which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Internal Revenue Code of 1986 to permit kindergarten through grade 12 educational expenses to be paid from a 529 account.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H2FF07C2A801943EBBEDDFE4C0A6EAF62"><section section-type="section-one" id="H2F62123BB624428CA58D9780D922A255"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Student Empowerment Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="H58A40EA720764E9194968550797C4A13"><enum>2.</enum><header>529 account funding for homeschool and additional elementary and secondary expenses</header><subsection id="HFA348597D55042D6B4553041352B268E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/529">Section 529(c)(7)</external-xref> of the Internal Revenue Code of 1986 is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC4C8549AE0C64494A3F0E7DB197B01DD"><paragraph id="H43F984C6B91D45BB908299526FA90324"><enum>(7)</enum><header>Treatment of elementary and secondary tuition</header><text>Any reference in this section to the term <term>qualified higher education expense</term> shall include a reference to the following expenses in connection with enrollment or attendance at, or for students enrolled at or attending, an elementary or secondary public, private, or religious school:</text><subparagraph id="H34976B78567B44C588D07BC43F9FD010"><enum>(A)</enum><text>Tuition.</text></subparagraph><subparagraph id="HE3DE3A777BDD4810B9DB59FEF847FE1E"><enum>(B)</enum><text>Curriculum and curricular materials.</text></subparagraph><subparagraph id="H20920F49A4564DB0B48AAD7CA9086956"><enum>(C)</enum><text>Books or other instructional materials.</text></subparagraph><subparagraph id="H86034C70FDF34D72BA2AC1A945D23E9F"><enum>(D)</enum><text>Online educational materials.</text></subparagraph><subparagraph id="HF64FA98D97404231AE1BD82FD3CF18DA"><enum>(E)</enum><text>Tuition for tutoring or educational classes outside of the home, including at a tutoring facility, but only if the tutor or instructor is not related to the student and—</text><clause id="HBDD03360129C4013A37BFCCA323F0DBD"><enum>(i)</enum><text>is licensed as a teacher in any State,</text></clause><clause id="H153179F94C0E408EA0A1D57BD3D9B442"><enum>(ii)</enum><text>has taught at an eligible educational institution, or</text></clause><clause id="H5E2EDF1FDCC44D3DB08FBEA65DE7235E"><enum>(iii)</enum><text>is a subject matter expert in the relevant subject.</text></clause></subparagraph><subparagraph id="HAC230B9F4ED54BD8AB51576DE873B6D5"><enum>(F)</enum><text>Fees for a nationally standardized norm-referenced achievement test, an advanced placement examination, or any examinations related to college or university admission.</text></subparagraph><subparagraph id="HF4DDCD820F904420AD408E37B04A744C"><enum>(G)</enum><text>Fees for dual enrollment in an institution of higher education.</text></subparagraph><subparagraph id="H128A82B47E9E451EA4B2EE27D48E67E0"><enum>(H)</enum><text>Educational therapies for students with disabilities provided by a licensed or accredited practitioner or provider, including occupational, behavioral, physical, and speech-language therapies.</text></subparagraph><continuation-text continuation-text-level="paragraph">Such term shall include expenses for the purposes described in subparagraphs (A) through (H) in connection with a homeschool (whether treated as a homeschool or a private school for purposes of applicable State law).</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD2A3B2E007A04CBEB704A007928BFD0E"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by this section shall apply to distributions made after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
