which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize the Secretary of Homeland Security to suspend the entry of aliens in order to achieve operational control of the border, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H6F84F0E8B9D24206B114056305EC7140"><section section-type="section-one" id="H0F90730105F8496087282F0175205219"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Border Safety and Security Act of 2023</short-title></quote>.</text></section><section id="HA2078AEA8B884F81A48308A841900B28"><enum>2.</enum><header>Suspension of entry of aliens</header><subsection id="HFEF5255AB7B44884B88FFAE18BB1820D"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HFBAA039FE20640B5A9D4322DCAB86BE1"><enum>(1)</enum><header>In general</header><text>Except as otherwise provided, the terms used in this section have the meanings given such terms in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>).</text></paragraph><paragraph id="HEDA6392933764424A1A93E0209670052"><enum>(2)</enum><header>Covered alien</header><text display-inline="yes-display-inline">The term <term>covered alien</term> means an alien seeking entry to the United States who is inadmissible under paragraph (6) or (7) of section 212(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)</external-xref>). </text></paragraph><paragraph id="H0927632DF4E4400AA38B00D08BA9248A" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Operational control</header><text>The term <term>operational control</term> has the meaning given such term in section 2(b) of the Secure Fence Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/8/1701">8 U.S.C. 1701</external-xref> note). </text></paragraph></subsection><subsection id="HCC5C0C695D844570B9B4D78DE25FD32F"><enum>(b)</enum><header>Authority To suspend entry of aliens at borders of the United States</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, if the Secretary of Homeland Security determines, in the discretion of the Secretary, that the suspension of the entry of covered aliens at an international land or maritime border of the United States is necessary in order to achieve operational control over such border, the Secretary may prohibit, in whole or in part, the entry of covered aliens at such border for such period as the Secretary determines is necessary for such purpose.</text></subsection><subsection id="H4C14716A7FB9407AA23371F86C45BFFA"><enum>(c)</enum><header>Required suspension of entry of aliens</header><text>Notwithstanding any other provision of law, the Secretary of Homeland Security shall prohibit the entry of covered aliens for any period during which the Secretary cannot—</text><paragraph id="HE99F86595B1247D4BF63148FFDCBD819"><enum>(1)</enum><text display-inline="yes-display-inline">detain such covered aliens in accordance with section 235(b)(1)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225(b)(1)(B)</external-xref>); or</text></paragraph><paragraph id="H8FFA6D21781345DCA895E212DB54791E"><enum>(2)</enum><text>place such covered aliens in a program consistent with section 235(b)(2)(C) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225(b)(2)(C)</external-xref>).</text></paragraph></subsection><subsection id="H387BBB812D564F0C89B5660CCF25F3D0"><enum>(d)</enum><header>Enforcement by State Attorneys General</header><text display-inline="yes-display-inline">The attorney general of a State, or another authorized State officer, alleging a violation of a subsection (c) that affects such State or its residents, may bring an action against the Secretary of Homeland Security on behalf of the residents of such State in an appropriate United States district court to obtain appropriate injunctive relief.</text></subsection></section></legis-body></bill>
