<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 844</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230316">March 16, 2023</action-date><action-desc><sponsor name-id="S309">Mr. Casey</sponsor> (for himself, <cosponsor name-id="S418">Mr. Fetterman</cosponsor>, and <cosponsor name-id="S307">Mr. Brown</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize the declaration of a hazardous train event, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Assistance for Local Heroes During Train Crises Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id10d7832c2c0844beb39f446eb229bcbe" section-type="subsequent-section"><enum>2.</enum><header>Hazardous train events</header><subsection commented="no" display-inline="no-display-inline" id="idca91e6d030fb4320b2cd044b7f1bbf51"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/209">Chapter 209</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id69461B2FB3304776B8AFA5DD317E7AD8"><section id="id20f76f66134e4644a247c06befb20e64"><enum>20904.</enum><header>Hazardous train events</header><subsection commented="no" display-inline="no-display-inline" id="idc24ee225a8a649658f95874acea7e3d0"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="ida6ffbda35778483a81b0f350dab349ad"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Federal Railroad Administration.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id172373ad04ae4a05afdfdaabc72c2ee3"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a State or local emergency response group, including a law enforcement agency, a fire department, and an emergency response agency, located in an area affected by a hazardous train event.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id53360da1aed844d6a3e6522e85744960"><enum>(3)</enum><header>Fund</header><text>The term <term>Fund</term> means the Hazardous Train Event Emergency Reimbursement Fund established under subsection (c).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id91bc120daf7c4e3e9dfb2cdeb766aba0"><enum>(4)</enum><header>Hazardous train event</header><text>The term <term>hazardous train event</term> means an train incident that the Administrator has declared to be a hazardous train event pursuant to subsection (b).</text></paragraph></subsection><subsection id="idedfbfa6c74c74d58928b1d7316cff174"><enum>(b)</enum><header>Declaration</header><paragraph commented="no" display-inline="no-display-inline" id="id191ad8e02f384745a96dd391bbadcc51"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Administrator, in consultation with the Administrator of the Federal Emergency Management Agency and the Administrator of the Environmental Protection Agency, may declare that a hazardous train event has occurred not later than 3 days after the occurrence of a train derailment, train crash, or other incident involving a train carrying hazardous materials, hazardous waste, or other materials that pose a threat to public health, safety, and the environment, as determined by the Administrator.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idabc9dbc631c94349b0413dc3a95ab812"><enum>(2)</enum><header>Effect of declaration</header><text>Upon a declaration pursuant to subsection (a), the Administrator shall immediately award at least $250,000 from the Fund to 1 or more eligible entities pursuant to subsection (d).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2b58995558ad4324b5cd67147da6ad56"><enum>(3)</enum><header>Additional funding award</header><text display-inline="yes-display-inline">Not later than 5 days after a declaration pursuant to subsection (a), the Administrator may award additional amounts to the initially awarded entities for further costs or other eligible entities from the Fund, not to exceed $3,000,000 per hazardous train event. Amounts awarded pursuant to this paragraph shall be allocated based on additional needs, as determined by the Administrator.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4ccbdac56f824a4cb6a80d42fc8d24fe"><enum>(c)</enum><header display-inline="yes-display-inline">Hazardous Train Event Emergency Reimbursement Fund</header><text display-inline="yes-display-inline">There is established within the Treasury of the United States a fund, which—</text><paragraph commented="no" display-inline="no-display-inline" id="idddfec8e4ec1e47fca39056dbcc1ee235"><enum>(1)</enum><text display-inline="yes-display-inline">shall be known as the <quote>Hazardous Train Event Emergency Reimbursement Fund</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id498272327cb843eda3e04d0bfe3df741"><enum>(2)</enum><text display-inline="yes-display-inline">shall be administered by the Administrator.