<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 683</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230307">March 7, 2023</action-date><action-desc><sponsor name-id="S413">Mr. Padilla</sponsor> (for himself and <cosponsor name-id="S221">Mrs. Feinstein</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To modify the boundary of the Berryessa Snow Mountain National Monument to include certain Federal land in Lake County, California, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H2BF6A3E07517490DAC0DCA5D489AF1CF"><section section-type="section-one" id="H06EDE65289614A90954DEA742B2FFD55"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Berryessa Snow Mountain National Monument Expansion Act</short-title></quote>.</text></section><section id="HD957713463D44F14BF9A5F1CBAA26D02"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id7B6D7A25576046C69E20560F7F299552"><enum>(1)</enum><header>Board</header><text>The term <quote>Board</quote> means the Board on Geographic Names established by section 2 of the Act of July 25, 1947 (61 Stat. 456, chapter 330; <external-xref legal-doc="usc" parsable-cite="usc/43/364a">43 U.S.C. 364a</external-xref>).</text></paragraph><paragraph id="H04B9E13FE1C5453B9A7A9C764D71EEDB"><enum>(2)</enum><header>Map</header><text display-inline="yes-display-inline">The term <term>Map</term> means the map entitled <quote>Proposed Walker Ridge (Molok Luyuk) Addition Berryessa Snow Mountain National Monument</quote> and dated October 26, 2021.</text></paragraph><paragraph id="H9F4325CA94F148589D99E52C60BBD739"><enum>(3)</enum><header>Molok Luyuk</header><text display-inline="yes-display-inline">The term <term>Molok Luyuk</term> means Condor Ridge (in the Patwin language).</text></paragraph><paragraph id="HAB6C71257BC8405A89B6C7458B675D90"><enum>(4)</enum><header>National monument</header><text display-inline="yes-display-inline">The term <term>National Monument</term> means the Berryessa Snow Mountain National Monument established by Presidential Proclamation 9298, dated July 10, 2015 (80 Fed. Reg. 41975), including all land, interests in the land, and objects on the land identified in that Presidential Proclamation.</text></paragraph><paragraph id="idBA12262AC0624FADBAF9DDE0394689D9"><enum>(5)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the Interior.</text></paragraph><paragraph display-inline="no-display-inline" id="H412924118C3E4D26B2735E7B7C80CFF1"><enum>(6)</enum><header>Walker Ridge (Molok Luyuk) Addition</header><text display-inline="yes-display-inline">The term <term>Walker Ridge (Molok Luyuk) Addition</term> means the approximately 3,925 acres of Federal land (including any interests in, or objects on, the land) administered by the Bureau of Land Management in Lake County, California, and identified as <quote>Proposed Walker Ridge (Molok Luyuk) Addition</quote> on the Map.</text></paragraph></section><section id="HECC2FF92CDC4479FB86BFA0E60F5E33D"><enum>3.</enum><header>National monument expansion</header><subsection id="H6A2934F8F2B349D9851AA3C5C1F4E053"><enum>(a)</enum><header>Boundary modification</header><text display-inline="yes-display-inline">The boundary of the National Monument is modified to include the Walker Ridge (Molok Luyuk) Addition.</text></subsection><subsection id="H9FE5FB52272E40DC9A942D45537117EB"><enum>(b)</enum><header>Map</header><paragraph id="H5A8601439C034F20ABD18E0BFC1835B0"><enum>(1)</enum><header>Corrections</header><text display-inline="yes-display-inline">The Secretary may make clerical and typographical corrections to the Map.</text></paragraph><paragraph id="HE26147F0E9464860A5C2B0D0706FAC86"><enum>(2)</enum><header>Public availability; effect</header><text>The Map and any corrections to the Map under paragraph (1) shall—</text><subparagraph id="id1536401126C9455DB2CD6AD4FC0A33AB"><enum>(A)</enum><text>be publicly available on the website of the Bureau of Land Management; and</text></subparagraph><subparagraph id="idF4A05D0358D44BDA830DD8568C28D04D"><enum>(B)</enum><text>have the same force and effect as if included in this Act.