Antideficiency.</toc-entry></toc></subsection></section><title id="id2B4E62FA50CD4AF6869749B902A2DF6D" style="OLC"><enum>I</enum><header>Pueblos of Acoma and Laguna Water Rights Settlement</header><section id="id039ba525901649d58e39d183522910b7"><enum>101.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this title are—</text><paragraph id="idcaef1b30ee2b433f921fea28852497a6"><enum>(1)</enum><text>to achieve a fair, equitable, and final settlement of all issues and controversies concerning claims to water rights in the general stream adjudication of the Rio San José Stream System captioned <quote>State of New Mexico, ex rel. State Engineer v. Kerr-McGee, et al.</quote>, No. D–1333–CV–1983–00190 and No. D–1333–CV1983–00220 (consolidated), pending in the Thirteenth Judicial District Court for the State of New Mexico, for—</text><subparagraph id="iddadb742f249b4202a344eafb28b02864"><enum>(A)</enum><text>the Pueblo of Acoma;</text></subparagraph><subparagraph id="ide0acd15801b94372a9710764ec408ff1"><enum>(B)</enum><text>the Pueblo of Laguna; and</text></subparagraph><subparagraph id="id76bd239f109849609d5df1fe17f09055"><enum>(C)</enum><text>the United States, acting as trustee for the Pueblos of Acoma and Laguna;</text></subparagraph></paragraph><paragraph id="idb4ce7e9d8b664ac78c4653674711f4ef"><enum>(2)</enum><text>to authorize, ratify, and confirm the agreement entered into by the Pueblos, the State, and various other parties to the Agreement, to the extent that the Agreement is consistent with this title;</text></paragraph><paragraph id="idba947455140b4cddb44a494b0e1b4330"><enum>(3)</enum><text>to authorize and direct the Secretary—</text><subparagraph id="id100bfdefcfbb4ceab38c77497a60d624"><enum>(A)</enum><text>to execute the Agreement; and</text></subparagraph><subparagraph id="id255443ecb7be4aaeadcddaa39d490f6c"><enum>(B)</enum><text>to take any other actions necessary to carry out the Agreement in accordance with this title; and</text></subparagraph></paragraph><paragraph id="id83a22950e57949ceaa4da5e922739171"><enum>(4)</enum><text>to authorize funds necessary for the implementation of the Agreement and this title.</text></paragraph></section><section id="id635f31442b574d0da2e5a419b28475b6"><enum>102.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="id0dd5001eb7e6423d8710ead1834cd654"><enum>(1)</enum><header>Acequia</header><text>The term <term>Acequia</term> means each of the Bluewater Toltec Irrigation District, La Acequia Madre del Ojo del Gallo, Moquino Water Users Association II, Murray Acres Irrigation Association, San Mateo Irrigation Association, Seboyeta Community Irrigation Association, Cubero Acequia Association, Cebolletita Acequia Association, and Community Ditch of San José de la Cienega.</text></paragraph><paragraph id="id0b4993d2a28249c390d290e921be09e1"><enum>(2)</enum><header>Adjudication</header><text>The term <term>Adjudication</term> means the general adjudication of water rights entitled <quote>State of New Mexico, ex rel. State Engineer v. Kerr-McGee, et al.</quote>, No. D–1333–CV–1983–00190 and No. D–1333–CV1983–00220 (consolidated) pending, as of the date of enactment of this Act, in the Decree Court.</text></paragraph><paragraph id="idc4da90c441f54b0e9438a7d63e54f0a0"><enum>(3)</enum><header>Agreement</header><text>The term <term>Agreement</term> means—</text><subparagraph id="id39dfc8bb0a934ff8b46283d82d539d4e"><enum>(A)</enum><text>the document entitled <quote>Rio San José Stream System Water Rights Local Settlement Agreement Among the Pueblo of Acoma, the Pueblo of Laguna, the Navajo Nation, the State of New Mexico, the City of Grants, the Village of Milan, the Association of Community Ditches of the Rio San José and Nine Individual Acequias and Community Ditches</quote> and dated May 13, 2022, and the attachments thereto; and</text></subparagraph><subparagraph id="id581994b5868c46f4a507c25bf163bc8a"><enum>(B)</enum><text>any amendment to the document referred to in subparagraph (A) (including an amendment to an attachment thereto) that is executed to ensure that the Agreement is consistent with this title.</text></subparagraph></paragraph><paragraph id="idF62235A20FFE405FAC9E55B202BCEFE3"><enum>(4)</enum><header>Allotment</header><text>The term <term>Allotment</term> means a parcel of land that is—</text><subparagraph id="ide38b43c309a74a67ada0a2ccd41786fd"><enum>(A)</enum><text>located within—</text><clause id="id54faef60c62a43f98435c5eece9c94fb"><enum>(i)</enum><text>the Rio Puerco Basin;</text></clause><clause id="id68860a1b29fb4026a1f22a2035aa972a"><enum>(ii)</enum><text>the Rio San José Stream System; or</text></clause><clause id="id36a775463362430c943f0c63a2fa7a16"><enum>(iii)</enum><text>the Rio Salado Basin; and</text></clause></subparagraph><subparagraph id="idb4abb7d35b264d6c841421838e40984a"><enum>(B)</enum><text>held in trust by the United States for the benefit of 1 or more individual Indians.</text></subparagraph></paragraph><paragraph id="idD4D057C4C583436AA7B78EB193867F51" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header>Allottee</header><text>The term <term>Allottee</term> means an individual with a beneficial interest in an Allotment. </text></paragraph><paragraph commented="no" id="id6306469F74744F7DB1D92E722A600B2C"><enum>(6)</enum><header>Decree Court</header><text>The term <term>Decree Court</term> means the Thirteenth Judicial District Court of the State of New Mexico.</text></paragraph><paragraph id="id382c3c843c84465aa787b07b78c31058"><enum>(7)</enum><header>Enforceability Date</header><text>The term <term>Enforceability Date</term> means the date described in section 107.</text></paragraph><paragraph commented="no" id="id2472A3004CF841F28CFA9150B7A3745F"><enum>(8)</enum><header>Partial Final Judgment and Decree</header><text>The term <term>Partial Final Judgment and Decree</term> means a final or interlocutory partial final judgment and decree entered by the Decree Court with respect to the water rights of the Pueblos—</text><subparagraph commented="no" id="id23FBEEA8E78A41E3AA5B3657B73ACE2E"><enum>(A)</enum><text>that is substantially in the form described in article 14.7.2 of the Agreement, as amended to ensure consistency with this title; and</text></subparagraph><subparagraph commented="no" id="idABCFBCE5C7A14ACE8C1C629C405B10A1"><enum>(B)</enum><text>from which no further appeal may be taken.</text></subparagraph></paragraph><paragraph id="id5d80fb933dc64f9d91e33184d5ec961a"><enum>(9)</enum><header>Pueblo</header><text>The term <term>Pueblo</term> means either of—</text><subparagraph id="id5D7CF740BDAB4FA38C5D6F8BCDF619B3"><enum>(A)</enum><text>the Pueblo of Acoma; or </text></subparagraph><subparagraph id="id0370918C39A947E4BF0007074BC0F2FD"><enum>(B)</enum><text>the Pueblo of Laguna.</text></subparagraph></paragraph><paragraph id="id22DD69268FD0423BA8D1B9F1FA82BE49"><enum>(10)</enum><header>Pueblo Land</header><subparagraph id="id407A91BA01654A20A5A3F34B5DF5B58A"><enum>(A)</enum><header>In general</header><text>The term <term>Pueblo Land</term> means any real property—</text><clause id="idB96D38E96D69457AACF2A55F4767B83C"><enum>(i)</enum><text>in the Rio San José Stream System that is held by the United States in trust for either Pueblo, or owned by either Pueblo, as of the Enforceability Date; </text></clause><clause id="idC00B55013C1046F8A224C023AFFE77EA"><enum>(ii)</enum><text>in the Rio Salado Basin that is held by the United States in trust for the Pueblo of Acoma, or owned by the Pueblo of Acoma, as of the Enforceability Date; or </text></clause><clause id="id96A6858561BB4FF8ABE0F1A89617BA68"><enum>(iii)</enum><text>in the Rio Puerco Basin that is held by the United States in trust for the Pueblo of Laguna, or owned by the Pueblo of Laguna, as of the Enforceability Date. </text></clause></subparagraph><subparagraph id="id1A1A34FE5EDC4FE09ED0480DCAB96F06"><enum>(B)</enum><header>Inclusions</header><text>The term <term>Pueblo Land</term> includes land placed in trust with the United States subsequent to the Enforceability Date for either Pueblo in the Rio San José Stream System, for the Pueblo of Acoma in the Rio Salado Basin, or for the Pueblo of Laguna in the Rio Puerco Basin.</text></subparagraph></paragraph><paragraph commented="no" id="id8E651234F7394C09A200B95B4766DFB9"><enum>(11)</enum><header>Pueblo Trust Fund</header><text>The term <term>Pueblo Trust Fund</term> means—</text><subparagraph commented="no" id="id03F8F4983E604475B77BF782D40E654A"><enum>(A)</enum><text>the Pueblo of Acoma Settlement Trust Fund established by section 105(a); </text></subparagraph><subparagraph commented="no" id="idC7475FC595294FAF92420A19AB6B17C1"><enum>(B)</enum><text>the Pueblo of Laguna Settlement Trust Fund established by that section; and </text></subparagraph><subparagraph commented="no" id="idA56AD1C77DF14ACD958A382EC7C17D12"><enum>(C)</enum><text>the Acomita Reservoir Works Trust Fund established by that section.</text></subparagraph></paragraph><paragraph id="id7473fa75237947419e5b80ca01435426"><enum>(12)</enum><header>Pueblo Water Rights</header><text>The term <term>Pueblo Water Rights</term> means—</text><subparagraph id="idE44A3CDC9D424A31926D54BF996AB8C5"><enum>(A)</enum><text>the respective water rights of the Pueblos in the Rio San José Stream System—</text><clause id="id695E7E78940A4034BD402B0A6B70C2D8"><enum>(i)</enum><text>as identified in the Agreement and section 104; and </text></clause><clause id="id17BF295B79AE447BB83E2C5FC69D1589"><enum>(ii)</enum><text>as confirmed in the Partial Final Judgment and Decree;</text></clause></subparagraph><subparagraph id="id6320B6958ABE43909691B9F7C72BA144"><enum>(B)</enum><text>the water rights of the Pueblo of Acoma in the Rio Salado Basin; and </text></subparagraph><subparagraph id="id4108468839DB4293920E3E84E385BC62"><enum>(C)</enum><text>the water rights of the Pueblo of Laguna in the Rio Puerco Basin, as identified in the Agreement and section 104.</text></subparagraph></paragraph><paragraph id="idb8d7f0b35d854c6984efc7f4d107bb91"><enum>(13)</enum><header>Pueblos</header><text>The term <term>Pueblos</term> means— </text><subparagraph id="idCE0A2DD4B39C46A097204E583445CC7B"><enum>(A)</enum><text>the Pueblo of Acoma; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id35ACC08BE64C4A5D86754E9DA8F60453"><enum>(B)</enum><text>the Pueblo of Laguna.</text></subparagraph></paragraph><paragraph id="id64E4C69B54A14DF89A73CD87E20B1255"><enum>(14)</enum><header>Rio Puerco Basin</header><text>The term <term>Rio Puerco Basin</term> means the area defined by the United States Geological Survey Hydrologic Unit Codes (HUC) 13020204 (Rio Puerco subbasin) and 13020205 (Arroyo Chico subbasin), including the hydrologically connected groundwater.</text></paragraph><paragraph id="idd13aa7f907cb4734a483a04c4b3037f9"><enum>(15)</enum><header>Rio San José Stream System</header><text>The term <term>Rio San José Stream System</term> means the geographic extent of the area involved in the Adjudication pursuant to the description filed in the Decree Court on November 21, 1986.</text></paragraph><paragraph id="id3c237957eead47229e31eec506d2ea9b"><enum>(16)</enum><header>Rio salado basin</header><text>The term <term>Rio Salado Basin</term> means the area defined by the United States Geological Survey Hydrologic Unit Code (HUC) 13020209 (Rio Salado subbasin), including the hydrologically connected groundwater.</text></paragraph><paragraph id="idc7819ee8b33f4dd4a87f58faa54968df"><enum>(17)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="id7ba83c951ed14be48d38d399c3ed4fc1"><enum>(18)</enum><header>Signatory Acequia</header><text>The term <term>Signatory Acequia</term> means an acequia that is a signatory to the Agreement.</text></paragraph><paragraph id="idfc9de918366b4b1c8abc3d3e9f588600"><enum>(19)</enum><header>State</header><text>The term <term>State</term> means the State of New Mexico and all officers, agents, departments, and political subdivisions of the State of New Mexico.</text></paragraph></section><section id="id46c337616ed04d10b178f98754d24e69"><enum>103.</enum><header>Ratification of Agreement</header><subsection id="idca70bd87fb294411a97f0d55882cde81"><enum>(a)</enum><header>Ratification</header><paragraph id="idb0ccf47ecda9430cbcf65eac50206b1e"><enum>(1)</enum><header>In general</header><text>Except as modified by this title and to the extent the Agreement does not conflict with this title, the Agreement is authorized, ratified, and confirmed.</text></paragraph><paragraph id="iddfed8e19fff645eab771b5c714004dc5"><enum>(2)</enum><header>Amendments</header><text>If an amendment to the Agreement or any attachment to the Agreement requiring the signature of the Secretary is executed in accordance with this title to make the Agreement consistent with this title, the amendment is authorized, ratified, and confirmed.</text></paragraph></subsection><subsection id="id3198232c535a4c96b4fb11c0ac442f59"><enum>(b)</enum><header>Execution</header><paragraph id="idddbea8e59f9d40b4914ece2e9db78fa3"><enum>(1)</enum><header>In general</header><text>To the extent the Agreement does not conflict with this title, the Secretary shall execute the Agreement, including all attachments to or parts of the Agreement requiring the signature of the Secretary.</text></paragraph><paragraph id="id4ecd7abc8fee46b3b9f235cc393db37b"><enum>(2)</enum><header>Modifications</header><text>Nothing in this title prohibits the Secretary, after execution of the Agreement, from approving any modification to the Agreement, including an attachment to the Agreement, that is consistent with this title, to the extent that the modification does not otherwise require congressional approval under section 2116 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/25/177">25 U.S.C. 177</external-xref>) or any other applicable provision of Federal law.</text></paragraph></subsection><subsection id="iddeb5f74f90bf4f07afa2943ecde16713"><enum>(c)</enum><header>Environmental compliance</header><paragraph id="id5f6cf9a96c894504aea2b1116d479bf7"><enum>(1)</enum><header>In general</header><text>In implementing the Agreement and this title, the Secretary shall comply with—</text><subparagraph id="idf47462ff512544619cf6fbdd51a7cbcc"><enum>(A)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);</text></subparagraph><subparagraph id="id057f407522cf4f099af586bb03cd3ed9"><enum>(B)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), including the implementing regulations of that Act; and</text></subparagraph><subparagraph id="id1e8ff83a8ab840b997ca5bb636998e57"><enum>(C)</enum><text>all other applicable Federal environmental laws and regulations.