Revision of notice requirements regarding disclosure of extent of health plan coverage of abortion and abortion premium surcharges.</toc-entry></toc></subsection></section><title id="H8A4813EF7CB241D992F169A88C19CC55"><enum>I</enum><header>Prohibiting Federally Funded Abortions</header><section id="HD9ACEF2FB8B34F149FFFC16B1B0246F5"><enum>101.</enum><header>Prohibiting taxpayer funded abortions</header><text display-inline="no-display-inline">Title 1, United States Code, is amended by adding at the end the following new chapter:</text><quoted-block style="USC" display-inline="no-display-inline" id="HDD24BCC999E248039E508A9BAF247FDF"><chapter id="H22E59226DE9E4AE7A3E899477D3D0484"><enum>4</enum><header>Prohibiting taxpayer funded abortions</header><toc container-level="chapter-container" idref="H22E59226DE9E4AE7A3E899477D3D0484" lowest-bolded-level="division-lowest-bolded" lowest-level="section" quoted-block="no-quoted-block" regeneration="yes-regeneration"><toc-entry idref="HB5C5BB5137E54722A68398AA54661409" level="section">301. Prohibition on funding for abortions. </toc-entry><toc-entry idref="H9FD0A5E527214F46B0FEA78030C0523A" level="section">302. Application to District of Columbia.</toc-entry></toc><section id="HB5C5BB5137E54722A68398AA54661409"><enum>301.</enum><header>Prohibition on funding for abortions</header><text display-inline="no-display-inline">No funds authorized or appropriated by Federal law, and none of the funds in any trust fund to which funds are authorized or appropriated by Federal law, shall be expended for any abortion.</text></section><section id="H9FD0A5E527214F46B0FEA78030C0523A"><enum>302.</enum><header>Prohibition on funding for health benefits plans that cover abortion</header><text display-inline="no-display-inline">None of the funds authorized or appropriated by Federal law, and none of the funds in any trust fund to which funds are authorized or appropriated by Federal law, shall be expended for health benefits coverage that includes coverage of abortion.</text></section><section id="H3C10AE56E47B45D9BCCB6C5492DBC907"><enum>303.</enum><header>Limitation on Federal facilities and employees</header><text display-inline="no-display-inline">No health care service furnished—</text><paragraph id="H3B328F7F92C545B4930DA881A04D1B0F"><enum>(1)</enum><text>by or in a health care facility owned or operated by the Federal Government; or</text></paragraph><paragraph id="H96FF93F6777A4F50802968B53FDEC3CB"><enum>(2)</enum><text>by any physician or other individual employed by the Federal Government to provide health care services within the scope of the physician’s or individual’s employment,</text></paragraph><continuation-text continuation-text-level="section">may include abortion. </continuation-text></section><section id="HE75B70D4FC9846CD80C9A000436FA5A3"><enum>304.</enum><header>Construction relating to separate coverage</header><text display-inline="no-display-inline">Nothing in this chapter shall be construed as prohibiting any individual, entity, or State or locality from purchasing separate abortion coverage or health benefits coverage that includes abortion so long as such coverage is paid for entirely using only funds not authorized or appropriated by Federal law and such coverage shall not be purchased using matching funds required for a federally subsidized program, including a State’s or locality’s contribution of Medicaid matching funds.</text></section><section id="H334B7A8FA5E34473B9A5B73F77DA16BC"><enum>305.</enum><header>Construction relating to the use of non-Federal funds for health coverage</header><text display-inline="no-display-inline">Nothing in this chapter shall be construed as restricting the ability of any non-Federal health benefits coverage provider from offering abortion coverage, or the ability of a State or locality to contract separately with such a provider for such coverage, so long as only funds not authorized or appropriated by Federal law are used and such coverage shall not be purchased using matching funds required for a federally subsidized program, including a State’s or locality’s contribution of Medicaid matching funds.</text></section><section id="HAB160EE30E9A4DF5B8F97CC6E3B854DB"><enum>306.