</text></subparagraph></paragraph></subsection><subsection id="H9E6322D8F0684134A2BE3956C6203FAB"><enum>(c)</enum><header>Administration</header><text display-inline="yes-display-inline">Subject to valid existing rights, the Secretary shall administer the Walker Ridge (Molok Luyuk) Addition—</text><paragraph id="H38170931A9D642D48A8B72A73343C0DA"><enum>(1)</enum><text>as part of the National Monument;</text></paragraph><paragraph id="HFC1EBEDF4CC447E49017866340A17D54"><enum>(2)</enum><text display-inline="yes-display-inline">in accordance with Presidential Proclamation 9298, dated July 10, 2015 (80 Fed. Reg. 41975); and</text></paragraph><paragraph id="HC74B5B69A1FD4375B27BB6097EF6BC0C"><enum>(3)</enum><text>in accordance with applicable laws (including regulations).</text></paragraph></subsection></section><section id="H41F1CC5A79F44129B3A420DC5A6CA92F"><enum>4.</enum><header>Management plan</header><subsection id="H2449747D000A43599DDDD435626C9378"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary and the Secretary of Agriculture shall jointly develop a comprehensive management plan for the National Monument in accordance with, and in a manner that fulfills the purposes described in, Presidential Proclamation 9298, dated July 10, 2015 (80 Fed. Reg. 41975).</text></subsection><subsection commented="no" id="HEB204B6EE8754355B7D5408205061F00"><enum>(b)</enum><header>Tribal Consultation</header><text display-inline="yes-display-inline">The Secretary and the Secretary of Agriculture shall consult with affected federally recognized Indian Tribes in—</text><paragraph commented="no" id="HAE40D9EE53EC49E1AC8F01F4BEC4528B"><enum>(1)</enum><text>the development of the management plan under subsection (a); and</text></paragraph><paragraph id="HDB7368CB31F643438C4C73CC477F767C"><enum>(2)</enum><text>making management decisions relating to the National Monument.</text></paragraph></subsection><subsection commented="no" id="HC017C9C4AF814A46985E49E98815A46A"><enum>(c)</enum><header>Continued engagement with Indian Tribes</header><text display-inline="yes-display-inline">The management plan developed under subsection (a) shall set forth parameters for continued meaningful engagement with affected federally recognized Indian Tribes in the implementation of the management plan.</text></subsection><subsection id="idF3009849D91A4CEFA6D5B24DF0C3A961"><enum>(d)</enum><header>Effect</header><text>Nothing in this Act affects the conduct of fire mitigation or suppression activities at the National Monument, including through the use of existing agreements. </text></subsection></section><section id="HCAF1A54A14F54FAE8EE744907DAB80CF"><enum>5.</enum><header>Agreements and partnerships</header><text display-inline="no-display-inline">To the maximum extent practicable and in accordance with applicable laws, on request of an affected federally recognized Indian Tribe, the Secretary (acting through the Director of the Bureau of Land Management) and the Secretary of Agriculture (acting through the Chief of the Forest Service) shall enter into agreements, contracts, and other cooperative and collaborative partnerships with the federally recognized Indian Tribe regarding management of the National Monument under relevant Federal authority, including—</text><paragraph id="H69ACE1B60FF9444F91E87558DA30A7C0"><enum>(1)</enum><text display-inline="yes-display-inline">the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5301">25 U.S.C. 5301 et seq.</external-xref>);</text></paragraph><paragraph id="H324AAD4213F447E19EA38D593DB621EC"><enum>(2)</enum><text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>);</text></paragraph><paragraph id="HE4487EF0A9D5476A9374E194091641E9"><enum>(3)</enum><text>the Tribal Self-Governance Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5361">25 U.S.C. 5361 et seq.</external-xref>);</text></paragraph><paragraph id="HF028B026B81446A78ABCD7ED2CE14778"><enum>(4)</enum><text>the Tribal Forest Protection Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/25/3115a">25 U.S.C. 3115a et seq.