which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 54, United States Code, to authorize the Secretary of the Interior to make financial assistance to States under the Land and Water Conservation Fund available for water quality projects, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Land and Water Conservation Fund Water Amendments Act of 2023</short-title></quote>.</text></section><section id="id8116e43eeac44bf48f3f59b0d372b262"><enum>2.</enum><header>Financial assistance to States for water quality projects</header><text display-inline="no-display-inline">Section 200305 of title 54, United States Code, is amended—</text><paragraph id="idF3501FC7910F4F13BE5576F1AFB033BC"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), in the second sentence, by inserting <quote>and water quality improvement</quote> after <quote>outdoor recreation</quote>;</text></paragraph><paragraph id="id44004C69134A429F832D2B121EA7E696"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2B0E9DB9544C465FA78802728C2B93EA"><paragraph id="id1BFC3DA8071440398A1769143FE7F163"><enum>(5)</enum><header>Water quality</header><text display-inline="yes-display-inline">A comprehensive statewide outdoor recreation plan shall identify—</text><subparagraph id="id95041833A33648B3820C6E14AAE2BA9B"><enum>(A)</enum><text display-inline="yes-display-inline">any body of water within the boundaries of the State for which a State water quality control plan has been developed pursuant to section 303(d) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1313">33 U.S.C. 1313(d)</external-xref>); and</text></subparagraph><subparagraph id="id3BFB33CE74A2489F9F8459E8F93038A3"><enum>(B)</enum><text display-inline="yes-display-inline">any proposed water quality project (as defined in subsection (e)(4)(A)) to be conducted with respect to a body of water that is identified under subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id2D260ED8080B417AABE39BCC0425FCC7"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (e)—</text><subparagraph id="id745CB01296B14DDAA5641AEEF2D6CEB3"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text level="subsection" style="OLC">and development of basic outdoor recreation facilities</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">, development of basic outdoor recreation facilities, and conduct of water quality projects</header-in-text></quote>;</text></subparagraph><subparagraph id="idF651122D953741F88996F1FE14DE6049"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>and (3)</quote> and inserting <quote>, (3), and (4)</quote>; and</text></subparagraph><subparagraph id="id0298707388814BBF8E0E3947BC9CA531"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id25fd8750c3bf4efab996e9200eed7d42"><paragraph id="idaeadad34ef30478c818c922e5e1330e2"><enum>(4)</enum><header>Water quality projects</header><subparagraph id="id95B2F3D29A6A4E00B2107ECE388B8FDC"><enum>(A)</enum><header>Definition of water quality project</header><text>In this paragraph, the term <quote>water quality project</quote> means any project identified in a State water quality control plan developed for the purpose of restoring any body of water that is identified by the State under section 303(d) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1313">33 U.S.C. 1313(d)</external-xref>) as being impaired.</text></subparagraph><subparagraph id="idad99f9c3344941049ecc4ee27101c1df"><enum>(B)</enum><header>Financial assistance</header><text>Under paragraph (1), the Secretary may provide financial assistance for the conduct of water quality projects.</text></subparagraph><subparagraph id="ide93b898f34b74e70b463085c032883ea"><enum>(C)</enum><header>Non-federal share credit</header><text>The Secretary may credit toward the non-Federal share required under subsection (c) funds allocated by a State for the conduct of a water quality project.</text></subparagraph><subparagraph id="ide8c4aa4894164b45bd64ba13211b7c94"><enum>(D)</enum><header>Consultation</header><text>The Secretary shall consult with the Administrator of the Environmental Protection Agency in carrying out this paragraph. </text></subparagraph><subparagraph id="idb25b490344a4449a9133b387d06e427b"><enum>(E)</enum><header>Limitations</header><clause id="id5E93F2BE844540E880B0189BAE0E5720"><enum>(i)</enum><header>In general</header><text>In providing financial assistance to water quality projects under this paragraph, the Secretary shall only provide financial assistance to water quality projects that seek to improve water quality by improving, restoring, or developing natural hydrological systems, such as wetlands, marshes, living shorelines, or any other naturally occurring hydrological features the Secretary determines to be necessary for the purpose of reducing nutrient loads. </text></clause><clause id="iddeff82c45c29471783d97421e7db7bfe"><enum>(ii)</enum><header>No reimbursement</header><text>Funds made available for a water quality project under this paragraph may not be used to reimburse the cost of any water quality project that has already been completed or is otherwise fully funded.</text></clause><clause id="id2c3ac8cf788d4e289c1a462ec7b12077"><enum>(iii)</enum><header>Effect</header><text>Nothing in this paragraph—</text><subclause id="idD069D0533A114CB185FA03AB5F0E61C6"><enum>(I)</enum><text>expands the authority of the Federal Government over nonnavigable waters; or</text></subclause><subclause commented="no" id="ide2a7106214e340949689fbbe5b0c706d"><enum>(II)</enum><text> authorizes the Secretary to regulate the conduct of water quality projects.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
