<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 769</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230309">March 9, 2023</action-date><action-desc><sponsor name-id="S337">Mr. Coons</sponsor> (for himself, <cosponsor name-id="S350">Mr. Rubio</cosponsor>, <cosponsor name-id="S324">Mrs. Shaheen</cosponsor>, and <cosponsor name-id="S293">Mr. Graham</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 36, United States Code, to designate March 9 as U.S. Hostage and Wrongful Detainee Day and to designate the Hostage and Wrongful Detainee flag as an official symbol to recognize citizens of the United States held as hostages or wrongfully detained abroad. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>U.S. Hostage and Wrongful Detainee Day Act of 2023</short-title></quote>.</text></section><section id="idE0CB8FDD326A48538C0DD0FFF48C5B55"><enum>2.</enum><header>Designation</header><subsection id="id24DB908D182D4A53920ABEB76402A84A"><enum>(a)</enum><header>Hostage and Wrongful Detainee Day</header><paragraph id="id1D0C9258B0144BB19D286598D52A0271"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/36/1">Chapter 1</external-xref> of title 36, United States Code, is amended—</text><subparagraph id="id3B543F028B31426D9E145E9D7A8366EC"><enum>(A)</enum><text>by redesignating the second section 146 (relating to Choose Respect Day) as section 147; and</text></subparagraph><subparagraph id="idF1561EC5A9D446918358EF27CAE65CE3"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id926980AA5897471D805DA65C8C39FC78"><section id="idF61A3005278C4497B35A95F5EF353729"><enum>148.</enum><header>U.S. Hostage and Wrongful Detainee Day</header><subsection id="id02E754EADF88497983722E326B9588B3"><enum>(a)</enum><header>Designation</header><text>March 9 is U.S. Hostage and Wrongful Detainee Day.</text></subsection><subsection id="idFA52203C14F844EB974C103324AF8D82"><enum>(b)</enum><header>Proclamation</header><text>The President is requested to issue each year a proclamation calling on the people of the United States to observe U.S. Hostage and Wrongful Detainee Day with appropriate ceremonies and activities.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id98c193eb64fa40eb8f7959a7a01c13fb"><enum>(2)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/36/1">chapter 1</external-xref> of title 36, United States Code, is amended by striking the item relating to the second section 146 and inserting the following new items:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1B3390CE002A4998863F9D56A65A39D2"><toc><toc-entry level="section" idref="idF61A3005278C4497B35A95F5EF353729">147. Choose Respect Day.</toc-entry></toc><toc><toc-entry level="section" idref="idF61A3005278C4497B35A95F5EF353729">148. U.S. Hostage and Wrongful Detainee Day.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id55C8D5630E6840CFA62DAB23DA7374BB"><enum>(b)</enum><header>Hostage and Wrongful Detainee flag</header><paragraph id="id994AE0B557A54F65857EF9EE89A3840E"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/36/9">Chapter 9</external-xref> of title 36, United States Code, is amended by adding at the end the following new section: </text><quoted-block style="USC" display-inline="no-display-inline" id="id91eb877991904109ad79c9d4fb5a63a3"><section id="id9A98D22F78104E81AB7F346072ECBF11"><enum>904.</enum><header>Hostage and Wrongful Detainee flag</header><subsection id="id3080B29310974B72955577C818AFDA7D"><enum>(a)</enum><header>Designation</header><text>The Hostage and Wrongful Detainee flag championed by the Bring Our Families Home Campaign is designated as the symbol of the commitment of the United States to recognizing, and prioritizing the freedom of, citizens and lawful permanent residents of the United States held as hostages or wrongfully detained abroad.</text></subsection><subsection id="id3e465a0cbb8548eaaa6d7383d3c20b8e"><enum>(b)</enum><header>Required display</header><paragraph id="id4AF8ED2F237141049B799EDD56140D66"><enum>(1)</enum><header>In general</header><text>The Hostage and Wrongful Detainee flag shall be displayed at the locations specified in paragraph (3) on the days specified in paragraph (2).</text></paragraph><paragraph id="id07ce383cf5fa4c1fb509b2857d182246"><enum>(2)</enum><header>Days specified</header><text>The days specified in this paragraph are the following:</text><subparagraph id="idA610264C2E6B48BC857439D7F4635CC4"><enum>(A)</enum><text>U.S. Hostage and Wrongful Detainee Day, March 9.</text></subparagraph><subparagraph id="id3B48B164ECF64857A6705AA8721EAEFF"><enum>(B)</enum><text>Flag Day, June 14.</text></subparagraph><subparagraph id="id1509ABDBB7FC4D43B42D5FF4ECF9487A"><enum>(C)</enum><text>Independence Day, July 4.</text></subparagraph><subparagraph id="id20959CDD9B9946508793E7DB7AE37090"><enum>(D)</enum><text>Any day on which a citizen or lawful permanent resident of the United States—</text><clause id="id79689C9C7F2D4D678857AEA8F2799098"><enum>(i)</enum><text>returns to the United States from being held hostage or wrongfully detained abroad; or </text></clause><clause id="id98AD9EA785B44FBE9F77507CADD0065A"><enum>(ii)</enum><text>dies while being held hostage or wrongfully detained abroad.</text></clause></subparagraph></paragraph><paragraph id="id6f3ea0232f464143a5857a4961bd1692"><enum>(3)</enum><header>Locations specified</header><text>The locations specified in this paragraph are the following:</text><subparagraph id="idCE9F8BA8E45A4E5899B2DE286A4F1AAE"><enum>(A)</enum><text>The Capitol. </text></subparagraph><subparagraph id="id6CEF3FB6E7274514866C9CE46FF3F091"><enum>(B)</enum><text>The White House.</text></subparagraph><subparagraph id="id784C6856D0F84F0A8872C354D3210716"><enum>(C)</enum><text>The buildings containing the official office of—</text><clause id="id1F01F1314F9A4C54A037E54CA938945A"><enum>(i)</enum><text>the Secretary of State; and</text></clause><clause id="idB9AC357A043D43E285B11F37E799806C"><enum>(ii)</enum><text>the Secretary of Defense.</text></clause></subparagraph></paragraph></subsection><subsection id="idC2A0B8D7D9F54F278AD5AAE186A7187E"><enum>(c)</enum><header>Display To be in a manner visible to the public</header><text>Display of the Hostage and Wrongful Detainee flag pursuant to this section shall be in a manner designed to ensure visibility to the public. </text></subsection><subsection id="id73024E8814D3439F967202A4782AB641"><enum>(d)</enum><header>Limitation</header><text>This section may not be construed or applied so as to require any employee to report to work solely for the purpose of providing for the display of the Hostage and Wrongful Detainee flag. </text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id03A3D4EAF4CA4A69987BE876626523DD"><enum>(2)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/36/9">chapter 9</external-xref> of title 36, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB3037F489B744EC1B1DD87ABD7DF8F06"><toc><toc-entry level="section" idref="idF61A3005278C4497B35A95F5EF353729">904.
