<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 809</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230315">March 15, 2023</action-date><action-desc><sponsor name-id="S381">Mr. Rounds</sponsor> (for himself, <cosponsor name-id="S404">Mr. Scott of Florida</cosponsor>, <cosponsor name-id="S395">Mrs. Hyde-Smith</cosponsor>, and <cosponsor name-id="S410">Ms. Lummis</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To transfer funds for Energy Efficiency Improvements and Renewable Energy Improvements at Public School Facilities to the Attorney General to award grants to States to promote safety and security in schools.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Security to Avoid Violence in Educational Settings Act </short-title></quote> or the <quote>SAVES Act</quote>.</text></section><section id="idF12F9BAB133D4DDCA783FBA8BBFC196A"><enum>2.</enum><header>Grant program for States for school safety and security</header><subsection id="id30390252AFC3436899730C868CED64E8"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id5B7AD966FB4E4EE980CD6DE865D8DA53"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="idCF280EFC6E1040B5AE9E12D7C1A5737C"><enum>(A)</enum><text>a local educational agency, as defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>);</text></subparagraph><subparagraph id="id552DE547DB784008B5AAE24FD95A2CB1"><enum>(B)</enum><text>an Indian Tribe or Tribal organization, as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>); or </text></subparagraph><subparagraph id="id80B9F02B5EB8488D98DE6CE6568AF1AD"><enum>(C)</enum><text>an elementary school or secondary school, as such terms are defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7BE8770E0FC44E0190154D8A0146FF1D"><enum>(2)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of the 50 States, the District of Columbia, and the Commonwealth of Puerto Rico.</text></paragraph></subsection><subsection id="id4244098B96254449AEC87E922B51EE22"><enum>(b)</enum><header>Transfer of funds</header><text>The amount appropriated for Energy Efficiency Improvements and Renewable Energy Improvements at Public School Facilities, as authorized under section 40541 of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18831">42 U.S.C. 18831</external-xref>), under the Infrastructure Investments and Jobs Appropriations Act (division B of <external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>) is transferred to the Attorney General to carry out subsection (c).</text></subsection><subsection id="id213E092832EB43649B3538857F26C21A"><enum>(c)</enum><header>Grant program for states for school safety and security</header><paragraph id="id3D72C1C763854D189666B8F8F5454C02"><enum>(1)</enum><header>In general</header><text>The Attorney General shall use the amount transferred under subsection (b) to award grants to States from allotments under paragraph (2) for each of fiscal years 2023 through 2027. From the amount transferred, $100,000,000 shall be available to be allotted for each fiscal year. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H858A739BBCFB4EB690F9C897111409CA"><enum>(2)</enum><header display-inline="yes-display-inline">State allotments</header><subparagraph commented="no" display-inline="no-display-inline" id="H4021AF45888C4850B74EF8CE9262EBA0"><enum>(A)</enum><header display-inline="yes-display-inline">Allotment</header><clause commented="no" display-inline="no-display-inline" id="H2792525B578D401DA326CD8D20F3AE6E"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to clauses (ii) and (iii), from the amount available to be allotted for a fiscal year under paragraph (1), the Attorney General shall allot to each State for the fiscal year an amount that bears the same relationship to the amount available as the number of individuals residing in the State who are aged 5 through 17, bears to the number of such individuals residing in all States.</text></clause><clause commented="no" display-inline="no-display-inline" id="H3829645F4EB24CF6BBE8764FD64D0EDD"><enum>(ii)</enum><header display-inline="yes-display-inline">Small state minimum</header><text display-inline="yes-display-inline">No State receiving an allotment under this subparagraph for a fiscal year shall receive less than 0.75 percent of the total amount allotted under this subparagraph for the fiscal year.</text></clause><clause commented="no" display-inline="no-display-inline" id="HD3EC53B936814E42BDD7CB4CE03376FB"><enum>(iii)</enum><header display-inline="yes-display-inline">Puerto rico</header><text display-inline="yes-display-inline">The amount allotted under this subparagraph to the Commonwealth of Puerto Rico for a fiscal year may not exceed 0.75 percent of the total amount allotted under this subparagraph for the fiscal year.