which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20230530">May 30, 2023</action-date><action-desc>Reported by <sponsor name-id="S380">Mr. Peters</sponsor>, without amendment</action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 31, United States Code, to require the Chief Operating Officer of each agency to compile a list of unnecessary programs, and for other purposes.</official-title></form><legis-body><section section-type="section-one" id="id109ef55a-dad0-480d-a923-a680b6ddd0c7" changed="not-changed"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Identifying and Eliminating Wasteful Programs Act</short-title></quote>.</text></section><section id="idebc713fb-673f-4a77-96c1-8174f3736d87" changed="not-changed"><enum>2.</enum><header>Identification and elimination of unnecessary agency programs or program activities</header><subsection id="id7A5BD73570C44FF683536D8C537FCB9D" changed="not-changed"><enum>(a)</enum><header>Transparency of programs, priority goals, and results</header><text>Section 1122(a)(3)(D) of title 31, United States Code, is amended—</text><paragraph id="id0CA030F92EBC4632B6A4C6E0B7CD75EB" changed="not-changed"><enum>(1)</enum><text>by redesignating clauses (vi) and (vii) as clauses (vii) and (viii), respectively;</text></paragraph><paragraph id="id2A2F9ADA56F8491B8666144A86521FEE" changed="not-changed"><enum>(2)</enum><text>by inserting after clause (v) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8920905D85F54F1F92443958CE316B9B" changed="not-changed"><clause id="idEBA3BFFB65DE443B8DCBED2B4F6DD45D" changed="not-changed"><enum>(vi)</enum><text>to the extent practicable and consistent with guidance issued by the Director of the Office of Management and Budget, budget justification materials described in section 3(b)(2)(B) of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note);</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idB3FB41A834DF44C0A7883644E4F6F5A0" changed="not-changed"><enum>(3)</enum><text>in clause (vii), as so redesignated, by striking <quote>accountability; and</quote> and inserting <quote>accountability, including information included in the list compiled under section 1127(b)(1); and</quote>.</text></paragraph></subsection><subsection id="id8ad6fdbe-540c-4d24-8961-7b2571ac3fd6" changed="not-changed"><enum>(b)</enum><header>Identification of unnecessary agency programs or program activities</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/11">Chapter 11</external-xref> of title 31, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id3920cf65-c57b-4f95-8e21-3fcce6dc384d" changed="not-changed"><section id="id02f6c9c8-5c98-4822-ba23-52b409569fa5" changed="not-changed"><enum>1127.</enum><header>Identification of unnecessary agency programs or program activities</header><subsection id="id2c710544-5ac6-4105-bed1-67f264ce7720" changed="not-changed"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id6039cab9-5217-420d-a11c-f513a6862f86" changed="not-changed"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> has the meaning given the term in section 1108(a).</text></paragraph><paragraph id="idb62efb1d-4ada-4615-b6ce-d12458406b84" changed="not-changed"><enum>(2)</enum><header>Program</header><text>The term <term>program</term> has the meaning given the term in section 1122(a)(1).</text></paragraph><paragraph id="id3362f0e1-6f8b-4e3e-ae8d-86977da71c11" changed="not-changed"><enum>(3)</enum><header>Program activity</header><text>The term <term>program activity</term> has the meaning given the term in section 1115(h).</text></paragraph></subsection><subsection id="id99f46d8d-f154-478b-993b-464e277363b7" changed="not-changed"><enum>(b)</enum><header>Agency identification of unnecessary programs or program activities</header><text>Not later than 20 days after the date on which the President submits the budget of the United States Government under section 1105(a) each year, and based on guidance provided by the Director of the Office of Management and Budget, the Chief Operating Officer of each agency shall—</text><paragraph id="id15bd6e03-bcd2-42fe-b8a2-e4c2afaf4ee6" changed="not-changed"><enum>(1)</enum><text>compile a list that identifies any program or program activity of the agency that—</text><subparagraph id="id9F9F2C72288E4AAE9FF87670AC72E584" changed="not-changed"><enum>(A)</enum><text>is unnecessary, defunct, or unnecessarily duplicative of another program or program activity of the agency;</text></subparagraph><subparagraph id="idEB37A69C0E9242688DD5CD3973356737" changed="not-changed"><enum>(B)</enum><text>another agency could administer more effectively; or</text></subparagraph><subparagraph id="id99FD81EA2AB94C218509883588F52D0B" changed="not-changed"><enum>(C)</enum><text>could operate more effectively if the program or activity were consolidated with other programs or activities;</text></subparagraph></paragraph><paragraph id="id2C3367E037AA46458E5C0911D325C898" changed="not-changed"><enum>(2)</enum><text>publish the list compiled under paragraph (1) in—</text><subparagraph id="id526B67E103DA4CBB8DA54D75423CBEA3" changed="not-changed"><enum>(A)</enum><text>with respect to each list compiled before the date of the implementation described in section 9601(b)(3) of title XCVI of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="usc" parsable-cite="usc/31/1122">31 U.S.C. 1122</external-xref> note) of the program inventory described in section 1122(a)(2)(B)(i) of this title, the pilot program described in section 9601(b)(2)(B) of title XCVI of that Act; and</text></subparagraph><subparagraph id="idF4578F82539D46A888427063966D45C4" changed="not-changed"><enum>(B)</enum><text>with respect to each successive list, the program inventory described in section 1122(a)(2)(B)(i); and</text></subparagraph></paragraph><paragraph id="id382D09FD781243EEAE311C745D475ADD" changed="not-changed"><enum>(3)</enum><text>submit the list compiled under paragraph (1) to—</text><subparagraph id="idC0C410B17E4E48E28E625692947618B2" changed="not-changed"><enum>(A)</enum><text>the relevant congressional committees of jurisdiction of the agency;</text></subparagraph><subparagraph id="id6C910F2CC8D54A4785B41343A505D1FF" changed="not-changed"><enum>(B)</enum><text><committee-name committee-id="SSAP00">the Committee on Appropriations of the Senate</committee-name>;</text></subparagraph><subparagraph id="id6559E898BDE24C17BE3AE7BF6A6A53A8" changed="not-changed"><enum>(C)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate;</text></subparagraph><subparagraph id="id8AC140570FDA4DFFA6C1FDDBDC041095" changed="not-changed"><enum>(D)</enum><text>the Committee on Appropriations of the House of Representatives; and</text></subparagraph><subparagraph id="idA4C84EFBEA454A04807927CD4B3046A4" changed="not-changed"><enum>(E)</enum><text>the Committee on Oversight and Accountability of the House of Representatives.</text></subparagraph></paragraph></subsection><subsection id="idD8E8AD229E3D4F3ABAF6E48CB9F03B81" changed="not-changed"><enum>(c)</enum><header>Recommendations</header><text>Based on guidance issued by the Director of the Office of Management and Budget, the head of an agency may submit to Congress recommendations for statutory changes to eliminate or consolidate programs or program activities identified under subsection (b)(1).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="ida3a6cc0a-3cab-42ea-97e0-5118982e0c73" changed="not-changed"><enum>(c)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/11">chapter 11</external-xref> of title 31, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6401673b-730a-479a-ade0-e49b87c4b549" changed="not-changed"><toc changed="not-changed"><toc-entry bold="off" level="section" changed="not-changed">1127.