</text></subparagraph></paragraph><paragraph id="idf0cf3523f59843b18d0a6cd1f705f0aa"><enum>(2)</enum><header>Compliance</header><subparagraph id="id87b79970ef0744348ba4fe984a726131"><enum>(A)</enum><header>In general</header><text>In implementing the Agreement and this title, the Pueblos shall prepare any necessary environmental documents consistent with—</text><clause id="id6a3cf92b8e85422ebce1261801bdf0f9"><enum>(i)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);</text></clause><clause id="id9f5bf18149da4591bf4cd9b8d3a3bf1e"><enum>(ii)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), including the implementing regulations of that Act; and</text></clause><clause id="idb2cf0e2a32cc4057970b545bacd63051"><enum>(iii)</enum><text>all other applicable Federal environmental laws and regulations.</text></clause></subparagraph><subparagraph id="id38a79e0669c54d699af5e261ea1bf95a"><enum>(B)</enum><header>Authorizations</header><text>The Secretary shall—</text><clause id="id4e7efbc507de464faa6c8ab02430f897"><enum>(i)</enum><text>independently evaluate the documentation required under subparagraph (A); and</text></clause><clause id="idf9dba0d23ac5423d9bcc5395cb6e56f5"><enum>(ii)</enum><text>be responsible for the accuracy, scope, and contents of that documentation.</text></clause></subparagraph></paragraph><paragraph id="id6d2a9544ece74934a4c8e70b5eb3d1f7"><enum>(3)</enum><header>Effect of execution</header><text>The execution of the Agreement by the Secretary under this section shall not constitute a major Federal action under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></paragraph><paragraph id="id1de00efa2b4848e6888d7403245c4b26"><enum>(4)</enum><header>Costs</header><text>Any costs associated with the performance of the compliance activities under subsection (c) shall be paid from funds deposited in the Pueblo Trust Funds, subject to the condition that any costs associated with the performance of Federal approval or other review of such compliance work or costs associated with inherently Federal functions shall remain the responsibility of the Secretary.</text></paragraph></subsection></section><section id="id71902499ec9d44dbb2989c336c1f90ec"><enum>104.</enum><header>Pueblo Water Rights</header><subsection id="id4885648272774f86afc1d63fa69935a6"><enum>(a)</enum><header>Trust status of the Pueblo Water Rights</header><text>The Pueblo Water Rights shall be held in trust by the United States on behalf of the Pueblos in accordance with the Agreement and this title.</text></subsection><subsection id="id8a8e899c29524397a5312f6f32e551cd"><enum>(b)</enum><header>Forfeiture and abandonment</header><paragraph id="id16B96CB7482148479A67F22EF10B56F6"><enum>(1)</enum><header>In general</header><text>The Pueblo Water Rights shall not be subject to loss through non-use, forfeiture, abandonment, or other operation of law. </text></paragraph><paragraph id="id14BDC0664FC94B7B812159F790E2B6C5"><enum>(2)</enum><header>State-law based water rights</header><text>Pursuant to the Agreement, State-law based water rights acquired by a Pueblo, or by the United States on behalf of a Pueblo, after the date for inclusion in the Partial Final Judgment and Decree, shall not be subject to forfeiture, abandonment, or permanent alienation from the time they are acquired.</text></paragraph></subsection><subsection id="id4adfe33a43544cf6a8bde97769b7fa4f"><enum>(c)</enum><header>Use</header><text>Any use of the Pueblo Water Rights shall be subject to the terms and conditions of the Agreement and this title.</text></subsection><subsection id="id6382E71A5D97410B869479A05F88D971"><enum>(d)</enum><header>Allotment rights not included</header><text>The Pueblo Water Rights shall not include any water uses or water rights claims on an Allotment. </text></subsection><subsection id="id253eaa6c7f4047ac8a595bd76d6a48e1"><enum>(e)</enum><header>Authority of the Pueblos</header><paragraph id="id7e254b2c86ee498a917e96ec0677e6a4"><enum>(1)</enum><header>In general</header><text>The Pueblos shall have the authority to allocate, distribute, and lease the Pueblo Water Rights for use on Pueblo Land in accordance with the Agreement, this title, and applicable Federal law.</text></paragraph><paragraph id="idb0d08b6629414bfb820be2bdaf7f7af8"><enum>(2)</enum><header>Use off Pueblo land</header><text>The Pueblos may allocate, distribute, and lease the Pueblo Water Rights for use off Pueblo Land in accordance with the Agreement, this title, and applicable Federal law, subject to the approval of the Secretary.</text></paragraph><paragraph id="ida388072b31bb45ac826c7a1359e5823a"><enum>(3)</enum><header>Allottee water rights</header><text>The Pueblos shall not object in any general stream adjudication, including the Adjudication, or any other appropriate forum, to the quantification of reasonable domestic, stock, and irrigation water uses on an Allotment, and shall administer any water use in accordance with applicable Federal law, including recognition of—</text><subparagraph id="id9ec773cfe0ec44158b522eee2e334f74"><enum>(A)</enum><text>any water use existing on an Allotment as of the date of enactment of this Act;</text></subparagraph><subparagraph id="ide4b711a93f8b46628b3ebc0427ba277e"><enum>(B)</enum><text>reasonable domestic, stock, and irrigation water uses on an Allotment; and</text></subparagraph><subparagraph id="id3ddaca4d7a734f198eccaedb55696eba" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>any Allotment water right decreed in a general stream adjudication, including the Adjudication, or other appropriate forum, for an Allotment. </text></subparagraph></paragraph></subsection><subsection id="idcb0f93d7974b4205aaa78bf9003999a6"><enum>(f)</enum><header>Administration</header><paragraph id="id7aaa11fb909c4912b63c1a0167a9d090"><enum>(1)</enum><header>No alienation</header><text>The Pueblos shall not permanently alienate any portion of the Pueblo Water Rights.</text></paragraph><paragraph id="ida65cf3625001433fa9c4ce70a2740806"><enum>(2)</enum><header>Purchases or grants of land from Indians</header><text>An authorization provided by this title for the allocation, distribution, leasing, or other arrangement entered into pursuant to this title shall be considered to satisfy any requirement for authorization of the action required by Federal law.</text></paragraph><paragraph id="id17c3ef829ec24c508dcd52f910916e04"><enum>(3)</enum><header>Prohibition on forfeiture</header><text>The non-use of all or any portion of the Pueblo Water Rights by any water user shall not result in the forfeiture, abandonment, relinquishment, or other loss of all or any portion of the Pueblo Water Rights.</text></paragraph></subsection></section><section id="id94a262137324428ea833734f2994004b"><enum>105.</enum><header>Settlement trust funds</header><subsection id="idb41f6fc0fe46447abd927f2cccd96d92"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish 2 trust funds, to be known as the <quote>Pueblo of Acoma Settlement Trust Fund</quote> and the <quote>Pueblo of Laguna Settlement Trust Fund</quote>, and a trust fund for the benefit of both Pueblos to be known as the <quote>Acomita Reservoir Works Trust Fund</quote>, to be managed, invested, and distributed by the Secretary and to remain available until expended, withdrawn, or reverted to the general fund of the Treasury, consisting of the amounts deposited in the Pueblo Trust Funds under subsection (c), together with any investment earnings, including interest, earned on those amounts, for the purpose of carrying out this title.</text></subsection><subsection id="id0e80377af0554587828e55791c0dadc2"><enum>(b)</enum><header>Accounts</header><paragraph commented="no" id="id31a80b0aef1f43b096346f75b944eb24"><enum>(1)</enum><header>Pueblo of Acoma Settlement Trust Fund</header><text>The Secretary shall establish in the Pueblo of Acoma Settlement Trust Fund the following accounts:</text><subparagraph commented="no" id="id3363cffc80d441fa81ebe0ab81242f25"><enum>(A)</enum><text>The Water Rights Settlement Account.</text></subparagraph><subparagraph commented="no" id="id43c3151aa5264f2bbe57ac64767cbe73"><enum>(B)</enum><text>The Water Infrastructure Operations and Maintenance Account.</text></subparagraph><subparagraph commented="no" id="idfed01905edc84b59ba73b1d943e8f0c3"><enum>(C)</enum><text>The Feasibility Studies Settlement Account.</text></subparagraph></paragraph><paragraph commented="no" id="idfbe45032cf6b406283bab6cd82d0b140"><enum>(2)</enum><header>Pueblo of Laguna Settlement Trust Fund</header><text>The Secretary shall establish in the Pueblo of Laguna Settlement Trust Fund the following accounts:</text><subparagraph commented="no" id="id42bd9447097f415cb4f0e6f90ada69a0"><enum>(A)</enum><text>The Water Rights Settlement Account.</text></subparagraph><subparagraph commented="no" id="id0c0da50e49844eae82c9ce25ee3bc74f"><enum>(B)</enum><text>The Water Infrastructure Operations and Maintenance Account.</text></subparagraph><subparagraph commented="no" id="idc90da05a525341569bb3333faff65abe"><enum>(C)</enum><text>The Feasibility Studies Settlement Account.</text></subparagraph></paragraph></subsection><subsection id="id602dada33552401bb7ff4137e2583749"><enum>(c)</enum><header>Deposits</header><text>The Secretary shall deposit in each Pueblo Trust Fund the amounts made available pursuant to section 106(a).</text></subsection><subsection id="id87a931be8ca14ed2806f07028254824c"><enum>(d)</enum><header>Management and interest</header><paragraph id="idba63247bd33d42219174a81c10f0b058"><enum>(1)</enum><header>Management</header><text>On receipt and deposit of funds into the Pueblo Trust Funds under subsection (c), the Secretary shall manage, invest, and distribute all amounts in the Pueblo Trust Funds in a manner that is consistent with the investment authority of the Secretary under—</text><subparagraph id="id6f6ed1ed68d04582998fed972223dcf5"><enum>(A)</enum><text>the first section of the Act of June 24, 1938 (<external-xref legal-doc="usc" parsable-cite="usc/25/162a">25 U.S.C. 162a</external-xref>);</text></subparagraph><subparagraph id="id831d310e68a3488788adebed463ff51c"><enum>(B)</enum><text>the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>); and</text></subparagraph><subparagraph id="id6a5a634960974fe19cd521b39ee02b9c"><enum>(C)</enum><text>this subsection.</text></subparagraph></paragraph><paragraph id="id6dc8ac0d05f0484ab430a5fa58777759"><enum>(2)</enum><header>Investment earnings</header><text>In addition to the deposits made to each Pueblo Trust Fund under subsection (c), any investment earnings, including interest, earned on those amounts held in each Pueblo Trust Fund are authorized to be used in accordance with subsections (f) and (h).</text></paragraph></subsection><subsection id="id16d72beefaf9496389b3b80e4e931e33"><enum>(e)</enum><header>Availability of amounts</header><paragraph id="idd1ac1b028b9f458f84d1116d08805941"><enum>(1)</enum><header>In general</header><text>Amounts appropriated to, and deposited in, each Pueblo Trust Fund, including any investment earnings (including interest) earned on those amounts, shall be made available to the Pueblo or Pueblos by the Secretary beginning on the Enforceability Date, subject to the requirements of this section, except for those funds to be made available to the Pueblos pursuant to paragraph (2).</text></paragraph><paragraph id="id5136fdffaf3e4a978e915369ce28ce7e"><enum>(2)</enum><header>Use of funds</header><text>Notwithstanding paragraph (1)—</text><subparagraph id="ide434d2791b3d443d93d48f601bddc013"><enum>(A)</enum><text>amounts deposited in the Feasibility Studies Settlement Account of each Pueblo Trust Fund, including any investment earnings, including interest, earned on those amounts shall be available to the Pueblo on the date on which the amounts are deposited for uses described in subsection (h)(3), and in accordance with the Agreement;</text></subparagraph><subparagraph id="id0be682071c8d46378146a2651d50ae84"><enum>(B)</enum><text>amounts deposited in the Acomita Reservoir Works Trust Fund, including any investment earnings, including interest, earned on those amounts shall be available to the Pueblos on the date on which the amounts are deposited for uses described in subsection (h)(4), and in accordance with the Agreement; and</text></subparagraph><subparagraph id="idff86dbb6ffd943dfab2f973ad3a98f15"><enum>(C)</enum><text>up to $15,000,000 from the Water Rights Settlement Account for each Pueblo shall be available on the date on which the amounts are deposited for installing, on Pueblo Lands, groundwater wells to meet immediate domestic, commercial, municipal and industrial water needs, and associated environmental, cultural, and historical compliance.</text></subparagraph></paragraph></subsection><subsection id="idc16a97a2df7d4b4cbbaba78d9f19897f"><enum>(f)</enum><header>Withdrawals</header><paragraph id="id2b896bbfd65c4773b7f2e1d78ae5ba67"><enum>(1)</enum><header>Withdrawals under the American Indian Trust Fund Management Reform Act of 1994</header><subparagraph id="id56b2935ee90d422faa22606ed4867563"><enum>(A)</enum><header>In general</header><text>Each Pueblo may withdraw any portion of the amounts in its respective Settlement Trust Fund on approval by the Secretary of a Tribal management plan submitted by each Pueblo in accordance with the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>).</text></subparagraph><subparagraph id="id83243f2fbdcb4f629b1171f87833769e"><enum>(B)</enum><header>Requirements</header><text>In addition to the requirements under the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>), the Tribal management plan under this paragraph shall require that the appropriate Pueblo shall spend all amounts withdrawn from each Pueblo Trust Fund, and any investment earnings (including interest) earned on those amounts through the investments under the Tribal management plan, in accordance with this title.</text></subparagraph><subparagraph id="idc034dc6e91fc40d98a62b7183d62c807"><enum>(C)</enum><header>Enforcement</header><text>The Secretary may carry out such judicial and administrative actions as the Secretary determines to be necessary to enforce the Tribal management plan under this paragraph to ensure that amounts withdrawn by each Pueblo from the Pueblo Trust Funds under subparagraph (A) are used in accordance with this title.</text></subparagraph></paragraph><paragraph id="id7bb1c6cbe5874c98859d510a11c560d7"><enum>(2)</enum><header>Withdrawals under expenditure plan</header><subparagraph id="idbd871791152a44329cde14249da0ade1"><enum>(A)</enum><header>In general</header><text>Each Pueblo may submit to the Secretary a request to withdraw funds from the Pueblo Trust Fund of the Pueblo pursuant to an approved expenditure plan.