<congress display="yes">118th CONGRESS</congress><session display="yes">1st Session</session><legis-num display="yes">S. 724</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To protect children against sexual abuse and exploitation, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section commented="no" display-inline="no-display-inline" section-type="section-one" id="id20431e9ada2844628b77f0dc30ba04df"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Child Sex Abuse Act of 2023</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idca6979dfe3484d1cbdcd2558f68398e9"><enum>2.</enum><header display-inline="yes-display-inline">Sense of Congress</header><text display-inline="no-display-inline">The sense of Congress is the following:</text><paragraph commented="no" display-inline="no-display-inline" id="id1c9d02c029c549b08204b7d38b617fe1"><enum>(1)</enum><text display-inline="yes-display-inline">The safety of children should be a top priority for public officials and communities in the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7c64d77e667f40899690df5ce723ba34"><enum>(2)</enum><text display-inline="yes-display-inline">According to the Rape, Abuse &amp; Incest National Network, an individual in the United States is sexually assaulted every 68 seconds. And every 9 minutes, that victim is a child. Meanwhile, only 25 out of every 1,000 perpetrators will end up in prison.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id18d0a2aa3a3843929e9ab16d5e9abc0e"><enum>(3)</enum><text display-inline="yes-display-inline">The effects of child sexual abuse can be long-lasting and affect the victim’s mental health. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id09A4BDE341554C08BEBA3901E92D9EEF"><enum>(4)</enum><text display-inline="yes-display-inline">Victims are more likely than non-victims to experience the following mental health challenges:</text><subparagraph commented="no" display-inline="no-display-inline" id="id6e3a8346ff4540a39f16d2daa905a690"><enum>(A)</enum><text display-inline="yes-display-inline">Victims are about 4 times more likely to develop symptoms of drug abuse.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id206f409fee7e4aa7ad24d763d827b0e9"><enum>(B)</enum><text display-inline="yes-display-inline">Victims are about 4 times more likely to experience post-traumatic stress disorder as adults.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0e379c0c603542f9afe93fe9ae9bba15"><enum>(C)</enum><text display-inline="yes-display-inline">Victims are about 3 times more likely to experience a major depressive episode as adults.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id51c6d9b09acf417698efa611ebf40b7c"><enum>(5)</enum><text display-inline="yes-display-inline">The criminal justice system should and has acted as an important line of defense to protect children and hold perpetrators accountable.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7b71a64992ec4f26a912dec01ca29936"><enum>(6)</enum><text display-inline="yes-display-inline">However, the horrific crimes perpetuated by Larry Nassar demonstrate firsthand the loopholes that still exist in the criminal justice system. While Larry Nassar was found guilty of several State-level offenses, he was not charged federally for his illicit sexual contact with minors, despite crossing State and international borders to commit this conduct. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6f1e711759574efdb97522e40ca742eb"><enum>(7)</enum><text display-inline="yes-display-inline">The Department of Justice has also identified a growing trend of Americans who use charitable or missionary work in a foreign country as a cover for sexual abuse of children.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id74252804c3b34cfd8b485a12576e2cab"><enum>(8)</enum><text display-inline="yes-display-inline">It is the intent of Congress to prohibit Americans from engaging in sexual abuse or exploitation of minors under the guise of work, including volunteer work, with an organization that affects interstate or foreign commerce, such as an international charity.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id20d642fa2d9b4587a4bac1cdcaea6f27"><enum>(9)</enum><text display-inline="yes-display-inline">Federal law does not require that an abuser’s intention to engage in sexual abuse be a primary, significant, dominant, or motivating purpose of the travel. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6feec0b921b14036bac233ede0311721"><enum>(10)</enum><text display-inline="yes-display-inline">Child sexual abuse does not require physical contact between the abuser and the child. This is especially true as perpetrators turn increasingly to internet platforms, online chat rooms, and webcams to commit child sexual abuse.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb9bb4bc4240d4e8ebcfffbfafce22b07"><enum>(11)</enum><text display-inline="yes-display-inline">However, a decision of the United States Court of Appeals for the Seventh Circuit found the use of a webcam to engage in sexually provocative activity with a minor did not qualify as <quote>sexual activity</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id28a6d7489b9149abad4f976a72e4072d"><enum>(12)</enum><text display-inline="yes-display-inline">Congress can address this issue by amending the definition of the term <term>sexual activity</term> to clarify that it does not require interpersonal, physical contact.