which was read twice and referred to the <committee-name committee-id="SSGA00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date>May 11, 2023</action-date><action-desc>Reported by <sponsor name-id="S380">Mr. Peters</sponsor>, without amendment</action-desc></action><legis-type>A BILL</legis-type><official-title>To improve plain writing and public experience, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clear and Concise Content Act of 2023</short-title></quote>.</text></section><section id="id51a444b08339490c9b214c3ecf182873"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id1a1890f1dc6b4f699d8e9cf5051336ac"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> means an executive agency and a military department, as such terms are defined in sections 105 and 102 of title 5, United States Code, respectively.</text></paragraph><paragraph id="idf72f70b4a2184233b324c0a378d754da"><enum>(2)</enum><header>Covered content</header><text>The term <term>covered content</term>—</text><subparagraph id="id8812c55c52054595bf369d2bcd45ea7d"><enum>(A)</enum><text>means any content that—</text><clause id="id3bf60bc6afe245a5abf09394c033a6c5"><enum>(i)</enum><text>is necessary for obtaining any benefit or service from the Federal Government or for filing taxes; or</text></clause><clause id="idb65ca69ae5994f44b5888c028f28c8ba"><enum>(ii)</enum><text>provides information about—</text><subclause id="id9d211a0ea9114eecaa84b3cd2b54ec35"><enum>(I)</enum><text>any benefit or service from the Federal Government;</text></subclause><subclause id="id0cf93227607d44558fc4b5dd050c696e"><enum>(II)</enum><text>any operations, policies, or guidance of an agency that are of material importance to the agency and are posted publicly by the agency, including any explanation of how to comply with a requirement the Federal Government administers or enforces;</text></subclause><subclause id="idcbff4aa120054126a5e6bd2243d7d7bc"><enum>(III)</enum><text>how to interact with or provide feedback to an agency regarding the operations, policies, or guidance of the agency; or </text></subclause><subclause id="ida06ed6be26dd410ba34c233d2f07e108"><enum>(IV)</enum><text>how to navigate or interact with any agency website, digital service, or office;</text></subclause></clause></subparagraph><subparagraph id="idb217c6a96efa4fc7899633e4e750a273"><enum>(B)</enum><text>includes— </text><clause id="id1897B7A6412944BC8D2F2D47ABD7FB13"><enum>(i)</enum><text>(whether in paper or electronic form) a letter, publication, form, notice, guidance, policy, instruction, or official correspondence of an agency; </text></clause><clause id="id6ae738809c5e461b93fff42a5fcaae1d"><enum>(ii)</enum><text>all content necessary for public understanding, interaction, and use of an agency digital service or website; and</text></clause><clause id="idBE7F8D5009264DD3A0EA017C00915690"><enum>(iii)</enum><text>instructions on how to submit comments, feedback, or information in response to a regulation during any portion of the rulemaking or implementation process for a regulation; and</text></clause></subparagraph><subparagraph id="idbf3a1f7fc5b34f348e31119eb07bebd6"><enum>(C)</enum><text>subject to subparagraph (B)(iii), does not include a regulation.</text></subparagraph></paragraph><paragraph id="id4e4ed3edab344c2c9574de49798d996d"><enum>(3)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget.</text></paragraph><paragraph id="id4426d69194864e6082ce43ea67447c06"><enum>(4)</enum><header>Open Government data asset</header><text>The term <term>open Government data asset</term> has the meaning given that term in section 3502 of title 44, United States Code.</text></paragraph><paragraph id="idDE52918C85684064847EA22F5C8F9691"><enum>(5)</enum><header>Plain writing</header><text>The term <term>plain writing</term> means writing that is clear, concise, well-organized, and follows other best practices appropriate to the subject or field and intended audience, including an audience who may be disabled, may not be proficient in English, or may otherwise be disadvantaged or traditionally underserved.</text></paragraph></section><section id="id925d601f988842ef8bdbd669fbedfe3c"><enum>3.</enum><header>Responsibilities of the Director</header><subsection id="id99893d0d1c384f999ee64949d8bb1359"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Director shall rescind outdated guidance and issue new guidance for the creation, maintenance, and use of covered content at agencies.