</text></subparagraph><subparagraph id="id1bc51250f6e74dd496618ecd22d13959"><enum>(B)</enum><header>Requirements</header><text>To be eligible to withdraw amounts under an expenditure plan under subparagraph (A), the appropriate Pueblo shall submit to the Secretary an expenditure plan for any portion of the Pueblo Trust Fund that the Pueblo elects to withdraw pursuant to that subparagraph, subject to the condition that the amounts shall be used for the purposes described in this title.</text></subparagraph><subparagraph id="idcc6044bbda7c44bb999b20cd147cc503"><enum>(C)</enum><header>Inclusions</header><text>An expenditure plan under this paragraph shall include a description of the manner and purpose for which the amounts proposed to be withdrawn from the Pueblo Trust Fund will be used by the Pueblo, in accordance with this subsection and subsection (h).</text></subparagraph><subparagraph id="id67ec07a82701414c8720afc1a5e7612d"><enum>(D)</enum><header>Approval</header><text>The Secretary shall approve an expenditure plan submitted under subparagraph (A) if the Secretary determines that the plan—</text><clause id="id3ec5a86278b648b1bbeb92f696cbfe9e"><enum>(i)</enum><text>is reasonable; and</text></clause><clause id="id431cdf2425974d919dc37c8f4b7eb80f"><enum>(ii)</enum><text>is consistent with, and will be used for, the purposes of this title.</text></clause></subparagraph><subparagraph id="idbda83d05de2046a6a0331c9c18ef73bb"><enum>(E)</enum><header>Enforcement</header><text>The Secretary may carry out such judicial and administrative actions as the Secretary determines to be necessary to enforce an expenditure plan to ensure that amounts disbursed under this paragraph are used in accordance with this title.</text></subparagraph></paragraph><paragraph id="id989e42c8091d4dbf8dad81e4581c423d"><enum>(3)</enum><header>Withdrawals from Acomita Reservoir Works Trust Fund</header><subparagraph id="id9d3975f8f51f4fd79db07850e2e529be"><enum>(A)</enum><header>In general</header><text>A Pueblo may submit to the Secretary a request to withdraw funds from the Acomita Reservoir Works Trust Fund pursuant to an approved joint expenditure plan.</text></subparagraph><subparagraph id="id3b9de1f749464e3f8bb097a875badbc5"><enum>(B)</enum><header>Requirements</header><clause id="id2D277D228E074B78913506F866C67520"><enum>(i)</enum><header>In general</header><text>To be eligible to withdraw amounts under a joint expenditure plan under subparagraph (A), the Pueblos shall submit to the Secretary a joint expenditure plan for any portion of the Acomita Reservoir Works Trust Fund that the Pueblos elect to withdraw pursuant to this subparagraph, subject to the condition that the amounts shall be used for the purposes described in subsection (h)(4). </text></clause><clause id="idB59D1DBCF72345B798F15D0CBCCEE6C8"><enum>(ii)</enum><header>Written resolution</header><text>Each request to withdraw amounts under a joint expenditure plan submitted under clause (i) shall be accompanied by a written resolution from the Tribal councils of both Pueblos approving the requested use and disbursement of funds.</text></clause></subparagraph><subparagraph id="id44dda0e4168c46da90fb1ef321d01ce8"><enum>(C)</enum><header>Inclusions</header><text>A joint expenditure plan under this paragraph shall include a description of the manner and purpose for which the amounts proposed to be withdrawn from the Acomita Reservoir Works Trust Fund will be used by the Pueblo or Pueblos to whom the funds will be disbursed, in accordance with subsection (h)(4).</text></subparagraph><subparagraph id="id4a39834531c549b5aef5296f673a46b5"><enum>(D)</enum><header>Approval</header><text>The Secretary shall approve a joint expenditure plan submitted under subparagraph (A) if the Secretary determines that the plan—</text><clause id="id3ea51a5ed0f741929fd373a66bdfb7a6"><enum>(i)</enum><text>is reasonable; and</text></clause><clause id="ide1f86053d40a45d3be1709d41bfca88a"><enum>(ii)</enum><text>is consistent with, and will be used for, the purposes of this title.</text></clause></subparagraph><subparagraph id="idc9aea2d883684be4adca4a09f2f0b086"><enum>(E)</enum><header>Enforcement</header><text>The Secretary may carry out such judicial and administrative actions as the Secretary determines to be necessary to enforce a joint expenditure plan to ensure that amounts disbursed under this paragraph are used in accordance with this title.</text></subparagraph></paragraph></subsection><subsection id="id370b0a36b88d407c815f062614eb2224"><enum>(g)</enum><header>Effect of section</header><text>Nothing in this section gives the Pueblos the right to judicial review of a determination of the Secretary relating to whether to approve a Tribal management plan under paragraph (1) of subsection (f) or an expenditure plan under paragraph (2) or (3) of that subsection, except under subchapter II of chapter 5, of title 5, United States Code, and <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/7">chapter 7</external-xref> of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>).</text></subsection><subsection id="idb65d88a5a5dd4cfbb245f5c36b7b9d63"><enum>(h)</enum><header>Uses</header><paragraph id="id4E92ECD881FA4234A8287D530F5F1243"><enum>(1)</enum><header>Water Rights Settlement Account</header><text>The Water Rights Settlement Account for each Pueblo may only be used for the following purposes:</text><subparagraph id="id4F9B0DBE812344F784F0EF716384AD48"><enum>(A)</enum><text>Acquiring water rights or water supply.</text></subparagraph><subparagraph id="id156E1B1216DE49CDA1E94752C986B38E"><enum>(B)</enum><text>Planning, permitting, designing, engineering, constructing, reconstructing, replacing, rehabilitating, operating, or repairing water production, treatment, or delivery infrastructure, including for domestic and municipal use, on-farm improvements, or wastewater infrastructure.</text></subparagraph><subparagraph id="id91B68B41B6BF455DB7908BF4E735C363"><enum>(C)</enum><text>Pueblo Water Rights management and administration.</text></subparagraph><subparagraph id="idDBBDD137C4054DA49859FB8C58C33A0B"><enum>(D)</enum><text>Watershed protection and enhancement, support of agriculture, water-related Pueblo community welfare and economic development, and costs relating to implementation of the Agreement.</text></subparagraph><subparagraph id="id4A4199DE6C4F4992981C81FC39561342"><enum>(E)</enum><text>Environmental compliance in the development and construction of infrastructure under this title.</text></subparagraph></paragraph><paragraph id="id967310A86A39462CA5E6700B2F44DC29"><enum>(2)</enum><header>Water Infrastructure Operations and Maintenance Trust Account</header><text>The Water Infrastructure Operations and Maintenance Account for each Pueblo may only be used to pay costs for operation and maintenance of water infrastructure to serve Pueblo domestic, commercial, municipal, and industrial water uses from any water source.</text></paragraph><paragraph id="id2169AFC1D6304571A8A758B611E35004"><enum>(3)</enum><header>Feasibility Studies Settlement Account</header><text>The Feasibility Studies Settlement Account for each Pueblo may only be used to pay costs for feasibility studies of water supply infrastructure to serve Pueblo domestic, commercial, municipal, and industrial water uses from any water source.</text></paragraph><paragraph id="id870C413FAFDD443FAB2C1B8D4A9FAC11"><enum>(4)</enum><header>Acomita Reservoir Works Trust Fund</header><text>The Acomita Reservoir Works Trust Fund may only be used for planning, permitting, designing, engineering, constructing, reconstructing, replacing, rehabilitating, maintaining, or repairing Acomita reservoir, its dam, inlet works, outlet works, and the North Acomita Ditch from the Acomita Reservoir outlet on the Pueblo of Acoma through its terminus on the Pueblo of Laguna.</text></paragraph></subsection><subsection id="id7a0ec6f7aabf4ec2b52de8dc0a2c2dec"><enum>(i)</enum><header>Liability</header><text>The Secretary and the Secretary of the Treasury shall not be liable for the expenditure or investment of any amounts withdrawn from the Pueblo Trust Funds by a Pueblo under paragraph (1), (2), or (3) of subsection (f).</text></subsection><subsection id="id11086b631dc94c28ae40dedc797798e1"><enum>(j)</enum><header>Expenditure reports</header><text>Each Pueblo shall annually submit to the Secretary an expenditure report describing accomplishments and amounts spent from use of withdrawals under a Tribal management plan or an expenditure plan under paragraph (1), (2), or (3) of subsection (f), as applicable.</text></subsection><subsection id="id8304349d4d0c4e47af4cde024f4c29c4"><enum>(k)</enum><header>No per capita distributions</header><text>No portion of the Pueblo Trust Funds shall be distributed on a per capita basis to any member of a Pueblo.</text></subsection><subsection id="id84453d1732894b4b89d8e030f422a09e"><enum>(l)</enum><header>Title to infrastructure</header><text>Title to, control over, and operation of any project constructed using funds from the Pueblo Trust Funds shall remain in the appropriate Pueblo or Pueblos.</text></subsection><subsection id="idbe83cf31c5dc43b3835e0d790907efb2"><enum>(m)</enum><header>Operation, maintenance, and replacement</header><text>All operation, maintenance, and replacement costs of any project constructed using funds from the Pueblo Trust Funds shall be the responsibility of the appropriate Pueblo or Pueblos.</text></subsection></section><section id="id736e8fa73d7c4a94bbece7b1065e8777"><enum>106.</enum><header>Funding</header><subsection id="idaf9b768b512b40ffb78b255b9348780c"><enum>(a)</enum><header>Mandatory appropriations</header><text>Out of any money in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Secretary the following amounts for the following accounts:</text><paragraph id="ida28432511bd0409e96b7c28fa346a5ab"><enum>(1)</enum><header>Pueblo of Acoma Settlement Trust Fund</header><subparagraph commented="no" id="idac1aba96ae4943968207afe0e8459643"><enum>(A)</enum><header>The Water Rights Settlement Account</header><text>$296,000,000, to remain available until expended, withdrawn, or reverted to the general fund of the Treasury.</text></subparagraph><subparagraph commented="no" id="id4a3e0fa7a633442eb50f8ebcdfd37b0f"><enum>(B)</enum><header>The Water Infrastructure Operations and Maintenance Account</header><text>$14,000,000, to remain available until expended, withdrawn, or reverted to the general fund of the Treasury.</text></subparagraph><subparagraph commented="no" id="id8e8b1947ec9645a380a4734c26bbf8b0"><enum>(C)</enum><header>The Feasibility Studies Settlement Account</header><text>$1,750,000, to remain available until expended, withdrawn, or reverted to the general fund of the Treasury.</text></subparagraph></paragraph><paragraph commented="no" id="id9ba04ff08ce3435a9b466bb09f90665c"><enum>(2)</enum><header>Pueblo of Laguna Settlement Trust Fund</header><subparagraph commented="no" id="idea35ee6c490746208639048ca226faf4"><enum>(A)</enum><header>The Water Rights Settlement Account</header><text>$464,000,000, to remain available until expended, withdrawn, or reverted to the general fund of the Treasury.</text></subparagraph><subparagraph commented="no" id="id1b37947f7fea4383911c00345e4c19f4"><enum>(B)</enum><header>The Water Infrastructure Operations and Maintenance Account</header><text>$26,000,000, to remain available until expended, withdrawn, or reverted to the general fund of the Treasury.</text></subparagraph><subparagraph commented="no" id="id2267a1101c6e4ade87ca2501b349a6d4"><enum>(C)</enum><header>The Feasibility Studies Settlement Account</header><text>$3,250,000, to remain available until expended, withdrawn, or reverted to the general fund of the Treasury.</text></subparagraph></paragraph><paragraph commented="no" id="id5cbe2063d13a4e0c96751f6148520eb3"><enum>(3)</enum><header>Acomita Reservoir Works Trust Fund</header><text>$45,000,000, to remain available until expended, withdrawn, or reverted to the general fund of the Treasury.</text></paragraph></subsection><subsection id="idcc4ca12c2b7d47c2aeb2eda0d8895af2"><enum>(b)</enum><header>Fluctuations in costs</header><paragraph id="id03702e00ef1141089364b7f32aa9de79"><enum>(1)</enum><header>In general</header><text>The amounts appropriated under subsection (a) shall be increased or decreased, as appropriate, by such amounts as may be justified by reason of ordinary fluctuations in costs, as indicated by the Bureau of Reclamation Construction Cost Index–Composite Trend.</text></paragraph><paragraph id="idf601762a2ac3427da8631d38404f64ee"><enum>(2)</enum><header>Construction costs adjustment</header><text>The amounts appropriated under subsection (a) shall be adjusted to address construction cost changes necessary to account for unforeseen market volatility that may not otherwise be captured by engineering cost indices, as determined by the Secretary, including repricing applicable to the types of construction and current industry standards involved.</text></paragraph><paragraph id="idd886e709e141406a8f4ea3dc9a29bfa5"><enum>(3)</enum><header>Repetition</header><text>The adjustment process under this subsection shall be repeated for each subsequent amount appropriated until the applicable amount, as adjusted, has been appropriated.</text></paragraph><paragraph id="id304804c801a84c03a7aa5441070453ad"><enum>(4)</enum><header>Period of indexing</header><text>The period of indexing and adjustment under this subsection for any increment of funding shall start on October 1, 2021, and shall end on the date on which funds are deposited in the applicable Pueblo Trust Fund.</text></paragraph></subsection><subsection id="idc9d92136e90443a9b7a0b0d77754c9ca"><enum>(c)</enum><header>State cost share</header><text>Pursuant to the Agreement, the State shall contribute—</text><paragraph id="id90a0d6172cce4981abb8f5c4390951b1"><enum>(1)</enum><text>$23,500,000, as adjusted for inflation pursuant to the Agreement, for the Joint Grants-Milan Project for Water Re-Use, Water Conservation and Augmentation of the Rio San José, the Village of Milan Projects Fund, and the City of Grants Projects Fund;</text></paragraph><paragraph id="id06fb6cabeb374494a6b91e84593d5448"><enum>(2)</enum><text>$12,000,000, as adjusted for the inflation pursuant to the Agreement, for Signatory Acequias Projects and Offset Projects Fund for the Association of Community Ditches of the Rio San José; and</text></paragraph><paragraph id="idce2b25a8a1e5446abc5bf0aa4b9026cf"><enum>(3)</enum><text>$500,000, as adjusted for inflation pursuant to the Agreement, to mitigate impairment to non-Pueblo domestic and livestock groundwater rights as a result of new Pueblo water use.</text></paragraph></subsection></section><section id="ida83ecb97d6814234a1e39bc7656cb83f"><enum>107.