which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend sections 801 and 804 of title 5, United States Code, to include guidance issued by non-agencies, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="idabaa89a3facb4a3a998b9169751cb1b1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Checks and Balances Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id00A0E956682C41E9B304C9D15F93A1F8"><enum>2.</enum><header>Guidance issued by non-agencies</header><text display-inline="no-display-inline">Section 801 of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6525677265D24AF6BCDB9AC6D29FF4AD"><subsection id="id6AEA511667A2438B880D0E1D4448ACD0"><enum>(h)</enum><text>For purposes of Congressional review under this chapter—</text><paragraph id="idf68299c9909f4d65a96803f2905a704c"><enum>(1)</enum><text>guidance that directs the operations of a Federal agency and is issued by an entity with authority delegated by the President shall be considered a rule; and</text></paragraph><paragraph id="idd15daadf77fb452dbed473eba4254a91"><enum>(2)</enum><text>the entity that issues the guidance is required to comply with this chapter in the same manner as a Federal agency.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idA107D4E87DBA44DAA9B21AB10052CB9F"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 804 of title 5, United States Code, is amended—</text><paragraph id="id0D52DCA142234153BBC952C94A110845"><enum>(1)</enum><text>by striking paragraph (1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2AFFFFEFABF54B14938AC421A96C7AE0"><paragraph id="iddad48d5bd2ba46c2a4cc9fc92f0ac2d0"><enum>(1)</enum><text>The term <term>Federal agency</term>—</text><subparagraph id="idaba2b5be8283437a928769eb0583e7ff"><enum>(A)</enum><text>means any agency as that term is defined in section 551(1); and</text></subparagraph><subparagraph id="iddfe1ce7f28d242daa0dcfe64c6c73daf"><enum>(B)</enum><text>includes a task force or similar entity composed of members of an agency.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id2768FCE974F74EB8ABE8FFFC222F3D30"><enum>(2)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idE8EB3D580BBB473FB4CD4F1A37280DBE"><paragraph id="idB212248CF62D4835BF41C0B6312FEF91"><enum>(4)</enum><text>The term <term>guidance</term>—</text><subparagraph id="id2faab8eb91724501bec15473413dbce1"><enum>(A)</enum><text>means an agency statement of general applicability (other than a rule that has the force and effect of law promulgated in accordance with the notice and comment procedures under section 553) that—</text><clause id="idd8c3346cf1434580ac401d2bf4ed4301"><enum>(i)</enum><text>does not have the force and effect of law; and</text></clause><clause id="id0ec26177b985423ba66dfcb477111782"><enum>(ii)</enum><text>is designated by an agency official as setting forth—</text><subclause id="idc674d70205e142218b1482c97380eb81"><enum>(I)</enum><text>a policy on a statutory, regulatory, personnel, or technical issue; or</text></subclause><subclause id="id433cdbbb478a45a490d8e54972bbc96c"><enum>(II)</enum><text>an interpretation of a statutory or regulatory issue, including a personnel issue; and</text></subclause></clause></subparagraph><subparagraph id="idc801ef633c854e0b9d7da53106a5347a"><enum>(B)</enum><text>may include—</text><clause id="id38279bd0c77f42baaa4aa9b4e61c1117"><enum>(i)</enum><text>a memorandum;</text></clause><clause id="idd1503fa22c5f4a188ac4270a40b5659e"><enum>(ii)</enum><text>a notice;</text></clause><clause id="idd5b94f29ae4040e590e4f90f11e56572"><enum>(iii)</enum><text>a bulletin;</text></clause><clause id="id4bcea918f60949ea8ee6725354705d0d"><enum>(iv)</enum><text>a directive;</text></clause><clause id="id5079c71ab9a04fa4b3ccf14879b91f4b"><enum>(v)</enum><text>a letter;</text></clause><clause id="id283e65be92264ba69baa86aa81b979fa"><enum>(vi)</enum><text>a no-action letter; </text></clause><clause id="idD028ABA444934DC894C03082AC970AC1"><enum>(vii)</enum><text>any final agency action intended to impose restrictions on the management of Federal public land, including the withdrawal of Federal public land; and</text></clause><clause id="id4bf2a8efe9ab4f678e57f1caf2d836e1"><enum>(viii)</enum><text>any combination of the items described in clauses (i) through (vii).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
