<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 813</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230315">March 15, 2023</action-date><action-desc><sponsor name-id="S409">Mr. Luján</sponsor> (for himself and <cosponsor name-id="S376">Ms. Ernst</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Secretary of Agriculture to amend regulations to allow for certain packers to have an interest in market agencies, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H4AC00419FC8040A88DCB392178D21716"><section section-type="section-one" id="HD60B23542B694AB8B82E37AA303AE80A"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expanding Local Meat Processing Act of 2023</short-title></quote>.</text></section><section id="H749CCA38230E4554B0ED667B1264AA96"><enum>2.</enum><header>Allowed interest of certain packers in market agencies</header><subsection id="idBDDB0B277492473B95F0A290B0AC74D9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Agriculture shall revise section 201.67 of title 9, Code of Federal Regulations (as in effect on the date of enactment of this Act), to exempt the packers described in subsection (b) from the prohibition described in that section.</text></subsection><subsection id="idD771249FDFA042B694522E68B9621868"><enum>(b)</enum><header>Packers described</header><text>A packer referred to in subsection (a) is a packer that—</text><paragraph id="idD344E1B9A66949ED8C4862E5E238895F"><enum>(1)</enum><text>with respect to cattle or sheep, has a cumulative slaughter capacity of less than—</text><subparagraph id="idCBDAB9003054427B91AC89B8620C495E"><enum>(A)</enum><text>2,000 animals per day; or</text></subparagraph><subparagraph id="idFBCBE8437AAA4BE49BED05B2FD7C818D"><enum>(B)</enum><text>700,000 animals per year; and</text></subparagraph></paragraph><paragraph id="id0919183DD54F44DEB97827A28A792976"><enum>(2)</enum><text>with respect to hogs, has a cumulative slaughter capacity of less than—</text><subparagraph id="id8B9E186116374246B102DEA9B9978922"><enum>(A)</enum><text>10,000 animals per day; or </text></subparagraph><subparagraph id="id16788B3851CE4A7BAB069FC8880E081A"><enum>(B)</enum><text>3,000,000 animals per year.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
