which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize the Secretary of Agriculture to provide grants to States, territories, and Indian Tribes to address contamination by perfluoroalkyl and polyfluoroalkyl substances on farms, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Relief for Farmers Hit with PFAS Act</short-title></quote>.</text></section><section id="idA88553B8C1634C3EAA6E2BFCA7AF8252"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id3665a3c917ba466ab9a6039d06abe8b7"><enum>(1)</enum><header>Agricultural land</header><subparagraph id="id9FAC27922F53472F907BFADF9EFDDDC9"><enum>(A)</enum><header>In general</header><text>The term <term>agricultural land</term> means any land that is used, or capable of use without substantial modification, for production of farm products. </text></subparagraph><subparagraph id="id0188045C49E8432CBB4313595B0F8B3C"><enum>(B)</enum><header>Inclusions</header><text>The term <term>agricultural land</term> includes irrigation water, livestock water, surface water, groundwater, and agricultural inputs on or associated with land described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="id04191b8c0ce14a9c8b6e719a3c3fac74"><enum>(2)</enum><header>Commercial farm</header><text>The term <term>commercial farm</term> means a farm on which a person produces any farm product with the intent that the farm product be sold or otherwise disposed of to generate income.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7df3d4c93f774c95bce9dacc57cbacab"><enum>(3)</enum><header>Eligible government</header><text>The term <term>eligible government</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb32a7d3205d24d36b1b125b3fab52829"><enum>(A)</enum><text display-inline="yes-display-inline">a State;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide841c8f405b540d69ffe8e97278f2797"><enum>(B)</enum><text>the District of Columbia;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id81db213f3a8649079a2c9c907195bc17"><enum>(C)</enum><text>a territory of the United States; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaba41df9aa504e27862b0e224c4e9293"><enum>(D)</enum><text>an Indian Tribe.</text></subparagraph></paragraph><paragraph id="id9befcbf07b0c4c4b8ab2f09482a10519"><enum>(4)</enum><header>Farm product</header><subparagraph id="idD983833219874D6A8FCD48B9FEE13202"><enum>(A)</enum><header>In general</header><text>The term <term>farm product</term> means any plant or animal that is useful to humans.</text></subparagraph><subparagraph id="id94B58F42D1EE43C6B345AA008C7FD9D0"><enum>(B)</enum><header>Inclusions</header><text>The term <term>farm product</term> includes—</text><clause id="id9B57E85B79B24D409DF483CD07AE7977"><enum>(i)</enum><text>forages;</text></clause><clause id="id5A7569171A0B41DB98908AA237E6F9C3"><enum>(ii)</enum><text>sod crops;</text></clause><clause id="idD0DAB0A5F73D453B9DE6A0B49121FC65"><enum>(iii)</enum><text>grains;</text></clause><clause id="idEBB3DD4B15CE476A9B2362734834DAA2"><enum>(iv)</enum><text>food crops;</text></clause><clause id="idE88C27FEA32044F09F8603F566E9571A"><enum>(v)</enum><text>dairy products;</text></clause><clause id="id67CA9DC29C324441A981814762B17086"><enum>(vi)</enum><text>poultry and poultry products;</text></clause><clause id="id6BC69617045B449FA49B8F4B93090711"><enum>(vii)</enum><text>bees;</text></clause><clause id="id7646EEE49F4343369472165F6D24EAF9"><enum>(viii)</enum><text>livestock and livestock products;</text></clause><clause commented="no" display-inline="no-display-inline" id="id6063e364a8a349c29b73f802d5197bd0"><enum>(ix)</enum><text>products of aquaculture;</text></clause><clause id="id3F5F010B37E94250B7937BAEDB53E390"><enum>(x)</enum><text>fruits;</text></clause><clause id="id3CED26AF9C45424B84A67328241BDC26"><enum>(xi)</enum><text>berries;</text></clause><clause id="id03B56EA5DE4142E4BD0222A736A73CE4"><enum>(xii)</enum><text>vegetables;</text></clause><clause id="id2D115B3824EE4774B9510FA81A9E2FC2"><enum>(xiii)</enum><text>flowers;</text></clause><clause