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idccbf278c5da347c3b833c3e9864804f7"><enum>(d)</enum><header display-inline="yes-display-inline">Assistance for eligible entities</header><paragraph commented="no" display-inline="no-display-inline" id="idd0f5740407a44ea6aa8f3f7d137e2302"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Administrator may use amounts from the Fund to reimburse eligible entities, in accordance with subsection (b)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id00a93d675b6e44b0a32a456ab79fb59f"><enum>(A)</enum><text display-inline="yes-display-inline">for the cost of replacing equipment that is damaged, contaminated, or otherwise rendered unusable as a result of the response of the eligible entity to a hazardous train event;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcfbfc844339a4ea8be8bb6993ff0f60c"><enum>(B)</enum><text display-inline="yes-display-inline">for overtime pay for firefighters, law enforcement officers, or other emergency responders who work at the scene of a hazardous train event;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id91ba48e273974bffa9789fda1df223ce"><enum>(C)</enum><text display-inline="yes-display-inline">for operational costs for actions taken to respond to a hazardous train event;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb30c9a3f30f74a50b1128aeef94e8e95"><enum>(D)</enum><text display-inline="yes-display-inline">for any other purpose related to a hazardous train event, as determined by the Administrator; and</text></subparagraph><subparagraph id="id04b1f973beac4d1fa95c1a09027e1bb7"><enum>(E)</enum><text>to retroactively cover a cost described in any of subparagraphs (A) through (D) that is incurred after the date of a hazardous train event or within 30 days of the receipt of amounts under this subsection.</text></subparagraph></paragraph><paragraph id="id5106d9b5ef7240eba3accfac3aa007d1"><enum>(2)</enum><header>Documentation of costs</header><subparagraph commented="no" display-inline="no-display-inline" id="id53096532f21148b6ac2daa3e43592307"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 120 days after the date on which the Administrator declares a hazardous train event for which an eligible entity receives assistance under this subsection, the eligible entity shall submit documentation to the Administrator for each item for which such assistance is used through procurement or reimbursement. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1c4603de9a7c451c8eeb6ac3d4bff92e"><enum>(B)</enum><header>Reimbursement</header><text display-inline="yes-display-inline">If the Administrator determines that an eligible entity has used assistance received under this subsection in violation of this subsection, the eligible entity shall reimburse the Fund for the amount of such assistance. Reimbursements to the Fund shall be made eligible for future hazardous train events.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id5097a6b0973a4d04b10d0224fd46ee1b"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/209">chapter 209</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="id5fb14087-d4a7-4f90-ac85-af8381ba1629"><toc><toc-entry level="section" idref="id20f76f66134e4644a247c06befb20e64">20904. Hazardous train events.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="idd9a6e726df4f49719f0de218242960fa"><enum>3.</enum><header>Advance warning requirement</header><text display-inline="no-display-inline">The Secretary of Transportation, in consultation with the Administrator of the Transportation Security Administration, shall issue regulations requiring any railroad that transports hazardous materials by train through any community in the United States to provide county and local emergency response groups in such community, including police departments, fire departments, and emergency response agencies, with—</text><paragraph id="idc4eded6197844e6f9331b480e0dd77a5"><enum>(1)</enum><text>advance warning of such train’s load and timing; and</text></paragraph><paragraph id="id023f2e653901432cac79a262b4aa2969"><enum>(2)</enum><text>real-time location information on such a train when it enters and exits its service area the applicable service area.</text></paragraph></section><section id="id0999e0220e7440a1a1d39f903858f2b8"><enum>4.</enum><header>Hazardous materials emergency reimbursement fee</header><subsection commented="no" display-inline="no-display-inline" id="id8864beaee8d94b34b86cd5e8f872b1f5"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 5108(g) of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id563CF287D2CC4C7EB678FE78E653DD09"><paragraph id="idd37098dde9eb4888b542e1a78492d0f6"><enum>(4)</enum><header>Hazardous materials emergency reimbursement fee for shippers and carriers of hazardous material</header><subparagraph commented="no" display-inline="no-display-inline" id="id33ba8fe0272b4eb9830d9be04d5416d6"><enum>(A)</enum><header>Schedule of fees</header><text>The Secretary shall prescribe a schedule of annual fees for shippers and carriers of hazardous materials by rail that have total annual collections of not less than $10,000,000. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id06f703e754ce4388b113504ecbc60ab3"><enum>(B)</enum><header>Deposits into trust fund</header><text display-inline="yes-display-inline">Fees collected pursuant to subparagraph (A) shall be deposited into the Hazardous Train Event Emergency Reimbursement Fund established under section 20904.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="ide75752e2e7684363a597117d24c95302"><enum>(b)</enum><header>Deposits into trust fund</header><text>Amounts collected from shippers and carriers pursuant to section 5108(g)(4), United States Code, as added by subsection (a), shall be regularly deposited into the Hazardous Train Event Emergency Reimbursement Fund established under section 20904 of title 49, United States Code, as added by section 2.</text></subsection></section></legis-body></bill>
