<legis-type>A BILL</legis-type>
<official-title>To require the Secretary of Transportation to establish a grant program to support the use of hydrogen- or ammonia-fueled equipment at ports and to require the Secretary of the department in which the Coast Guard is operating to conduct a study, together with the Secretary of Energy and the Secretary of Transportation, regarding the feasibility and safety of using hydrogen and ammonia as fuels in maritime applications. </official-title>

<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hydrogen for Ports Act of 2023</short-title></quote>.</text></section> <section id="id55e3baaaf5d74952873a99fc534e6b8d"><enum>2.</enum><header>Maritime fuel modernization grant program</header> <subsection id="id050b77cd6e5c4d80b90516460a7be78e"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="id21de0ed58c32484bbf67a631d8b185f1"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means an entity described in subsection (d).</text></paragraph> <paragraph id="idfb0175ceff794645bf8fda01d7dbdc24"><enum>(2)</enum><header>Eligible fuel</header><text>The term <term>eligible fuel</term> means—</text>
<subparagraph id="id45B2B423263B417D929DC4CF7875D3F3"><enum>(A)</enum><text>hydrogen; or</text></subparagraph> <subparagraph id="id84ABE2C8B0F848ACA0FE5D1BAF39A9B8"><enum>(B)</enum><text>ammonia.</text></subparagraph></paragraph>
<paragraph id="id2ef4b392ad0d40638a47ddf251579491"><enum>(3)</enum><header>Low-income or disadvantaged community</header><text>The term <term>low-income or disadvantaged community</term> means a community (including a city, a town, a county, and any reasonably isolated and divisible segment of a larger municipality) with an annual median household income that is less than 100 percent of the statewide annual median household income for the State in which the community is located, according to the most recent decennial census.</text></paragraph> <paragraph id="id948350f60ae44856983f69684a77221f"><enum>(4)</enum><header>Program</header><text>The term <term>program</term> means the program established under subsection (b).</text></paragraph>
<paragraph id="idd155c6ce76834886bb0dae05259af517"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph> <paragraph id="idb38d1a7407ab43e19142b9c49f841500"><enum>(6)</enum><header>Tribal government</header><text>The term <term>Tribal government</term> means the recognized governing body of any Indian or Alaska Native Tribe, band, nation, pueblo, village, community, component band, or component reservation, individually identified (including parenthetically) on the list published most recently as of the date of enactment of this Act pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>).</text></paragraph></subsection>
<subsection id="id42c61424e2314da0b06fbbd489a1d736"><enum>(b)</enum><header>Establishment of program</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary, in coordination with the Secretary of Energy, shall establish a program under which the Secretary shall provide grants, on a competitive basis, to eligible entities for—</text> <paragraph id="idfeee3e75b88b459aa929ea99fd60c85f"><enum>(1)</enum><text>the purchase, installation, planning, design, or construction of, as appropriate—</text>
<subparagraph id="idd472c06294dc4f0b85895496b2ee89f2"><enum>(A)</enum><text>fuel cell cargo-handling equipment that uses an eligible fuel;</text></subparagraph> <subparagraph id="idf1201a90abe04c6297d328dbf77d98be"><enum>(B)</enum><text>fuel cell drayage or long-haul trucks that—</text>
<clause id="id9C023EB053024D8BBEC2A2D80E73D398"><enum>(i)</enum><text>use an eligible fuel; and</text></clause> <clause id="idC6786B4759A84B21B55ECE879BE63325"><enum>(ii)</enum><text>are for use at ports;</text></clause></subparagraph>
<subparagraph id="id2a0bd37e84334acea7413132566f778c"><enum>(C)</enum><text>fuel cell ferries, tugboats, dredging vessels, container ships, bulk carriers, fuel tankers, commercial fishing vessels, cruise ships, or other marine vessels that use an eligible fuel;</text></subparagraph> <subparagraph id="idccc6adadd4b547e7bbea356ff66cb403"><enum>(D)</enum><text>fuel cell locomotives that—</text>