</enum><header>Non-preemption of other Federal laws</header><text display-inline="no-display-inline">Nothing in this chapter shall repeal, amend, or have any effect on any other Federal law to the extent such law imposes any limitation on the use of funds for abortion or for health benefits coverage that includes coverage of abortion, beyond the limitations set forth in this chapter.</text></section><section id="H248FD3D052474747A09A1DEE29C201C4"><enum>307.</enum><header>Construction relating to complications arising from abortion</header><text display-inline="no-display-inline">Nothing in this chapter shall be construed to apply to the treatment of any infection, injury, disease, or disorder that has been caused by or exacerbated by the performance of an abortion. This rule of construction shall be applicable without regard to whether the abortion was performed in accord with Federal or State law, and without regard to whether funding for the abortion is permissible under section 308.</text></section><section id="H5CA60E5A483F411B9D67D31194D85B46"><enum>308.</enum><header>Treatment of abortions related to rape, incest, or preserving the life of the mother</header><text display-inline="no-display-inline">The limitations established in sections 301, 302, and 303 shall not apply to an abortion—</text><paragraph id="H2777DC5B96A447699CE2FE0B73E60316"><enum>(1)</enum><text display-inline="yes-display-inline">if the pregnancy is the result of an act of rape or incest; or</text></paragraph><paragraph id="HA8CEB129ACEA456392C4E106593B73FC"><enum>(2)</enum><text>in the case where a woman suffers from a physical disorder, physical injury, or physical illness that would, as certified by a physician, place the woman in danger of death unless an abortion is performed, including a life-endangering physical condition caused by or arising from the pregnancy itself.</text></paragraph></section><section id="H2CDF522701F54389827A4AA05E1BF763"><enum>309.</enum><header>Application to District of Columbia</header><text display-inline="no-display-inline">In this chapter:</text><paragraph id="H42C2263C5A7046C19D6151FD54018A6D"><enum>(1)</enum><text display-inline="yes-display-inline">Any reference to funds appropriated by Federal law shall be treated as including any amounts within the budget of the District of Columbia that have been approved by an Act of Congress pursuant to section 446 of the District of Columbia Home Rule Act (or any applicable successor Federal law).</text></paragraph><paragraph id="HE56BD662ABB345AC8DD5974D4838F5B7"><enum>(2)</enum><text>The term <term>Federal Government</term> includes the government of the District of Columbia.</text></paragraph></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H26893AF7739541838F5CA3B2CCF5473F"><enum>102.</enum><header>Amendment to table of chapters</header><text display-inline="no-display-inline">The table of chapters for title 1, United States Code, is amended by adding at the end the following new item:</text><quoted-block style="USC" display-inline="no-display-inline" id="H25531728F77749C1ABF6C33E8D2FEC2D"><toc regeneration="no-regeneration"><multi-column-toc-entry bold="on" level="section"><toc-enum>4.</toc-enum><level-header bold="on" level="section">Prohibiting taxpayer funded abortions</level-header><target>301</target></multi-column-toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></section></title><title id="HFE692C044EB64E9A9E9B0C5EB64891AD"><enum>II</enum><header>Application under the Affordable Care Act</header><section id="HEDD23D2F34FC4E6BAA0B30BBF0E96DEE"><enum>201.</enum><header>Clarifying application of prohibition to premium credits and cost-sharing reductions under ACA</header><subsection display-inline="no-display-inline" id="H02A00C8FE0AB4386BFF76F30B709EB62"><enum>(a)</enum><header>In general</header><paragraph id="H3E5F7D1E6D1D49749D5D71EBD632CC7A"><enum>(1)</enum><header>Disallowance of refundable credit and cost-sharing reductions for coverage under qualified health plan which provides coverage for abortion</header><subparagraph id="H123CBA6DCF214F32A3B1FAC580645EBF"><enum>(A)</enum><header>In general</header><text>Subparagraph (A) of <external-xref legal-doc="usc" parsable-cite="usc/26/36B">section 36B(c)(3)</external-xref> of the Internal Revenue Code of 1986 is amended by inserting before the period at the end the following: <quote>or any health plan that includes coverage for abortions (other than any abortion or treatment described in section 307 or 308 of title 1, United States Code)</quote>.