id="id0C60EF5EB697405588FEDB1D4BB71F59"><enum>(xiv)</enum><text>seeds;</text></clause><clause id="idF8DFE82F75BD4DE4838CC06402277BD8"><enum>(xv)</enum><text>grasses;</text></clause><clause id="idA45A9226AC6F4EBE8D9BBC0AAA15289D"><enum>(xvi)</enum><text>Christmas trees; and </text></clause><clause id="id52DD4AF1E7FC40F397DB5C0DC1654B13"><enum>(xvii)</enum><text>other similar products, as determined by the Secretary. </text></clause></subparagraph></paragraph><paragraph id="id42f35c04a4ec4d37ac98dd3447bf2653"><enum>(5)</enum><header>Perfluoroalkyl or polyfluoroalkyl substance; PFAS</header><text>The term <term>perfluoroalkyl or polyfluoroalkyl substance</term> or <term>PFAS</term> means a chemical that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8c2aaebf9c4e4613aec9f876317e31c5"><enum>(A)</enum><text display-inline="yes-display-inline">contains at least one of—</text><clause id="idf4846acc62f5443ba559047d85a3fd76"><enum>(i)</enum><text>R–(CF2)–CF(R′)R′′, where both the CF2 and CF moieties are saturated carbons, and none of the R groups can be hydrogen;</text></clause><clause id="id79a78b26a2e049a683a312c1503ba928"><enum>(ii)</enum><text>R–CF2OCF2–R′, where both the CF2 moieties are saturated carbons, and none of the R groups can be hydrogen; or</text></clause><clause id="idf9771c14d113472fbb8c8b5232c572f7"><enum>(iii)</enum><text>CF3C(CF3)RR′, where all the carbons are saturated, and none of the R groups can be hydrogen; or </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide987e9bf4af74f1eb87f3bb98dff4831"><enum>(B)</enum><text display-inline="yes-display-inline">is covered by the most recent working definition of PFAS issued by the Administrator of the Environmental Protection Agency.</text></subparagraph></paragraph><paragraph id="id206E69D867EA4829AAF18B95E6B31A03"><enum>(6)</enum><header>Program</header><text>The term <term>program</term> means the program established under section 3(a). </text></paragraph><paragraph id="idD2B22171C82B4C0BBBC7FAD380CAF237"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture. </text></paragraph><paragraph id="ida9f80f65e65c4df0a3f70d4a863608e6"><enum>(8)</enum><header>Septage</header><text>The term <term>septage</term> means waste, refuse, effluent, sludge, and any other materials from septic tanks, cesspools, or any other similar facilities. </text></paragraph><paragraph id="id75c301c6e4e84aa0846d147bcccac5f8"><enum>(9)</enum><header>Sludge</header><text>The term <term>sludge</term> means—</text><subparagraph id="idDD91E1FEC8AC4E198088C82A9ACE0117"><enum>(A)</enum><text>solid, semisolid, or liquid waste generated from a municipal, commercial, or industrial—</text><clause id="idE42B19118BEA4444BA70FD2E5541E5FD"><enum>(i)</enum><text>wastewater treatment plant;</text></clause><clause id="idBCEA585AFDBC414E9D669AF705EC5FE3"><enum>(ii)</enum><text>water supply treatment plant; or </text></clause><clause id="id2FE4F6B909024B4A896C17D1CAB58CA3"><enum>(iii)</enum><text>wet process air pollution control facility; and</text></clause></subparagraph><subparagraph id="idC747401D13B9466F980B5B6E3466D301"><enum>(B)</enum><text>any other waste having similar characteristics and effect. </text></subparagraph></paragraph></section><section id="id639BF69DE8B0486BA6940835DD3D9960"><enum>3.</enum><header>Establishment</header><subsection id="id545EBCB917BF45B2AF11244B4D91EBC7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish a program under which the Secretary shall provide grants to eligible governments for the purposes described in section 4(a).</text></subsection><subsection id="idDE3E4382C58D46C5B4A05541C04A5C96"><enum>(b)</enum><header>Eligibility</header><paragraph commented="no" display-inline="no-display-inline" id="id34ffe06509bb43e481549ce6638f022d"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">To be eligible to receive a grant under the program, the territory of an eligible government shall contain—</text><subparagraph id="id5D73DA6B63414B709180D65CE079CBD5"><enum>(A)</enum><text>agricultural land that contains any soil with levels of PFAS that the Secretary, in coordination with the Administrator of the Environmental Protection Agency, determines to be unsafe; or</text></subparagraph><subparagraph id="id03F306384F844F58B1FA5152BE69EC82"><enum>(B)</enum><text>water used for the production of farm products with levels of PFAS that the Administrator of the Environmental Protection Agency, in coordination with the Secretary, determines to be unsafe.