<clause id="idF5CDEDFFDC474302B18B4987D4D8C5DF"><enum>(i)</enum><text>use an eligible fuel; and</text></clause> <clause id="id2543B3052B8540668878DE91916AEE6A"><enum>(ii)</enum><text>are for use at ports;</text></clause></subparagraph>
<subparagraph id="idd67722b6e5e14d189ce9abf90e847c61"><enum>(E)</enum><text>fuel cell shore power systems that—</text> <clause id="id1B003B743A974678B21CB23715961159"><enum>(i)</enum><text>use an eligible fuel; and</text></clause>
<clause id="id65C16BCD2506456C9EAD1DD44099B6A4"><enum>(ii)</enum><text>are used for ships while docked at port;</text></clause></subparagraph> <subparagraph id="idbec05a3afb2a426699560a3730d9529e"><enum>(F)</enum><text>onsite fuel cell power plants that—</text>
<clause id="id14A5D95B0E1644AD9025E8E46AB4EB55"><enum>(i)</enum><text>use an eligible fuel; and</text></clause> <clause id="id592A827DDDEC471D9CDE6944B422A0CA"><enum>(ii)</enum><text>are located at port facilities; or</text></clause></subparagraph>
<subparagraph id="id62cfe22ac1f14e0aa401cebeda240595"><enum>(G)</enum><text>port infrastructure for establishing or expanding the supply of eligible fuel for import, export, storage, bunkering, or fueling; and</text></subparagraph></paragraph> <paragraph id="id5cc24a64c0b341f39de3526a01d73d31"><enum>(2)</enum><text>the training of ship crew and shore personnel—</text>
<subparagraph id="id39B0B0A61A79406DBFE6923AA8565CBC"><enum>(A)</enum><text>to safely handle eligible fuel; and</text></subparagraph> <subparagraph id="idEFBBD3E76B6C4F4885F69D021FFEB87A"><enum>(B)</enum><text>to perform operation and maintenance on equipment that uses an eligible fuel.</text></subparagraph></paragraph></subsection>
<subsection id="id58c289973d0f4eb6934103d4561084e6"><enum>(c)</enum><header>Goals</header><text>The goals of the program shall be—</text> <paragraph id="id6448f05de3a84cc99e87e2224c0f39c1"><enum>(1)</enum><text>to demonstrate hydrogen, ammonia, or fuel cell technologies in maritime and associated logistics applications;</text></paragraph>
<paragraph id="id95f9993dbe04426e998aad15a204be13"><enum>(2)</enum><text>to assist in the development and validation of technical targets for hydrogen, ammonia, and fuel cell systems for maritime and associated logistics applications;</text></paragraph> <paragraph id="id3814b2fbf40e431abd27ac12cd0e309f"><enum>(3)</enum><text>to benchmark the conditions required for broad commercialization of hydrogen, ammonia, and fuel cell technologies in maritime and associated logistics applications;</text></paragraph>
<paragraph id="id50d2959324184c1e893c5f1a91be8651"><enum>(4)</enum><text>to assess the operational and technical considerations for—</text> <subparagraph id="id1AF75D515A384161B514BDC1657BBF86"><enum>(A)</enum><text>installing, constructing, and using hydrogen- or ammonia-fueled equipment; and</text></subparagraph>
<subparagraph id="id171FA2D3DFE447F6A474AB01805C8193"><enum>(B)</enum><text>supporting infrastructure at ports; and</text></subparagraph></paragraph> <paragraph id="id9ad826ca19614cd185dad4a7606a6941"><enum>(5)</enum><text>to reduce greenhouse gas emissions and improve air quality in areas located in and around ports.</text></paragraph></subsection>
<subsection id="ida2f8a009d4694022af40e58b6a8b6001"><enum>(d)</enum><header>Eligible entities</header>
<paragraph id="id679f0d56946a4f2098381df47ea81b62"><enum>(1)</enum><header>In general</header><text>An entity eligible to receive a grant under the program is—</text> <subparagraph id="idec4bfe0dd47943a5b27769caeb59e04b"><enum>(A)</enum><text>a State;</text></subparagraph>
<subparagraph id="id7cf9567635a244da8001a8996250a9ec"><enum>(B)</enum><text>a political subdivision of a State;</text></subparagraph> <subparagraph id="id9bc69fde63a8495c866630911dc0ebf8"><enum>(C)</enum><text>a local government;</text></subparagraph>
<subparagraph id="idc37bbcbafdae474bbb0c87b85bc7edcd"><enum>(D)</enum><text>a public agency or publicly chartered authority established by 1 or more States;</text></subparagraph> <subparagraph id="id274cbaff20414c2d93da6b10b5497c5a"><enum>(E)</enum><text>a special purpose district with a transportation function;</text></subparagraph>