</text></subparagraph><subparagraph id="H20AA620E0A01431BB033820EDF7AB173"><enum>(B)</enum><header>Option to purchase or offer separate coverage or plan</header><text display-inline="yes-display-inline">Paragraph (3) of section 36B(c) of such Code is amended by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB81F73B767DB43CAB899156AD1FDF06A"><subparagraph id="H87BB2AEA79F148E2A469D26A3987E7B2"><enum>(C)</enum><header>Separate abortion coverage or plan allowed</header><clause id="H43722AC7BF0C42CFBD57C28B0A7DBB3B"><enum>(i)</enum><header>Option to purchase separate coverage or plan</header><text display-inline="yes-display-inline">Nothing in subparagraph (A) shall be construed as prohibiting any individual from purchasing separate coverage for abortions described in such subparagraph, or a health plan that includes such abortions, so long as no credit is allowed under this section with respect to the premiums for such coverage or plan.</text></clause><clause id="HEE8C9F3C67DC4133906D9FB34E4843D4"><enum>(ii)</enum><header>Option to offer coverage or plan</header><text>Nothing in subparagraph (A) shall restrict any non-Federal health insurance issuer offering a health plan from offering separate coverage for abortions described in such subparagraph, or a plan that includes such abortions, so long as premiums for such separate coverage or plan are not paid for with any amount attributable to the credit allowed under this section (or the amount of any advance payment of the credit under section 1412 of the Patient Protection and Affordable Care Act).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HB11090BC9C6148CE90589B651641CE38"><enum>(2)</enum><header>Disallowance of small employer health insurance expense credit for plan which includes coverage for abortion</header><text>Subsection (h) of <external-xref legal-doc="usc" parsable-cite="usc/26/45R">section 45R</external-xref> of the Internal Revenue Code of 1986 is amended—</text><subparagraph display-inline="no-display-inline" id="H662672974FBB4E7DAC3E5FCB74F46CEA"><enum>(A)</enum><text>by striking <quote>Any term</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H566B969A7D9740D08624F05D690E5D6A"><paragraph id="H18C039104BC74AF590B66C95EBE21F30"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Any term</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HA96BD997AD524FBE95F573950501F106"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3DBE6681C5934E1F9AF331DCA32CC95E"><paragraph id="HA6B2FE79E32D4A6BB979DDB56D61E307"><enum>(2)</enum><header>Exclusion of health plans including coverage for abortion</header><subparagraph id="H40B339E033CF46349955678165F644EE"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>qualified health plan</term> does not include any health plan that includes coverage for abortions (other than any abortion or treatment described in section 307 or 308 of title 1, United States Code).</text></subparagraph><subparagraph id="H8AE81A70F68B4FA281A4465BFA9F427B"><enum>(B)</enum><header>Separate abortion coverage or plan allowed</header><clause display-inline="no-display-inline" id="H574253A8399A46C4A47DDF0EA23FA507"><enum>(i)</enum><header>Option to purchase separate coverage or plan</header><text display-inline="yes-display-inline">Nothing in subparagraph (A) shall be construed as prohibiting any employer from purchasing for its employees separate coverage for abortions described in such subparagraph, or a health plan that includes such abortions, so long as no credit is allowed under this section with respect to the employer contributions for such coverage or plan.</text></clause><clause id="H7B6BC91727F441988207204A3FE46414"><enum>(ii)</enum><header>Option to offer coverage or plan</header><text>Nothing in subparagraph (A) shall restrict any non-Federal health insurance issuer offering a health plan from offering separate coverage for abortions described in such subparagraph, or a plan that includes such abortions, so long as such separate coverage or plan is not paid for with any employer contribution eligible for the credit allowed under this section.