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5DC4BD707469401687F999A99E9BD4E4"><enum>(B)</enum><header display-inline="yes-display-inline">Reallotment</header><text display-inline="yes-display-inline">If a State does not receive an allotment under this paragraph for a fiscal year, the Attorney General shall reallot the amount of the State’s allotment to the remaining States for the fiscal year in accordance with this paragraph.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF402C4E04B4545C8B3513103759EC9BD"><enum>(3)</enum><header display-inline="yes-display-inline">Use of allotment</header><text display-inline="yes-display-inline">Each State that receives an allotment under paragraph (2) for a fiscal year shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="H762F3B104662439596DB5BCEEACDEE0D"><enum>(A)</enum><text display-inline="yes-display-inline">reserve not less than 95 percent of the allotment to make subgrants to eligible entities under paragraph (4);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H50EDFCDC39F34F04B4AF03A4D4FF2F25"><enum>(B)</enum><text display-inline="yes-display-inline">reserve not more than 1 percent of the allotment for the administrative costs of carrying out its responsibilities under this section, including public reporting on how funds made available under this section are being expended by eligible entities; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9DEBB1A37E2A45EF987A0A66BC5D9B5D"><enum>(C)</enum><text display-inline="yes-display-inline">use the amount made available to the State and not reserved under subparagraphs (A) and (B) for activities designed to support eligible entities in identifying, planning, and implementing school security improvements. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE30B6CC764F34FA8BFE2C5892232DAEF"><enum>(4)</enum><header>Subgrants to eligible entities</header><subparagraph commented="no" display-inline="no-display-inline" id="idFE1F1957E23C490DA465BBD0B457C4FA"><enum>(A)</enum><header>In general</header><text>Each State that receives an allotment under paragraph (2) shall award subgrants to eligible entities to support the eligible entities in identifying, planning, and implementing school security improvements. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE72B627EF75F486BAF5BEC88AC40F742"><enum>(B)</enum><header>Applications</header><text>An eligible entity that desires to receive a subgrant grant under this paragraph shall submit an application to the State at such time, in such manner, and accompanied by such information as the State may require.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id096CD53113444D65A8E39B92E8536877"><enum>(C)</enum><header>Use of subgrant funds</header><text>An eligible entity that receives a subgrant under this paragraph shall use the subgrant funds, subject to any rules established by the State, for the purpose of planning and designing school buildings and facilities, installing infrastructure, and implementing technology or other measures, that strengthen security on school premises, which may include—</text><clause commented="no" display-inline="no-display-inline" id="id5D69B92F42234BC493FD62DE3CC7618A"><enum>(i)</enum><text>controlling access to school premises or facilities, through the use of metal detectors, or other measures, or technology, with evidence-based effectiveness (to the extent the State involved determines that such evidence is reasonably available), in accordance with the needs of the school;</text></clause><clause commented="no" display-inline="no-display-inline" id="id68438C5280574DE491D79D1A2E4E0525"><enum>(ii)</enum><text>implementing any technology or measure, or installing any infrastructure, to cover and conceal students within the school during crisis situations;</text></clause><clause commented="no" display-inline="no-display-inline" id="id4C9134A129B24C24AF4AD16500A6E870"><enum>(iii)</enum><text>implementing technology to provide notification to relevant law enforcement and first responders during crisis situations;</text></clause><clause commented="no" display-inline="no-display-inline" id="id80377DF730A846FB8B8BC664FC447DD2"><enum>(iv)</enum><text>implementing any technology or measure, including hiring school security officers, or installing any infrastructure, with evidence-based effectiveness (to the extent the State involved determines that such evidence is reasonably available) to increase the safety of school students and staff;</text></clause><clause