<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 851</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230316">March 16, 2023</action-date><action-desc><sponsor name-id="S370">Mr. Booker</sponsor> (for himself and <cosponsor name-id="S253">Mr. Durbin</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To include a Federal defender as a nonvoting member of the United States Sentencing Commission.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sentencing Commission Improvements Act</short-title></quote>.</text></section><section id="id48d7ee4cf7664aeea459133f654ef7fd"><enum>2.</enum><header>Federal defender as a nonvoting member of the United States Sentencing Commission</header><subsection id="id05344b123c234eedad976377e5f40ecf"><enum>(a)</enum><header>In general</header><text>Section 991(a) of title 28, United States Code, is amended—</text><paragraph id="id86dddbde0ec9413cb16584009584b925"><enum>(1)</enum><text>in the first sentence, by striking <quote>one nonvoting member</quote> and inserting <quote>2 nonvoting members</quote>; and</text></paragraph><paragraph id="id60c7ecc27d1049ebb53d0472cb6668dd"><enum>(2)</enum><text>in the fifth sentence, by striking <quote>shall be an ex officio, nonvoting member</quote> and inserting <quote>and a Federal public defender, or a community defender, designated by the Defender Services Office of the Administrative Office of the United States Courts, shall be ex officio, nonvoting members</quote>.</text></paragraph></subsection><subsection id="id2fa0e09b11c94475a3518d572590ba00"><enum>(b)</enum><header>Conforming amendment</header><text>Section 235(b)(5) of the Sentencing Reform Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/18/3551">18 U.S.C. 3551</external-xref> note) is amended, in the third sentence, by striking <quote>nine members, including two</quote> and inserting <quote>10 members, including 3</quote>. </text></subsection></section></legis-body></bill>
