personnel, and scientists, available during all operational hours to prevent, detect, and interdict the unlawful importation of fentanyl, other synthetic opioids, and other narcotics and psychoactive substances.</text></subsection></section></legis-body></bill>
