which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To reform the requirements regarding the safety and security of families living in public and federally assisted housing in high-crime areas.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Liberty City Rising Act of 2023</short-title></quote>.</text></section><section id="id5D9E2280B2F6411DAB690871920CF5D4"><enum>2.</enum><header>Safety standards for federally assisted housing in high-crime areas</header><subsection id="idFFF8BE76425544A3B0FEC1D6BCD562E8"><enum>(a)</enum><header>Public housing</header><text>Section 6(f)(2) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437d">42 U.S.C. 1437d(f)(2)</external-xref>) is amended—</text><paragraph id="id99F18699125441EB969503D38C638B7E"><enum>(1)</enum><text>by striking <quote>The Secretary shall</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id85E99A79FF9D442E9ACDDEE7CE6900A5"><subparagraph id="idC953E4C9D76A4E3B910E864125A3B266"><enum>(A)</enum><header>Safe and habitable</header><text>The Secretary shall</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idA70DBFF232D648C6B109FB8789C635C2"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id32A14EBADAD74BCB8DD20F01E32A9141"><subparagraph id="idDDB98230E36A473C8BF58425419CFD28"><enum>(B)</enum><header>High-Crime areas</header><clause id="idEA97A0E8B519416CBB3847057E54D6C1"><enum>(i)</enum><header>Definition</header><text>In this subparagraph, the term <term>high-crime area</term> means a neighborhood or other small geographic area that the Secretary determines has a high incidence of violent crime, based on the most recent violent crime data available from a State, unit of local government, or other source determined appropriate by the Secretary, that lists the types of crimes and number of offenses committed in the area.</text></clause><clause id="id743518338C3543E89DA05B25419B5FEB"><enum>(ii)</enum><header>Additional safety and security standards</header><text>In addition to the standards under subparagraph (A), the Secretary shall establish standards to ensure the safety and security of dwellings located in a high-crime area.</text></clause><clause id="id4BE12015CB58443D88289CCCA26C0742"><enum>(iii)</enum><header>Contents</header><text>The standards established under clause (ii)—</text><subclause id="idC171F6A4A1F14B01A8517FDA009F2E58"><enum>(I)</enum><text>shall require a public housing agency to consider security measures that meet the specific needs of a property or building; and</text></subclause><subclause id="id5BEB61A293634D49A780BDC97499CBE5"><enum>(II)</enum><text>may include requirements related to security cameras, locks, lighting, or other security measures.</text></subclause></clause><clause id="id10B39223924C4ACA946195FABE00C606"><enum>(iv)</enum><header>Anonymous hotline</header><text>A public housing agency that operates a public housing project in a high-crime area shall establish an anonymous hotline for tenants to report suspicious activity and crimes that occur in the community in which the public housing project is located.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id6F6E4A36FD4C424799A28DB0AADA8546"><enum>(b)</enum><header>Project-Based assisted housing</header><paragraph id="id3F449E65840C4D14AA7EC8E518698D47"><enum>(1)</enum><header>In general</header><text>Section 8(o)(13) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)(13)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD06CBDB727954902A1DB4ABAD40C24E7"><subparagraph id="id055551E7EB09467D9623BBF43DC7F5DA"><enum>(P)</enum><header>Safety and security standards for high-crime areas</header><clause id="id8817A68F73A84DD4B62791042AE7DE22"><enum>(i)</enum><header>Definition</header><text>In this subparagraph, the term <term>high-crime area</term> means a neighborhood or other small geographic area that the Secretary determines has a high incidence of violent crime, based on the most recent violent crime data available from a State, unit of local government, or other source determined appropriate by the Secretary, that lists the types of crimes and number of offenses committed in the area.</text></clause><clause id="id1004E9FC9DE7422C97B76D32FE43B316"><enum>(ii)</enum><header>Contract requirement</header><text>An assistance contract for project-based assistance entered into under this paragraph with respect to a structure shall require that the owner maintain the structure, if determined to be in a high-crime area, in a condition that complies with standards that meet or exceed the safety and security standards established under clause (iii).