which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To identify social media entities under the influence of certain foreign entities and to take measures to protect the United States from such entities, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stopping Attempts by Foreign Entities to Target Youths on Social Media Act Act of 2023</short-title></quote> or the <quote><short-title>SAFETY on Social Media Act of 2023</short-title></quote>.</text></section><section id="id16669F53147D4A32A79E88703E5B9D5C"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id971c8a8fe0414cdcbc8d607925c54c83"><enum>(1)</enum><header>App</header><text>The term <term>app</term> means a software application or electronic service that may be run or directed by a user on a computer, a mobile device, or any other general purpose computing device.</text></paragraph><paragraph id="idc7a8861ae8724a5da55b8af64a062560"><enum>(2)</enum><header>App store</header><text>The term <term>app store</term> means a publicly available website, software application, or other electronic service that distributes apps from third-party developers to users of a computer, a mobile device, or any other general purpose computing device.</text></paragraph><paragraph id="idf0a9597603bc483ca5423ea821b9dff6"><enum>(3)</enum><header>Covered nation</header><text>The term <term>covered nation</term> has the meaning given that term in section 4872 of title 10, United States Code.</text></paragraph><paragraph id="id31ebe521d35a448fa99e345a6d2a3877"><enum>(4)</enum><header>Foreign entity of concern</header><text>The term <term>foreign entity of concern</term> means—</text><subparagraph id="id528fa594a94e424f98feae0d69f5751d"><enum>(A)</enum><text>the government, Armed Forces, or ruling party of a covered nation;</text></subparagraph><subparagraph id="id1cc3488c6b7246aa86988954979861e3"><enum>(B)</enum><text> any entity that is owned or controlled, directly or indirectly, by the government, Armed Forces, or ruling party of a covered nation;</text></subparagraph><subparagraph id="id6EEED86801744BBF809A7E8371EF9487"><enum>(C)</enum><text>any entity that is organized under the laws of, or otherwise subject to the jurisdiction of, the government of a covered nation; or </text></subparagraph><subparagraph id="idc773c25d19884d9185b60fc4a628a5aa"><enum>(D)</enum><text>any entity acting on behalf of an entity described in subparagraph (A), (B), or (C).</text></subparagraph></paragraph><paragraph id="id05230305c97f4671931e2b2fac49195b" commented="no"><enum>(5)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means any individual or entity that is not a United States person.</text></paragraph><paragraph id="id5F646F65B53948ECA02FA30E6BE93194" commented="no"><enum>(6)</enum><header>Social media entity</header><text>The term <term>social media entity</term> means any entity that—</text><subparagraph id="id04390f31fa5048b5aa58422dba5bc1f9" commented="no"><enum>(A)</enum><text>owns or operates, directly or indirectly, an app or website, the primary or sole purpose of which is not—</text><clause id="id774B00BFC0FB487A99F52A0C558B924A" commented="no"><enum>(i)</enum><text>to conduct commercial transactions;</text></clause><clause id="id1E7385AED3954F3DBB5748CF79B86056" commented="no"><enum>(ii)</enum><text>to make video games available for play by users;</text></clause><clause id="id0269D3616C57433D8461874D32FA2EDD" commented="no"><enum>(iii)</enum><text>to report news; or</text></clause><clause id="id2897078D1151417B9DC6053483E9021A" commented="no"><enum>(iv)</enum><text>to provide other kinds of information concerning businesses, products, or travel information; and</text></clause></subparagraph><subparagraph id="ida300930364b54db1a8e43a5e780428b0" commented="no"><enum>(B)</enum><text>allows users of the app or website to publish and distribute to the public or to other users text, images, videos, and other forms of media content.</text></subparagraph></paragraph><paragraph id="id17c5f1e293364885ae591353d96d2d68"><enum>(7)</enum><header>United states person</header><text>The term <term>United States person</term> means—</text><subparagraph id="id4895f72edb90441c99801925aeba9716"><enum>(A)</enum><text>a United States citizen or an alien lawfully admitted for permanent residence to the United States; or</text></subparagraph><subparagraph id="id5a2e5743974c49dda4b59f6a635bba48"><enum>(B)</enum><text>an entity organized under the laws of the United States or of any jurisdiction within the United States, including a foreign branch of such an entity.</text></subparagraph></paragraph></section><section id="id413613709d7349adb80611ecd13a41cb"><enum>3.</enum><header>List of untrustworthy applications and social media entities</header><subsection id="id3b2168c5fa8b4538b753917c39a7ea73"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, and annually thereafter, the President shall publish and submit to Congress a list of untrustworthy applications and social media entities (in this Act referred to as the <quote>List</quote>), which shall include all entities that meet the criteria described in subsection (b).