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HFCBF549F5FE347A38BA4D276C9EA79D4"><enum>(3)</enum><header>Conforming ACA amendments</header><text display-inline="yes-display-inline">Section 1303(b) of <external-xref legal-doc="public-law" parsable-cite="pl/111/148">Public Law 111–148</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/42/18023">42 U.S.C. 18023(b)</external-xref>) is amended—</text><subparagraph id="HBB636734746045C9A695235E932E9F10"><enum>(A)</enum><text>by striking paragraph (2);</text></subparagraph><subparagraph commented="no" id="H3A4C10F84F4E468ABF4F9B3D4AA802F0"><enum>(B)</enum><text>by striking paragraph (3), as amended by section 202(a); and</text></subparagraph><subparagraph id="H4B7C08912FB14D8FAD32F57D2E918ED6"><enum>(C)</enum><text>by redesignating paragraph (4) as paragraph (2).</text></subparagraph></paragraph></subsection><subsection id="H7B382E87686C4FFAB5FD45916E50740D"><enum>(b)</enum><header>Application to multi-State plans</header><text>Paragraph (6) of section 1334(a) of <external-xref legal-doc="public-law" parsable-cite="pl/111/148">Public Law 111–148</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/42/18054">42 U.S.C. 18054(a)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H2D628A338A1F497B84F34E22FA144004"><paragraph id="H5ACFE2135D2E4F2EBAE4A72054ABCFA1"><enum>(6)</enum><header>Coverage consistent with federal abortion policy</header><text display-inline="yes-display-inline">In entering into contracts under this subsection, the Director shall ensure that no multi-State qualified health plan offered in an Exchange provides health benefits coverage for which the expenditure of Federal funds is prohibited under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/1/4">chapter 4</external-xref> of title 1, United States Code.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0875261C98484821B7EAEAE3A13EFDF7"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall apply to taxable years ending after December 31, 2023, but only with respect to plan years beginning after such date, and the amendment made by subsection (b) shall apply to plan years beginning after such date.</text></subsection></section><section id="H02E15BE0BE9646188B288E52B5C9EBFC"><enum>202.</enum><header>Revision of notice requirements regarding disclosure of extent of health plan coverage of abortion and abortion premium surcharges</header><subsection id="HFBB8138A730E45A5883B193F39B1F945"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Paragraph (3) of section 1303(b) of <external-xref legal-doc="public-law" parsable-cite="pl/111/148">Public Law 111–148</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/42/18023">42 U.S.C. 18023(b)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H965CE94F0F134632B87A94FE8D8D9DE0"><paragraph id="HF8D4A33C091C4F5FA340BF4DBB72B5D8"><enum>(3)</enum><header>Rules relating to notice</header><subparagraph id="H6A6AAB5679DC4B38B51577A1680CDC60"><enum>(A)</enum><header>In general</header><text>The extent of coverage (if any) of services described in paragraph (1)(B)(i) or (1)(B)(ii) by a qualified health plan shall be disclosed to enrollees at the time of enrollment in the plan and shall be prominently displayed in any marketing or advertising materials, comparison tools, or summary of benefits and coverage explanation made available with respect to such plan by the issuer of the plan, by an Exchange, or by the Secretary, including information made available through an internet portal or Exchange under sections 1311(c)(5) and 1311(d)(4)(C).</text></subparagraph><subparagraph commented="no" id="H7331CE76AAE4454B9ADA3165011170B4"><enum>(B)</enum><header>Separate disclosure of abortion surcharges</header><text display-inline="yes-display-inline">In the case of a qualified health plan that includes the services described in paragraph (1)(B)(i) and where the premium for the plan is disclosed, including in any marketing or advertising materials or any other information referred to in subparagraph (A), the surcharge described in paragraph (2)(B)(i)(II) that is attributable to such services shall also be