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5ac0e4c0895841e18a34905e842c05f9"><enum>(2)</enum><header>Consideration</header><text>In determining the eligibility of an eligible government for a grant under the program, the Secretary, in consultation with the Administrator of the Environmental Protection Agency, shall consider State standards and limitations relating to soil and water.</text></paragraph></subsection><subsection id="idB4CFC0BB599E46E5A9A271F0CBEF1621"><enum>(c)</enum><header>Applications</header><paragraph id="id397E575575474AAFB475D749B330C4E7"><enum>(1)</enum><header>In general</header><text>To receive a grant under the program, the department of agriculture or similar agency of an eligible government shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph><paragraph id="idBB54735EA8584277AB202AE19B253D53"><enum>(2)</enum><header>Spend plan</header><text>An application submitted under paragraph (1) shall contain a plan describing how the eligible government will administer the funding received under the program, including funding priorities and oversight.</text></paragraph></subsection><subsection id="id022DD5FAB2654FD0B2611C66D4EDCE33"><enum>(d)</enum><header>Set-Aside</header><text>Each year, the Secretary shall provide not less than 30 percent of the total funding provided under the program to 1 or more eligible governments with a population of less than 3,000,000.</text></subsection></section><section id="id79B977FB6ACA4C84AB37BF1D74F0659B"><enum>4.</enum><header>Purposes</header><subsection commented="no" display-inline="no-display-inline" id="idf3f47b976e3f48c1902121531f97b963"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible government may use a grant received under the program to provide funding for any of the following purposes:</text><paragraph id="id9485844b483e4c4ba7399e105ff4ed06"><enum>(1)</enum><text>Monitoring (including through blood serum testing) the PFAS-related health complications of a person, and members of the household of that person, if agricultural land the person lives or works on is found to be contaminated by PFAS.</text></paragraph><paragraph id="id610a8d74f2ba483daa12339656bfdeb5"><enum>(2)</enum><text>Buying, selling, or providing compensation for agricultural land or farm products found, through test results provided to the eligible government, to be contaminated by PFAS, including costs associated with the depopulation or disposal of farm products, premortem or postmortem.</text></paragraph><paragraph id="idb665832df9e741019579dc2594693b92"><enum>(3)</enum><text>Investing in agricultural equipment, facilities, and infrastructure to ensure that agricultural land that, or a commercial farm any agricultural land of which, is found to be contaminated by PFAS maintains profitability while the producers on the agricultural land, in response to the PFAS contamination—</text><subparagraph id="idE12289F4AFDF4A6CB2FA2F5BDE43DF1D"><enum>(A)</enum><text>transition to an alternative production system; or </text></subparagraph><subparagraph id="id165DC1988F3C4E9987240F38CBA7BD93"><enum>(B)</enum><text>implement remediation strategies (including disposal), technological adaptations, or other modifications to the operations of the agricultural land or commercial farm.