STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To ensure that the National Advisory Council on Indian Education includes at least 1 member who is the president of a Tribal College or University and to require the Secretaries of Education and Interior to consider the National Advisory Council on Indian Education's reports in the preparation of budget materials.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section section-type="section-one" id="S1" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Advisory Council on Indian Education Improvement Act</short-title></quote> or the <quote><short-title>NACIE Improvement Act</short-title></quote>.</text></section><section id="id90A867EC48444AB58BCDA8DE8359AEE1" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">National Advisory Council on Indian Education</header><subsection id="id02BCB6E8328547018DA87BEB1A28C983" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Membership of NACIE</header><text display-inline="yes-display-inline">By not later than 180 days after the date of enactment of this Act and notwithstanding any other provision of section 6141 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7471">20 U.S.C. 7471</external-xref>), the President shall ensure that the National Advisory Council on Indian Education established under such section includes at least one member who is a president of a Tribal College or University (as defined in section 316(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c(b)</external-xref>).</text></subsection><subsection id="id17614528CFAA452D8179F208DC11AAF6" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Consideration of reports</header><paragraph id="idD59E65D1E404435097311E62F94568A0" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Sharing of report with Secretaries of Education and Interior</header><text display-inline="yes-display-inline">By not later than June 30 of each year, the National Advisory Council on Indian Education shall provide the NACIE annual report submitted to Congress under section 6141(b)(3) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7471">20 U.S.C. 7471(b)(3)</external-xref>) for such year to the Secretary of Education and the Secretary of the Interior. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8ad8c47f359d4ca4abfa8de3d0a884a7"><enum>(2)</enum><header display-inline="yes-display-inline">Department of Education</header><text display-inline="yes-display-inline">The Secretary of Education, in preparing the budget materials submitted to Congress by the Secretary in support of the budget of the United States Government that is submitted under section 1105 of title 31, United States Code, shall consider the most recent NACIE annual report.</text></paragraph><paragraph id="id1118FF23111644B4BB94203A2422BB56" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Department of the Interior</header><text display-inline="yes-display-inline">The Secretary of the Interior, in consultation with the Education Subcommittee of the Tribal-Interior Budget Council, in preparing the budget materials submitted to Congress by the Secretary of the Interior in support of the budget of the United States Government that is submitted under section 1105 of title 31, United States Code, shall consider the most recent NACIE annual report.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide524657ec2a94d6886514031b71400c0"><enum>(c)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this section, the term <term>NACIE annual report</term> means the report prepared under section 6141(b)(3) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7471">20 U.S.C.
