which was read twice and referred to the <committee-name committee-id="SSSB00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Small Business and Entrepreneurship</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20230725">July 25, 2023</action-date><action-desc>Reported by <sponsor name-id="S308">Mr. Cardin</sponsor>, without amendment</action-desc></action><legis-type>A BILL</legis-type><official-title>To allow nonprofit child care providers to participate in certain loan programs of the Small Business Administration, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Business Child Care Investment Act</short-title></quote>.</text></section><section id="idB1AF31D4F7E04C3FB56539A714F3011D"><enum>2.</enum><header>Small business loans for nonprofit child care providers</header><subsection id="id5F65E618A29148F8A60C39FCCE26F600"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBA8293AF0A6747329DE09A1728C8322F"><paragraph id="id0D837607ECE4411894F22597C101740C"><enum>(10)</enum><header>Nonprofit child care providers</header><subparagraph id="idB6D2661E3DE049B99E03454CB5A4FDAB"><enum>(A)</enum><header>Definition</header><text>In this paragraph, the term <term>covered nonprofit child care provider</term> means an organization—</text><clause id="id29367CDBF6374B42943CDC304B4F2D52"><enum>(i)</enum><text>that—</text><subclause id="id09025FA16E2F467881204CF533CA261C"><enum>(I)</enum><text>is in compliance with licensing requirements for child care providers of the State in which the organization is located;</text></subclause><subclause id="ide0aa27e4774e4f96b8fb7a8ba3135bb6"><enum>(II)</enum><text>is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from tax under section 501(a) of such Code; </text></subclause><subclause id="ideb32d94c17ed492fb06c173725a32356"><enum>(III)</enum><text>is primarily engaged in providing child care for children from birth to compulsory school age; and</text></subclause><subclause id="idfd2ed4d9494e47d38b6cc978cf16f666"><enum>(IV)</enum><text>is in compliance with the size standards established under this subsection for business concerns in the applicable industry; </text></subclause></clause><clause id="idBFF599AE376F47528127F64F302B5F5A"><enum>(ii)</enum><text>for which each employee and regular volunteer complies with the criminal background check requirements under section 658H(b) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858f">42 U.S.C. 9858f(b)</external-xref>); </text></clause><clause id="id6AC96888D8D640FAA6793B1AAA731981"><enum>(iii)</enum><text>that may—</text><subclause id="id62F7DBC3321A4AE8B0CAFB51D53357DC"><enum>(I)</enum><text>provide care for school-age children outside of school hours or outside of the school year; or</text></subclause><subclause id="id4DCDEC98D5E441C98CCEFD67E713D3D6"><enum>(II)</enum><text>offer preschool or prekindergarten educational programs; and</text></subclause></clause><clause id="id2f75bccb2879495d9c48b4346dc7abf3"><enum>(iv)</enum><text>subject to any exemption under Federal law applicable to the organization, that certifies to the Administrator that the organization will not discriminate in any business practice, including providing services to the public, on the basis of race, color, religion, sex, sexual orientation, marital status, age, disability, or national origin. </text></clause></subparagraph><subparagraph id="id29EB971D4E3142718CBBA1B5A6D28B58"><enum>(B)</enum><header>Eligibility for certain loan programs</header><clause id="id9AD738D3CE9649999E136CBDF66BA167"><enum>(i)</enum><header>In general</header><text>Notwithstanding any other provision of this subsection, a covered nonprofit child care provider shall be deemed to be a small business concern for purposes of loans under section 7(a) of this Act or financing under title V of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/695">15 U.S.C. 695 et seq.</external-xref>). </text></clause><clause id="id8EA59B5111694A9DADEA1EBD6DE86A3F"><enum>(ii)</enum><header>Loan guarantee</header><text>A covered nonprofit child care center provider— </text><subclause commented="no" display-inline="no-display-inline" id="id1c80bec8481641c2823fb4a5009d741a"><enum>(I)</enum><text display-inline="yes-display-inline">shall obtain a guarantee of timely payment of the loan or financing from another person or entity to be eligible for a loan or financing of more than $500,000 under the authority under clause (i); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id4173d59437504aff97e9192f094c81ff"><enum>(II)</enum><text display-inline="yes-display-inline">shall not be required to obtain a guarantee of timely payment of the loan or financing to be eligible for a loan or financing that is not more than $500,000 under the authority under clause (i).</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id609a0f8365704a9aba65a903bded998f"><enum>(C)</enum><header>Limitation on basis for ineligibility</header><text display-inline="yes-display-inline">The Administrator may not determine that a covered nonprofit child care center provider is not eligible for a loan or financing described in subparagraph (B)(i) on the basis that the proceeds of the loan or financing will be used for a religious activity protected under the First Amendment to the Constitution of the United States, as interpreted by the courts of the United States.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id8763B57BF63C4E95B4608A623EE24CE4"><enum>(b)</enum><header>Reporting</header><paragraph id="idBD2DF0B75EAB4EC39CF1F9897EB9577E"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>covered nonprofit child care provider</term> has the meaning given the term in paragraph (10) of section 3(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632(a)</external-xref>), as added by subsection (a).</text></paragraph><paragraph id="idD04114BCCEFF451B98A33866A68B6E7E"><enum>(2)</enum><header>Requirement</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Administrator of the Small Business Administration shall submit to Congress a report that contains—</text><subparagraph id="id4ED35D4C67244804B7E73470E0D54E21"><enum>(A)</enum><text>for the year covered by the report— </text><clause commented="no" display-inline="no-display-inline" id="idcd9b4b22255842cb80c71347404a84c7"><enum>(i)</enum><text display-inline="yes-display-inline">the number of loans made under section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>) and the number of financings provided under title V of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/695">15 U.S.C. 695 et seq.</external-xref>) to covered nonprofit child care providers; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idD8FC01BFC94C4C80A4849BCEEC83235F"><enum>(ii)</enum><text display-inline="yes-display-inline">the amount of such loans made and the amount of such financings provided to covered nonprofit child care providers; and </text></clause></subparagraph><subparagraph id="id21EAB592034C4B239D6B46CD07B6261E"><enum>(B)</enum><text>any other information determined relevant by the Administrator.</text></subparagraph></paragraph></subsection></section></legis-body><endorsement><action-date date="20230725">July 25, 2023</action-date><action-desc>Reported without amendment</action-desc></endorsement></bill>
