which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Insecticide, Fungicide, and Rodenticide Act to provide for a consistent definition for plant biostimulants.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H3C4D329EFB2A434B9B511D062E1BFDA1"><section section-type="section-one" id="HE1330296089E42A1AC73889B40EBA086"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Plant Biostimulant Act of 2023</short-title></quote>.</text></section><section id="H129A2F86112B487BA3D7295F4028E27C"><enum>2.</enum><header>Exclusion from regulation under FIFRA</header><subsection id="HEC430FBF5808471F95C9D9D4A71D3F00"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Federal Insecticide, Fungicide, and Rodenticide Act (<external-xref legal-doc="usc" parsable-cite="usc/7/136">7 U.S.C. 136 et seq.</external-xref>) is amended by inserting after section 3 (<external-xref legal-doc="usc" parsable-cite="usc/7/136a">7 U.S.C. 136a</external-xref>) the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H829822EBBF7E40E9BC4529DD2626A8D3"><section id="HF6DC6DD3E1204820ADF19A24EE184FC7"><enum>3A.</enum><header>Exclusion of plant biostimulants</header><text display-inline="no-display-inline">A plant biostimulant shall not be subject to regulation under this Act.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HEDE11D99D8B04DD1B17AF56249D969FD"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 2 of the Federal Insecticide, Fungicide, and Rodenticide Act (<external-xref legal-doc="usc" parsable-cite="usc/7/136">7 U.S.C. 136</external-xref>) is amended—</text><paragraph id="HCA8BA4FE961F42C784546002C1D876A8"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (v)—</text><subparagraph id="HAF9FA6FBB7374C089E046FC3C06728CB"><enum>(A)</enum><text>by striking <quote>vitamin-hormone horticultural products</quote> and inserting <quote>vitamin hormone products</quote>; and </text></subparagraph><subparagraph id="H9174F281DB5C41B2AB107724A197D6E1"><enum>(B)</enum><text>by adding at the end the following: <quote>Such term shall not include a plant biostimulant.</quote>; and</text></subparagraph></paragraph><paragraph id="HE04CB9F13FE94F4BB82F7D5712F58ECF"><enum>(2)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="HCFC88D6CD8814C49A3D0B46ADC9EBD93"><subsection id="H70EDFA7F375F45C381B2DBB22BC915C4"><enum>(pp)</enum><header>Plant biostimulant</header><text display-inline="yes-display-inline">The term <term>plant biostimulant</term> means a substance, micro-organism, or mixture thereof, that, when applied to seeds, plants, the rhizosphere, soil, or other growth media, act to support a plant’s natural processes independently of the biostimulant’s nutrient content, thereby improving nutrient availability, uptake or use efficiency, tolerance to abiotic stress, and consequent growth, development, quality, or yield.</text></subsection><subsection id="H4384A8BB067243E89A713E99045A0ACA"><enum>(qq)</enum><header>Nutritional chemical</header><text display-inline="yes-display-inline">The term <term>nutritional chemical</term>—</text><paragraph id="HA75777E063504DE6A36BC4015B47846C"><enum>(1)</enum><text>means a compound or mixture that interacts with plant nutrients in a manner which improves nutrient availability or aids the plant in acquiring or utilizing plant nutrients; and</text></paragraph><paragraph id="HBF54F0D1436A4636A175BBAEDD486E44"><enum>(2)</enum><text>includes some plant biostimulants.</text></paragraph></subsection><subsection id="H1D33BFEDD0A1477090A83E0886CE3372"><enum>(rr)</enum><header>Vitamin hormone product</header><text display-inline="yes-display-inline">The term <term>vitamin hormone product</term> means a product consisting of a mixture of plant hormones, plant nutrients, inoculants, or soil amendments.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H206FAF9DE6DF4BED8FB66E805BA4EAEA"><enum>(c)</enum><header>Regulations</header><text>Not later than 120 days after the date of the enactment of this Act, the Administrator of Environmental Protection Agency shall revise the regulations under subchapter E of chapter I of title 40, Code of Federal Regulations (as in effect on the date of the enactment of this Act) to carry out the amendments made by subsections (a) and (b). </text></subsection></section><section id="HA33DFAF8E80B4BCA9F5754CA4BDFE405"><enum>3.</enum><header>Soil health study</header><subsection id="H9C1DB87C821E4107BC3B7B1008753388"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall conduct a study to assess the types of, and practices using, plant biostimulants (as defined in section 2 of the Federal Insecticide, Fungicide, and Rodenticide Act (<external-xref legal-doc="usc" parsable-cite="usc/7/136">7 U.S.C. 136</external-xref>)) that best achieve the following:</text><paragraph id="HA1E2E622D0A342A880B31994B26AB946"><enum>(1)</enum><text>Increasing organic matter content.</text></paragraph><paragraph id="H969242BF2DD7442D987478F14DDDE7A2"><enum>(2)</enum><text>Reducing atmospheric volatilization.</text></paragraph><paragraph id="H96125CA976A545D2B1B3C8C0B1D072E3"><enum>(3)</enum><text>Promotion of nutrient management practices.</text></paragraph><paragraph id="H4B6387D62EFA452F912031399B3A460F"><enum>(4)</enum><text>Limiting or eliminating runoff or leaching of soil or nutrients such as phosphorus and nitrogen into groundwater or other water sources.</text></paragraph><paragraph id="H6B9CC35A95DA492CB3CE55528EDB4D89"><enum>(5)</enum><text>Restoring beneficial bioactivity or healthy nutrients to the soil.</text></paragraph><paragraph id="H086D044D6AF246B9A3F39007B8D83827"><enum>(6)</enum><text>Aiding in carbon sequestration, nutrient use efficiency, and other climate-related benefits.</text></paragraph><paragraph id="HC33E74BF30504D5CA09CDC222C812F77"><enum>(7)</enum><text>Supporting innovative approaches to improving agricultural sustainability, including the adoption of performance-based outcome standards and criteria.</text></paragraph></subsection><subsection id="H9F597E66924F45DAB8C2CD546C5FF02C"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date on which funds are first made available for the study under subsection (a), the Secretary shall make publicly available and submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report that describes the results of the study.</text></subsection></section></legis-body></bill>