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4c3ad65e765f4073a39520b98b16ff2f"><enum>(13)</enum><text display-inline="yes-display-inline">It is the duty of Congress to provide clearer guidance to ensure that those who commit crimes against children are prosecuted to the fullest extent of the law.</text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="ida5368d7b2e8e411c8d8d0ded2525445f"><enum>3.</enum><header display-inline="yes-display-inline">Interstate child sexual abuse</header><text display-inline="no-display-inline">Section 2423 of title 18, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id36038666EFC644F880219605D7F45C7E"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b), by striking <quote>with a motivating purpose of engaging in any illicit sexual conduct with another person</quote> and inserting <quote>with intent to engage in any illicit sexual conduct with another person</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0F0A5253C7004E59B882225D3E94C75A"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsections (d), (e), (f), and (g) as subsections (e), (f), (g), and (i), respectively; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id239daefe9e674511b4bc9204a40308da"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (e), as so redesignated, by striking <quote>with a motivating purpose of engaging in any illicit sexual conduct</quote> and inserting <quote>with intent to engage in any illicit sexual conduct</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id699fc713f459422c8cb1c0c21706434e"><enum>(4)</enum><text display-inline="yes-display-inline">by inserting after subsection (g), as so redesignated, the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3199c523667e474396bdd6799470c76d"><subsection commented="no" display-inline="no-display-inline" id="id8b74f19c8ea7487d82a76aa6cc47555a"><enum>(h)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">As used in this section, the term <term>intent</term> shall be construed as any intention to engage in illicit sexual conduct at the time of the travel.</text></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id864aa218739f42f388d9b2980a527919"><enum>4.</enum><header display-inline="yes-display-inline">Abuse under the guise of charity</header><text display-inline="no-display-inline">Section 2423 of title 18, United States Code, as amended by section 3 of this Act, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id6936fc44378f4572978a54663863ac8d"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting after subsection (c) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD1437738BD964890A9DB37F823A7493E"><subsection commented="no" display-inline="no-display-inline" id="idd7d20c9236bc439fbe026707dd594d33"><enum>(d)</enum><header display-inline="yes-display-inline">Illicit sexual conduct in connection with certain organizations</header><text display-inline="yes-display-inline">Any citizen of the United States or alien admitted for permanent residence who—</text><paragraph commented="no" display-inline="no-display-inline" id="idf4d1fae5f7ce4641a219a6cac95d6173"><enum>(1)</enum><text display-inline="yes-display-inline">is an officer, director, employee, or agent of an organization that affects interstate or foreign commerce;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide57bd9d90a074cbd9943fa5d17fef700"><enum>(2)</enum><text display-inline="yes-display-inline">makes use of the mails or any means or instrumentality of interstate or foreign commerce through the connection or affiliation of the person with such organization; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida3db9ece059446859ee364b7e1704201"><enum>(3)</enum><text display-inline="yes-display-inline">commits an act in furtherance of illicit sexual conduct through the connection or affiliation of the person with such organization, </text></paragraph><continuation-text commented="no" continuation-text-level="subsection">shall be fined under this title, imprisoned for not more than 30 years, or both.</continuation-text></subsection><after-quoted-block display="yes">; </after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB38A4B44468E4B78B586DA1DEFCCFC15"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (f), as so redesignated, by striking <quote>or (d)</quote> and inserting <quote>(d), or (e)</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBDCB7D1AB6BE4BA9BB996DBE362C2BFD"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (i), as so redesignated, by striking <quote>(f)(2)</quote> and inserting <quote>(g)(2)</quote>.</text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id38284e12c9d543aabf8afe680bbcbf10"><enum>5.</enum><header display-inline="yes-display-inline">Sexual activity with minors</header><text display-inline="no-display-inline">Section 2427 of title 18, United States Code, is amended by inserting <quote>does not require interpersonal physical contact, and</quote> before <quote>includes</quote>.</text></section></legis-body><attestation><attestation-group><attestation-date date="20230308" chamber="Senate">Passed the Senate March 8, 2023.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
