<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 757</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230309">March 9, 2023</action-date><action-desc><sponsor name-id="S401">Mr. Romney</sponsor> (for himself and <cosponsor name-id="S330">Mr. Bennet</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Agricultural Credit Act of 1978 with respect to preagreement costs of emergency watershed protection measures, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HA78B5250BEB242CBBD8A8680CB8F9594"><section section-type="section-one" id="H0D1275B0051E43D1A1C4872617F0F292"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Making Access To Cleanup Happen Act of 2023</short-title></quote> or the <quote><short-title>MATCH Act of 2023</short-title></quote>.</text></section><section id="HAE779D8A7B2248F8BA75E0EF32430643"><enum>2.</enum><header>Emergency watershed program</header><text display-inline="no-display-inline">Section 403 of the Agricultural Credit Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2203">16 U.S.C. 2203</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HE1FECD3632614F6BBF1AD4E7B0157F25"><subsection id="H00FACDDE23EF4228B92B7E0B8A135EEF"><enum>(c)</enum><header>Preagreement costs</header><paragraph id="H6F04B7496ECE4479B372B7933956A6E5"><enum>(1)</enum><header>Definition of sponsor</header><text>In this subsection, the term <term>sponsor</term> means—</text><subparagraph id="id4939A63798B340B99C8500FA108420AC"><enum>(A)</enum><text>a State or local government; and</text></subparagraph><subparagraph id="id8CBFA7F1C83844DF998CD13A98FF9ECE"><enum>(B)</enum><text>an Indian Tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)).</text></subparagraph></paragraph><paragraph id="H49705B49CEB7442DB66B56941C32BC96"><enum>(2)</enum><header>Preagreement project costs</header><text>Not later than 180 days after the date of enactment of this subsection, the Secretary shall—</text><subparagraph id="H7EB2B2FC15394974905CB497DED22186"><enum>(A)</enum><text>identify a list of emergency watershed protection measures the cost of which may be incurred by a sponsor prior to entering into an agreement with the Secretary under this section; and</text></subparagraph><subparagraph id="HA662BA28C42F4AB393DC599349C6AA4C"><enum>(B)</enum><text>develop a procedure, including appropriate deadlines, to be implemented at the State level, through which a sponsor may request, for a specified natural disaster, additional emergency watershed protection measures the cost of which may be incurred by a sponsor prior to entering into an agreement with the Secretary under this section.</text></subparagraph></paragraph><paragraph id="H167A60AE75C94815B20C7043C3AE6587"><enum>(3)</enum><header>Agreement contribution</header><text>If the Secretary and a sponsor enter into an agreement under this section, the Secretary shall consider any applicable preagreement costs incurred by the sponsor for undertaking emergency watershed protection measures identified under paragraph (2) as meeting part of the contribution of the sponsor toward the cost of the project.</text></paragraph><paragraph id="H0F2070E27694498F9A48015AC0970DCD"><enum>(4)</enum><header>Assumption of risk</header><text display-inline="yes-display-inline">A sponsor that undertakes emergency watershed protection measures prior to entering into an agreement with the Secretary under this section shall assume the risk of incurring any cost of undertaking those measures.</text></paragraph><paragraph id="idD88A6D60AB904401967F3FCCA5395AAA"><enum>(5)</enum><header>Effect</header><text display-inline="yes-display-inline">Nothing in this subsection requires the Secretary to enter into an agreement with a sponsor.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