</enum><header>Enforceability Date</header><subsection id="id6e3a00dcd4e64456b2402106f01d497c"><enum/><text>The Enforceability Date shall be the date on which the Secretary publishes in the Federal Register a statement of findings that—</text><paragraph id="idb5c6289cbf4b464f947bb771be98e8c0"><enum>(1)</enum><text>to the extent that the Agreement conflicts with this title, the Agreement has been amended to conform with this title;</text></paragraph><paragraph id="id76dd9148cd534fcf908dbc05e59b3958"><enum>(2)</enum><text>the Agreement, as amended, has been executed by all parties to the Agreement, including the United States;</text></paragraph><paragraph id="id9376da7f265c4395a5dfc0c80806cfbd"><enum>(3)</enum><text>all of the amounts appropriated under section 106 have been appropriated and deposited in the designated accounts of the Pueblo Trust Fund;</text></paragraph><paragraph id="ida22937e215f845cf8daeef8972e80d3d"><enum>(4)</enum><text>the State has—</text><subparagraph id="idb42dbeeaa57a4152bb34400263b3c06c"><enum>(A)</enum><text>provided the funding under section 106(c)(3) into appropriate funding accounts;</text></subparagraph><subparagraph id="id5c2448a3f3af4ec0ad7967a010014e63"><enum>(B)</enum><text>provided the funding under paragraphs (1) and (2) of section 106(c) into appropriate funding accounts or entered into funding agreements with the intended beneficiaries for funding under those paragraphs of that section; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc9a7d2037ffc4997829e446d05e4ba9a"><enum>(C)</enum><text>enacted legislation to amend State law to provide that a Pueblo Water Right may be leased for a term not to exceed 99 years, including renewals;</text></subparagraph></paragraph><paragraph id="idb06a6ffecf2248369015980d74e71be1"><enum>(5)</enum><text>the Decree Court has approved the Agreement and has entered a Partial Final Judgment and Decree; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb961f060ecd74bb384b6246798b8225f"><enum>(6)</enum><text>the waivers and releases under section 108 have been executed by the Pueblos and the Secretary.</text></paragraph></subsection></section><section id="id693fdfb9e796455e94319f8c917cd3ca"><enum>108.</enum><header>Waivers and releases of claims</header><subsection id="id317849d2dcb94bb1b2de2dd56d6e0fab"><enum>(a)</enum><header>Waivers and releases of claims by Pueblos and the United States as trustee for Pueblos</header><text>Subject to the reservation of rights and retention of claims under subsection (d), as consideration for recognition of the Pueblo Water Rights and other benefits described in the Agreement and this title, the Pueblos and the United States, acting as trustee for the Pueblos, shall execute a waiver and release of all claims for—</text><paragraph id="id30c93bb1a5b24a3e81255e1f519b510e"><enum>(1)</enum><text>water rights within the Rio San José Stream System that the Pueblos, or the United States acting as trustee for the Pueblos, asserted or could have asserted in any proceeding, including the Adjudication, on or before the Enforceability Date, except to the extent that such rights are recognized in the Agreement and this title; and</text></paragraph><paragraph id="idd85b15050c0041cc835b93a8de2a4995"><enum>(2)</enum><text>damages, losses, or injuries to water rights or claims of interference with, diversion of, or taking of water rights (including claims for injury to land resulting from such damages, losses, injuries, interference with, diversion, or taking of water rights) in waters in the Rio San José Stream System against any party to the Agreement, including the members and parciantes of Signatory Acequias, that accrued at any time up to and including the Enforceability Date.</text></paragraph></subsection><subsection id="id9325be2d3a91449196548fd693b8c1fe"><enum>(b)</enum><header>Waivers and releases of claims by Pueblos against United States</header><text>Subject to the reservation of rights and retention of claims under subsection (d), the Pueblos shall execute a waiver and release of all claims against the United States (including any agency or employee of the United States) first arising before the Enforceability Date relating to—</text><paragraph id="id1bb1b4c55799434f8be1df9337ac5317"><enum>(1)</enum><text>water rights within the Rio San José Stream System that the United States, acting as trustee for the Pueblos, asserted or could have asserted in any proceeding, including the Adjudication, except to the extent that such rights are recognized as part of the Pueblo Water Rights under this title;</text></paragraph><paragraph id="id35ac3c88537c45d58b74e02a10dabd98"><enum>(2)</enum><text>foregone benefits from non-Pueblo use of water, on and off Pueblo Land (including water from all sources and for all uses), within the Rio San José Stream System;</text></paragraph><paragraph id="idd0c23f5f65a2434f99d0def080df1851"><enum>(3)</enum><text>damage, loss, or injury to water, water rights, land, or natural resources due to loss of water or water rights (including damages, losses, or injuries to hunting, fishing, gathering, or cultural rights due to loss of water or water rights, claims relating to interference with, diversion of, or taking of water, or claims relating to a failure to protect, acquire, replace, or develop water, water rights, or water infrastructure) within the Rio San José Stream System;</text></paragraph><paragraph id="id5be8a3fcbd124197a35fda8942d30904"><enum>(4)</enum><text>a failure to provide operation, maintenance, or deferred maintenance for any irrigation system or irrigation project within the Rio San José Stream System;</text></paragraph><paragraph id="id2724878651c9406ea7527d7bb8bb07ee"><enum>(5)</enum><text>a failure to establish or provide a municipal, rural, or industrial water delivery system on Pueblo Land within the Rio San José Stream System;</text></paragraph><paragraph id="idc4d071e1e4414a02963b043675282806"><enum>(6)</enum><text>damage, loss, or injury to water, water rights, land, or natural resources due to construction, operation, and management of irrigation projects on Pueblo Land (including damages, losses, or injuries to fish habitat, wildlife, and wildlife habitat) within the Rio San José Stream System;</text></paragraph><paragraph id="id51e1bdf7e9ec409b851cb82038826c2b"><enum>(7)</enum><text>a failure to provide a dam safety improvement to a dam on Pueblo Land within the Rio San José Stream System;</text></paragraph><paragraph id="id55b0249212b34e1cb3aa278b16086f86"><enum>(8)</enum><text>the litigation of claims relating to any water right of the Pueblos within the Rio San José Stream System; and</text></paragraph><paragraph id="idb94b5ade0f144e618d092152a35cff4a"><enum>(9)</enum><text>the negotiation, execution, or adoption of the Agreement (including attachments) and this title.</text></paragraph></subsection><subsection id="id49934e85824e458eb4ec790e5a189b81"><enum>(c)</enum><header>Effective date</header><text>The waivers and releases described in subsections (a) and (b) shall take effect on the Enforceability Date.</text></subsection><subsection id="id24ca6288f0454bad831c5465469c2d93"><enum>(d)</enum><header>Reservation of rights and retention of claims</header><text>Notwithstanding the waivers and releases under subsections (a) and (b), the Pueblos and the United States, acting as trustee for the Pueblos, shall retain all claims relating to—</text><paragraph id="id59a3a8cc748440de8384f792d0c126d6"><enum>(1)</enum><text>the enforcement of, or claims accruing after the Enforceability Date relating to, water rights recognized under the Agreement, this title, or the Partial Final Judgment and Decree entered in the Adjudication;</text></paragraph><paragraph id="id22b16c2a1a2b4973841cd6810af1c08d"><enum>(2)</enum><text>activities affecting the quality of water and the environment, including claims under—</text><subparagraph id="idea449946ea4742f69e9eadd644ece113"><enum>(A)</enum><text>the Comprehensive Environmental Response, Compensation and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>), including claims for damages to natural resources;</text></subparagraph><subparagraph id="id2636658039634c39bae358ed9c99da7a"><enum>(B)</enum><text>the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f et seq.</external-xref>);</text></subparagraph><subparagraph id="id2814efdc83eb4b408692b239a8356a8b"><enum>(C)</enum><text>the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) (commonly referred to as the <quote>Clean Water Act</quote>); and</text></subparagraph><subparagraph id="id4f3de3a3f80c40db837a8c760831b974"><enum>(D)</enum><text>any regulations implementing the Acts described in subparagraphs (A) through (C);</text></subparagraph></paragraph><paragraph id="id745d3f4692fa459a9f4a73ba17ccbe04"><enum>(3)</enum><text>the right to use and protect water rights acquired after the date of enactment of this Act;</text></paragraph><paragraph id="id8c2fd1b14f0047318d970a165e3e7345"><enum>(4)</enum><text>damage, loss, or injury to land or natural resources that is not due to loss of water or water rights, including hunting, fishing, gathering, or cultural rights;</text></paragraph><paragraph id="id12fdc87b07614977aadfeab571fd1cc0"><enum>(5)</enum><text>all claims for water rights, and claims for injury to water rights, in basins other than the Rio San José Stream System, subject to article 8.5 of the Agreement with respect to the claims of the Pueblo of Laguna for water rights in the Rio Puerco Basin and the claims of the Pueblo of Acoma for water rights in the Rio Salado Basin;</text></paragraph><paragraph id="id4cedc5d16f7f416494b195a5aa3dd6aa"><enum>(6)</enum><text>all claims relating to the Jackpile-Paguate Uranium Mine in the State that are not due to loss of water or water rights; and</text></paragraph><paragraph id="iddc4aee543ed84d05a35420e1aee604f4"><enum>(7)</enum><text>all rights, remedies, privileges, immunities, powers, and claims not specifically waived and released pursuant to this title or the Agreement.</text></paragraph></subsection><subsection id="id8af618d445664045b12999b73d0ff8ae"><enum>(e)</enum><header>Effect of Agreement and title</header><text>Nothing in the Agreement or this title—</text><paragraph id="idbaa8a3f006d84f37a3bab724ff7f7cde"><enum>(1)</enum><text>reduces or extends the sovereignty (including civil and criminal jurisdiction) of any government entity, except as provided in section 110;</text></paragraph><paragraph id="id12d4987e5e844bc985bbc7fe440ad770"><enum>(2)</enum><text>affects the ability of the United States, as a sovereign, to carry out any activity authorized by law, including—</text><subparagraph id="id3c44a92864884453abb67cea6d0bafe8"><enum>(A)</enum><text>the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>);</text></subparagraph><subparagraph id="ida4b308a8ca34462b93eabd3089e14bec"><enum>(B)</enum><text>the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f et seq.</external-xref>);</text></subparagraph><subparagraph id="idffbd210adba6411fb8bf3a7e155bb072"><enum>(C)</enum><text>the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) (commonly referred to as the <quote>Clean Water Act</quote>);</text></subparagraph><subparagraph id="id291eb65848b049ef9cd3974a988b3f2c"><enum>(D)</enum><text>the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901 et seq.</external-xref>); and</text></subparagraph><subparagraph id="id604a82775b034ebebe7f3543ba3ad31f"><enum>(E)</enum><text>any regulations implementing the Acts described in subparagraphs (A) through (D);</text></subparagraph></paragraph><paragraph id="idcc2ef57005dd44cfbe33cea217144973"><enum>(3)</enum><text>affects the ability of the United States to act as trustee for the Pueblos (consistent with this title), any other pueblo or Indian Tribe, or an Allottee of any Indian Tribe;</text></paragraph><paragraph id="idc82dedce12dc4fb7af381b92ecb6ac13"><enum>(4)</enum><text>confers jurisdiction on any State court—</text><subparagraph id="idc5d704e08d054675b8f2439b2c2a6b52"><enum>(A)</enum><text>to interpret Federal law relating to health, safety, or the environment;</text></subparagraph><subparagraph id="ide2873fd31a1a4214a283a5d70771d2e5"><enum>(B)</enum><text>to determine the duties of the United States or any other party under Federal law regarding health, safety, or the environment; or</text></subparagraph><subparagraph id="idfe4d1a4ceee14990ac034bcee936f41b"><enum>(C)</enum><text>to conduct judicial review of any Federal agency action; or</text></subparagraph></paragraph><paragraph id="id46ee69008887480cbbb9d2d5d056bbb4"><enum>(5)</enum><text>waives any claim of a member of a Pueblo in an individual capacity that does not derive from a right of the Pueblos.</text></paragraph></subsection><subsection id="idb2ec2236431b4a0da59ab8a071d96d1e"><enum>(f)</enum><header>Tolling of claims</header><paragraph id="id703fae9e69a14d4398469079ba541ffe"><enum>(1)</enum><header>In general</header><text>Each applicable period of limitation and time-based equitable defense relating to a claim described in this section shall be tolled for the period beginning on the date of enactment of this Act and ending on the Enforceability Date.</text></paragraph><paragraph id="idbaa85a83e5424d94ab3f3c5e37db42e7"><enum>(2)</enum><header>Effect of subsection</header><text>Nothing in this subsection revives any claim or tolls any period of limitation or time-based equitable defense that expired before the date of enactment of this Act.</text></paragraph><paragraph id="idd93618c9dc254a309140e0c85621d538"><enum>(3)</enum><header>Limitation</header><text>Nothing in this section precludes the tolling of any period of limitation or any time-based equitable defense under any other applicable law.</text></paragraph></subsection><subsection id="id40e524aa07dc41b6a7a568635fc0ea49"><enum>(g)</enum><header>Expiration</header><paragraph id="ida6bfd1adf5d94118a0d109371dab642b"><enum>(1)</enum><header>In general</header><text>This title shall expire in any case in which the Secretary fails to publish a statement of findings under section 107 by not later than—</text><subparagraph id="ided78cd099c1e479f9a87c5b154bd1fbe"><enum>(A)</enum><text>July 1, 2030; or</text></subparagraph><subparagraph id="id20535590466b452583b4b4bc5f431d34"><enum>(B)</enum><text>such alternative later date as is agreed to by the Pueblos and the Secretary, after providing reasonable notice to the State.