<subparagraph id="id7b506041c2ac469c86153967cf56d487"><enum>(F)</enum><text>a Tribal government or a consortium of Tribal governments;</text></subparagraph> <subparagraph id="id7232a343755845c48c8484ec79deb59d"><enum>(G)</enum><text>a port authority for a port;</text></subparagraph>
<subparagraph id="id7b0d334469964c6eacafb63e2874959c"><enum>(H)</enum><text>an Alaska Native or Native Hawaiian entity that has jurisdiction over a port authority or a port;</text></subparagraph> <subparagraph id="id75883ef50862433a811e6eaa50280bc7"><enum>(I)</enum><text>a multistate or multijurisdictional group of entities described in any of subparagraphs (A) through (H); or</text></subparagraph>
<subparagraph id="id35c4085124734b0a804a6bd06b1eb72a"><enum>(J)</enum><text>subject to paragraph (2), a private entity or group of private entities, including the owners or operators of 1 or more facilities at a port.</text></subparagraph></paragraph> <paragraph id="id91c2deb1ff2d4f17af3eb361c2dedf4a"><enum>(2)</enum><header>Joint eligibility with private entities</header><text>A private entity or group of private entities is eligible for a grant under the program if—</text>
<subparagraph id="id8adc947e091c4d6786c588098f0b0305"><enum>(A)</enum><text>the private entity or group of private entities partners with an entity described in any of subparagraphs (A) through (I) of paragraph (1) for purposes of applying for, and carrying out activities under, the grant; and</text></subparagraph> <subparagraph id="idb7820801a8d84a6187caa1072a0cd177"><enum>(B)</enum><text>the entity described in the applicable subparagraph of paragraph (1) is the lead entity with respect to the application and those activities.</text></subparagraph></paragraph></subsection>
<subsection id="id1738c6b5296a4055992f0c137fa4b3ae"><enum>(e)</enum><header>Applications</header>
<paragraph id="idbc7f78a242234814a3fc21c708a9a7d3"><enum>(1)</enum><header>In general</header><text>An eligible entity desiring a grant under the program shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph> <paragraph id="id4826ab21cfb94da2a651ff231bd14546"><enum>(2)</enum><header>Requirement</header><text>The application of an eligible entity described in subparagraph (J) of subsection (d)(1) shall be submitted jointly with an entity described in subparagraphs (A) through (I) of that subsection.</text></paragraph></subsection>
<subsection id="id41d5bb241a904e49925d293107a30e29"><enum>(f)</enum><header>Considerations</header><text>In providing grants under the program, the Secretary, to the maximum extent practicable, shall select projects that—</text> <paragraph id="id999D0D011B084EB2BF39DC89C7D09AC3"><enum>(1)</enum><text>will generate the greatest benefit to low-income or disadvantaged communities;</text></paragraph>
<paragraph id="idbea295ab8e4b4df8b619289ad6b5e005"><enum>(2)</enum><text>represent a combination of land-side and vessel-side end-uses of eligible fuel;</text></paragraph> <paragraph id="ide276cb3137fb4c9cb8a433c783c53e4b"><enum>(3)</enum><text>maximize the creation or retention of jobs in the United States; and</text></paragraph>
<paragraph id="idb52f581c16c94fedbd229923251e2ca8"><enum>(4)</enum><text>provide the highest job quality.</text></paragraph></subsection> <subsection id="id971ccf713b344c539ce97bb20d8612d6"><enum>(g)</enum><header>Priority</header><text>In selecting eligible entities to receive grants under the program, the Secretary shall give priority to projects that will provide greater net impact in avoiding or reducing emissions of greenhouse gases.</text></subsection>
<subsection id="idcedb9dbf514943369efcc37aa838e0c3"><enum>(h)</enum><header>Leak detection</header><text>Each eligible entity that receives a grant under the program shall conduct—</text> <paragraph id="idb83b96cb19e74411b57e9aa389215873"><enum>(1)</enum><text>a hydrogen leakage monitoring, reporting, and verification (also known as <quote>MRV</quote>) program for all eligible fuel used by the eligible entity; and</text></paragraph>