commented="no" display-inline="no-display-inline" id="idc3291ad6ee6a4208b948a70edf5506cd"><enum>(v)</enum><text>implementing any digital content monitoring technology to assist in the monitoring of communication on school-provided platforms, as long as the system does not transmit data outside of the United States and uses human review instead of automated alerts to increase safety of school students and staff; </text></clause><clause commented="no" display-inline="no-display-inline" id="idB847306F9144424EBED8183727348AD4"><enum>(vi)</enum><text>implementing any technology or measure, or installing any infrastructure, for school safety reinforcement, including bullet-resistant doors and windows; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id6E41D891310F4E369EF4A22FB7272FA1"><enum>(vii)</enum><text>implementing any technology or system that would reduce the time needed to disseminate official information to parents regarding the safety of their children during and immediately following a crisis. </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7981C3D761EF4FBB816C90549CC41F0A"><enum>(D)</enum><header>Restriction on DOJ</header><text>The Attorney General may not promulgate a rule that restricts a State's ability to determine the eligible uses of subgrant funds awarded under this paragraph.</text></subparagraph></paragraph><paragraph id="id9ab84857413e43048b4115c5c8626bbf"><enum>(5)</enum><header>Matching requirements</header><subparagraph id="id00D6BED57CD74A009E0B8AF43D5B781A"><enum>(A)</enum><header>State match</header><text>Each State that receives a grant under this section shall provide non-Federal matching funds equal to 20 percent of the amount of the grant toward the cost of carrying out the activities described in this section.</text></subparagraph><subparagraph id="idEE6425CA7398473D96DCBC9CE9CAA193"><enum>(B)</enum><header>Eligible entity match</header><clause id="idFFA8DD351AF94656B23A6D3452B73820"><enum>(i)</enum><header>In general</header><text>Each eligible entity that receives a subgrant under this section shall provide matching funds, in cash or through in-kind contributions, from Federal, State, local, or private sources in an amount equal to 5 percent of the amount of the subgrant toward the cost of carrying out the activities described in this section.</text></clause><clause id="idEF852F0AB06C4640859701AD0F400D7A"><enum>(ii)</enum><header>Waiver</header><subclause id="idD354E64CACAF4015AC516333F06B8DE9"><enum>(I)</enum><header>In general</header><text>A State may waive the matching funds requirement under clause (i), on a case-by-case basis, upon a showing of exceptional circumstances, such as—</text><item id="id417a75db9fe74491aa20e2fc06cd81ae"><enum>(aa)</enum><text>the difficulty of raising matching funds for a program to serve a rural area;</text></item><item id="idf8b6b217b61243e8a43e3047a772cf66"><enum>(bb)</enum><text>the difficulty of raising matching funds in areas with a concentration of local educational agencies or schools with a high percentage of students aged 5 through 17—</text><subitem id="id9297e987136c42cbba997602b6b3b959"><enum>(AA)</enum><text>who are in poverty, as counted in the most recent census data approved by the Attorney General;</text></subitem><subitem id="idaad07a95c98e48ab9a137f317d5d971c"><enum>(BB)</enum><text>who are eligible for a free or reduced price lunch under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>);</text></subitem><subitem id="idb369991e3bde459d919a16dd64c78295"><enum>(CC)</enum><text>whose families receive assistance under the State program funded under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>); or</text></subitem><subitem id="idfe71dd65f0ed4d0f86d58c3efe81f44d"><enum>(DD)</enum><text>who are eligible to receive medical assistance under the Medicaid program; and</text></subitem></item><item id="id9fde5120848f4364970088ba4a9106d2"><enum>(cc)</enum><text>the difficulty of raising funds on tribal land.</text></item></subclause><subclause id="idBD9CB698D9EF4C97A25DE79DCD95BEB7"><enum>(II)</enum><header>State to cover eligible entity match</header><text>A State that waives the matching funds requirement under clause (i), shall provide the amount waived in addition to the State match required under subparagraph (A). </text></subclause></clause><clause id="id7deef0506bec4c81be715d6f66a004a3"><enum>(iii)</enum><header>Consideration</header><text>A State shall not consider an eligible entity's ability to match funds when determining which eligible entity will receive subgrants under this section. </text></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