</text></subparagraph></paragraph><paragraph id="id74f1e1683e264c208cae9d747fc8958f"><enum>(2)</enum><header>Consequences</header><text>If this title expires under paragraph (1)—</text><subparagraph id="id1835d84e8acd4bf6884e9ab9352a03a9"><enum>(A)</enum><text>the waivers and releases under subsections (a) and (b) shall—</text><clause id="idbe8cede0f893408dac20bace3740febe"><enum>(i)</enum><text>expire; and</text></clause><clause id="id040fd5c96ad84c12a50e47e72788e0be"><enum>(ii)</enum><text>have no further force or effect;</text></clause></subparagraph><subparagraph id="id49d50a0855b14ce7a3e6b01a6397150c"><enum>(B)</enum><text>the authorization, ratification, confirmation, and execution of the Agreement under section 103 shall no longer be effective;</text></subparagraph><subparagraph id="id12f962c2acd54f99a50407b0d0f8cccf"><enum>(C)</enum><text>any action carried out by the Secretary, and any contract or agreement entered into, pursuant to this title shall be void;</text></subparagraph><subparagraph id="idddcb5ea5f09c45c9911dbfbeeac75a95"><enum>(D)</enum><text>any unexpended Federal funds appropriated or made available to carry out the activities authorized by this title, together with any interest earned on those funds, and any water rights or contracts to use water and title to other property acquired or constructed with Federal funds appropriated or made available to carry out the activities authorized by this title, shall be returned to the Federal Government, unless otherwise agreed to by the Pueblos and the United States and approved by Congress; and</text></subparagraph><subparagraph id="id4d8840ee6ec54d918458c0053a94ea79"><enum>(E)</enum><text>except for Federal funds used to acquire or construct property that is returned to the Federal Government under subparagraph (D), the United States shall be entitled to offset any Federal funds made available to carry out this title that were expended or withdrawn, or any funds made available to carry out this title from other Federal authorized sources, together with any interest accrued on those funds, against any claims against the United States—</text><clause id="id43102242f910456e878cef07be4dd092"><enum>(i)</enum><text>relating to—</text><subclause id="idc9fb5a7d0af248ddb162cab6ebb2aca8"><enum>(I)</enum><text>water rights in the State asserted by—</text><item commented="no" display-inline="no-display-inline" id="id26e8f5c1f8d1466a95115b936ce4f46d"><enum>(aa)</enum><text display-inline="yes-display-inline">the Pueblos; or </text></item><item commented="no" display-inline="no-display-inline" id="id3ff700388742416e81e69d15e98ca4a1"><enum>(bb)</enum><text display-inline="yes-display-inline">any user of the Pueblo Water Rights; or</text></item></subclause><subclause id="id4c87e60eb9514217a4f219e436a33e75"><enum>(II)</enum><text>any other matter covered by subsection (b); or</text></subclause></clause><clause id="id946972215b7e4002a2a578c27f3f4c1f" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>in any future settlement of water rights of the Pueblos.</text></clause></subparagraph></paragraph></subsection></section><section id="id19410c05e03b48eb9a36fbae3c826fe9"><enum>109.</enum><header>Satisfaction of claims</header><text display-inline="no-display-inline"> The benefits provided under this title shall be in complete replacement of, complete substitution for, and full satisfaction of any claim of the Pueblos against the United States that are waived and released by the Pueblos pursuant to section 108(b).</text></section><section id="idf1e01cb96e6148e28b85edd452b046fc"><enum>110.</enum><header>Consent of United States to jurisdiction for judicial review of a Pueblo Water Right permit decision</header><subsection id="ide7598a668c094cb5abfa6f543ca31819"><enum>(a)</enum><header>Consent</header><text>On the Enforceability Date, the consent of the United States is hereby given, with the consent of each Pueblo under article 11.5 of the Agreement, to jurisdiction in the District Court for the Thirteenth Judicial District of the State of New Mexico, and in the New Mexico Court of Appeals and the New Mexico Supreme Court on appeal therefrom in the same manner as provided under New Mexico law, over an action filed in such District Court by any party to a Pueblo Water Rights Permit administrative proceeding under article 11.4 of the Agreement for the limited and sole purpose of judicial review of a Pueblo Water Right Permit decision under article 11.5 of the Agreement.</text></subsection><subsection id="ide731386fca574f4fa4201d8bcfafea46"><enum>(b)</enum><header>Limitation</header><text>The consent of the United States under this title is limited to judicial review, based on the record developed through the administrative process of the Pueblo, under a standard of judicial review limited to determining whether the Pueblo decision on the application for Pueblo Water Right Permit—</text><paragraph id="id17BE92D20D77408286A67F61ABF79CCC"><enum>(1)</enum><text>is supported by substantial evidence; </text></paragraph><paragraph id="idAEDDAA8665CC4EE38AEF5644B6D3C1D2"><enum>(2)</enum><text>is not arbitrary, capricious, or contrary to law;</text></paragraph><paragraph id="idDC68C497DDC74EBFB4BFDD4E37EC38CB"><enum>(3)</enum><text>is not in accordance with this Agreement or the Partial Final Judgment and Decree; or </text></paragraph><paragraph id="idCA5240DDB73447EA99BB9B85AF37E927"><enum>(4)</enum><text>shows that the Pueblo acted fraudulently or outside the scope of its authority.</text></paragraph></subsection><subsection id="ideef113d8bec14e439a473491e028a354"><enum>(c)</enum><header>Pueblo Water Code and interpretation</header><paragraph id="id5815101A8D10496CA8F4D15A653FA875"><enum>(1)</enum><header>In general</header><text>Pueblo Water Code or Pueblo Water Law provisions that meet the requirements of article 11 of the Agreement shall be given full faith and credit in any proceeding described in this section. </text></paragraph><paragraph id="id5E1A7C51AE6B414BAB51928821E13D62"><enum>(2)</enum><header>Provisions of the Pueblo Water Code</header><text>To the extent that a State court conducting judicial review under this section must interpret provisions of Pueblo law that are not express provisions of the Pueblo Water Code, the State court shall certify the question of interpretation to the Pueblo court. </text></paragraph><paragraph id="idADBC1E88AE3543AEA2D5A1045D5843C9"><enum>(3)</enum><header>No certification</header><text>Any issues of interpretation of standards in article 11.6 of the Agreement are not subject to certification. </text></paragraph><paragraph id="idF0C99241B6094EC285507F925F3CF496"><enum>(4)</enum><header>Limitation</header><text>Nothing in this section limits the jurisdiction of the Decree Court to interpret and enforce the Agreement.</text></paragraph></subsection></section><section id="id30e88e606eb94f08b482bd8f0534fdd3"><enum>111.</enum><header>Miscellaneous provisions</header><subsection id="id85c9c4e8ce764a5b8d52d4f2633d489e"><enum>(a)</enum><header>No waiver of sovereign immunity by the United States</header><text>Nothing in this title waives the sovereign immunity of the United States.</text></subsection><subsection id="id77da387d3a5f4ffc9ded0da9dadcc775"><enum>(b)</enum><header>Other tribes not adversely affected</header><text>Nothing in this title quantifies or diminishes any land or water right, or any claim or entitlement to land or water, of an Indian Tribe, band, or community other than the Pueblos.</text></subsection><subsection id="id8DBA81495FB847DE8E96B111EBD815FC"><enum>(c)</enum><header>Allottees not adversely affected</header><text>Nothing in this title quantifies or diminishes any water right, or any claim or entitlement to water, of an Allottee. </text></subsection><subsection id="ide2b5c191e9ac42bb987af1809636b993"><enum>(d)</enum><header>Effect on current law</header><text>Nothing in this title affects any provision of law (including regulations) in effect on the day before the date of enactment of this Act with respect to pre-enforcement review of any Federal environmental enforcement action.</text></subsection><subsection id="ide746b85b6d1e4843947c6892da12a3c3"><enum>(e)</enum><header>Conflict</header><text>In the event of a conflict between the Agreement and this title, this title shall control.</text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id46e1e991007e4f5096cbd8da45ad792e"><enum>112.</enum><header>Antideficiency</header><text display-inline="no-display-inline">The United States shall not be liable for any failure to carry out any obligation or activity authorized by this title, including any obligation or activity under the Agreement, if adequate appropriations are not provided expressly by Congress to carry out the purposes of this title.</text></section></title><title style="OLC" id="id05B68D83C91641DBB81E174B452E825E"><enum>II</enum><header>Pueblos of Jemez and Zia Water Rights Settlement</header><section id="idda40ddb77bf94733a5a43f85e057dfad"><enum>201.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this title are—</text><paragraph id="id873c2396a86e434eb82b895e19e55db0"><enum>(1)</enum><text>to achieve a fair, equitable, and final settlement of all claims to water rights in the Jemez River Stream System in the State of New Mexico for—</text><subparagraph id="id4692b5d641e14ed58603638e7518287f"><enum>(A)</enum><text>the Pueblo of Jemez;</text></subparagraph><subparagraph id="id51b9893e148b4aafb91fe0d1c40d03ee"><enum>(B)</enum><text>the Pueblo of Zia; and</text></subparagraph><subparagraph id="idcf51ca6cb4ce4c7f8759243ed61592d8"><enum>(C)</enum><text>the United States, acting as trustee for the Pueblos of Jemez and Zia;</text></subparagraph></paragraph><paragraph id="idf64f67d2bd28425b96dce1636c66b78b"><enum>(2)</enum><text>to authorize, ratify, and confirm the Agreement entered into by the Pueblos, the State, and various other parties to the extent that the Agreement is consistent with this title;</text></paragraph><paragraph id="idb6d01a3aec394850a3d48d4560010745"><enum>(3)</enum><text>to authorize and direct the Secretary—</text><subparagraph id="idac83d8d5abe14729a06d43af31dacd5c"><enum>(A)</enum><text>to execute the Agreement; and</text></subparagraph><subparagraph id="idb6096a271fe24cafa68f7fc24a7c95d1"><enum>(B)</enum><text>to take any other actions necessary to carry out the Agreement in accordance with this title; and</text></subparagraph></paragraph><paragraph id="idad510abdaf104a0594f31f967ae64a74"><enum>(4)</enum><text>to authorize funds necessary for the implementation of the Agreement and this title.</text></paragraph></section><section id="id7ace3f5d890f4c479cb4faa742f0e97d"><enum>202.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph commented="no" id="id85742445e27943e1a2f30862bc85e5f9"><enum>(1)</enum><header>Adjudication</header><text>The term <term>Adjudication</term> means the adjudication of water rights pending before the United States District Court for the District of New Mexico: United States of America, on its own behalf, and on behalf of the Pueblos of Jemez, Santa Ana, and Zia, State of New Mexico, ex rel. State Engineer, Plaintiffs, and Pueblos of Jemez, Santa Ana, and Zia, Plaintiffs-in-Intervention v. Tom Abousleman, et al., Defendants, Civil No. 83–cv–01041 (KR).</text></paragraph><paragraph id="idc5f724458ec74084ae9cb2e203056ff8"><enum>(2)</enum><header>Agreement</header><text>The term <term>Agreement</term> means—</text><subparagraph id="id07457e6689544f2ebab2963bd736d7a9"><enum>(A)</enum><text>the document entitled <quote>Pueblos of Jemez and Zia Water Rights Settlement Agreement</quote> and dated May 11, 2022, and the appendices and exhibits attached thereto; and</text></subparagraph><subparagraph id="id3f57a6bba7b8483588c38887bf91b525"><enum>(B)</enum><text>any amendment to the document referred to in subparagraph (A) (including an amendment to an appendix or exhibit) that is executed to ensure that the Agreement is consistent with this title.</text></subparagraph></paragraph><paragraph id="id8157196e82264dce8e4572ab5fe32d50"><enum>(3)</enum><header>Enforceability Date</header><text>The term <term>Enforceability Date</term> means the date described in section 207.</text></paragraph><paragraph id="id8dfd56797c994bbca6635caf07816a27"><enum>(4)</enum><header>Jemez River Stream System</header><text>The term <term>Jemez River Stream System</term> means the geographic extent of the area involved in the Adjudication.</text></paragraph><paragraph commented="no" id="id07309ec4ce16453da8aa6e554df7a658"><enum>(5)</enum><header>Partial Final Judgment and Decree</header><text>The term <term>Partial Final Judgment and Decree</term> means a final or interlocutory partial final judgment and decree entered by the United States District Court for the District of New Mexico with respect to the water rights of the Pueblos—</text><subparagraph commented="no" id="idB068CA41062E41099A7640CAC396740F"><enum>(A)</enum><text>that is substantially in the form described in the Agreement, as amended to ensure consistency with this title; and</text></subparagraph><subparagraph commented="no" id="idBB9A39DB96BE48D5B1D541A33367962C"><enum>(B)</enum><text>from which no further appeal may be taken.</text></subparagraph></paragraph><paragraph id="id91A617FD283345CC815E2B927C1D8D73"><enum>(6)</enum><header>Pueblo</header><text>The term <term>Pueblo</term> means either of—</text><subparagraph id="id2DF7ADA783B84EFA956D1DC6063BBF27"><enum>(A)</enum><text>the Pueblo of Jemez; or </text></subparagraph><subparagraph id="id78C9AB5744384A7CBA1CA6A6241A2A7E"><enum>(B)</enum><text>the Pueblo of Zia.</text></subparagraph></paragraph><paragraph id="id55125a39e42049d792c30d6fafd8da7c"><enum>(7)</enum><header>Pueblo Land</header><text>The term <term>Pueblo Land</term> means any real property that is—</text><subparagraph id="id31fc92b2b6ed465c9f70fc7795f3f246"><enum>(A)</enum><text>held by the United States in trust for a Pueblo within the Jemez River Stream System;</text></subparagraph><subparagraph id="id68958032e04242d986dadbf6e3b3f3ef"><enum>(B)</enum><text>owned by a Pueblo within the Jemez River Stream System before the date on which a court approves the Agreement; or</text></subparagraph><subparagraph id="idbba53c321ed5418ba83dfd002e674349"><enum>(C)</enum><text>acquired by a Pueblo on or after the date on which a court approves the Agreement if the real property—</text><clause id="id0dfd581ffa9949bda19fbb9df67ea72a"><enum>(i)</enum><text>is located within the exterior boundaries of the Pueblo, as recognized and confirmed by a patent issued under the Act of December 22, 1858 (11 Stat. 374, chapter V);</text></clause><clause id="id6462246c17e74aaf846f74bac1540f71"><enum>(ii)</enum><text>is located within the exterior boundaries of any territory set aside for a Pueblo by law, executive order, or court decree;</text></clause><clause id="id73274ae5ec224521bb0e65c1c6271806"><enum>(iii)</enum><text>is owned by a Pueblo or held by the United States in trust for the benefit of a Pueblo outside the Jemez River Stream System that is located within the exterior boundaries of the Pueblo, as recognized and confirmed by a patent issued under the Act of December 22, 1858 (11 Stat. 374, chapter V); or</text></clause><clause id="id61602d39de314cf9b2eb9b2e5b0171dc"><enum>(iv)</enum><text>is located within the exterior boundaries of any real property located outside the Jemez River Stream System set aside for a Pueblo by law, executive order, or court decree if the land is within or contiguous to land held by the United States in trust for the Pueblo as of June 1, 2022.