<congress display="yes">118th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 709</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To improve performance and accountability in the Federal Government, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Agency Performance Act of 2023</short-title></quote>.</text></section><section id="idD06CA3E3E6C645A8B1435EAF3D322F4C" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Establishment of Strategic Reviews and Reporting</header><subsection id="id1d7879d657d048c9ae5cafe89476c0cb" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Strategic Reviews</header><paragraph id="id2FE97C8F8DE848F39940106EEA85A04B" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1121 of title 31, United States Code, is amended—</text><subparagraph id="id1b98dc44a8c24809a5c60aadb8759027" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">by striking the section heading and inserting <quote><header-in-text level="section" style="USC">Progress reviews and use of performance information</header-in-text></quote>; and</text></subparagraph><subparagraph id="id4eb17c9813a84f7bb5c4577f8756aaa4" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id24c5b2bced0949bc868b884c92f5d24e"><subsection id="ida66951fe700d4395b2d2ccbf214936c6" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Agency reviews of progress towards strategic goals and objectives</header><paragraph id="id8162DF331AF24F8DAB03C751FEC42D64" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Covered Goal defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>covered goal</term> means a goal or objective established in the strategic plan of the agency under section 306(a) of title 5.</text></paragraph><paragraph id="id5C0FA44C9E514CFBAA3966864616A71E" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Review</header><text display-inline="yes-display-inline">Not less frequently than annually and consistent with guidance issued by the Director of the Office of Management and Budget, the head and Chief Operating Officer of each agency, shall—</text><subparagraph id="idb2ec97efdbcd4d7994b31e02d541df6e" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">for each covered goal, review with the appropriate agency official responsible for the covered goal—</text><clause id="id06FF8E461D7347138429B462F09EA8EF" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the progress achieved toward the covered goal—</text><subclause id="id37EF1E7BF498428DA976681A2693964B" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">during the most recent fiscal year; or </text></subclause><subclause id="id482A61FFD9A646FEB9EF149F3AE29F0D" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">from recent sources of evidence available at the time of the review; and</text></subclause></clause><clause id="idA9F9352BA0374C279B04C2B9628B9780" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the likelihood that the agency will achieve the covered goal;</text></clause></subparagraph><subparagraph id="id1482562c70134992997921cb784bcf64" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">coordinate with relevant personnel within and outside the agency who contribute to the accomplishment of each covered goal;</text></subparagraph><subparagraph id="ida92602538101449aa80d22b7401c6a70" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">assess progress toward each covered goal by reviewing performance information and other types of evidence relating to each covered goal, such as program evaluations and statistical data;</text></subparagraph><subparagraph id="id469ca57b54434b45b6376f154c964a8c" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">identify whether additional evidence is necessary to better assess progress toward each covered goal, and prioritize the development of the evidence described in subparagraph (C), such as through the plans required under section 312 of title 5, if applicable;</text></subparagraph><subparagraph id="id7192fa11d97c4dea96eba4e277acd9d2" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">assess whether relevant organizations, program activities, regulations, policies, and other activities contribute as planned to each covered goal;</text></subparagraph><subparagraph id="id845E111365074FC49859D61A6B03C437" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">as appropriate, leverage the assessment performed under subparagraph (E) as part of the portfolio reviews required under section 503(c)(1)(G);</text></subparagraph><subparagraph id="id6fbf2434d6c3447cb1468c002f5d9faf" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">identify any risks or impediments that would reduce or otherwise decrease the likelihood that the agency will achieve the covered goal; and</text></subparagraph><subparagraph id="id46006db5903e44789d323265a6a905b0" commented="no" display-inline="no-display-inline"><enum>(H)</enum><text display-inline="yes-display-inline">for each covered goal at greatest risk of not being achieved, identify prospects and strategies for performance improvement, including any necessary changes to program activities, regulations, policies, or other activities of the agency.</text></subparagraph></paragraph><paragraph id="idE15B61B349074FFAAF1D82C1EB8B43BB" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Support</header><text display-inline="yes-display-inline">In fulfilling the requirements of paragraph (2), the head and Chief Operating Officer of each agency shall be supported by—</text><subparagraph id="idBDD34128CF944DDF80DA957066BB05E1" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Performance Improvement Officer of the agency; </text></subparagraph><subparagraph id="idB939D0469B8C41989AEF951CFB5C1C3E" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">as appropriate, the Chief Data Officer, Evaluation Officer, Program Management Improvement Officer, and Statistical Official of the agency; and</text></subparagraph><subparagraph id="idC3DD0899437149F49E873FD7AA382344" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">any other senior agency official designated by the head of the agency, the sustained involvement of whom may help the agency increase the likelihood of achieving 1 or more covered goals.</text></subparagraph></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id86262034D1F54EDE9C52044D71111C46" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/11">Chapter 11</external-xref> of title 31, United States Code, is amended by striking the item relating to section 1121 and inserting the following:</text><toc><toc-entry bold="off" level="section"><quote>1121. Progress reviews and use of performance information.