</text></subparagraph></paragraph><paragraph id="id7e94f12bc82843659fba779627ca843d"><enum>(4)</enum><text>Assisting the producers on agricultural land that, or a commercial farm any agricultural land of which, is found to be contaminated by PFAS in developing an enterprise budget for—</text><subparagraph id="id5A2253D74D0D42A68B7812294F844E39"><enum>(A)</enum><text>alternative production systems;</text></subparagraph><subparagraph id="id8A4B97C8D6C6426BAA9F041915A2637C"><enum>(B)</enum><text>remediation strategies; </text></subparagraph><subparagraph id="idAB814BA3F0C4460784E523C931DD3241"><enum>(C)</enum><text>technological adaptations; </text></subparagraph><subparagraph id="id6B9E2868F8A841AB86EBE15E0D9775B4"><enum>(D)</enum><text>transitioning to an alternative revenue stream; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7678417a605b419bb5e3cbcdea6bf1a7"><enum>(E)</enum><text display-inline="yes-display-inline">relocating a farming operation to new agricultural land.</text></subparagraph></paragraph><paragraph id="idaa204f2c354e4ec58f2cd3068023c93a"><enum>(5)</enum><text>Providing financial assistance to a person the commercial farm of which is found to be contaminated by PFAS, including income replacement.</text></paragraph><paragraph id="idd5f4791c73c14e6ca305762bc8b70222"><enum>(6)</enum><text>Evaluating and expanding the capacity of PFAS testing and data management in the territory of the eligible government.</text></paragraph><paragraph id="id96458b45c04c44069e503b380e4e55b7"><enum>(7)</enum><text>Conducting research that—</text><subparagraph id="id8844DE7AF0FA4648B59E79F3FAC3323B"><enum>(A)</enum><text>supports short-term farm management decisions with respect to agricultural land that has been contaminated by PFAS; and </text></subparagraph><subparagraph id="id2EB5BDA192744A6A97388B034BC9C48A"><enum>(B)</enum><text>assesses future options for viable uses of agricultural land and water used for agricultural production that has been contaminated by PFAS.</text></subparagraph></paragraph><paragraph id="id9e814d1f0e1044a3bd621ee0d805c481"><enum>(8)</enum><text>Conducting research that quantifies the impact of PFAS on commercial farms and agricultural communities in the territory of the eligible government.</text></paragraph><paragraph id="id45bf7fe4aa494c4e86df66530a183e05"><enum>(9)</enum><text>Conducting research on—</text><subparagraph id="id19C0E3FBAA2548B0AAC56FC5076583B5"><enum>(A)</enum><text>soil and water remediation systems;</text></subparagraph><subparagraph id="id71F03DE3FC9D40889EB4A8D67D19711A"><enum>(B)</enum><text>the viability of those systems for PFAS-contaminated commercial farms; </text></subparagraph><subparagraph id="id437260fc2d554fa6a4271d6fc5642f4d"><enum>(C)</enum><text>the composting or disposal of PFAS-contaminated crops or livestock;</text></subparagraph><subparagraph id="idB5A5FFCC3FDE4DD9B1214E4472B01172"><enum>(D)</enum><text>implementing alternative production systems in response to PFAS contamination;</text></subparagraph><subparagraph id="id8B936F01EA0C4551A47891962B24D4DE"><enum>(E)</enum><text>the PFAS uptake of various farm products; and</text></subparagraph><subparagraph id="idC0D5C2CD9FCC407586583504B6ED7320"><enum>(F)</enum><text>food safety relating to PFAS contamination.</text></subparagraph></paragraph><paragraph id="idfeddc36219a349a8a64460d2e120098b"><enum>(10)</enum><text>Developing and implementing educational programs for owners of agricultural land, including determining best practices for—</text><subparagraph id="idE2085DF9EA8C4FF38B70628D62EFB8D2"><enum>(A)</enum><text>informing residents about the potential of being near or on a site on which sludge or septage application was licensed or permitted by the eligible government or the Federal Government; and </text></subparagraph><subparagraph id="idA32F511B763C4F11A16A4BEA000179D7"><enum>(B)</enum><text>providing information and guidance on buying or selling agricultural land on which sludge or septage was applied.</text></subparagraph></paragraph><paragraph id="id2d4db9a0b7fe4da98bbc6f9f80208370"><enum>(11)</enum><text>Long-term monitoring of agricultural land contaminated by PFAS and establishing a corresponding centralized data repository.</text></paragraph><paragraph id="idd232f96cea47431a9755df1e8c441bc6"><enum>(12)</enum><text>Assisting owners and operators of commercial farms not directly affected by PFAS contamination with marketing efforts whose branding and marketing may be affected by the public perception of PFAS contamination in the territory of the eligible government.