<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 678</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230307">March 7, 2023</action-date><action-desc><sponsor name-id="S153">Mr. Grassley</sponsor> (for himself, <cosponsor name-id="S311">Ms. Klobuchar</cosponsor>, <cosponsor name-id="S346">Mr. Lee</cosponsor>, and <cosponsor name-id="S253">Mr. Durbin</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Sherman Act to make oil-producing and exporting cartels illegal.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HA789098A14CB4EE6BDE707928568AB52"><section section-type="section-one" id="H855C370B0B0C4B13807FD57CDD19CAA2"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Oil Producing and Exporting Cartels Act of 2023</short-title></quote> or <quote><short-title>NOPEC</short-title></quote>.</text></section><section id="H0D5749873BF34405B78E1F0BA0EC7D4B"><enum>2.</enum><header>Sherman Act</header><text display-inline="no-display-inline">The Sherman Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1">15 U.S.C. 1 et seq.</external-xref>) is amended by adding after section 7 the following:</text><quoted-block style="OLC" id="H1EF606D820784052BBC6E1969952C4C6"><section id="HB6405F3173884F78952A0A510413DEA0"><enum>7A.</enum><header>Oil producing cartels</header><subsection id="HF14EFD9E04F7436D8B159896AFBFDB0F"><enum>(a)</enum><header>In general</header><text>It shall be illegal and a violation of this Act for any foreign state, or any instrumentality or agent of any foreign state, to act collectively or in combination with any other foreign state, any instrumentality or agent of any other foreign state, or any other person, whether by cartel or any other association or form of cooperation or joint action—</text><paragraph id="HCD4DB6AD05F244DEBCA90B0E1A9C63E0"><enum>(1)</enum><text>to limit the production or distribution of oil, natural gas, or any other petroleum product;</text></paragraph><paragraph id="H9203A0314C3F40CBBF1B855FB4E1ED13"><enum>(2)</enum><text>to set or maintain the price of oil, natural gas, or any petroleum product; or</text></paragraph><paragraph id="HF7E117BC16A448CB930D241092031638"><enum>(3)</enum><text>to otherwise take any action in restraint of trade for oil, natural gas, or any petroleum product,</text></paragraph><continuation-text continuation-text-level="subsection">when such action, combination, or collective action has a direct, substantial, and reasonably foreseeable effect on the market, supply, price, or distribution of oil, natural gas, or other petroleum product in the United States.</continuation-text></subsection><subsection id="H96DA6EA7A1B64B93A153B649E4897250"><enum>(b)</enum><header>Inapplicability of defenses</header><text>No court of the United States shall decline, based on the act of state, foreign sovereign compulsion, or political question doctrine to make a determination on the merits in an action brought under this section.</text></subsection><subsection id="HB88522AC5F1C4C96BC482666062FBB18"><enum>(c)</enum><header>Enforcement</header><text display-inline="yes-display-inline">The Attorney General of the United States shall have the sole authority to bring an action to enforce this section. Any such action shall be brought in any district court of the United States as provided under the antitrust laws.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HEF5A3F7AA06147E3B603A31FEF75E23E"><enum>3.</enum><header>No sovereign immunity in oil cartel cases</header><text display-inline="no-display-inline">Title 28, United States Code, is amended—</text><paragraph id="HAA3B539FC78E46D4A99EFED6237B8EAE"><enum>(1)</enum><text>in section 1605(a)—</text><subparagraph id="HF8C63ECD17B7489EA0587EE6F76D4302"><enum>(A)</enum><text>in paragraph (5), by striking <quote>or</quote> after the semicolon;</text></subparagraph><subparagraph id="H1D311400560E42359A85800442B6B198"><enum>(B)</enum><text>in paragraph (6), by striking the period and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="H453F1289865F4D3A8BBD702CA4E1B752"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" changed="deleted" id="HD5E9386EF3554DDB879F4FB7CB3A5595"><paragraph id="HD07F4EBFE7A84292B4D689E0F19FE176"><enum>(7)</enum><text display-inline="yes-display-inline">in which the action is brought under section 7A of the Sherman Act.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H1269463070B0463795C23817FCE16CA8"><enum>(2)</enum><text>in section 1610(a)—</text><subparagraph id="H3A59E6BA4E0743BC811BC7D22AC57DF4"><enum>(A)</enum><text>in paragraph (7) by striking the period at the end and inserting <quote>, or</quote>; and</text></subparagraph><subparagraph id="H37320B5DA7534114BA4ABEF5F9A1BE85"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" changed="deleted" id="H7C4229771EFA4F819EEA3421B6C1936A"><paragraph id="H6EC78133FAC94961B64876960FB1CBB1"><enum>(8)</enum><text display-inline="yes-display-inline">the judgment relates to a claim that is brought under section 7A of the Sherman Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="HE57DC91FCCB54C7D8893B9DDEE25D0A7"><enum>4.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act (or of an amendment made by this Act) is held invalid, the remainder of this Act (or of the amendment) shall not be affected thereby.</text></section></legis-body></bill>