</quote>.</toc-entry></toc></paragraph></subsection><subsection id="id5a7b1dcae66b4c1eaad77934f9d9c83e" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Summary required</header><text display-inline="yes-display-inline">Section 1116 of title 31, United States Code, is amended—</text><paragraph id="idd2e560a740644c4b906b9639c7c457b0" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c)—</text><subparagraph id="idC4E18841C7674B70BA042E03913063B7" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (6)(E), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id937c9e2cada247308e8f0b3a15d805b5" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (7), by striking the period at the end and inserting <quote>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id225dd4668edf41d187e455b5465c95c5" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsections (f) through (i).</text></paragraph></subsection></section><section id="idde3f82c53a3e48188c9f36508ebab366" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Revisions to the Federal Performance Website</header><text display-inline="no-display-inline">Section 1122 of title 31, United States Code, is amended—</text><paragraph id="id8c8fc0b16e1c42bb8021e7a945db0cb2" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph id="idc6b99b9028074adc99a63549a5833d0d" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text><clause id="idCC69F00C37C24564B59BAB6395239743" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (C)—</text><subclause id="id555c01e3b4144c4a902decab8ba6023a" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">by inserting <quote>required to be included on the single website under subparagraph (A) and the information</quote>; before <quote>in the program inventory</quote>; and</text></subclause><subclause id="iddc4add0252824a36b0c871f452c06912" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">by striking <quote>and</quote> at the end;</text></subclause></clause><clause id="id4b9c46d2d56c4202aa96a66a62de6399" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause id="id828BE02C2ADA401D93B41BB2151574B4" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="USC" id="idD5A26A30AC104D54B0F2140F7155089F" act-name="" display-inline="no-display-inline"><subparagraph id="id7074A928B336456BBB0ADEC80A87D06E" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">ensure that the website described in subparagraph (A) conforms with the requirements for websites under section 3(a) of the 21st Century Integrated Digital Experience Act (<external-xref legal-doc="usc" parsable-cite="usc/44/3501">44 U.S.C. 3501</external-xref> note).</text></subparagraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idF50AE02895ED462EA9A47DC110D43A7B" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking subparagraph (A) and inserting the following:</text><quoted-block style="USC" id="id28B38217F7AF41FA93CB4C9D83765BF5" act-name="" display-inline="no-display-inline"><subparagraph id="id7FA78167C1C44DE0BB77C0C81CA63808" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">archive and preserve—</text><clause id="id66F7E879AD2F423F9BAD8E3146BC8747" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the information included in the program inventory required under paragraph (2)(B), including the information described in paragraph (3), after the end of the period during which that information is made available; and</text></clause><clause id="idE6A1B67AC27B4709AAF2B31249AE6DEA" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the information included in the single website under paragraph (2)(A) in accordance with subsections (b) and (c) after the end of the period during which such information is made available on the website; and</text></clause></subparagraph><after-quoted-block display="yes">;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3fa3acce2c0548468d5ec26d5a2006f6"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b), by striking paragraph (6) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8FA86FE440874FF3A9164F7AEF295A7F"><paragraph commented="no" display-inline="no-display-inline" id="id424ee49e2c6b4966b2915b8a49949e34"><enum>(6)</enum><text display-inline="yes-display-inline">the results achieved toward the agency priority goals established under section 1120(b)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd94f86f668b6414297ab60d2264be919"><enum>(A)</enum><text display-inline="yes-display-inline">during the most recent quarter and overall trend data for each quarter compared to the planned level of performance; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7b4ba7576e814786ba7ad6ce021a3438"><enum>(B)</enum><text display-inline="yes-display-inline">at the end of the 2-year agency priority goal period compared to the overall planned level of performance;</text></subparagraph></paragraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></paragraph><paragraph id="idf45aa3a4cac84fc299028392720fc205" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (c), by striking paragraph (5) and inserting the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id8d0c9ce00ede445586906b69d342e1f4"><paragraph id="id61ea164ef5c84a2c805c4b7864b2e715" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">the results achieved toward the priority goals developed under section 1120(a)(1)—</text><subparagraph id="id6d761f82be0743bf8970c6caa7ee61e8" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">during the most recent quarter and overall trend data for each quarter compared to the planned level of performance; and</text></subparagraph><subparagraph id="id72f93cc7266540d098b157e4d800b2e0" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">at the end of the 4-year Federal Government priority goal period compared to the overall planned level of performance;</text></subparagraph></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></section><section id="id26185811AB0847D8A23C8E514AE0DCBB" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Federal Government Priority Goals</header><text display-inline="no-display-inline">Section 1120(a)(2) of title 31, United States Code, is amended by striking the second sentence and inserting “Such goals shall—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id87667C2676C34F049675F16E0FEA96C4"><subparagraph id="id4919A740E3B441EC9AA3BC8AA3D93D26" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">be updated and revised not less frequently than during the first year of each Presidential term;</text></subparagraph><subparagraph id="id414E7AABE9E7462AADD01EE1BD0F595E" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">be made publicly available not less frequently than concurrently with the submission of the budget of the United States Government under section 1105(a) made during the first full fiscal year following any year during which a term of the President commences under section 101 of title 3;</text></subparagraph><subparagraph id="id34E53279B9B24BE3A7E9AF38732F179F" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">include plans for the successful achievement of each goal within each single Presidential term; and</text></subparagraph><subparagraph id="id280544E6CB984C0599362685ABCFA179" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">explicitly cite to any specific contents of the budget described in subparagraph (B) that support the achievement of each goal.