</text></paragraph><paragraph id="id21a165db080d45aab19a473c34b49b17"><enum>(13)</enum><text>Voluntary testing of farm products, agricultural land, or other locations that are suspected to be contaminated with PFAS. </text></paragraph></subsection><subsection id="id01a73b78b6d0417ea32fef8b165dfaa8"><enum>(b)</enum><header>Priority</header><paragraph commented="no" display-inline="no-display-inline" id="iddf26e194be6944d69f127d8b66f1e382"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In using funding received under the program, an eligible government shall prioritize purposes that directly assist producers who are experiencing financial losses due to agricultural PFAS contamination.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2c444cad89c14d89b2be08b11d440510"><enum>(2)</enum><header>Department of Agriculture priority</header><text display-inline="yes-display-inline">In providing grants under the program, the Secretary shall prioritize the provision of grants to eligible governments that will use the grant funds for the purposes described in paragraphs (3) through (5) of subsection (a).</text></paragraph></subsection></section><section id="id884F15A046894FE99FF91A1EF9C2A63D"><enum>5.</enum><header>Reports</header><text display-inline="no-display-inline">Each year of the period of a grant received under the program, the department of agriculture or similar agency of an eligible government shall submit to the Secretary and Congress a report describing—</text><paragraph id="id8C682BB1EA4E448AB7E85796771E2DC9"><enum>(1)</enum><text display-inline="yes-display-inline">the uses of the grant during the previous year, including—</text><subparagraph id="id3C7A8E9EF5CB40069287E9A7BEBEC47A"><enum>(A)</enum><text>the purposes described in section 4(a) for which the grant was used;</text></subparagraph><subparagraph id="idC0A41ACE63E944F596B968B7F12B9A7F"><enum>(B)</enum><text>the amount of the grant allocated to each purpose described in section 4(a); and</text></subparagraph><subparagraph id="id3A9B2317F3ED4175A1298B82E38D5990"><enum>(C)</enum><text>the extent to which the funding received under the program, including funding priorities and oversight, was administered in accordance with the plan described in section 3(c)(2); </text></subparagraph></paragraph><paragraph id="idE4BAC4CAB99047BD9271FFD32784A03C"><enum>(2)</enum><text>any additional needs identified by agricultural producers in the territory of the eligible government; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6ceffaa212584bdb8a96644adaf8d536"><enum>(3)</enum><text display-inline="yes-display-inline">any additional information the Secretary determines to be appropriate.</text></paragraph></section><section id="id263408D4538F438491429CF8A81478B2"><enum>6.</enum><header>Task force</header><text display-inline="no-display-inline">The Secretary shall establish a task force composed of officers or employees of the Department of Agriculture—</text><paragraph id="id51DFC19704D14A0F8D1F7991F52E6770"><enum>(1)</enum><text display-inline="yes-display-inline">to provide advice to the Secretary relating to whether addressing PFAS contamination should be added as an eligible activity under each program of the Department of Agriculture; </text></paragraph><paragraph id="idddcc539372cc47b3b5ca8223519082ed"><enum>(2)</enum><text>to evaluate necessary actions for farms already enrolled in a Department of Agriculture program where PFAS is detected; and </text></paragraph><paragraph id="idCD3C5A428E354FA39D45060418449F56"><enum>(3)</enum><text>to provide technical assistance to eligible governments in addressing PFAS contamination.</text></paragraph></section><section id="idBEBD709A92AF4179BBBB5E3F3FFF3F3A"><enum>7.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to the Secretary to carry out this Act $500,000,000 for the period of fiscal years 2024 through 2028.</text></section></legis-body></bill>