</external-xref>);</text></paragraph><paragraph id="ide2a7a9883bc4433487fb5799c1ef6862"><enum>(5)</enum><text>the good neighbor authority under section 8206 of the Agricultural Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/16/2113a">16 U.S.C. 2113a</external-xref>); </text></paragraph><paragraph id="H7D8DF21C7FF14586B7F6EED171431794"><enum>(6)</enum><text>Executive Order 13175 (<external-xref legal-doc="usc" parsable-cite="usc/25/5301">25 U.S.C. 5301</external-xref> note; relating to consultation and coordination with Indian Tribal governments); </text></paragraph><paragraph id="H1FA326EAFA1F4CA0A674B7E7C1461830"><enum>(7)</enum><text>Secretarial Order 3342, issued by the Secretary on October 21, 2016 (relating to identifying opportunities for cooperative and collaborative partnerships with federally recognized Indian Tribes in the management of Federal lands and resources); and</text></paragraph><paragraph id="H467ABBBB80084405BA6D7B49095413C8"><enum>(8)</enum><text>Joint Secretarial Order 3403, issued by the Secretary and the Secretary of Agriculture on November 15, 2021 (relating to fulfilling the trust responsibility to Indian Tribes in the stewardship of Federal lands and waters).</text></paragraph></section><section id="H6ACCD5375E084CEDA996A228A8A58272"><enum>6.</enum><header>Designation of Condor Ridge (Molok Luyuk) in Lake and Colusa Counties, California</header><subsection id="H3CBA9AFE86D4444891A79347C0D9B81A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The parcel of Federal land administered by the Bureau of Land Management located in Lake and Colusa Counties in the State of California and commonly referred to as <quote>Walker Ridge</quote> shall be known and designated as <quote>Condor Ridge (Molok Luyuk)</quote>.</text></subsection><subsection id="H7944696171274CFDAF32B288B984A87D"><enum>(b)</enum><header>References</header><text>Any reference in a law, map, regulation, document, paper, or other record of the United States to the parcel of Federal land described in subsection (a) shall be deemed to be a reference to <quote>Condor Ridge (Molok Luyuk)</quote>.</text></subsection><subsection id="H07DD38FC875843FE91D80DD2FE6640F7"><enum>(c)</enum><header>Map and legal description</header><paragraph id="H10E0C64401E440FDADCADF381B721C9E"><enum>(1)</enum><header>Preparation</header><subparagraph id="H148AFF2C59394C0D96712DC5DB86B9F8"><enum>(A)</enum><header>Initial map</header><text>The Board shall prepare a map and legal description of the parcel of Federal land designated by subsection (a).</text></subparagraph><subparagraph id="H081B5BA5744A48BB8861D0327B461E98"><enum>(B)</enum><header>Corrections</header><text display-inline="yes-display-inline">The Board and the Director of the Bureau of Land Management may make clerical and typographical corrections to the map and legal description prepared under subparagraph (A).</text></subparagraph></paragraph><paragraph id="H79F402549A4342D49E9B0C8CC0A3997C"><enum>(2)</enum><header>Consultation</header><text>In preparing the map and legal description under paragraph (1)(A), the Board shall consult with—</text><subparagraph id="H709D638B839946AF999502798CD50CFB"><enum>(A)</enum><text>the Director of the Bureau of Land Management; and</text></subparagraph><subparagraph id="H9988528408D04595BC3D90D920F50952"><enum>(B)</enum><text>affected federally recognized Indian Tribes.</text></subparagraph></paragraph><paragraph id="H72B0F89194BB44C4A96D588D465DE503"><enum>(3)</enum><header>Public availability; effect</header><text>The map and legal description prepared under paragraph (1)(A) and any correction to the map or legal description made under paragraph (1)(B) shall—</text><subparagraph id="idC6D0A71CBD10431B8B46A757D6BD55F1"><enum>(A)</enum><text>be publicly available on the website of the Board, the Bureau of Land Management, or both; </text></subparagraph><subparagraph id="idFCD961C895F14176B69DA63F526B436C"><enum>(B)</enum><text>be subject to a public notice and comment period of not less than 30 days; and </text></subparagraph><subparagraph id="idAF016A8D7BB141D0954F73522118DD10"><enum>(C)</enum><text>have the same force and effect as if included in this Act.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