</text></subparagraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></section><section id="id5AC906D82C6B46B08F3F41F4E9F3AE36" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Federal Government Priority Goal Co-Leaders</header><text display-inline="no-display-inline">Section 1115(a) of title 31, United States Code, is amended by striking paragraph (3) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9a44ac9907014cd18006aa66090cf68d"><paragraph id="id030a8dc6d97e4bb3b70df4d35a52f1cb" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">For each Federal Government performance goal, identify, as appropriate, not fewer than 2 lead Government officials who shall jointly be responsible for coordinating the efforts to achieve the goal, of whom—</text><subparagraph commented="no" id="idAE193592BFA94667A853905057E38C0E" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">not less than 1 shall be from the Executive Office of the President; and</text></subparagraph><subparagraph commented="no" id="idE21A282041664D19A7755DD6987923DD" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">not less than 1 shall be from an agency identified as contributing to the Federal Government performance goal described in paragraph (2);</text></subparagraph></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></section><section id="idd91d6e23f1c44f61968cd8ed4ae8f7b5" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Establishment of Deputy Performance Improvement Officers</header><text display-inline="no-display-inline">Section 1124(a) of title 31, United States Code, is amended—</text><paragraph id="idf5dccf45dafd42ea9e3350c77fce8623" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraph (1) and inserting the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idb0ca3cac7b2f404abedbf726a0eb5427"><paragraph id="id33f1c05aab104e23b9089f89f8fd9fd2" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">At each agency, the head of the agency, in consultation with the Chief Operating Officer of the agency, shall designate—</text><subparagraph id="id0a621264ac5a4c8da61c9f2d5b461764" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a Performance Improvement Officer, who shall be a senior executive of the agency; and</text></subparagraph><subparagraph id="id09bc73e7e12e47bcb69a073f48423ca9" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">if the Performance Improvement Officer designated under subparagraph (A) is not a career appointee of the Senior Executive Service, a Deputy Performance Improvement Officer, who shall be a career appointee of the Senior Executive Service.</text></subparagraph></paragraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></paragraph><paragraph id="idaf601c3f13a8419ebddbeb613a87f80b" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id716A4F7C94694DCAAACF2854D8636C6C"><paragraph id="id5C3575CB52D34F5DA3EE7AC8D5B6AA15" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Deputy Performance Improvement Officer</header><text display-inline="yes-display-inline">A Deputy Performance Improvement Officer designated under paragraph (1)(B) shall support the Performance Improvement Officer in carrying out the functions of the Performance Improvement Officer under paragraph (2).</text></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></section><section id="idbe6e3e4ea86745eb841c539339854540" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Repeal of Outdated Pilot Projects</header><subsection id="idD34330A968EC4A4DB376C5904AAB4DA5" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/11">Chapter 11</external-xref> of title 31, United States Code, is amended by striking sections 1118 and 1119.</text></subsection><subsection id="id97bbfdce2b6e4c3c92fbf7ea3a60af5d" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">Section 9704 of title 31, United States Code, is amended—</text><paragraph id="id61D6A837E61841618D3E5ABE9F0368F2" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (c); and</text></paragraph><paragraph id="id34f3c19f04174f6bb89229ac1fa083ae" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (9), in the matter preceding subparagraph (A), by inserting <quote>with respect to the head of an agency required to develop a plan described in subsection (a) or (b) of section 312,</quote> before <quote>an assessment</quote>.</text></paragraph></subsection><subsection id="id51cc8c2e0e624ff2911426dd583c1fdb" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Clarification of Timing of Agency Performance Report</header><text display-inline="yes-display-inline">Section 1116(b)(1) of title 31, United States Code, is amended by striking <quote>shall occur no less than 150 days after</quote> and inserting <quote>shall occur not later than 150 days after</quote>.</text></subsection></section><section id="id3192121e982c4785a5a7a5a98b77c15f" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">GAO report</header><text display-inline="no-display-inline">Not later than 18 months after the date of enactment of this Act, the Comptroller General of the United States shall submit to the<committee-name committee-id="SSGA00"> Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Oversight and Accountability of the House of Representatives</committee-name> a report on the effectiveness of this Act and the amendments made by this Act.</text></section></legis-body><attestation><attestation-group><attestation-date date="20240208" legis-day="20240207" chamber="Senate">Passed the Senate February 8 (legislative day, February 7), 2024.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
