which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To make daylight saving time permanent, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id86B4F943E6C943469701452D72CBD835"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sunshine Protection Act of 2023</short-title></quote>.</text></section><section section-type="subsequent-section" id="id17685CF047724C839083BB3471FC8E0C"><enum>2.</enum><header>Making daylight saving time permanent</header><subsection id="id9888ED0192CC4FDA84D2CF203BBD7BCD"><enum>(a)</enum><header>Repeal of temporary period for daylight saving time</header><text display-inline="yes-display-inline">Section 3 of the Uniform Time Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/15/260a">15 U.S.C. 260a</external-xref>) is hereby repealed.</text></subsection><subsection id="id9C6D0B87A4974CBD96D4C621793A0AE9"><enum>(b)</enum><header>Advancement of standard time</header><paragraph id="id00CBCB8A351D40E28A9490F3BFDAF74C"><enum>(1)</enum><header>In general</header><text>The second sentence of subsection (a) of section 1 of the Act of March 19, 1918 (commonly known as the <quote>Calder Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/15/261">15 U.S.C. 261</external-xref>), is amended—</text><subparagraph id="id5A1711FBB02D49C7818C027C2DFDB644"><enum>(A)</enum><text>by striking <quote>4 hours</quote> and inserting <quote>3 hours</quote>;</text></subparagraph><subparagraph id="idC70E953798C149A988A059A923575CB0"><enum>(B)</enum><text>by striking <quote>5 hours</quote> and inserting <quote>4 hours</quote>;</text></subparagraph><subparagraph id="id44FAF70C983C46C8878B6A876E494C21"><enum>(C)</enum><text>by striking <quote>6 hours</quote> and inserting <quote>5 hours</quote>;</text></subparagraph><subparagraph id="idEBC68CD0C2FF44778035377063338C01"><enum>(D)</enum><text>by striking <quote>7 hours</quote> and inserting <quote>6 hours</quote>;</text></subparagraph><subparagraph id="id03F744636E7D4B548EC7D03FACF4631D"><enum>(E)</enum><text>by striking <quote>8 hours</quote> and inserting <quote>by 7 hours</quote>;</text></subparagraph><subparagraph id="idA935B6174EC347A884C1EAA660E29AB9"><enum>(F)</enum><text>by striking <quote>9 hours</quote> and inserting <quote>8 hours</quote>;</text></subparagraph><subparagraph id="id2D2D1BF333344DE59FA2BE1D06F55A45"><enum>(G)</enum><text>by striking <quote>10 hours;</quote> and inserting <quote>9 hours;</quote>;</text></subparagraph><subparagraph id="id9A76263AA19C40669BBE65BE807CC671"><enum>(H)</enum><text>by striking <quote>11 hours</quote> and inserting <quote>10 hours</quote>; and</text></subparagraph><subparagraph id="idE27C6641BC2F4EEB91B980C2E3062A58"><enum>(I)</enum><text>by striking <quote>10 hours.</quote> and inserting <quote>11 hours.</quote>.</text></subparagraph></paragraph><paragraph id="idAFB7030FB9B04298B9B737900328D33C"><enum>(2)</enum><header>State exemption</header><text>Such section is further amended by—</text><subparagraph id="idC493B6EBB494410DBA2CD086A67907AB"><enum>(A)</enum><text>redesignating subsection (b) as subsection (c); and</text></subparagraph><subparagraph id="id8D6460ADC3E04CD6AE69EEBBD3C59AFE"><enum>(B)</enum><text>inserting after subsection (a) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE533FDD234A744DAB2BB5633FA9C7A68"><subsection id="id4CA7AE970B6A48618902211293920B35"><enum>(b)</enum><header>Standard time for certain States and areas</header><text>The standard time for a State that has exempted itself from the provisions of section 3(a) of the Uniform Time Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/15/260a">15 U.S.C. 260a(a)</external-xref>), as in effect on the day before the date of the enactment of the <short-title>Sunshine Protection Act of 2023</short-title>, pursuant to such section or an area of a State that has exempted such area from such provisions pursuant to such section shall be, as such State considers appropriate—</text><paragraph id="id735ABAAAE14347F1AD6034CC0478D464"><enum>(1)</enum><text>the standard time for such State or area, as the case may be, pursuant to subsection (a) of this section; or</text></paragraph><paragraph id="id70504DDB89AC49509C11580A7D75471A"><enum>(2)</enum><text>the standard time for such State or area, as the case may be, pursuant to subsection (a) of this section as it was in effect on the day before the date of the enactment of the <short-title>Sunshine Protection Act of 2023</short-title>.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idE17E94F870C047649D43BA10AF7D0853"><enum>(3)</enum><header>Conforming amendment</header><text>Such section is further amended, in the second sentence, by striking <quote>Except as provided in section 3(a) of the Uniform Time Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/15/260a">15 U.S.C. 260a</external-xref>), the</quote> and inserting <quote>Except as provided in subsection (b),</quote>.</text></paragraph></subsection></section></legis-body></bill>