</text></subsection><subsection id="id01e49130ef42438fbc4cec314cc0ccb6"><enum>(b)</enum><header>Criteria for list</header><text>The President shall include on the List any social media entity that—</text><paragraph id="id3f2ee601036341a6901370affa3f5735"><enum>(1)</enum><text>is a foreign person;</text></paragraph><paragraph id="id08ef95e569e64052a2cc3daab573e565"><enum>(2)</enum><text>owns or controls, is directly or indirectly owned or controlled by, or is under common ownership or control with a foreign entity of concern; </text></paragraph><paragraph id="id8d923362d3d0400cb111fbd08d9725ce"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idDBB2747002B64565958955A2ED65E6A6"><enum>(A)</enum><text>as a result of the influence of a foreign entity of concern—</text><clause id="idFB00DC6C884643B8B77CE14D7A1B491E" indent="up1"><enum>(i)</enum><text>has altered the content of an app or website owned or operated by the social media entity to comply with the request of, or to advance the interests of, a foreign entity of concern; or</text></clause><clause id="id1d58c8388dfb40b3a09e8accc3c11b52" indent="up1"><enum>(ii)</enum><text>has shared the data of United States persons with a foreign entity of concern; or</text></clause></subparagraph><subparagraph id="idb556da38e0b04bb7b9e2d5435d28f4c1" indent="up1"><enum>(B)</enum><text>may be compelled by a foreign entity of concern—</text><clause id="id642CA478AEC04F7BBEC2C9ABC79AD9F7"><enum>(i)</enum><text>to alter the content of an app or website owned or operated by the social media entity; or</text></clause><clause id="id59cf974d5231486782e460a79ae32aa6"><enum>(ii)</enum><text>to share the data of United States persons with a foreign entity of concern; and</text></clause></subparagraph></paragraph><paragraph id="idf2c70f34d64d46319044b9eac4916305"><enum>(4)</enum><text>had, in at least one month in the 12-month period preceding submission of the report, more than—</text><subparagraph commented="no" display-inline="no-display-inline" id="id51ebf40252c241a5bddbf0076ff01732"><enum>(A)</enum><text display-inline="yes-display-inline">1,000,000 active monthly users; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idad934b268202451c8e7279b708061de5"><enum>(B)</enum><text>1,000,000 downloads.</text></subparagraph></paragraph></subsection></section><section id="idebd15a16a6d24bfd8823170b5c624955"><enum>4.</enum><header>Blocking of property of listed entities</header><subsection id="id4fcc60d2f28344f5b5182a8b2c6b712f"><enum>(a)</enum><header>In general</header><text>Not later than 30 days after each publication of the List under section 3, the President shall exercise all of the powers granted to the President under the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) to the extent necessary to block and prohibit all transactions in property and interests in property of each entity on the List if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></subsection><subsection id="ided15b359c2d746e0a1dabae2f1600cf1"><enum>(b)</enum><header>Inapplicability of certain IEEPA provisions</header><text>For purposes of subsection (a), the following provisions of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) shall not apply:</text><paragraph id="id32481fc99a4241acb462cfd8fbcf4ccf"><enum>(1)</enum><text>The requirement under section 202(b) (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701(b)</external-xref>) to declare a national emergency.</text></paragraph><paragraph id="id99B9818E24D94FAEA0DC04074146D92E"><enum>(2)</enum><text>The exceptions under section 203(b) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1702">50 U.S.C. 1702(b)</external-xref>).</text></paragraph></subsection><subsection id="idce9325a7c60a47ad8815b8463ae1d228"><enum>(c)</enum><header>Implementation; penalties</header><paragraph id="idfa33ed587fc44d7baf1636620e4de46c"><enum>(1)</enum><header>Implementation</header><text>The President may exercise the authorities provided to the President under sections 203 and 205 of the International Emergency Economic Powers Act (50 U.S.C. 1702 and 1704) to the extent necessary to carry out this section.</text></paragraph><paragraph id="idef8cdde028164fd896fdef3ffe22feda"><enum>(2)</enum><header>Penalties</header><text>A person that violates, attempts to violate, conspires to violate, or causes a violation of subsection (a) or any regulation, license, or order issued to carry out that subsection shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act described in subsection (a) of that section. </text></paragraph></subsection></section><section id="idff0224c762234f0ab1e91ff5d873b1bd"><enum>5.</enum><header>Halting operations of listed entities</header><subsection id="id75ab0ab462b44bdcaef949c57e0ec6db"><enum>(a)</enum><header>Removal from app stores</header><text>After the first publication of the List under section 3 and not later than 1 year after the date of the enactment of this Act, the Federal Communications Commission (referred to in this section as the <term>Commission</term>) shall prescribe a rule prohibiting any entity that owns, controls, or operates an app store in the United States from carrying or supporting in the app store in the United States an app or website owned or operated by a social media entity that is on the List.</text></subsection><subsection id="id3e7843ea8a70473cb7e7115b19d19611"><enum>(b)</enum><header>Internet service providers</header><paragraph id="idF1684147FCEE422ABB6B3603073ED124"><enum>(1)</enum><header>In general</header><text>After the first publication of the List under section 3 and not later than 1 year after the date of the enactment of this Act, the Commission shall prescribe a rule requiring each internet service provider to ensure that the internet service of the provider cannot be used to access the website of any social media entity on the List.