<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 796</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230314">March 14, 2023</action-date><action-desc><sponsor name-id="S410">Ms. Lummis</sponsor> (for herself, <cosponsor name-id="S266">Mr. Crapo</cosponsor>, <cosponsor name-id="S323">Mr. Risch</cosponsor>, <cosponsor name-id="S375">Mr. Daines</cosponsor>, and <cosponsor name-id="S383">Mr. Sullivan</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To exempt discharges of fire retardant by Federal land management agencies, State governments, political subdivisions of States, and Tribal governments from the permitting requirements of the National Pollutant Discharge Elimination System, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HC913DD3108264496833CBD6DA0B87631"><section id="idd422f596498a41a18cab76cf90ec9959" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Forest Protection and Wildland Firefighter Safety Act of 2023</short-title></quote>.</text></section><section section-type="subsequent-section" id="HDF82679B6D1946EB8CBABEB151713E61"><enum>2.</enum><header>Permitting requirements for certain discharges of fire retardant</header><subsection commented="no" display-inline="no-display-inline" id="id0deada0e6c5b472bb902b52b92695431"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of Federal land management agency</header><text display-inline="yes-display-inline">In this section, the term <term>Federal land management agency</term> means—</text><paragraph commented="no" display-inline="no-display-inline" id="id2e03da5a1f474be280799451d3416f2e"><enum>(1)</enum><text display-inline="yes-display-inline">the Forest Service;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idadf03a077b1040b3a3130036ac75248b"><enum>(2)</enum><text display-inline="yes-display-inline">the National Park Service;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1810ca9ffa214e819dc234c3938487d6"><enum>(3)</enum><text display-inline="yes-display-inline">the Bureau of Land Management;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2a7bb2c0f28d4f7c84ad421d6f1c45ee"><enum>(4)</enum><text display-inline="yes-display-inline">the United States Fish and Wildlife Service;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id73ae5d38e4cd4c9a81d6f35480663113"><enum>(5)</enum><text display-inline="yes-display-inline">the Bureau of Indian Affairs; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id18de0b28d6104a36a50593eb2d962052"><enum>(6)</enum><text display-inline="yes-display-inline">the Federal Emergency Management Agency. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id539a5c29d32b4de8ae16432ab6f53826"><enum>(b)</enum><header>No permitting required</header><text display-inline="yes-display-inline">Notwithstanding any provision of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>), a permit under section 402 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342</external-xref>) shall not be required for the discharge of fire retardant in connection with fire suppression, control, or prevention activities carried out by a Federal land management agency, a State government, a political subdivision of a State, or a Tribal government. </text></subsection></section></legis-body></bill>