</text></clause><clause id="idFEEC2B0BFDB94CFFBB5F7E1C1A9DD85C"><enum>(iii)</enum><header>Safety and security standards</header><text>The Secretary shall establish standards to ensure the safety and security of structures located in a high-crime area.</text></clause><clause id="id8B19F88367E3473894EC0DF25B8DC3B6"><enum>(iv)</enum><header>Contents</header><text>The standards established under clause (iii)—</text><subclause id="idF22986DCD4DE4F33BEA9A0CC086CCE62"><enum>(I)</enum><text>shall require the owner of a structure that receives project-based assistance under this paragraph to consider security measures that meet the specific needs of the structure; and</text></subclause><subclause id="id81F7E18780F14229B96F5F063F1738DE"><enum>(II)</enum><text>may include requirements related to security cameras, locks, lighting, or other security measures.</text></subclause></clause><clause id="idBC52F039E49741C29B46A38A7DAF4351"><enum>(v)</enum><header>Inspections</header><text>When determining whether a dwelling unit that is in a high-crime area meets the housing quality standards under paragraph (8)(B), a public housing agency shall also determine whether the dwelling unit meets the standards established under this subparagraph.</text></clause><clause id="idCAC441C3E70B48FAAFB07FD908911776"><enum>(vi)</enum><header>Anonymous hotline</header><text>A public housing agency that provides project-based assistance under this paragraph with respect to a structure in a high-crime area shall establish an anonymous hotline for tenants to report suspicious activity and crimes that occur in the community in which the structure is located.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id5F16CB67C2624CA0BBCA50E35A080F7D"><enum>(2)</enum><header>Conforming amendment</header><text>Section 8(d)(2) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(d)(2)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC9ECDAAB9B3D400480A8FC45F48BB017"><subparagraph id="id20E109CF189A41FDBBC44E4C2849A9E9" indent="up2"><enum>(E)</enum><clause commented="no" display-inline="yes-display-inline" id="id3FF5B20227F64729A0B51CEBB6E8CB63"><enum>(i)</enum><text>Subsection (o)(13)(P) (relating to safety and security standards for high-crime areas) shall apply to a contract for project-based assistance under this paragraph and to a public housing agency that enters into such a contract.</text></clause><clause id="idB7773914AE954EA2AC7FD345C8F2AB90" indent="up1"><enum>(ii)</enum><text>When determining whether a structure assisted under this paragraph that is in a high-crime area, as defined in subsection (o)(13)(P), meets any applicable housing quality standards, a public housing agency shall also determine whether the structure meets the safety and security standards established under that subsection.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idC6E0BB0918FB4DA5902F02AC03B6E181"><enum>(c)</enum><header>Deadlines</header><paragraph id="id50929C09B9D948E3B070C89FEBC0C106"><enum>(1)</enum><header>Determination of high-crime areas</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary of Housing and Urban Development shall make an initial determination as to which areas of the United States are high-crime areas for purposes of sections 6(f)(2)(B), 8(d)(2)(E), and 8(o)(13)(P) of the United States Housing Act of 1937, as added by this section.</text></paragraph><paragraph id="id9AB99286737E44AEB7C5812558C8C6D0"><enum>(2)</enum><header>Safety and security standards</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of Housing and Urban Development shall establish the safety and security standards for public housing projects and other assisted structures located in high-crime areas required under sections 6(f)(2)(B), 8(d)(2)(E), and 8(o)(13)(P) of the United States Housing Act of 1937, as added by this section.</text></paragraph></subsection></section><section id="idF3C029BF379B47878AB2D422378E34E8"><enum>3.</enum><header>Grant priority for public housing projects in high-crime areas</header><text display-inline="no-display-inline">Section 9(d) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437g">42 U.S.C. 1437g(d)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3F0BF0C14A594A19BF9B37F5093B8844"><paragraph id="id52CE8FC266104980A23AFC5151E4F32D"><enum>(4)</enum><header>Emergency Safety and Security funding priority for high-crime areas</header><text>In awarding grants for safety and security measures using amounts from the Capital Fund, the Secretary shall give priority to an application from a public housing agency that proposes to use the grant for a public housing project located in a high-crime area (as defined in section 6(f)(2)(B)).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