</text></paragraph><paragraph id="id5bfdf0128e41423591e5d863acf31fe8"><enum>(2)</enum><header>Liability protection</header><text>An internet service provider shall not be liable under the rule prescribed under paragraph (1) for access to the website of a social media entity on the List that is obtained through the use of a virtual private network.</text></paragraph></subsection><subsection id="id421BCC97A90F425BA1013EB369D8F1A6"><enum>(c)</enum><header>Enforcement</header><text>The Commission may impose a forfeiture penalty under section 503 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/503">47 U.S.C. 503</external-xref>) on any person who violates a rule prescribed under this section.</text></subsection><subsection id="id55e3610f92db4cdda02c53a6e8d6e2c5"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to give the Commission the authority to carry out any action under subsection (a) or (b) with respect to any entity that is not on the List. </text></subsection></section><section id="idD65FC2D7D47644D8BADAC4D8CD374CA3"><enum>6.</enum><header>Countermeasures against employees of listed entities</header><subsection id="idF805D778DEC04216ABE1A80DDB3DC972"><enum>(a)</enum><header>Visa ineligibility</header><text>Beginning on the date that is 30 days after an entity is first included on the List—</text><paragraph id="id41C5376E2471477C9F5DC574C4228206"><enum>(1)</enum><text>any foreign person employed by such entity on or after such date of first inclusion who is a national of a covered nation—</text><subparagraph id="id95D836F264E94CD29335C6378EE44D68"><enum>(A)</enum><text>shall be permanently ineligible to be issued or to retain a nonimmigrant visa under section 101(a)(15)(H)(i)(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(H)(i)(b)</external-xref>); and</text></subparagraph><subparagraph id="id8A7C82D7F6414195889553DA2E1EE670"><enum>(B)</enum><text>shall be ineligible to be issued or to retain any other visa authorizing entry into the United States until the date that is 3 years after the date on which—</text><clause id="id0554B65F1CCE4E95AF84950174BC8858"><enum>(i)</enum><text>such foreign person terminates his or her employment with such entity; or</text></clause><clause id="id37FEE32715414631A9B431BAF045AB7E"><enum>(ii)</enum><text>such entity is removed from the List; and </text></clause></subparagraph></paragraph><paragraph id="idc5be740cb2e44b4f8154c800ee833355"><enum>(2)</enum><text>any foreign person employed by such entity on or after such date of first inclusion who is not a national of a covered nation shall be ineligible to be issued or to retain any visa authorizing entry into the United States until the date that is 3 years after the date on which—</text><subparagraph id="idBFB67980A94549F98E459458897C2249"><enum>(A)</enum><text>such foreign person terminates his or her employment with such entity; or</text></subparagraph><subparagraph id="id5BB6E54D9B854611A5462BC1B5D428D5"><enum>(B)</enum><text>such entity is removed from the List. </text></subparagraph></paragraph></subsection><subsection id="id3b6a937a142b4a05b6d0115dd6c038bf"><enum>(b)</enum><header>Foreign agent registration required</header><paragraph id="id2DD4D32E6D624920B4F1811F273640AD"><enum>(1)</enum><header>Registration</header><text>Section 1(b) of the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611(b)</external-xref>) is amended—</text><subparagraph id="idAB9A6B484D194610BBD4DF2EF0309AD6"><enum>(A)</enum><text>in paragraph (2), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="idD0FC78EEC8D44F57A85C8913A6BBF731"><enum>(B)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="idFBD6A3FFF49640A68E23BD07FA61B363"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1110A6AC301F43FE85138C6A07003B14"><paragraph id="id2BD0D29F6B9D43B6A7E9BC12F398B6AE"><enum>(4)</enum><text>an entity on the list of untrustworthy applications and social media entities under section 3 of the <short-title>Stopping Attempts by Foreign Entities to Target Youths on Social Media Act Act of 2023</short-title>. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idD052DB2DB4234ACBBA51941B2EBB4129"><enum>(2)</enum><header>Cessation of employment</header><text>Section 2 of the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/612">22 U.S.C. 612</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id81BAF049B10E479C8590E7730A3A56B6"><subsection id="idD8E0241F2347417CBA077FF266CC7105"><enum>(e)</enum><header>Agents of entities listed in the Untrustworthy Applications and Social Media Entities List</header><text>Any individual who ceases employment as an agent of a foreign principal that is an entity on the list of untrustworthy applications and social media entities under section 3 of the <short-title>Stopping Attempts by Foreign Entities to Target Youths on Social Media Act Act of 2023</short-title> shall, during the 2-year period beginning on the date on which the individual ceases such employment with the foreign principal—</text><paragraph id="idA7849E1CB8E4445A9B10DEE74179F88A"><enum>(1)</enum><text>continue to register as an agent of a foreign principal; and</text></paragraph><paragraph id="idEC8018025663414CB64A2D0DBB4E5D01"><enum>(2)</enum><text>be subject to the penalties under section 8 of this Act.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
