which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Healthy Forests Restoration Act of 2003 to require the Secretary of Agriculture to expedite hazardous fuel or insect and disease risk reduction projects on certain National Forest System land, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expediting Forest Restoration and Recovery Act of 2023</short-title></quote>.</text></section><section id="id7E804E8B55C0401F89E01821CBDDC8A1"><enum>2.</enum><header>Application by Forest Service of authorities to expedite environmental analyses in carrying out hazardous fuel and insect and disease risk reduction projects</header><text display-inline="no-display-inline">Section 104 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6514">16 U.S.C. 6514</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idED8FE589BC334A6C92B249299117ECE2"><subsection id="id8F726342A5D64E0CB8B15FB551233FDE"><enum>(i)</enum><header>Application by Forest Service of authorities To expedite environmental analyses in carrying out hazardous fuel and insect and disease risk reduction projects</header><paragraph id="id03ABCA9B9BDA42218A7A5412A767C702"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id60D18146234B4A2589F2B7898E681CA0"><enum>(A)</enum><header>Insect and disease treatment area</header><text>The term <term>insect and disease treatment area</term> means an area that—</text><clause id="idFEE4D5266640449DBFA0C0BFE01088B3"><enum>(i)</enum><text>is designated by the Secretary as an insect and disease treatment area under this title; or</text></clause><clause id="idAD833D3C273141C0962563E75F2CF2D5"><enum>(ii)</enum><text>is designated as at risk or a hazard on the most recent National Insect and Disease Risk Map published by the Forest Service.</text></clause></subparagraph><subparagraph id="id331E0010608144538595411BE4A72DFE"><enum>(B)</enum><header>Secretary</header><text>The term <term>Secretary</term> has the meaning given the term in section 101(14)(A).</text></subparagraph></paragraph><paragraph id="id8BB0F93DAB044A089284CFBB2F40015E"><enum>(2)</enum><header>Use of authorities</header><text>In carrying out a hazardous fuel or insect and disease risk reduction project in an insect and disease treatment area authorized under this Act, the Secretary shall—</text><subparagraph id="id03029b24bb8f498aba839e5505beeade"><enum>(A)</enum><text>apply the categorical exclusion established by section 603 in the case of a hazardous fuel or insect and disease risk reduction project carried out in an area—</text><clause id="id6C9EC30343C14AA092A2756467B57BCD"><enum>(i)</enum><text>designated as suitable for timber production within the applicable forest plan; or</text></clause><clause id="idFF06DEC7F6E2401E8E6D5BD90471533F"><enum>(ii)</enum><text>where timber harvest activities are not prohibited;</text></clause></subparagraph><subparagraph id="id6ccd71fedfe84b9f888a57bb9eea02e1"><enum>(B)</enum><text>conduct applicable environmental assessments and environmental impact statements in accordance with this section in the case of a hazardous fuel or insect and disease risk reduction project—</text><clause id="idA596F7500DD54655BEFD44FE730E8956"><enum>(i)</enum><text>carried out in an area—</text><subclause id="idFADC92C239DF4C55BE17454E78D782AC"><enum>(I)</enum><text>outside of an area described in subparagraph (A); or </text></subclause><subclause id="idD132DE9356E64ADEBAB137B3B026A2CF"><enum>(II)</enum><text>where other significant resource concerns exist, as determined exclusively by the Secretary; or</text></subclause></clause><clause id="id7D6A7F2B65F84580B48805A00CCDA8A9"><enum>(ii)</enum><text>that is carried out in an area equivalent to not less than a hydrologic unit code 5 watershed, as defined by the United States Geological Survey; and</text></clause></subparagraph><subparagraph id="id61231f648f4442889e11933d76c08c3c"><enum>(C)</enum><text>notwithstanding subsection (d), in the case of any other hazardous fuel or insect and disease risk reduction project, in the environmental assessment or environmental impact statement prepared under subsection (b), study, develop, and describe—</text><clause id="ID8DBCCE8C66DE4ED380AC22B1F824ECDB"><enum>(i)</enum><text>the proposed agency action; and</text></clause><clause id="ID46DECDC6443242BC98BED739CD84F36D"><enum>(ii)</enum><text>the alternative of no action.</text></clause></subparagraph></paragraph><paragraph id="id5519bcc7df4e493083b3e46bb26e0112"><enum>(3)</enum><header>Priority for reducing risks of insect infestation and wildfire</header><text>Except where established as a mandatory standard that constrains project and activity decision making in a resource management plan (as defined in section 101(13)(A)) in effect on the date of enactment of this Act, in the case of an insect and disease treatment area, the Secretary shall prioritize reducing the risks of insect and disease infestation and wildfire over other planning objectives.</text></paragraph><paragraph id="id032D3A58A9CF4D7F9620B1E6DE64AFE4"><enum>(4)</enum><header>Inclusion of Fire Regime Group IV</header><text>Notwithstanding section 603(c)(2)(B), the Secretary shall apply the categorical exclusion described in paragraph (2)(A) to areas in Fire Regime Group IV.</text></paragraph><paragraph id="id7df500fe2bd748aab01bc6574f4c9c04"><enum>(5)</enum><header>Excluded areas</header><text>This subsection shall not apply to—</text><subparagraph id="id9c7fd163af0a44b5a50e1db69601154d"><enum>(A)</enum><text>a component of the National Wilderness Preservation System; or</text></subparagraph><subparagraph id="id227ab42f443443a28eb390e1c44a0640"><enum>(B)</enum><text>an inventoried roadless area, except in the case of an activity that is permitted under—</text><clause id="idBC515DB22F9444D6AE57BB6C769C08F1"><enum>(i)</enum><text>the final rule of the Secretary entitled <quote>Special Areas; Roadless Area Conservation</quote> (66 Fed. Reg. 3244 (January 12, 2001)); or</text></clause><clause id="id0CD50D34F88C4B7E8B0347C542BE8272"><enum>(ii)</enum><text>a State-specific roadless area conservation rule.</text></clause></subparagraph></paragraph><paragraph id="id49C04487130A42938BF5A04884849295"><enum>(6)</enum><header>Reports</header><text>The Secretary shall annually make publicly available data describing the acreage treated under hazardous fuel or insect and disease risk reduction projects in insect and disease treatment areas during the previous year.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idc4cdcc943da344289eb1168c3811202b"><enum>3.</enum><header>Good neighbor authority</header><text display-inline="no-display-inline">Section 8206(b)(2) of the Agricultural Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/16/2113a">16 U.S.C. 2113a(b)(2)</external-xref>) is amended by striking subparagraph (C) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9c2066ead0ae448a9d040ab978fd6ea8"><subparagraph id="idd4f87ab544984073a5264ba63a604f79"><enum>(C)</enum><header>Treatment of revenue</header><text>Funds received from the sale of timber by a Governor of a State under a good neighbor agreement shall be retained and used by the Governor—</text><clause id="idfbcfa06f2e6f4d799314ca5cf3a2ca57"><enum>(i)</enum><text>to carry out authorized restoration services under that good neighbor agreement; and</text></clause><clause id="ida1f6b674227049f19e3136bcf68b9021"><enum>(ii)</enum><text>if funds remain after carrying out authorized restoration services under clause (i), to carry out authorized restoration services within the State under other good neighbor agreements.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
