<congress display="yes">118th CONGRESS</congress><session display="yes">1st Session</session><legis-num display="yes">S. 758</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend the Tariff Act of 1930 to protect personally identifiable information, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section section-type="section-one" id="S1" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Moving Americans Privacy Protection Act</short-title></quote>.</text></section><section id="id2178B52EC60940A8AB133AA417426C39" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Protection of personally identifiable information</header><subsection id="idCDF09C690A6840D3B1C4A10B410418C8" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Paragraph (2) of section 431(c) of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1431">19 U.S.C. 1431(c)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBEFBB5C84D0F46BAB34D06186E3EC989"><paragraph id="id2B3EDFED8A1E44F1B31640CDBF44E4F9" indent="up1" commented="no" display-inline="no-display-inline"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id46EC5708D51A40289856E09650B58DDD"><enum>(A)</enum><text display-inline="yes-display-inline">The information listed in paragraph (1) shall not be available for public disclosure if—</text><clause id="idB952AA130ED24E959A902EE60626542A" indent="up1" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary of the Treasury makes an affirmative finding on a shipment-by-shipment basis that disclosure is likely to pose a threat of personal injury or property damage; or</text></clause><clause id="id9AC165F700B04A7C92FC934988B17334" indent="up1" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the information is exempt under the provisions of section 552(b)(1) of title 5, United States Code.</text></clause></subparagraph><subparagraph id="idEE6D9F8BA6B446C5BD7E8CCA881051CB" indent="up1" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">The Secretary shall ensure that any personally identifiable information, including Social Security numbers and passport numbers, is removed from any manifest signed, produced, delivered, or electronically transmitted under this section before access to the manifest is provided to the public.</text></subparagraph></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection><subsection id="idE1BFBAE074CD41CB957B5A03A8D1AC38" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall take effect on the date that is 30 days after the date of the enactment of this Act.</text></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20230309" chamber="Senate">Passed the Senate March 9, 2023.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
