<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 600</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230301">March 1, 2023</action-date><action-desc><sponsor name-id="S345">Mr. Johnson</sponsor> (for himself, <cosponsor name-id="S397">Mr. Braun</cosponsor>, <cosponsor name-id="S374">Mr. Cotton</cosponsor>, and <cosponsor name-id="S174">Mr. McConnell</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Controlled Substances Act to list fentanyl-related substances as schedule I controlled substances.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stopping Overdoses of Fentanyl Analogues Act</short-title></quote>.</text></section><section id="id1DBA3C1826E6402CAB025973B554EBEA"><enum>2.</enum><header>Fentanyl-related substances</header><subsection id="idCE3791758B214312AE8885BAD41C7464"><enum>(a)</enum><header>In general</header><text>Schedule I of section 202(c) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/812">21 U.S.C. 812(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id359D1349451342C489C926E5384A4AA6"><subsection id="id5A4FE8272A6F436A81B8E282F962FC43"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id8011703F5BBB418C8B2F3BB6E991BDC6"><enum>(1)</enum><text>Unless specifically exempted or unless listed in another schedule, any material, compound, mixture, or preparation which contains any quantity of fentanyl-related substances, including their isomers, esters, ethers, salts, and salts of isomers, esters, and ethers, whenever the existence of such isomers, esters, ethers, and salts is possible within the specific chemical designation.</text></paragraph><paragraph id="id04AFC0EE23FD418BA2C92BD7460C4093" indent="up1"><enum>(2)</enum><text>In paragraph (1), the term <term>fentanyl-related substances</term> includes any substance that is structurally related to fentanyl by 1 or more of the following modifications:</text><subparagraph id="idC593F1CAB642419DB275BA2AAC121861"><enum>(A)</enum><text>By replacement of the phenyl portion of the phenethyl group by any monocycle, whether or not further substituted in or on the monocycle.</text></subparagraph><subparagraph id="idC65A6A4E84074294AEB7195EEB5493F6"><enum>(B)</enum><text>By substitution in or on the phenethyl group with alkyl, alkenyl, alkoxyl, hydroxyl, halo, haloalkyl, amino, or nitro groups.</text></subparagraph><subparagraph id="id6C31362D3B9F4BD8B0F70F95D065CAB1"><enum>(C)</enum><text>By substitution in or on the piperidine ring with alkyl, alkenyl, alkoxyl, ester, ether, hydroxyl, halo, haloalkyl, amino, or nitro groups.</text></subparagraph><subparagraph id="id4C5844D758764AB0A542455AECE78119"><enum>(D)</enum><text>By replacement of the aniline ring with any aromatic monocycle whether or not further substituted in or on the aromatic monocycle.</text></subparagraph><subparagraph id="id6854CEADA0BB4D1E836D969FC264489A"><enum>(E)</enum><text>By replacement of the N-propionyl group by another acyl group.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idDF34EE13D87B4E4495C71B565AB7DDAA"><enum>(b)</enum><header>Effective date</header><text>This Act shall take effect 1 day after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