</text></subsection><subsection id="id809affb2a6704de7ad9877537210f6cf"><enum>(b)</enum><header>Requirements</header><text>The guidance required under subsection (a) shall—</text><paragraph id="id87a3e1c1f5d34bac9d2c88aa8aba3258"><enum>(1)</enum><text>establish procedures under which an agency shall review any content in use on the date of enactment of this Act to determine if it is covered content;</text></paragraph><paragraph id="idf03b15bf2f884b959887e7f0020eb7ab"><enum>(2)</enum><text>establish policies for an agency to ensure that any content of the agency that is covered content, including any content created or updated after the date of enactment of this Act that is determined to be covered content, is drafted in plain writing;</text></paragraph><paragraph id="id664ea0c42095402f95e31e0dd3738269"><enum>(3)</enum><text>establish qualitative and quantitative metrics by which an agency shall be measured for compliance with the requirements to identify covered content, draft covered content in plain writing, and solicit and incorporate public feedback and data to improve public engagement and interaction with the agency; </text></paragraph><paragraph id="id7549547f92804a5b8a21dea085810a8b"><enum>(4)</enum><text>prescribe processes by which agencies shall submit agency reports required by the Director, in an appropriate manner and form, to support the governmentwide reports required under subsection (c); and </text></paragraph><paragraph id="id4406e5d6a12f41e79bd6b8a3bf7fa7d1"><enum>(5)</enum><text>require an agency to solicit public feedback, collect data, and routinely test the creation or modification of covered content of the agency.</text></paragraph></subsection><subsection id="idd0bee8699b494a10ad15e4aef36de814"><enum>(c)</enum><header>Reports</header><paragraph id="id769bed3492754ac9bb19efd8ac741d2b"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, and not less frequently than every 2 years thereafter, the Director shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Accountability of the House of Representatives a report on implementation of this Act by agencies, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id785c2dde9c9a428c93c68f04642475a8"><enum>(A)</enum><text display-inline="yes-display-inline">the progress of agencies towards achieving the metrics established under subsection (b)(3); </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc589786ad1ff474f9a7078ac5f531971"><enum>(B)</enum><text display-inline="yes-display-inline">information regarding Government-wide trends or activities related to the implementation of this Act with respect to covered content across 1 or more agencies; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida7fdeca97934471b85c5bce59d7da739"><enum>(C)</enum><text display-inline="yes-display-inline">any other information or data determined by the Director to inform Congress and the public regarding plain writing in covered content by agencies.</text></subparagraph></paragraph><paragraph id="id75D5F1FE7C954A028A7E8044DDE8E721"><enum>(2)</enum><header>Public website</header><text>The Director shall— </text><subparagraph commented="no" display-inline="no-display-inline" id="id33e7824ccadc462f8ba1d97dafab23b7"><enum>(A)</enum><text display-inline="yes-display-inline">make the reports submitted under paragraph (1) available on a public website determined by the Director; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddc362b6fbf17409bbc779ed43f5fc680"><enum>(B)</enum><text display-inline="yes-display-inline">maintain the reports as open Government data assets. </text></subparagraph></paragraph><paragraph id="id83974a0f0dde4c8abe2d672abb5d4e5a"><enum>(3)</enum><header>Federal Government and agency performance plans</header><subparagraph id="id99d8d7e7acba461fab8b1e8c75934c2d"><enum>(A)</enum><header>Federal Government</header><text>The Director shall ensure that the information regarding the Federal Government performance plan and agency performance plans required to be made available under subsection (a) or (b) of section 1115 of title 31, United States Code, is treated as covered content and published (whether in paper or electronic form) using plain writing.</text></subparagraph><subparagraph id="id2a584b62c3314e23a9f3c646228fa56f"><enum>(B)</enum><header>Agency performance plans</header><text>Section 1115(b) of title 31, United States Code, is amended—</text><clause id="idEE9E7C4E3FF846D28D234C9798B1F56B"><enum>(i)</enum><text> in paragraph (9)(C), by striking <quote>and</quote> at the end; </text></clause><clause id="idFAA90E11FED7401DBF0D035DE04E9EAC"><enum>(ii)</enum><text>in paragraph (10), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause id="idB42BDEDA6AB84241B731F9AE283F3FB3"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1A4C3BF032D14569B4C4B9DA1A005C00"><paragraph id="id8C0BD3180520405C8D87AD51E5AAB90E"><enum>(11)</enum><text>incorporate the metrics established under section 3(b)(3) of the <short-title>Clear and Concise Content Act of 2023</short-title>.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection></section><section id="id960589ad1cba48c5bf75d6ad1e345eb2"><enum>4.</enum><header>Agency responsibilities</header><subsection id="id91ba93fc3c2e4861af0cc44d54385b3a"><enum>(a)</enum><header>In general</header><text>The head of each agency shall ensure compliance with this Act, including through the designation of a senior officer at the agency (not lower than an Assistant Secretary or equivalent) to oversee implementation by the agency, including all bureaus, offices, or other subordinate components of the agency.