<distribution-code display="yes">II</distribution-code><calendar>Calendar No. 142</calendar><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 843</legis-num><associated-doc role="report">[Report No. 118–68]</associated-doc><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230316">March 16, 2023</action-date><action-desc><sponsor name-id="S323">Mr. Risch</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Energy and Natural Resources</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20230719">July 19, 2023</action-date><action-desc>Reported by <sponsor name-id="S338">Mr. Manchin</sponsor>, without amendment</action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Infrastructure Investment and Jobs Act to authorize the use of funds for certain additional Carey Act projects, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id6a2802f67e16401f98e624216a4f8c6b"><enum>1.</enum><header>Eligibility under the Infrastructure Investment and Jobs Act of additional Carey Act projects for certain funds</header><text display-inline="no-display-inline">Section 40904(b) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/43/3204">43 U.S.C. 3204(b)</external-xref>) is amended—</text><paragraph id="id844A07D3B917469BAEE6CA7616EA597E"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3), by redesignating subparagraphs (A) through (C) as clauses (i) through (iii), respectively, and indenting appropriately;</text></paragraph><paragraph id="id8BF93BAB0EB6471DB2E8CDFFBEC4AAEE"><enum>(2)</enum><text>by redesignating paragraphs (1) through (4) as subparagraphs (A) through (D), respectively, and indenting appropriately;</text></paragraph><paragraph id="idFEF98C53952B4FCBB035EF5A8F5F6CF0"><enum>(3)</enum><text>in the matter preceding subparagraph (A) (as so redesignated), by striking <quote>The Secretary</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2E65A386A4BC423BA1116F4561CB13B7"><paragraph id="idD4E48923DDB748A1815FD4B29E68CD98"><enum>(1)</enum><header>In general</header><text>The Secretary</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id339BFFCC7C0F4ECF93CD231AAE438446"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEB6804FB81594AD9A2F05D4F5903151E"><paragraph id="id060692302F064A3DA2AC013F408562E3"><enum>(2)</enum><header>Additional projects</header><subparagraph id="id2B65C260B7674BCDB0DD2F7EED970CE2"><enum>(A)</enum><header>In general</header><text>On making the affirmative determinations described in subparagraph (B), the Secretary shall use amounts made available under section 40901(2)(B) to fund the rehabilitation, reconstruction, or replacement of any dams that were developed pursuant to, and continue to operate as dams under, section 4 of the Act of August 18, 1894 (commonly known as the <quote>Carey Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/43/641">43 U.S.C. 641</external-xref>; 28 Stat. 422, chapter 301).</text></subparagraph><subparagraph id="id8108D659D20B47DDB36C4F96A67D8664"><enum>(B)</enum><header>Determinations described</header><text>The determinations referred to in subparagraph (A) are—</text><clause id="id816BB902DAC84E61A760FD555AD3C2DA"><enum>(i)</enum><text>a determination by the Secretary that any dams that meet the criteria described in paragraph (1) have received the necessary funding to complete rehabilitation, reconstruction, or replacement activities under this subsection; and</text></clause><clause id="id9FC86DF6916A432089DABA2D233E29B9"><enum>(ii)</enum><text>a determination by the Secretary that amounts made available under section 40901(2)(B) remain available.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body><endorsement><action-date date="20230719">July 19, 2023</action-date><action-desc>Reported without amendment</action-desc></endorsement></bill>