</text></clause></subparagraph></paragraph><paragraph commented="no" id="id3C2ECDF34004476F8D2427B81106B113"><enum>(8)</enum><header>Pueblo Trust Fund</header><text>The term <term>Pueblo Trust Fund</term> means—</text><subparagraph commented="no" id="id659E88832D2641B9A078298D4BC2B72D"><enum>(A)</enum><text>the Pueblo of Jemez Settlement Trust Fund established under section 205(a); and </text></subparagraph><subparagraph commented="no" id="idAC8AFA041F104BAEA7CA96ED96C30E44"><enum>(B)</enum><text>the Pueblo of Zia Settlement Trust Fund established under that section.</text></subparagraph></paragraph><paragraph id="id2db586a913cb40f9aa810a68afae5744"><enum>(9)</enum><header>Pueblo Water Rights</header><text>The term <term>Pueblo Water Rights</term> means the respective water rights of the Pueblos—</text><subparagraph id="idE1E0712D4CE04A4C8892A4DB8E77CF3D"><enum>(A)</enum><text>as identified in the Agreement and section 204; and </text></subparagraph><subparagraph id="id9CBE565E740A46BAA132A5F265B01D30"><enum>(B)</enum><text>as confirmed in the Partial Final Judgment and Decree.</text></subparagraph></paragraph><paragraph id="ida3dfcd56dc3c40479de504521ecc07cf"><enum>(10)</enum><header>Pueblos</header><text>The term <term>Pueblos</term> means—</text><subparagraph id="id5D1BAAE72157456ABED887DC6BACE077"><enum>(A)</enum><text>the Pueblo of Jemez; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2DB3FD8802A34ECAA63F65A50E336A2E"><enum>(B)</enum><text>the Pueblo of Zia.</text></subparagraph></paragraph><paragraph id="id60D2BC08E527403FB922B0D84393E19E"><enum>(11)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="ide16dfdf5b2884900bb9ca6cead87a6ac"><enum>(12)</enum><header>State</header><text>The term <term>State</term> means the State of New Mexico and all officers, agents, departments, and political subdivisions of the State of New Mexico.</text></paragraph></section><section id="id41a2dbbc758345298e3f264709c65829"><enum>203.</enum><header>Ratification of Agreement</header><subsection id="id2aacb79946944122a221a3df1862dd24"><enum>(a)</enum><header>Ratification</header><paragraph id="id78abbef8e8f747f5b24386980c856926"><enum>(1)</enum><header>In general</header><text>Except as modified by this title and to the extent that the Agreement does not conflict with this title, the Agreement is authorized, ratified, and confirmed.</text></paragraph><paragraph id="idc571a07f213c4d1982e1f2a28fedc149"><enum>(2)</enum><header>Amendments</header><text>If an amendment to the Agreement, or to any appendix or exhibit attached to the Agreement requiring the signature of the Secretary, is executed in accordance with this title to make the Agreement consistent with this title, the amendment is authorized, ratified, and confirmed.</text></paragraph></subsection><subsection id="id69d9f1429a814a10bd9cb2130b81a8b6"><enum>(b)</enum><header>Execution</header><paragraph id="id9b873ce6b0ce4dad90e93dc4e75287eb"><enum>(1)</enum><header>In general</header><text>To the extent the Agreement does not conflict with this title, the Secretary shall execute the Agreement, including all appendices or exhibits to, or parts of, the Agreement requiring the signature of the Secretary.</text></paragraph><paragraph id="id7386b30cae76426a858afb45f72abf3c"><enum>(2)</enum><header>Modifications</header><text>Nothing in this title prohibits the Secretary, after execution of the Agreement, from approving any modification to the Agreement, including an appendix or exhibit to the Agreement, that is consistent with this title, to the extent that the modification does not otherwise require congressional approval under section 2116 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/25/177">25 U.S.C. 177</external-xref>) or any other applicable provision of Federal law.</text></paragraph></subsection><subsection id="id8365186a9925466486694c8f9b2b66aa"><enum>(c)</enum><header>Environmental compliance</header><paragraph id="id65852b477e184130a53478676f725bdd"><enum>(1)</enum><header>In general</header><text>In implementing the Agreement and this title, the Secretary shall comply with—</text><subparagraph id="ida6acb81d0985485d83c04ceb2c09aecf"><enum>(A)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);</text></subparagraph><subparagraph id="idf149ac9efbf742b3b6cf9cfc49b906ec"><enum>(B)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), including the implementing regulations of that Act; and</text></subparagraph><subparagraph id="id703ae4ea9f0d412ba6cb2e7809d13765"><enum>(C)</enum><text>all other applicable Federal environmental laws and regulations.</text></subparagraph></paragraph><paragraph id="ided165eff35824fb8a73c7cfb7a7e284b"><enum>(2)</enum><header>Compliance</header><subparagraph id="id486276661365424385295fe77b95a762"><enum>(A)</enum><header>In general</header><text>In implementing the Agreement and this title, the Pueblos shall prepare any necessary environmental documents, consistent with—</text><clause id="id72945c015195401da9b6c022ea28bf6d"><enum>(i)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);</text></clause><clause id="id26cbf87d18a4473c9a44ece0a081d0c0"><enum>(ii)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), including the implementing regulations of that Act; and</text></clause><clause id="id54a084083a034fd4b9317c28f3af67b7"><enum>(iii)</enum><text>all other applicable Federal environmental laws and regulations.</text></clause></subparagraph><subparagraph id="id5dbe19c2e2dc4268bff2f2928e7386be"><enum>(B)</enum><header>Authorizations</header><text>The Secretary shall—</text><clause id="idfe13f8518f5543f8b5ce4bda5de11272"><enum>(i)</enum><text>independently evaluate the documentation required under subparagraph (A); and</text></clause><clause id="idc20dfc2928044029972037727e4ef35e"><enum>(ii)</enum><text>be responsible for the accuracy, scope, and contents of that documentation.</text></clause></subparagraph></paragraph><paragraph id="idd4feebdb4c304a46b0e3b2e79205d9cb"><enum>(3)</enum><header>Effect of execution</header><text>The execution of the Agreement by the Secretary under this section shall not constitute a major Federal action under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></paragraph><paragraph id="id409cc877d44243c9b92b35ee8ff7f234"><enum>(4)</enum><header>Costs</header><text>Any costs associated with the performance of the compliance activities under this subsection shall be paid from funds deposited in the Pueblo Trust Funds, subject to the condition that any costs associated with the performance of Federal approval or other review of such compliance work or costs associated with inherently Federal functions shall remain the responsibility of the Secretary.</text></paragraph></subsection></section><section id="id178bedb47d684a10a919c6db937c2765"><enum>204.</enum><header>Pueblo Water Rights</header><subsection id="id49806f6013ff486b9830a452af1de633"><enum>(a)</enum><header>Trust status of the Pueblo Water Rights</header><text>The Pueblo Water Rights shall be held in trust by the United States on behalf of the Pueblos in accordance with the Agreement and this title.</text></subsection><subsection id="id7fd82919bf594e31b81eb5a5d51c53e0"><enum>(b)</enum><header>Forfeiture and abandonment</header><paragraph commented="no" display-inline="no-display-inline" id="id818642257ce84fbca8d468899aea3789"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Pueblo Water Rights shall not be subject to loss through non-use, forfeiture, abandonment, or other operation of law.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id46fe37f4642441d0b9f6b69278c480a6"><enum>(2)</enum><header>State-law based water rights</header><text>State-law based water rights acquired by a Pueblo, or by the United States on behalf of a Pueblo, after the date for inclusion in the Partial Final Judgment and Decree, shall not be subject to forfeiture, abandonment, or permanent alienation from the time they are acquired. </text></paragraph></subsection><subsection id="id7f1b79cce7e24593afcab26e44c9dd28"><enum>(c)</enum><header>Use</header><text>Any use of the Pueblo Water Rights shall be subject to the terms and conditions of the Agreement and this title.</text></subsection><subsection id="ida5644569b8d84549b901c8a1d6996585"><enum>(d)</enum><header>Authority of the Pueblos</header><paragraph id="id8f6344febdec4cf9ad5ad8a0f08de9d6"><enum>(1)</enum><header>In general</header><text>The Pueblos shall have the authority to allocate, distribute, and lease the Pueblo Water Rights for use on Pueblo Land in accordance with the Agreement, this title, and applicable Federal law.</text></paragraph><paragraph id="idb4f4b466f22c461983588a8f4eba1dd1"><enum>(2)</enum><header>Use off Pueblo land</header><text>The Pueblos may allocate, distribute, and lease the Pueblo Water Rights for use off Pueblo Land in accordance with the Agreement, this title, and applicable Federal law, subject to the approval of the Secretary.</text></paragraph></subsection><subsection id="id0b70acab924d481d95154f87c965fa49"><enum>(e)</enum><header>Administration</header><paragraph id="id2b8a854e8ba1461d8f18800816705aa6"><enum>(1)</enum><header>No alienation</header><text>The Pueblos shall not permanently alienate any portion of the Pueblo Water Rights.</text></paragraph><paragraph id="id30a16688fbe64d6dac89f930e9797893"><enum>(2)</enum><header>Purchases or grants of land from Indians</header><text>An authorization provided by this title for the allocation, distribution, leasing, or other arrangement entered into pursuant to this title shall be considered to satisfy any requirement for authorization of the action required by Federal law.</text></paragraph><paragraph id="id99d2851751a7463ab0a8df8cd43e194e"><enum>(3)</enum><header>Prohibition on forfeiture</header><text>The non-use of all or any portion of the Pueblo Water Rights by any water user shall not result in the forfeiture, abandonment, relinquishment, or other loss of all or any portion of the Pueblo Water Rights.</text></paragraph></subsection></section><section id="id4d20b606f41f44bdab99d90e6c0a8f7b"><enum>205.</enum><header>Settlement trust funds</header><subsection id="id3254fcb051d34009ae72901685af6e89"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish 2 trust funds, to be known as the <quote>Pueblo of Jemez Settlement Trust Fund</quote> and the <quote>Pueblo of Zia Settlement Trust Fund</quote>, to be managed, invested, and distributed by the Secretary and to remain available until expended, withdrawn, or reverted to the general fund of the Treasury, consisting of the amounts deposited in the Pueblo Trust Funds under subsection (b), together with any investment earnings, including interest, earned on those amounts for the purpose of carrying out this title.</text></subsection><subsection id="idd1dca7d79247489596179566217b7e04"><enum>(b)</enum><header>Deposits</header><text>The Secretary shall deposit in each Pueblo Trust Fund the amounts made available pursuant to section 206(a).</text></subsection><subsection id="idbac650673d9f4799a00856c1bde5cabf"><enum>(c)</enum><header>Management and interest</header><paragraph id="id8f97eb48964c4ae3872a3bf04232c079"><enum>(1)</enum><header>Management</header><text>On receipt and deposit of funds into the Pueblo Trust Funds under subsection (b), the Secretary shall manage, invest, and distribute all amounts in the Pueblo Trust Funds in a manner that is consistent with the investment authority of the Secretary under—</text><subparagraph id="idca95bd8352564d92875c6577fafc7981"><enum>(A)</enum><text>the first section of the Act of June 24, 1938 (<external-xref legal-doc="usc" parsable-cite="usc/25/162a">25 U.S.C. 162a</external-xref>);</text></subparagraph><subparagraph id="id78b14d5ed33f42c58868d732a0954bf6"><enum>(B)</enum><text>the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>); and</text></subparagraph><subparagraph id="ide88347a376b74a5ab4798cce8639c879"><enum>(C)</enum><text>this subsection.</text></subparagraph></paragraph><paragraph id="id432d7b034cd5412e8f2168e800aeaa2a"><enum>(2)</enum><header>Investment earnings</header><text>In addition to the deposits made to each Pueblo Trust Fund under subsection (b), any investment earnings, including interest, earned on those amounts held in each Pueblo Trust Fund are authorized to be used in accordance with subsections (e) and (g).</text></paragraph></subsection><subsection id="id1b05d6fa346b4c6da5c0b4f4d32cf32e"><enum>(d)</enum><header>Availability of amounts</header><paragraph id="id058d36c48ecb43f5a0c1355f6269283d"><enum>(1)</enum><header>In general</header><text>Amounts appropriated to, and deposited in, each Pueblo Trust Fund, including any investment earnings (including interest) earned on those amounts, shall be made available to each Pueblo by the Secretary beginning on the Enforceability Date, subject to the requirements of this section, except for funds to be made available to the Pueblos pursuant to paragraph (2).</text></paragraph><paragraph commented="no" id="idfab38a38d2354dcd80921c0c319e56a0"><enum>(2)</enum><header>Use of funds</header><text>Notwithstanding paragraph (1), $25,000,000 of the amounts deposited in each Pueblo Trust Fund shall be available to the appropriate Pueblo for—</text><subparagraph commented="no" id="idEC3845F0BC484FC4A1A21B3146B7C070"><enum>(A)</enum><text>developing economic water development plans;</text></subparagraph><subparagraph commented="no" id="idB46B491CC06E41598CF3C501A603FC29"><enum>(B)</enum><text>preparing environmental compliance documents;</text></subparagraph><subparagraph commented="no" id="id58285CC0E1694F15AE961333C95A3E3E"><enum>(C)</enum><text>preparing water project engineering designs;</text></subparagraph><subparagraph commented="no" id="id0E7DB1C99D574AB7A01E3484A52CF7E4"><enum>(D)</enum><text>establishing and operating a water resource department;</text></subparagraph><subparagraph commented="no" id="id1553CFA54CD7409A867E992C30F355DE"><enum>(E)</enum><text>installing supplemental irrigation groundwater wells; and</text></subparagraph><subparagraph commented="no" id="idD23CF200F23D43189160CFFA2D6E743C"><enum>(F)</enum><text>developing water measurement and reporting water use plans.</text></subparagraph></paragraph></subsection><subsection commented="no" id="id4a07986abf424e08ab7c4a4bea1e1ad1"><enum>(e)</enum><header>Withdrawals</header><paragraph id="id65CFC9EB01854A04857BC1DE8D7812A8"><enum>(1)</enum><header>Withdrawals under the American Indian Trust Fund Management Reform Act of 1994</header><subparagraph id="id9ba78c92d66a4d068b5ae2f86362069e"><enum>(A)</enum><header>In general</header><text>Each Pueblo may withdraw any portion of the amounts in the Pueblo Trust Fund on approval by the Secretary of a Tribal management plan submitted by the Pueblo in accordance with the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>).