<paragraph id="id5323c25c98bf4d3092f0c9662e4a451a"><enum>(2)</enum><text>a hydrogen leak detection and repair (also known as <quote>LDAR</quote>) program for all eligible fuel used by the eligible entity.</text></paragraph></subsection> <subsection id="id58bfac52888c48679340d313f3949061"><enum>(i)</enum><header>Funding</header> <paragraph id="idC2DD12611C784A7CB0D68B541B44F4C4"><enum>(1)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out the program $100,000,000 for each of fiscal years 2024 through 2028.</text></paragraph>
<paragraph id="id8dbed320835948639edd50e6f383bb30"><enum>(2)</enum><header>Human-operated equipment requirement</header><text>In carrying out the program, the Secretary shall ensure that funding is made available for each fiscal year for cargo-handling equipment that uses an eligible fuel and is human-operated.</text></paragraph></subsection></section> <section id="id8c333ff2301b4f5e8944beb9a2e89d77"><enum>3.</enum><header>Study on feasibility and safety of using hydrogen and ammonia as fuels in maritime applications</header> <subsection id="idf13baba85a2e48f58334a128c4bad118"><enum>(a)</enum><header>In general</header><text>Not later than 270 days after the date of enactment of this Act, the Secretary of the department in which the Coast Guard is operating, in consultation with the Secretary of Energy, the Secretary of Transportation, and the heads of other Federal departments and agencies, as appropriate, shall conduct, and submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report describing the results of, a study—</text>
<paragraph id="id7fda7ccb84244c0aadceff5e96e3f566"><enum>(1)</enum><text>to fully address the challenges to ensure the safe use and handling of hydrogen, ammonia, and other hydrogen-based fuels on vessels and in ports;</text></paragraph> <paragraph id="id42dbf1e1de4a4002b5f8374c5079ace6"><enum>(2)</enum><text>to identify, compare, and evaluate the feasibility of, the safety, environmental, and health impacts of, and best practices with respect to, the use of hydrogen-derived fuels, including ammonia, as a shipping fuel;</text></paragraph>
<paragraph id="id355e15b976f84f34a297bc961527cc08"><enum>(3)</enum><text>to identify and evaluate considerations for hydrogen and ammonia storage, including—</text> <subparagraph id="ide5ff6e7e5c3b4f6484c71eeea78612ac"><enum>(A)</enum><text>at ports;</text></subparagraph>
<subparagraph id="id9b5e92021fa2401b94dfc6edb3310c23"><enum>(B)</enum><text>on board vessels; and</text></subparagraph> <subparagraph id="id9db641ea3fc54c48babb76cb08e3227c"><enum>(C)</enum><text>for subsea hydrogen storage; and</text></subparagraph></paragraph>
<paragraph id="id0882e888ced1446d8c60226d367c68f6"><enum>(4)</enum><text>to assess the cost and value of a hydrogen or ammonia strategic reserve, either as a new facility or as a modification to the Strategic Petroleum Reserve established under part B of title I of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6231">42 U.S.C. 6231 et seq.</external-xref>).</text></paragraph></subsection> <subsection id="id749b1c11333a4244b202e1a90718c462"><enum>(b)</enum><header>Requirements</header><text>In carrying out subsection (a), the Secretary of the department in which the Coast Guard is operating shall—</text>
<paragraph id="id25f09394ec6a4bf784d62a9bb63a09fe"><enum>(1)</enum><text>consult with entities in the private sector with experience in the hydrogen or ammonia industry;</text></paragraph> <paragraph id="id8febc26059ef42d3b7dc4a5cb95b989c"><enum>(2)</enum><text>take into account lessons learned from demonstration projects in other industries, including—</text>
<subparagraph id="id9e939283361f4c4d9adc2ef789426fde"><enum>(A)</enum><text>projects carried out in the United States;</text></subparagraph> <subparagraph id="idf38ae3f2034545779c353646256fbd38"><enum>(B)</enum><text>projects carried out in other countries; and</text></subparagraph>
<subparagraph id="id5783930293cd4396a5255fa5852ea8db"><enum>(C)</enum><text>projects relating to the automotive industry, buses, petroleum refining, chemical production, fertilizer production, and stationary power; and</text></subparagraph></paragraph> <paragraph id="ida29adf48aeb14f7a80ec5bb492a10b23"><enum>(3)</enum><text>evaluate the applicability of the lessons described in paragraph (2) to the use of hydrogen in maritime and associated logistics applications.</text></paragraph></subsection></section>
