<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 68</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230125">January 25, 2023</action-date><action-desc><sponsor name-id="S412">Mr. Tuberville</sponsor> (for himself, <cosponsor name-id="S397">Mr. Braun</cosponsor>, <cosponsor name-id="S398">Mr. Cramer</cosponsor>, <cosponsor name-id="S411">Mr. Marshall</cosponsor>, <cosponsor name-id="S410">Ms. Lummis</cosponsor>, <cosponsor name-id="S404">Mr. Scott of Florida</cosponsor>, and <cosponsor name-id="S344">Mr. Hoeven</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Defense Production Act of 1950 to prevent harm and disruption to the United States agriculture industry by protecting against foreign influence over agriculture production and supply chains, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HBC074171479748BEB22E6AFEBB510432"><section section-type="section-one" id="HA8E1CDC3F85A431EB97AD4AA8294F6EA"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Foreign Adversary Risk Management Act</short-title></quote> or the <quote><short-title>FARM Act</short-title></quote>.</text></section><section id="H2C6401E175484271B8EB2AE110A801F8"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H979206E0E348416792B49986A9FDA8F3"><enum>(1)</enum><text display-inline="yes-display-inline">United States agriculture and supply chains are critical to United States economic success and prosperity, and should each be classified as critical infrastructure and critical technologies.</text></paragraph><paragraph id="H0151421DA4514801A78ED60D057CC46B"><enum>(2)</enum><text>Agriculture is the lifeblood that helps to feed United States families nationwide. As such, food security is a matter of national security and should be a top priority of the United States.</text></paragraph><paragraph id="H25A5B0E6B95247C388E470FFCEA98F53"><enum>(3)</enum><text>To prevent harm to the United States public health sector and to prevent disruption to the United States economy and food supply chains, the increasing influence foreign countries may have on the United States agriculture industry and agriculture supply chains should be mitigated.</text></paragraph></section><section id="H7B7352E64463430482BAC32D0B303B31"><enum>3.</enum><header>United States agriculture included in Committee on Foreign Investment in the United States</header><subsection id="H7D64381B9E1B40579C5527435524C482"><enum>(a)</enum><header>Agriculture representative</header><text display-inline="yes-display-inline">Section 721(k)(2) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565(k)(2)</external-xref>) is amended—</text><paragraph id="H135C30EED5AB42A2900CA5F409B06B39"><enum>(1)</enum><text>by redesignating subparagraphs (H), (I), and (J) as subparagraphs (I), (J), and (K), respectively; and</text></paragraph><paragraph id="HD9056DC45B9E40C483CD38709EDD23EA"><enum>(2)</enum><text>by inserting after subparagraph (G) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H50E3CB4809A64771999C9A62C44FFAC9"><subparagraph id="H95A5501343DA490B83E2C1FD7DEC5E9E"><enum>(H)</enum><text display-inline="yes-display-inline">The Secretary of Agriculture.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HC2839A3CABE0461895B3945F242BB0FC"><enum>(b)</enum><header>Review of agriculture investments by foreign entities</header><text display-inline="yes-display-inline">Section 721(a)(4) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565(a)(4)</external-xref>) is amended—</text><paragraph id="id31253ECA3569458EBA2901607239788D"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A)—</text><subparagraph id="id608D4FFD5D984FDBA40A2E190D53BBDA"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (i), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="id062B623A36BE4B1A8646438817B28B12"><enum>(B)</enum><text>in clause (ii), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="idDEB5A8736E9D4FC6A1449114F8F4E882"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA9BD538E6C3A40E7879069AD527B7242"><clause id="id29E7401DD9504C8A93E4341628A4F444"><enum>(iii)</enum><text>any transaction described in subparagraph (B)(vi) that is proposed, pending, or completed on or after the date of the enactment of the <short-title>Foreign Adversary Risk Management Act</short-title>.