</text></subsection><subsection id="idee548486338847149409a66b32176296"><enum>(b)</enum><header>Requirement To use plain language in covered content</header><text>Except as provided in the amendments made by section 5(1), on and after the date that is 1 year after the date of enactment of this Act, each agency shall use plain writing in all covered content made available by the agency, consistent with the guidance issued by the Director under section 3(a).</text></subsection><subsection id="ida7ccf33db6774bd3b2da97e36c12de0c"><enum>(c)</enum><header>Requirement for feedback from customers</header><text>The head of each agency shall ensure that there are opportunities and mechanisms in place (whether in paper or electronic form) that incorporate plain writing instructions for feedback from individuals or entities obtaining services from or engaging in transactions with the agency. </text></subsection><subsection id="id34a8e411fb1d408ab9e24788d1304027"><enum>(d)</enum><header>Public feedback</header><text>The head of each agency shall maintain an accessible form, survey tool, or other portion of a website of the agency to solicit feedback from the public on compliance with this Act by the agency and to collect the feedback and data required under section 3(b)(5). </text></subsection></section><section id="id91b25e9a21b446a88b244e6c1c1d09c0"><enum>5.</enum><header>Amendments to the 21st Century IDEA Act</header><text display-inline="no-display-inline">Section 3 of the 21st Century Integrated Digital Experience Act (<external-xref legal-doc="usc" parsable-cite="usc/44/3501">44 U.S.C. 3501</external-xref> note) is amended—</text><paragraph id="idf015acd9a1be4e08a2ad482af10b2494"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id606A97B77B164256A323C728DE3D2C2D"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>Not later</quote> and inserting <quote>Except as provided in paragraph (9), not later</quote>; </text></subparagraph><subparagraph id="id7F7E3E61009B4DBEBF6408B6FFEC45F7"><enum>(B)</enum><text>in paragraph (7), by striking <quote>and</quote> at the end; </text></subparagraph><subparagraph id="id08F948679E6A47039356C9BC6AD13F2C"><enum>(C)</enum><text>in paragraph (8), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="idFD0F0BFF4BA54D2A913D599AD2D4E1F4"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF715D4970675458E8058B8C11409DF58"><paragraph id="id388456c8a971410e9d948f2bd18c2f10"><enum>(9)</enum><text>is drafted using plain writing (as defined in section 2 of the <short-title>Clear and Concise Content Act of 2023</short-title>), as is required under section 4 of such Act for covered content (as defined in section 2 of such Act), by not later than 180 days after the date of enactment of such Act.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id4E3B2C1F196A4A3D9F8641D1037F6C2B"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="id4A375F8698AD47DF9E6061613613C554"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>Not later</quote> and inserting <quote>Except as provided in paragraph (2), not later</quote>; and</text></subparagraph><subparagraph id="id76F67482E3484306BB9E0E1C3581C1B0"><enum>(B)</enum><text>by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFF946B5CAA8F40E1AE62496143412085"><paragraph id="id5d752fc8b9af41f69e39716ddbd0c14d"><enum>(2)</enum><text>by not later than 1 year after the date of enactment of the <short-title>Clear and Concise Content Act of 2023</short-title>, comply with the requirements under subsection (a).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="idda40b215d14f44cc9eceb9f4655565b3"><enum>6.</enum><header>Limitation on judicial enforceability</header><subsection id="id21ee6fd279b54d38ab96932741ac2ab8"><enum>(a)</enum><header>Judicial review</header><text>No court shall have jurisdiction over any claim related to any act or omission arising out of any provision of this Act.</text></subsection><subsection id="id7a12549f7a454bcb9f9087d3cc79da26"><enum>(b)</enum><header>Enforceability</header><text>No provision of this Act shall be construed to create any right or benefit, substantive or procedural, enforceable by any administrative or judicial action.</text></subsection></section><section id="idfc0ee26bd56e42dd8db81a7214cf9817"><enum>7.</enum><header>Repeal</header><text display-inline="no-display-inline">Effective on the date that is 1 year after the date of enactment of this Act, the Plain Writing Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/5/301">5 U.S.C. 301</external-xref> note) is repealed. </text></section></legis-body><endorsement><action-date>May 11, 2023</action-date><action-desc>Reported without amendment</action-desc></endorsement></bill>