</text></subparagraph><subparagraph id="idf961cae7469c4f7ba166ab8e612a9abc"><enum>(B)</enum><header>Requirements</header><text>In addition to the requirements under the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>), the Tribal management plan under this paragraph shall require that the appropriate Pueblo shall spend all amounts withdrawn from each Pueblo Trust Fund, and any investment earnings (including interest) earned on those amounts through the investments under the Tribal management plan, in accordance with this title.</text></subparagraph><subparagraph id="idb03c07b8565d49d9a07f511a6d492c58"><enum>(C)</enum><header>Enforcement</header><text>The Secretary may carry out such judicial and administrative actions as the Secretary determines to be necessary to enforce the Tribal management plan under this paragraph to ensure that amounts withdrawn by each Pueblo from the Pueblo Trust Fund of the Pueblo under subparagraph (A) are used in accordance with this title.</text></subparagraph></paragraph><paragraph id="idbcf792a3bebc4278bcbe6b7acd42f3da"><enum>(2)</enum><header>Withdrawals under expenditure plan</header><subparagraph id="id134b7fd9f03c42ae9aa77ba31b76b9a4"><enum>(A)</enum><header>In general</header><text>Each Pueblo may submit to the Secretary a request to withdraw funds from the Pueblo Trust Fund of the Pueblo pursuant to an approved expenditure plan.</text></subparagraph><subparagraph id="idf30abe62e8ab427ab74bb50bf9ed0d09"><enum>(B)</enum><header>Requirements</header><text>To be eligible to withdraw amounts under an expenditure plan under subparagraph (A), each Pueblo shall submit to the Secretary an expenditure plan for any portion of the Pueblo Trust Fund that the Pueblo elects to withdraw pursuant to that subparagraph, subject to the condition that the amounts shall be used for the purposes described in this title.</text></subparagraph><subparagraph id="idbe874cab70ba40f89508fd21d287202a"><enum>(C)</enum><header>Inclusions</header><text>An expenditure plan under this paragraph shall include a description of the manner and purpose for which the amounts proposed to be withdrawn from the Pueblo Trust Fund will be used by the Pueblo, in accordance with this subsection and subsection (g).</text></subparagraph><subparagraph id="idfc6bb97c70414e998511bcda2acfde8a"><enum>(D)</enum><header>Approval</header><text>The Secretary shall approve an expenditure plan submitted under subparagraph (A) if the Secretary determines that the plan—</text><clause id="idd65b3b7ecdf94c3e8b9948d050e50fad"><enum>(i)</enum><text>is reasonable; and</text></clause><clause id="id49a4dfc907df4604b560698acd130b4e"><enum>(ii)</enum><text>is consistent with, and will be used for, the purposes of this title.</text></clause></subparagraph><subparagraph id="idb6a2687c08f148bab603032fe5aa49f4"><enum>(E)</enum><header>Enforcement</header><text>The Secretary may carry out such judicial and administrative actions as the Secretary determines to be necessary to enforce an expenditure plan to ensure that amounts disbursed under this paragraph are used in accordance with this title.</text></subparagraph></paragraph></subsection><subsection id="id8725c65b946a486a9c03d2883c8c78c0"><enum>(f)</enum><header>Effect of section</header><text>Nothing in this section gives the Pueblos the right to judicial review of a determination of the Secretary relating to whether to approve a Tribal management plan under paragraph (1) of subsection (e) or an expenditure plan under paragraph (2) of that subsection except under subchapter II of chapter 5, and chapter 7, of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>).</text></subsection><subsection id="idd01edb057b9b499b8f57d2a0d1d7920e"><enum>(g)</enum><header>Uses</header><text>Amounts from a Pueblo Trust Fund may only be used by the appropriate Pueblo for the following purposes:</text><paragraph id="idc34f2a7cc87348cd93688036a3dfd754"><enum>(1)</enum><text>Planning, permitting, designing, engineering, constructing, reconstructing, replacing, rehabilitating, operating, or repairing water production, treatment, or delivery infrastructure, including for domestic and municipal use, on-farm improvements, or wastewater infrastructure.</text></paragraph><paragraph id="id238eb6fd774d46649ae4118cbcd6dd5f"><enum>(2)</enum><text>Watershed protection and enhancement, support of agriculture, water-related Pueblo community welfare and economic development, and costs related to implementation of the Agreement.</text></paragraph><paragraph id="id4c7ae5b6df244acebad199d357acf019"><enum>(3)</enum><text>Planning, permitting, designing, engineering, construction, reconstructing, replacing, rehabilitating, operating, or repairing water production of delivery infrastructure of the Augmentation Project, as set forth in the Agreement.</text></paragraph><paragraph id="ided183c618bf14dafb98e290e2d772ef3"><enum>(4)</enum><text>Ensuring environmental compliance in the development and construction of projects under this title.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3e126f06d0f443b39c62ce8d5cc3a140"><enum>(5)</enum><text>The management and administration of the Pueblo Water Rights.</text></paragraph></subsection><subsection id="id2325c436e630418c9824afbed897bd1e"><enum>(h)</enum><header>Liability</header><text>The Secretary and the Secretary of the Treasury shall not be liable for the expenditure or investment of any amounts withdrawn from a Pueblo Trust Fund by a Pueblo under paragraph (1) or (2) of subsection (e).</text></subsection><subsection id="id71d6b3c0ed0542dabfafcbf6724bf35c"><enum>(i)</enum><header>Expenditure reports</header><text>Each Pueblo shall annually submit to the Secretary an expenditure report describing accomplishments and amounts spent from use of withdrawals under a Tribal management plan or an expenditure plan under paragraph (1) or (2) of subsection (e), as applicable.</text></subsection><subsection id="id9eca4f837eee48bab37ece9d696805ea"><enum>(j)</enum><header>No per capita distributions</header><text>No portion of a Pueblo Trust Fund shall be distributed on a per capita basis to any member of a Pueblo.</text></subsection><subsection id="id114b967842fa4616839a4fea405c3003"><enum>(k)</enum><header>Title to infrastructure</header><text>Title to, control over, and operation of any project constructed using funds from a Pueblo Trust Fund shall remain in the appropriate Pueblo.</text></subsection><subsection id="idcbda5fd8e0bd4342b9685ad6e126bc56"><enum>(l)</enum><header>Operation, maintenance, and replacement</header><text>All operation, maintenance, and replacement costs of any project constructed using funds from a Pueblo Trust Fund shall be the responsibility of the appropriate Pueblo.</text></subsection></section><section id="id20eec718773e4622a0e1b41aa8e9a758"><enum>206.</enum><header>Funding</header><subsection id="ida9c16c50b114448dbd51cad5b5dd281b"><enum>(a)</enum><header>Mandatory appropriation</header><text>Out of any money in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Secretary—</text><paragraph id="id25ac7463fa484e6a9612a8a5b72736da"><enum>(1)</enum><text>for deposit in the Pueblo of Jemez Settlement Trust Fund established under section 205(a) $290,000,000, to remain available until expended, withdrawn, or reverted to the general fund of the Treasury; and</text></paragraph><paragraph id="id690b0353c93c441c82268bd74e9a5b04"><enum>(2)</enum><text>for deposit in the Pueblo of Zia Settlement Trust Fund established under that section $200,000,000, to remain available until expended, withdrawn, or reverted to the general fund of the Treasury.</text></paragraph></subsection><subsection id="idab7514a50ee74f3e9d6fdcc9a693def9"><enum>(b)</enum><header>Fluctuation in costs</header><paragraph id="idb67334b8f46d48599200fd23fc8a3387"><enum>(1)</enum><header>In general</header><text>The amount appropriated under subsection (a) shall be increased or decreased, as appropriate, by such amounts as may be justified by reason of ordinary fluctuations in costs, as indicated by the Bureau of Reclamation Construction Cost Index–Composite Trend.</text></paragraph><paragraph id="id3742322faa3b422aa9f1040b037a3294"><enum>(2)</enum><header>Construction costs adjustment</header><text>The amount appropriated under subsection (a) shall be adjusted to address construction cost changes necessary to account for unforeseen market volatility that may not otherwise be captured by engineering cost indices, as determined by the Secretary, including repricing applicable to the types of construction and current industry standards involved.</text></paragraph><paragraph id="id8475e5abaca841b488439ff9f5636343"><enum>(3)</enum><header>Repetition</header><text>The adjustment process under this subsection shall be repeated for each subsequent amount appropriated until the applicable amount, as adjusted, has been appropriated.</text></paragraph><paragraph id="iddbb3deaec21041898fabc0e32453bb58"><enum>(4)</enum><header>Period of indexing</header><text>The period of indexing adjustment under this subsection for any increment of funding shall start on October 1, 2021, and end on the date on which the funds are deposited in the applicable Pueblo Trust Fund.</text></paragraph></subsection><subsection id="id1747407a1f094fa593e7b02c5b8fc173"><enum>(c)</enum><header>State cost share</header><text>The State shall contribute—</text><paragraph id="id8affc3775e4c4a7085ae8c42959a5c6e"><enum>(1)</enum><text>$3,400,000, as adjusted for inflation pursuant to the Agreement, to the San Ysidro Community Ditch Association for capital and operating expenses of the mutual benefit Augmentation Project;</text></paragraph><paragraph id="id759AA6EA7B584EE69CF63A1C7B647344"><enum>(2)</enum><text>$16,159,000, as adjusted for inflation pursuant to the Agreement, for Jemez River Basin Water Users Coalition acequia ditch improvements; and</text></paragraph><paragraph id="id723c271886244e278e847c22c17b61f0"><enum>(3)</enum><text>$500,000, as adjusted for inflation, to mitigate impairment to non-Pueblo domestic and livestock groundwater rights as a result of new Pueblo water use.</text></paragraph></subsection></section><section id="id88ce72c567ec4badb5e960bafc9ffddc"><enum>207.</enum><header>Enforceability date</header><text display-inline="no-display-inline">The Enforceability Date shall be the date on which the Secretary publishes in the Federal Register a statement of findings that—</text><paragraph id="id55a967fe49484827a1fc4ced5a78cfd7"><enum>(1)</enum><text>to the extent that the Agreement conflicts with this title, the Agreement has been amended to conform with this title;</text></paragraph><paragraph id="id96771537d6a243afa3946c1f92776426"><enum>(2)</enum><text>the Agreement, as amended, has been executed by all parties to the Agreement, including the United States;</text></paragraph><paragraph id="id0c81d431c1b94070ab2007f606fc6494"><enum>(3)</enum><text>the United States District Court for the District of New Mexico has approved the Agreement and has entered a Partial Final Judgment and Decree;</text></paragraph><paragraph id="idb082473da20649bcb88b434f20f4e388"><enum>(4)</enum><text>all of the amounts appropriated under section 206 have been appropriated and deposited in the designated accounts of the applicable Pueblo Trust Fund;</text></paragraph><paragraph id="idc64c0ef57f874266837c25d96982c34b"><enum>(5)</enum><text>the State has—</text><subparagraph id="idb8ee7b04132f4773ae6e0477888891a7"><enum>(A)</enum><text>provided the funding under section 206(c)(2) into appropriate funding accounts;</text></subparagraph><subparagraph id="idaf85072907a149b1a2aca171ccd26b0e"><enum>(B)</enum><text>provided the funding under section 206(c)(1) or entered into a funding agreement with the intended beneficiaries for that funding; and</text></subparagraph><subparagraph id="ida5440f50beeb4323baecd10af0baa30e"><enum>(C)</enum><text>enacted legislation to amend State law to provide that a Pueblo Water Right may be leased for a term of not to exceed 99 years, including renewals;</text></subparagraph></paragraph><paragraph id="id56d2a93e47c14c46a8cd91edcb6ad090"><enum>(6)</enum><text>the waivers and releases under section subsections (a) and (b) of section 208 have been executed by the Pueblos and the Secretary; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idca2a72f6b53e4df291cefbbe101ccdbe"><enum>(7)</enum><text>the waivers and releases under section 208 have been executed by the Pueblos and the Secretary.</text></paragraph></section><section id="id79bd507946954b03bb412a5ebc299f05"><enum>208.</enum><header>Waivers and releases of claims</header><subsection id="idac1374f14d7f41329ecf43c7271a76b6"><enum>(a)</enum><header>Waivers and releases of claims by Pueblos and United States as trustee for pueblos</header><text>Subject to the reservation of rights and retention of claims under subsection (d), as consideration for recognition of the Pueblo Water Rights and other benefits described in the Agreement and this title, the Pueblos and the United States, acting as trustee for the Pueblos, shall execute a waiver and release of all claims for—</text><paragraph id="id747fce4d10e941b58a597e73cedf3a79"><enum>(1)</enum><text>water rights within the Jemez River Stream System that the Pueblos, or the United States acting as trustee for the Pueblos, asserted or could have asserted in any proceeding, including the Adjudication, on or before the Enforceability Date, except to the extent that such a right is recognized in the Agreement and this title; and</text></paragraph><paragraph id="id88b49acf02d749a594c22877a5bd596a"><enum>(2)</enum><text>damages, losses, or injuries to water rights or claims of interference with, diversion of, or taking of water rights (including claims for injury to land resulting from such damages, losses, injuries, interference, diversion, or taking of water rights) in the Jemez River Stream System against any party to a settlement, including the members and parciantes of signatory acequias, that accrued at any time up to and including the Enforceability Date.