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id8AEAD23725244703BBE78C75672F43DA"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B), by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H59B1C1C02800460E9A8CF420577167BF"><clause id="HCC73BACD31B44DCC859EDFAA1CF29EE3"><enum>(vi)</enum><text display-inline="yes-display-inline">Any transaction, merger, acquisition, transfer, agreement, takeover, or other arrangement that could result in foreign control of any United States business that is engaged in agriculture and uses agricultural products (as defined in the first section of the Act of July 2, 1926 (44 Stat. 802, chapter 725; <external-xref legal-doc="usc" parsable-cite="usc/7/451">7 U.S.C. 451</external-xref>)).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA7EF3D8079A84EB8971F96B54B47CFF7"><enum>(c)</enum><header>Agricultural supply chains included in critical infrastructure</header><text display-inline="yes-display-inline">Section 721(a)(5) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565(a)(5)</external-xref>) is amended—</text><paragraph id="H62B55C4D74B346F8872D5F9DD9FC8C7F"><enum>(1)</enum><text>by striking <quote><quote>critical infrastructure</quote> means</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="H4690935E59C9403CA8832B0BB02D865D"><text><quote>critical infrastructure</quote>—</text><subparagraph id="HC9CA300C5CA745D3BF2F4F56D5B447BA"><enum>(A)</enum><text display-inline="yes-display-inline">means</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HDB9492B7A3FD4D3EA16353C8FDBA7029"><enum>(2)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H6C9C6D4DEDC3438AADC47601883F6946"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1C54A0B5DC6642AAA8F9C3DD08F7582C"><subparagraph id="H0BB6995085C44280B3016D21B8E1F27C"><enum>(B)</enum><text display-inline="yes-display-inline">includes, subject to regulations prescribed by the Committee, agricultural systems and supply chains.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H3816EFD0C82645DF888FB53F806DB7F5"><enum>(d)</enum><header>Agricultural supply chains included as critical technologies</header><text display-inline="yes-display-inline">Section 721(a)(6)(A) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565(a)(6)(A)</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="HDA6EA7F1C081436E9238582A03AC16D0"><clause id="H3A3A24A306C94BAA899BA548A49E0E25"><enum>(vii)</enum><text display-inline="yes-display-inline">Agricultural supply chains used for agricultural products (as defined in the first section of the Act of July 2, 1926 (44 Stat. 802, chapter 725; <external-xref legal-doc="usc" parsable-cite="usc/7/451">7 U.S.C. 451</external-xref>)).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HA335338F13B644D982E697C3C653C3C4"><enum>4.</enum><header>Reports on investments by foreign countries in United States agriculture industry</header><text display-inline="no-display-inline">Not later than one year after the date of the enactment of this Act, the Secretary of Agriculture and the Comptroller General of the United States shall each—</text><paragraph id="H5CE0385191D84C828A23C6AFBFFA0F18"><enum>(1)</enum><text>conduct an analysis of foreign influence in the United States agriculture industry; and</text></paragraph><paragraph id="H9EDA770DA15B4256A2351CA622947BDF"><enum>(2)</enum><text>submit to Congress a report that includes a summary of—</text><subparagraph id="H27F3342153564E7DBE5EF33187D8378A"><enum>(A)</enum><text>foreign investments in the United States agriculture industry;</text></subparagraph><subparagraph id="H0D9B6E61ED27457AA82F5E3F9212DA36"><enum>(B)</enum><text>the potential for foreign investment to undermine United States agriculture production and agricultural supply chains;</text></subparagraph><subparagraph id="HF357AFDF8FED43439C4A53FD0B65CA2B"><enum>(C)</enum><text>the largest international threats for increased foreign control of, and investment in, the United States agriculture sector; and</text></subparagraph><subparagraph id="H1119FD617F4D4347B2D5EF61499D8B20"><enum>(D)</enum><text>agriculture-related espionage and theft techniques used by foreign governments, including any attempts to target United States agricultural intellectual property, innovation, research and development, cost or pricing data, or internal strategy documents.</text></subparagraph></paragraph></section></legis-body></bill>