</text></paragraph></subsection><subsection id="id5aae3dfd39ec4e149867c4efddf2a328"><enum>(b)</enum><header>Waivers and releases of claims by Pueblos against United States</header><text>Subject to the reservation of rights and retention of claims under subsection (d), each Pueblo shall execute a waiver and release of all claims against the United States (including any agency or employee of the United States) for water rights within the Jemez River Stream System first arising before the Enforceability Date relating to—</text><paragraph id="idbe245ad4be9846c8b7d1922516f6f564"><enum>(1)</enum><text>water rights within the Jemez River Stream System that the United States, acting as trustee for the Pueblos, asserted or could have asserted in any proceeding, including the Adjudication, except to the extent that such rights are recognized as part of the Pueblo Water Rights under this title;</text></paragraph><paragraph id="id309957dd6a814ccea2c4cdd8f69a98af"><enum>(2)</enum><text>foregone benefits from non-Pueblo use of water, on and off Pueblo Land (including water from all sources and for all uses), within the Jemez River Stream System;</text></paragraph><paragraph id="id7cdf07f701e64f1e831e1ae7a908e3c0"><enum>(3)</enum><text>damage, loss, or injury to water, water rights, land, or natural resources due to loss of water or water rights (including damages, losses, or injuries to hunting, fishing, gathering, or cultural rights due to loss of water or water rights, claims relating to interference with, diversion of, or taking of water, or claims relating to a failure to protect, acquire, replace, or develop water, water rights, or water infrastructure) within the Jemez River Stream System;</text></paragraph><paragraph id="id4213ec58819240648e3099b5cc13c002"><enum>(4)</enum><text>a failure to establish or provide a municipal, rural, or industrial water delivery system on Pueblo Land within the Jemez River Stream System;</text></paragraph><paragraph id="id0cb04d1076eb412ca97f855a39fe8d0c"><enum>(5)</enum><text>damage, loss, or injury to water, water rights, land, or natural resources due to construction, operation, and management of irrigation projects on Pueblo Land or Federal land (including damages, losses, or injuries to fish habitat, wildlife, and wildlife habitat) within the Jemez River Stream System;</text></paragraph><paragraph id="idfd4759ecc9e141a9a5b3fe56129502ca"><enum>(6)</enum><text>a failure to provide for operation, maintenance, or deferred maintenance for any irrigation system or irrigation project within the Jemez River Stream System;</text></paragraph><paragraph id="id72f732e428f84a15af065f7701be1dbf"><enum>(7)</enum><text>a failure to provide a dam safety improvement to a dam on Pueblo Land within the Jemez River Stream System;</text></paragraph><paragraph id="idde0acaa75e024a00a60df4e9c986eabd"><enum>(8)</enum><text>the litigation of claims relating to any water right of a Pueblo within the Jemez River Stream System; and</text></paragraph><paragraph id="id09331e2d1a4a4828bfd307b398ca132c"><enum>(9)</enum><text>the negotiation, execution, or adoption of the Agreement (including exhibits or appendices) and this title.</text></paragraph></subsection><subsection id="id2fedd3e091904117a1422a4604214b12"><enum>(c)</enum><header>Effective date</header><text>The waivers and releases described in subsections (a) and (b) shall take effect on the Enforceability Date.</text></subsection><subsection id="id184db6a701654273be8151bd5d2dd1b7"><enum>(d)</enum><header>Reservation of rights and retention of claims</header><text>Notwithstanding the waivers and releases under subsections (a) and (b), the Pueblos and the United States, acting as trustee for the Pueblos, shall retain all claims relating to—</text><paragraph id="id04482a55e7e14cb9a53cf06fff94987c"><enum>(1)</enum><text>the enforcement of, or claims accruing after the Enforceability Date relating to, water rights recognized under the Agreement, this title, or the Partial Final Judgement and Decree entered into in the Adjudication;</text></paragraph><paragraph id="idebb39a532f0f4feeafb1a57670de21ab"><enum>(2)</enum><text>activities affecting the quality of water, including claims under—</text><subparagraph id="idc6b6fcb4252942f5ac99e99adfd69521"><enum>(A)</enum><text>the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>), including claims for damages to natural resources;</text></subparagraph><subparagraph id="ide9e00c13002044818f67b57e4262e336"><enum>(B)</enum><text>the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f et seq.</external-xref>);</text></subparagraph><subparagraph id="idb117f64b6a7949d9b144de780ba639cc"><enum>(C)</enum><text>the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) (commonly referred to as the <quote>Clean Water Act</quote>); and</text></subparagraph><subparagraph id="id3c3e6e8c08cb40389b921d240d2396a0"><enum>(D)</enum><text>any regulations implementing the Acts described in subparagraphs (A) through (C);</text></subparagraph></paragraph><paragraph id="id49541350447b4d289217ce201d25ef86"><enum>(3)</enum><text>the right to use and protect water rights acquired after the date of enactment of this Act;</text></paragraph><paragraph id="id2908246ce56140e1959af2174c95f874"><enum>(4)</enum><text>damage, loss, or injury to land or natural resources that is not due to loss of water or water rights, including hunting, fishing, gathering, or cultural rights;</text></paragraph><paragraph id="id9bdf23cac6c8452bb7153a67a6994617"><enum>(5)</enum><text>all rights, remedies, privileges, immunities, and powers not specifically waived and released pursuant to this title or the Agreement; and</text></paragraph><paragraph id="idea1b3db5f2a343798166eebcd1b7da16"><enum>(6)</enum><text>loss of water or water rights in locations outside of the Jemez River Stream System.</text></paragraph></subsection><subsection id="id80552bbb026b4ad3bb6152e3b26ef159"><enum>(e)</enum><header>Effect of Agreement and title</header><text>Nothing in the Agreement or this title—</text><paragraph id="id4f2fc3dffe1b4104a42c4f9e401029fe"><enum>(1)</enum><text>reduces or extends the sovereignty (including civil and criminal jurisdiction) of any government entity;</text></paragraph><paragraph id="ide36ac09bbe67477f913dcaf03473fbab"><enum>(2)</enum><text>affects the ability of the United States, as sovereign, to carry out any activity authorized by law, including—</text><subparagraph id="id2d3a368b9cda4778988a6e7711c07d29"><enum>(A)</enum><text>the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>);</text></subparagraph><subparagraph id="ide76e8c1af7234a73b7dfd53a247a8988"><enum>(B)</enum><text>the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f et seq.</external-xref>);</text></subparagraph><subparagraph id="id9f66942f451a4b76864d5606883930ba"><enum>(C)</enum><text>the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) (commonly referred to as the <quote>Clean Water Act</quote>);</text></subparagraph><subparagraph id="id0331992b6c3349f1b9ce0394893617a0"><enum>(D)</enum><text>the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901 et seq.</external-xref>); and</text></subparagraph><subparagraph id="id2e55f3e5b4604bb5ade47af5efb55576"><enum>(E)</enum><text>any regulations implementing the Acts described in subparagraphs (A) though (D);</text></subparagraph></paragraph><paragraph id="id58639bbf411344849d6e8dc6110d0166"><enum>(3)</enum><text>affects the ability of the United States to act as trustee for the Pueblos (consistent with this title), any other pueblo or Indian Tribe, or an allottee of any Indian Tribe;</text></paragraph><paragraph id="id9a49ea45f8394ec697dcef0c48414ead"><enum>(4)</enum><text>confers jurisdiction on any State court—</text><subparagraph id="idcf1d187c9e83424290f1cd3836638c5d"><enum>(A)</enum><text>to interpret Federal law relating to health, safety, or the environment;</text></subparagraph><subparagraph id="iddb7e9fb8dd5f4639bb87f324cb33e5dd"><enum>(B)</enum><text>to determine the duties of the United States or any other party under Federal law regarding health, safety, or the environment;</text></subparagraph><subparagraph id="id483a68c141aa42b39a38a5172b9353b6"><enum>(C)</enum><text>to conduct judicial review of any Federal agency action; or</text></subparagraph><subparagraph id="id5a4895ff0f0043b59e9d6283ab513120"><enum>(D)</enum><text>to interpret Pueblo or Tribal law; or</text></subparagraph></paragraph><paragraph id="iddb4e2f5532bd40c69ec7572e49488d29"><enum>(5)</enum><text>waives any claim of a member of a Pueblo in an individual capacity that does not derive from a right of the Pueblos.</text></paragraph></subsection><subsection id="id144bb23ea4f64aca881ad04712259ee1"><enum>(f)</enum><header>Tolling of claims</header><paragraph id="id7f37de9ef9c349cb8dd7abd714564b43"><enum>(1)</enum><header>In general</header><text>Each applicable period of limitation and time-based equitable defense relating to a claim described in this section shall be tolled for the period beginning on the date of enactment of this Act and ending on the Enforceability Date.</text></paragraph><paragraph id="id7b839a8226a5477780bc45e5bc8a6902"><enum>(2)</enum><header>Effect of subsection</header><text>Nothing in this subsection revives any claim or tolls any period of limitation or time-based equitable defense that expired before the date of enactment of this Act.</text></paragraph><paragraph id="id3c58eb55b14744c0b8b40da1734802f4"><enum>(3)</enum><header>Limitation</header><text>Nothing in this section precludes the tolling of any period of limitation or any time-based equitable defense under any other applicable law.</text></paragraph></subsection><subsection id="ide53108e91684491aa4f765e585319f49"><enum>(g)</enum><header>Expiration</header><paragraph id="id67df44e1bc5f46e3950fb6cca7904c01"><enum>(1)</enum><header>In general</header><text>This title shall expire in any case in which the Secretary fails to publish a statement of findings under section 207 by not later than—</text><subparagraph id="id62a28b9971d94c9cbdc2fb795552e3a7"><enum>(A)</enum><text>July 1, 2030; or</text></subparagraph><subparagraph id="id562e0a707f65427980973bb3cb40c008"><enum>(B)</enum><text>such alternative later date as is agreed to by the Pueblos and the Secretary, after providing reasonable notice to the State.</text></subparagraph></paragraph><paragraph id="ida1af1fadb32c4130ab83373b48423c6b"><enum>(2)</enum><header>Consequences</header><text>If this title expires under paragraph (1)—</text><subparagraph id="id0e1bc6cb9e954105a2bc66ad9b99a233"><enum>(A)</enum><text>the waivers and releases under subsections (a) and (b) shall—</text><clause id="idca1047d77a124592983449e87e7479f9"><enum>(i)</enum><text>expire; and</text></clause><clause id="id3c2bf17414b14a2eaddd33be23f0e00c"><enum>(ii)</enum><text>have no further force or effect;</text></clause></subparagraph><subparagraph id="id1fc666cf4d454d4da1fef5f043c0b8ac"><enum>(B)</enum><text>the authorization, ratification, confirmation, and execution of the Agreement under section 203 shall no longer be effective;</text></subparagraph><subparagraph id="id4f9a97c8034443f39daa4094e167f713"><enum>(C)</enum><text>any action carried out by the Secretary, and any contract or agreement entered into, pursuant to this title shall be void;</text></subparagraph><subparagraph id="idde8d3271ce2c4c6ca95e03350ae6ab3a"><enum>(D)</enum><text>any unexpended Federal funds appropriated or made available to carry out the activities authorized by this title, together with any interest earned on those funds, and any water rights or contracts to use water and title to other property acquired or constructed with Federal funds appropriated or made available to carry out the activities authorized by this title shall be returned to the Federal Government, unless otherwise agreed to by the Pueblos and the United States and approved by Congress; and</text></subparagraph><subparagraph id="iddd9501aff365489ca63c8118d3bf5ba0"><enum>(E)</enum><text>except for Federal funds used to acquire or construct property that is returned to the Federal Government under subparagraph (D), the United States shall be entitled to offset any Federal funds made available to carry out this title that were expended or withdrawn, or any funds made available to carry out this title from other Federal authorized sources, together with any interest accrued on those funds, against any claims against the United States—</text><clause id="id73cd046f27684718a56e977627a09753"><enum>(i)</enum><text>relating to—</text><subclause id="id9a878fec18964d18b77f441a6df7fd2a"><enum>(I)</enum><text>water rights in the State asserted by—</text><item id="id1c1c5db59f16496185237d852996183c"><enum>(aa)</enum><text>the Pueblos; or</text></item><item id="idd00ef52e68db4d6a8907abd6b671071b"><enum>(bb)</enum><text>any user of the Pueblo Water Rights; or</text></item></subclause><subclause id="id80164d2f0e6243b3a5b078fae6584b83"><enum>(II)</enum><text>any other matter covered by subsection (b); or</text></subclause></clause><clause id="id83057e494c9442e7980fef9e4c192c42"><enum>(ii)</enum><text>in any future settlement of water rights of the Pueblos.</text></clause></subparagraph></paragraph></subsection></section><section id="idfcc62db2eb9c4883b52b93d3030caed9"><enum>209.</enum><header>Satisfaction of claims</header><text display-inline="no-display-inline">The benefits provided under this title shall be in complete replacement of, complete substitution for, and full satisfaction of any claim of the Pueblos against the United States that are waived and released by the Pueblos pursuant to section 208(b).</text></section><section id="id84a5eb1fb986413d8ba697b60d525b87"><enum>210.</enum><header>Miscellaneous provisions</header><subsection id="id3e95a72b5ce947679ce6315995ca547a"><enum>(a)</enum><header>No waiver of sovereign immunity by the United States</header><text>Nothing in this title waives the sovereign immunity of the United States.</text></subsection><subsection id="id82f628c59cf04a299eb65d92bc024a2b"><enum>(b)</enum><header>Other Tribes not adversely affected</header><text>Nothing in this title quantifies or diminishes any land or water right, or any claim or entitlement to land or water, of an Indian Tribe, band, or community other than the Pueblos.</text></subsection><subsection id="ide670723dec2b402abe8b827e57309539"><enum>(c)</enum><header>Effect on current law</header><text>Nothing in this title affects any provision of law (including regulations) in effect on the day before the date of enactment of this Act with respect to pre-enforcement review of any Federal environmental enforcement action.</text></subsection><subsection id="idb4436b08266c4b3fab42c2cd213e1e90"><enum>(d)</enum><header>Conflict</header><text>In the event of a conflict between the Agreement and this title, this title shall control. </text></subsection></section><section id="idb09e03d8c1b84252bcc1dbd8e9684ad9" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>211.</enum><header>Antideficiency</header><text display-inline="no-display-inline">The United States shall not be liable for any failure to carry out any obligation or activity authorized by this title, including any obligation or activity under the Agreement, if adequate appropriations are not provided expressly by Congress to carry out the purposes
